Salient Features of Bharatiya Nyaya Sanhita, 2023: Key Changes and Important Provisions
Bharatiya Nyaya Sanhita, 2023 (BNS) ने भारतीय दंड विधि में एक महत्वपूर्ण परिवर्तन किया है। इसने Indian Penal Code, 1860 (IPC) को repeal करके offences और punishments की नई statutory framework स्थापित की है। BNS का उद्देश्य criminal law को contemporary परिस्थितियों के अनुरूप बनाना, नागरिक-केंद्रित करना तथा offences और punishments को अधिक व्यवस्थित करना है।
Introduction
BNS, 2023 Act No. 45 of 2023 है और इसका enforcement 1 July 2024 से हुआ। इसका मूल उद्देश्य offences से संबंधित कानून को consolidate और amend करना है।
यह ध्यान रखना महत्वपूर्ण है कि BNS मुख्यतः substantive criminal law से संबंधित है। Criminal procedure के लिए Bharatiya Nagarik Suraksha Sanhita, 2023 और evidence law के लिए Bharatiya Sakshya Adhiniyam, 2023 लागू हैं।
Replacement of the Indian Penal Code
BNS की सबसे मूलभूत विशेषता यह है कि इसने Indian Penal Code, 1860 को repeal कर दिया है। Section 358 में repeal and savings का प्रावधान है। पुराने IPC के अंतर्गत पहले से किए गए acts, accrued rights, liabilities, punishments तथा pending proceedings पर repeal का प्रभाव नहीं पड़ेगा और संबंधित proceedings को savings provision के अनुसार जारी रखा जा सकता है।
इस प्रकार BNS केवल IPC का नाम बदलने वाला कानून नहीं है, बल्कि criminal offences की statutory classification और कई substantive provisions में महत्वपूर्ण परिवर्तन करता है।
Community Service as a Punishment
BNS की सबसे उल्लेखनीय innovations में से एक community service को punishment के रूप में expressly recognize करना है।
Section 4 के अंतर्गत punishments में death, imprisonment for life, rigorous या simple imprisonment, forfeiture of property, fine और community service शामिल हैं।
यह विशेष रूप से petty offences के संदर्भ में reformative approach को दर्शाता है। BNS के Statement of Objects and Reasons में भी community service को पहली बार punishment के रूप में introduce करने का उद्देश्य स्पष्ट किया गया है।
यह approach Supreme Court की sentencing jurisprudence में विकसित proportionality और reformative principles के साथ broadly consistent है। Death penalty के संदर्भ में Bachan Singh v. State of Punjab, (1980) 2 SCC 684 में Supreme Court ने life imprisonment को rule और death penalty को exceptional punishment के रूप में विकसित किया था।
New Offences of Organised Crime and Petty Organised Crime
BNS ने पहली बार सामान्य penal statute में organised crime को expressly criminalise किया है।
Section 111 organised crime से संबंधित है और Section 112 petty organised crime से संबंधित है। इनके माध्यम से criminal syndicates, continuing unlawful activities और organised criminal conduct जैसी contemporary criminal phenomena को statutory recognition दिया गया है।
यह परिवर्तन महत्वपूर्ण है क्योंकि IPC में organised crime के लिए कोई एक comprehensive general provision नहीं था और ऐसे मामलों में अलग-अलग special statutes तथा IPC provisions का सहारा लिया जाता था।
Terrorist Act
BNS ने Section 113 के माध्यम से terrorist act को भी penal framework में शामिल किया है।
यह provision national security और गंभीर हिंसक गतिविधियों को criminal law framework में address करता है। हालांकि terrorism से संबंधित मामलों में अन्य विशेष legislation, विशेषकर Unlawful Activities (Prevention) Act, 1967 की applicability भी facts और statutory requirements पर निर्भर कर सकती है।
Offence Against Sovereignty, Unity and Integrity of India
BNS ने पुराने IPC के sedition provision की जगह एक नया offence structure अपनाया है।
Section 152 उन acts को address करता है जो भारत की sovereignty, unity और integrity को endanger करते हैं तथा secession, armed rebellion, subversive activities या separatist activities से संबंधित conduct को criminalise करता है।
इस provision को IPC की sedition jurisprudence से mechanically equate नहीं किया जाना चाहिए। Kedar Nath Singh v. State of Bihar, AIR 1962 SC 955 में Supreme Court ने sedition provision की constitutional interpretation करते हुए केवल उन expressions को criminal liability के दायरे में माना था जो violence या public disorder से संबंधित incitement के स्तर तक पहुंचते हैं। BNS Section 152 की interpretation अब उसके अपने statutory language और constitutional standards के आधार पर विकसित होगी।
Stronger Protection for Women and Children
BNS में offences against women and children को प्रमुखता दी गई है। Chapter V में rape, aggravated rape, gang rape, sexual harassment, voyeurism, stalking, dowry death, cruelty तथा child-related offences को व्यवस्थित रूप से रखा गया है।
Section 63 rape को define करता है और Sections 64–71 rape तथा उसके विभिन्न aggravated forms और punishments से संबंधित हैं। Section 69 deceitful means आदि द्वारा sexual intercourse को specifically criminalise करता है।
Rape prosecutions में Supreme Court की established jurisprudence अभी भी महत्वपूर्ण रहेगी। State of Punjab v. Gurmit Singh, (1996) 2 SCC 384 में Supreme Court ने स्पष्ट किया कि यदि prosecutrix की testimony confidence-inspiring है, तो केवल corroboration के अभाव में उसे reject नहीं किया जा सकता।
Gender-Neutral Provisions
BNS के legislative objective में कई offences को gender-neutral बनाने पर भी जोर दिया गया है। Statement of Objects and Reasons expressly बताता है कि various offences को gender neutral बनाया गया है।
हालांकि प्रत्येक offence की statutory wording अलग है और इसलिए gender neutrality का extent provision-to-provision examine करना आवश्यक है।
New Provision on Deceitful Sexual Intercourse
Section 69 एक महत्वपूर्ण नया offence है। इसके अंतर्गत deceitful means द्वारा sexual intercourse, जिसमें marriage का false promise या employment/promotion का false promise जैसी परिस्थितियां शामिल हो सकती हैं, अलग offence के रूप में punishable है।
यह provision rape से अलग statutory offence है; इसलिए Section 69 और Section 63 के ingredients को एक-दूसरे के समान नहीं माना जा सकता।
Murder and Mob or Group Violence
Section 103 murder की punishment से संबंधित है। BNS ने murder के context में group-based killing को भी specifically address किया है।
विशेष महत्व इस बात का है कि यदि five or more persons acting in concert certain specified grounds के आधार पर किसी व्यक्ति की हत्या करते हैं, तो statutory punishment structure में विशेष treatment दिया गया है।
Murder cases में Supreme Court की longstanding principles—विशेषकर intention, knowledge, culpable homicide और murder के distinction—अभी भी महत्वपूर्ण रहेंगे। Virsa Singh v. State of Punjab, AIR 1958 SC 465 और State of Andhra Pradesh v. Rayavarapu Punnayya, (1976) 4 SCC 382 जैसे leading decisions इस distinction को समझने के लिए महत्वपूर्ण हैं।
Enhanced Focus on Crimes Affecting National Security
BNS में offences against the State और national security को नए statutory framework में पुनर्गठित किया गया है। इसके अंतर्गत sovereignty, unity and integrity of India को प्रभावित करने वाली activities तथा terrorist acts को specifically address किया गया है।
यह approach Statement of Objects and Reasons में व्यक्त उस legislative objective से मेल खाती है जिसमें organised crime और terrorist activities से प्रभावी रूप से निपटने के लिए नए offences introduce करने की बात कही गई है।
Expanded Extra-Territorial Application
Section 1 BNS की territorial और extra-territorial application को स्पष्ट करता है। यह Indian citizens द्वारा India के बाहर किए गए offences, Indian-registered ships या aircraft पर किए गए offences तथा India में स्थित computer resource को target करने वाले certain offences तक लागू हो सकता है।
Digital और transnational crimes के बढ़ते प्रभाव के कारण यह provision आधुनिक criminal jurisdiction की दृष्टि से विशेष महत्व रखता है।
Recognition of Electronic and Digital Records
BNS की definitions में document के अंतर्गत electronic और digital records को expressly include किया गया है।
यह criminal law को digital environment के साथ compatible बनाता है। हालांकि electronic evidence की admissibility और proof मुख्यतः Bharatiya Sakshya Adhiniyam, 2023 के provisions के अनुसार निर्धारित होगी।
Protection Against Non-Treatment of Victims
Section 200 hospital authorities द्वारा victim के non-treatment को punishable बनाता है, जहाँ BNSS की applicable victim-treatment requirements का contravention हो।
इसी प्रकार Section 199 कुछ specified offences में public servant द्वारा information record न करने को punishable बनाता है।
यह provisions criminal justice system में victim-oriented accountability को strengthen करते हैं।
Defamation Retained
BNS ने defamation को समाप्त नहीं किया है। Section 356 में defamation का offence retained है और इसके basic ingredients तथा exceptions statutory form में continue किए गए हैं।
Criminal defamation की constitutional validity को Supreme Court ने Subramanian Swamy v. Union of India, (2016) 7 SCC 221 में uphold किया था।
Repeal and Savings
BNS का Section 358 IPC को repeal करता है लेकिन transitional protection प्रदान करता है। पुराने IPC के तहत किए गए acts, acquired rights, liabilities, punishments तथा pending investigations/proceedings केवल BNS लागू होने के कारण समाप्त नहीं होते।
इसका practical importance उन criminal cases में विशेष है जिनमें offence BNS के commencement से पहले committed हुआ था।
Conclusion
Bharatiya Nyaya Sanhita, 2023 की प्रमुख विशेषताएं केवल IPC की renumbering तक सीमित नहीं हैं। Community service, organised crime, petty organised crime, terrorist act, deceitful sexual intercourse, sovereignty-related offences, digital records तथा victim-oriented provisions इसके महत्वपूर्ण substantive changes हैं।
साथ ही, murder, rape, defamation और अन्य traditional offences की judicial interpretation में Supreme Court की established criminal-law jurisprudence महत्वपूर्ण बनी रहेगी, जब तक कि BNS की नई statutory language उससे अलग परिणाम निर्धारित न करे। BNS को इसलिए continuity और substantive reform दोनों के combination के रूप में समझना अधिक उचित है।
