घरेलू हिंसा अधिनियम, 2005 की Section 34 — Protection Officer के विरुद्ध अपराध का संज्ञान
Section 34 Protection Officer के विरुद्ध prosecution अथवा अन्य legal proceeding शुरू करने से पहले State Government या उसके द्वारा अधिकृत अधिकारी की previous sanction को अनिवार्य बनाती है। यह provision मुख्यतः Protection Officer को उसके statutory functions के निर्वहन के कारण frivolous अथवा अनावश्यक proceedings से सुरक्षा देने के साथ-साथ prosecution के लिए एक पूर्व-शर्त निर्धारित करती है।
Section 34 का वैधानिक प्रावधान
Section 34 में कहा गया है कि Protection Officer के विरुद्ध कोई prosecution या अन्य legal proceeding तब तक नहीं चलेगी, जब तक State Government या इस उद्देश्य के लिए उसके द्वारा authorised officer की previous sanction के साथ complaint filed न हो।
इस provision की भाषा अत्यंत महत्वपूर्ण है क्योंकि इसमें दो बातें एक साथ रखी गई हैं। पहली, Protection Officer के विरुद्ध prosecution या अन्य legal proceeding पर statutory restriction है। दूसरी, ऐसी proceeding के लिए previous sanction आवश्यक है।
Section 34 का उद्देश्य
Section 34 को Section 33 और Section 35 के साथ पढ़ना आवश्यक है।
Section 33 Protection Officer द्वारा Magistrate के protection order में दिए गए direction के अनुसार duty discharge करने में बिना sufficient cause failure या refusal को punishable offence बनाती है। इसके लिए अधिकतम एक वर्ष का imprisonment, ₹20,000 तक fine या दोनों का प्रावधान है।
Section 34 इसके बाद यह निर्धारित करती है कि Protection Officer के विरुद्ध prosecution किस procedural condition के अधीन प्रारम्भ होगी।
Section 35 दूसरी ओर good faith में किए गए या किए जाने के उद्देश्य से किए गए statutory acts के संबंध में Protection Officer को अलग protection देती है।
इस प्रकार statutory scheme में Section 33 liability, Section 34 sanction, और Section 35 good-faith protection से Protection Officer की accountability और protection दोनों का संतुलन बनाया गया है।
Previous Sanction का अर्थ
Section 34 में प्रयुक्त शब्द “previous sanction” का अर्थ है कि prosecution अथवा legal proceeding शुरू होने से पहले निर्धारित competent authority से sanction प्राप्त होना चाहिए।
इसलिए sanction ऐसी चीज नहीं है जिसे prosecution शुरू होने के बाद सामान्यतः पूरा किया जा सकता है। Section 34 स्वयं “previous” sanction की requirement रखती है।
Sanction देने वाली authority दो प्रकार की हो सकती है। State Government स्वयं sanction दे सकती है अथवा State Government द्वारा इस उद्देश्य के लिए authorised officer sanction दे सकता है।
किसके विरुद्ध Section 34 लागू होती है
यह provision specifically Protection Officer के संबंध में है। Act में Protection Officer वह officer है जिसे State Government Section 8(1) के अंतर्गत appoint करती है।
Protection Officer Magistrate के control और supervision में कार्य करता है तथा Act के अंतर्गत Magistrate और Government द्वारा लगाए गए duties को perform करता है।
इसलिए Section 34 का protection किसी सामान्य व्यक्ति या प्रत्येक सरकारी अधिकारी को उपलब्ध statutory protection नहीं है। इसकी language specifically Protection Officer तक सीमित है।
Section 33 और Section 34 का सीधा संबंध
व्यावहारिक दृष्टि से Section 33 और Section 34 को साथ समझना सबसे महत्वपूर्ण है।
यदि Protection Officer ने Magistrate के protection order में दिए गए direction के अनुसार duty discharge नहीं की और ऐसा failure या refusal बिना sufficient cause हुआ, तो Section 33 के तहत offence बन सकता है।
लेकिन उसके बाद prosecution शुरू करने के लिए Section 34 की requirement सामने आती है। अर्थात Section 33 offence की substantive penal provision है, जबकि Section 34 prosecution के लिए procedural safeguard है।
इसका अर्थ यह नहीं है कि Section 34 Protection Officer को Section 33 की liability से मुक्त कर देती है। Section 34 केवल यह निर्धारित करती है कि prosecution किस पूर्व-स्वीकृति के बाद institute की जा सकती है।
“No prosecution or other legal proceeding shall lie” का प्रभाव
Section 34 की भाषा है कि “No prosecution or other legal proceeding shall lie” जब तक prescribed previous sanction के साथ complaint filed न हो।
इसका परिणाम यह है कि sanction requirement को केवल technical formality मानना उचित नहीं है। यह statutory condition है।
यदि किसी proceeding में Section 34 लागू होती है और आवश्यक previous sanction के बिना proceeding institute की जाती है, तो sanction की absence proceeding की maintainability पर महत्वपूर्ण प्रभाव डाल सकती है।
Complaint और Sanction
Section 34 में केवल sanction का उल्लेख नहीं है बल्कि complaint being filed with the previous sanction की भाषा है।
इसलिए statutory scheme में complaint और sanction परस्पर जुड़े हुए हैं। शिकायत करने वाला व्यक्ति Protection Officer के विरुद्ध allegation रख सकता है, लेकिन Section 34 के अनुसार prosecution/legal proceeding के लिए State Government अथवा authorised officer की previous sanction आवश्यक है।
Section 35 से अंतर
Section 34 और Section 35 में महत्वपूर्ण अंतर है।
Section 34 कहती है कि Protection Officer के विरुद्ध prosecution या अन्य legal proceeding previous sanction के बिना institute नहीं होगी।
Section 35 कहती है कि Protection Officer के विरुद्ध ऐसे damage के लिए suit, prosecution या अन्य legal proceeding नहीं होगी जो Act, Rules या orders के अंतर्गत good faith में किए गए या किए जाने के उद्देश्य से किए गए कार्य के कारण हुआ हो या होने की संभावना हो।
अर्थात Section 34 एक procedural protection है, जबकि Section 35 एक substantive statutory protection for good-faith action प्रदान करती है।
यदि Protection Officer ने good faith में statutory function perform किया है, तो Section 35 स्वयं protection प्रदान कर सकती है। दूसरी ओर, जहाँ आरोप duty failure/refusal का है, Section 33 और Section 34 प्रासंगिक होंगे।
Protection Officer की duties के संदर्भ में महत्व
Section 9 Protection Officer को कई महत्वपूर्ण duties देती है। इनमें Magistrate की सहायता करना, Domestic Incident Report तैयार करके Magistrate को देना, aggrieved person की इच्छा पर protection order के लिए application में सहायता करना, legal aid उपलब्ध कराने में सहायता करना, safe shelter home उपलब्ध कराने में सहायता करना, medical examination कराना तथा Section 20 के monetary relief order के compliance और execution को सुनिश्चित करना शामिल है।
Protection Officer Magistrate के control और supervision में कार्य करता है।
Rules भी Protection Officer की duties को विस्तार देती हैं। Rule 8 में complaint में सहायता, rights की information, applications में सहायता, Safety Plan तैयार करना, legal aid, medical assistance, shelter, service providers के साथ coordination तथा records maintain करना जैसी duties निर्धारित हैं।
Rule 10 में Magistrate के written direction पर home visit, emoluments/assets/bank accounts की inquiry, personal effects और jewellery की restoration, child custody/visitation में assistance तथा court के orders के enforcement में सहायता जैसी अतिरिक्त duties दी गई हैं।
इसी विस्तृत statutory role के कारण Section 34 Protection Officer के विरुद्ध proceedings के लिए prior sanction की requirement रखती है।
क्या Section 34 केवल Section 33 के मामलों में लागू होती है?
Section 34 का text केवल Section 33 का reference नहीं देता। यह broadly “No prosecution or other legal proceeding” के विरुद्ध Protection Officer को statutory sanction protection देता है।
इसलिए Section 34 को केवल Section 33 तक mechanically सीमित करना उचित नहीं है। इसकी actual applicability इस बात पर निर्भर करेगी कि Protection Officer के विरुद्ध प्रस्तावित prosecution या legal proceeding किस nature की है और वह Act के तहत Protection Officer के रूप में किए गए conduct से किस प्रकार संबंधित है।
इसके विपरीत, Section 35 expressly उस conduct को address करती है जो Act, Rules या orders के अंतर्गत good faith में किया गया हो या intended to be done हो।
Rules, 2006 का Section 34 से संबंध
Protection of Women from Domestic Violence Rules, 2006 में Section 34 के लिए कोई अलग sanction-form prescribed दिखाई नहीं देता। Rules मुख्यतः Protection Officer की appointment, qualifications, duties, Domestic Incident Report, applications, notices, counselling, service providers, shelter और medical assistance आदि की procedural व्यवस्था करती हैं।
Rule 10 विशेष रूप से Magistrate के written directions के पालन से संबंधित Protection Officer की duties को स्पष्ट करती है।
इसलिए Section 34 का मुख्य operative requirement Act की statutory provision से आता है, न कि Rules में किसी अलग prescribed sanction form से।
Section 34 और Section 30
Section 30 के अनुसार Protection Officer और service provider के members, Act अथवा उसके Rules/orders के अनुसरण में कार्य करते समय, Indian Penal Code की Section 21 के अर्थ में public servants माने जाते हैं।
Section 34 Protection Officer के विरुद्ध prosecution के लिए एक अलग और विशेष statutory sanction requirement देती है। इसलिए Protection Officer का public-servant status और Section 34 की sanction requirement दोनों अलग statutory concepts हैं।
Section 34 का व्यावहारिक प्रभाव
मान लीजिए किसी Protection Officer पर आरोप लगाया गया कि उसने Magistrate द्वारा दिए गए direction का पालन नहीं किया। Section 33 के तहत ऐसा conduct, यदि बिना sufficient cause हुआ है, punishable हो सकता है।
लेकिन Section 34 के कारण complainant को सीधे ऐसी prosecution आगे बढ़ाने से पहले State Government या authorised officer की previous sanction की statutory requirement पूरी करनी होगी।
इससे यह स्पष्ट होता है कि Protection Officer के विरुद्ध criminal proceeding शुरू करने की प्रक्रिया respondent के विरुद्ध Section 31 की proceeding से अलग है। Section 31 respondent द्वारा protection/interim protection order के breach को offence बनाती है, जबकि Section 33 Protection Officer की specified failure/refusal को punish करती है।
इस provision की व्याख्या का प्राथमिक आधार स्वयं Section 34, तथा उसके साथ पढ़े जाने वाले Sections 33 और 35 हैं।
निष्कर्ष
Section 34 Protection Officer के विरुद्ध prosecution या अन्य legal proceeding शुरू करने से पहले previous sanction को अनिवार्य बनाती है। यह sanction State Government या उसके द्वारा इस उद्देश्य के लिए authorised officer से प्राप्त होना चाहिए।
Section 33 जहाँ Protection Officer के duty failure या refusal without sufficient cause को punishable बनाती है, वहीं Section 34 यह निर्धारित करती है कि ऐसे Protection Officer के विरुद्ध prosecution previous sanction के बिना आगे नहीं बढ़ेगी। Section 35 इसके अतिरिक्त good-faith statutory action के लिए अलग protection देती है।
इसलिए परीक्षा और practical interpretation के लिए मुख्य सूत्र है: Section 33 = Protection Officer की penal liability; Section 34 = prosecution के लिए previous sanction; Section 35 = good-faith action की statutory protection।
