Section 32 — संज्ञान और अपराध का प्रमाण DV Act 2005

 

घरेलू हिंसा अधिनियम, 2005 की धारा 32 — संज्ञान और अपराध का प्रमाण

धारा 32 घरेलू हिंसा अधिनियम, 2005 की महत्वपूर्ण दंडात्मक प्रक्रिया संबंधी धारा है। यह मुख्यतः दो विषयों को नियंत्रित करती है। पहला, धारा 31(1) के अपराध का स्वरूप क्या होगा; और दूसरा, ऐसे अपराध को सिद्ध करने के लिए aggrieved person की अकेली गवाही का क्या evidentiary महत्व होगा।

धारा 32(1) — अपराध संज्ञेय और अजमानतीय है

धारा 32(1) में स्पष्ट किया गया है कि CrPC, 1973 में किसी विपरीत प्रावधान के होते हुए भी, धारा 31(1) का अपराध cognizable और non-bailable होगा।

इसका अर्थ है कि Section 31(1) के अंतर्गत Protection Order अथवा Interim Protection Order के breach को Legislature ने विशेष रूप से गंभीर criminal offence माना है।

यहाँ यह समझना महत्वपूर्ण है कि Section 32 स्वयं कोई नया substantive offence नहीं बनाती। अपराध Section 31(1) बनाता है और Section 32 उस अपराध के cognizance/proof से संबंधित विशेष व्यवस्था करती है।

धारा 31 और धारा 32 का सीधा संबंध

Section 31(1) कहती है कि respondent द्वारा Protection Order या Interim Protection Order का breach offence है और उसके लिए imprisonment up to one year, fine up to ₹20,000, या दोनों हो सकते हैं।

Section 32(1) आगे यह निर्धारित करती है कि वही offence cognizable और non-bailable होगा।

इसलिए दोनों धाराओं को साथ पढ़ने पर statutory scheme यह बनती है:

Protection Order/Interim Protection Order का उल्लंघन → Section 31(1) offence → Section 32(1) के कारण cognizable और non-bailable।

“Notwithstanding anything contained in CrPC” का महत्व

Section 32(1) की शुरुआत “Notwithstanding anything contained in the Code of Criminal Procedure, 1973” शब्दों से होती है।

यह एक non obstante clause है। इसका उद्देश्य यह स्पष्ट करना है कि यदि CrPC की सामान्य procedural व्यवस्था Section 31(1) के offence के cognizable या bailable character के संबंध में कुछ अलग प्रभाव उत्पन्न करती हो, तो Section 32(1) की विशेष statutory declaration प्रभावी होगी।

इसलिए Section 31(1) का offence DV Act के तहत अपने statutory character में cognizable तथा non-bailable है।

Cognizable offence का अर्थ

“Cognizable” होने का statutory significance यह है कि criminal law machinery ऐसे offence को cognizable offence के रूप में treat करेगी और police investigation संबंधी सामान्य statutory powers लागू हो सकती हैं।

DV Act Rules, 2006 भी इसी scheme को reinforce करते हैं। Rule 15 में protection order या interim protection order के breach को local police station को report करने और उसे Sections 31 और 32 के अनुसार cognizable offence के रूप में deal करने का प्रावधान है।

अर्थात breach केवल Magistrate के सामने compliance का प्रश्न नहीं है; statute ने उसके लिए स्वतंत्र criminal enforcement mechanism बनाया है।

Non-bailable offence का अर्थ

Section 32(1) के अनुसार Section 31(1) का offence non-bailable है।

इसका अर्थ यह नहीं है कि bail कभी दी ही नहीं जा सकती। इसका अर्थ यह है कि यह bailable offence की statutory category में नहीं आता, इसलिए bail का प्रश्न court के judicial discretion और applicable criminal procedure के अनुसार निर्धारित होगा।

Rules, 2006 में भी breach के मामलों में bail पर court द्वारा aggrieved person की protection और accused की presence सुनिश्चित करने के लिए conditions लगाने की व्यवस्था दिखाई देती है। ऐसी conditions में domestic violence से दूर रहने, aggrieved person से contact न करने तथा उसके residence से दूर रहने जैसी directions शामिल हो सकती हैं।

धारा 32(2) — aggrieved person की अकेली गवाही

धारा 32(2) इस provision का सबसे महत्वपूर्ण evidentiary हिस्सा है।

इसके अनुसार:

“Upon the sole testimony of the aggrieved person, the court may conclude that an offence under sub-section (1) of section 31 has been committed by the accused.”

अर्थात यदि aggrieved person की testimony से court संतुष्ट होता है कि respondent ने Section 31(1) का offence अर्थात protection order/interim protection order का breach किया है, तो केवल इस आधार पर conviction या finding को अस्वीकार नहीं किया जा सकता कि कोई independent witness उपलब्ध नहीं है।

यह Legislature द्वारा बनाया गया एक विशेष evidentiary rule है।

“Sole testimony” का वास्तविक अर्थ

Section 32(2) का अर्थ यह नहीं है कि aggrieved person द्वारा लगाया गया प्रत्येक आरोप स्वतः सिद्ध मान लिया जाएगा।

Statutory language यह कहती है कि court may conclude कि offence committed हुआ है।

इसका मतलब है कि final conclusion फिर भी judicial appreciation of testimony पर निर्भर करता है।

Court को यह देखना होगा कि testimony विश्वसनीय है या नहीं और उससे Section 31(1) के आवश्यक elements establish होते हैं या नहीं।

विशेष रूप से यह स्थापित होना चाहिए कि जिस conduct को breach कहा जा रहा है, वह वास्तव में उस Protection Order अथवा Interim Protection Order की terms का उल्लंघन करता है।

केवल domestic violence साबित होना पर्याप्त नहीं

Section 32(2) को Section 31 के साथ पढ़ना आवश्यक है।

Section 31 का offence केवल domestic violence करने का सामान्य offence नहीं है। Section 31 specifically protection order या interim protection order के breach को punish करता है।

इसलिए Section 32(2) में aggrieved person की sole testimony से Section 31(1) का offence सिद्ध करने के लिए testimony में ऐसा material होना चाहिए जिससे order और उसके breach का आधार स्थापित हो सके।

उदाहरण के लिए, यदि Magistrate ने respondent को aggrieved person से contact करने से restrain किया है और aggrieved person विश्वसनीय रूप से testimony देती है कि respondent ने उस specific prohibition का उल्लंघन करते हुए contact किया, तो Section 31/32 का प्रश्न उत्पन्न हो सकता है।

Protection Order की terms क्यों महत्वपूर्ण हैं

Section 18 Magistrate को respondent के विरुद्ध विभिन्न प्रकार के prohibitory directions देने की शक्ति देती है। इनमें domestic violence करने या abet करने से रोकना, workplace/school में प्रवेश से रोकना, communication पर रोक, assets या stridhan को alienate करने से रोकना और अन्य specified acts पर restraint शामिल हो सकता है।

Section 31 breach offence है, इसलिए prosecution को alleged breach को order की specific operative direction से जोड़ना आवश्यक है।

इस दृष्टि से protection order की certified/served copy तथा उसमें दी गई specific conditions Section 31 proceedings में अत्यंत महत्वपूर्ण हो सकती हैं।

धारा 32 और Rule 15

Protection of Women from Domestic Violence Rules, 2006 का Rule 15 — Breach of Protection Orders Section 32 की practical implementation में महत्वपूर्ण है।

Aggrieved person breach की report Protection Officer को कर सकती है और report लिखित तथा signed होनी चाहिए। Protection Officer उस complaint के साथ संबंधित protection order की copy Magistrate को appropriate orders के लिए forward करता है।

Aggrieved person अपनी इच्छा से breach की complaint directly Magistrate या Police के पास भी कर सकती है।

यदि breach के बाद aggrieved person Protection Officer की assistance मांगती है, तो Protection Officer local police station की सहायता से उसे rescue करने और appropriate cases में police authorities के समक्ष report lodge कराने में सहायता करेगा।

Respondent द्वारा enforcement का प्रतिरोध

Rule 15(7) एक महत्वपूर्ण अतिरिक्त व्यवस्था करता है। इसके अनुसार Act के तहत court के orders के enforcement में respondent अथवा उसकी ओर से purportedly acting किसी अन्य व्यक्ति द्वारा किया गया resistance, protection order या interim protection order का breach माना जाएगा।

इससे statutory protection order को केवल कागजी आदेश बनकर रह जाने से रोकने का उद्देश्य स्पष्ट होता है।

Section 32 और bail

क्योंकि Section 31(1) का offence Section 32(1) द्वारा non-bailable बनाया गया है, bail का प्रश्न सामान्यतः criminal court के समक्ष judicial determination का विषय होगा। Rules में bail देते समय aggrieved person की सुरक्षा तथा accused की court में उपस्थिति सुनिश्चित करने के लिए conditions लगाने का express mechanism है।

इन conditions में accused को domestic violence करने या करने की धमकी देने से रोकना, aggrieved person को telephone या अन्य माध्यम से contact करने से रोकना तथा उसके residence या उस स्थान से दूर रहने का निर्देश शामिल हो सकता है।

Section 32 और Section 31(3)

Section 31(3) Magistrate को Section 31(1) के charges frame करते समय, यदि facts किसी अन्य offence को disclose करते हैं, तो Section 498A IPC, अन्य IPC provision अथवा Dowry Prohibition Act के अंतर्गत भी charges frame करने की अनुमति देती है।

इसलिए Section 32 का cognizable और non-bailable character Section 31(1) के offence पर लागू होता है; यदि साथ में अन्य offences भी charge किए जाते हैं, तो उन offences की अपनी statutory classification और applicable procedural provisions भी relevant होंगी।

Section 28 और Section 32 का संबंध

Section 28(1) के अनुसार Section 31 के offences की proceedings सामान्यतः CrPC के provisions द्वारा governed होती हैं।

लेकिन Section 32(1) उसी procedural framework के भीतर एक specific statutory exception बनाती है और कहती है कि Section 31(1) का offence cognizable और non-bailable होगा, notwithstanding anything contained in CrPC.

इसलिए Section 28 और Section 32 में कोई contradiction नहीं है। Section 28 सामान्य procedure बताती है, जबकि Section 32 Section 31(1) offence की विशेष statutory characterisation करती है।

धारा 32 का महत्व

धारा 32 को DV Act की enforcement mechanism की दृष्टि से अत्यंत महत्वपूर्ण माना जा सकता है क्योंकि यह Protection Order को effective legal remedy बनाती है।

यदि protection order का breach केवल एक सामान्य civil consequence होता, तो उसके enforcement की शक्ति सीमित हो सकती थी। Legislature ने इसके विपरीत Section 31 में breach को offence बनाया और Section 32(1) में उसे cognizable तथा non-bailable घोषित किया।

इसके अतिरिक्त Section 32(2) यह स्पष्ट करती है कि aggrieved person की sole testimony भी Section 31(1) offence के proof का आधार बन सकती है, यदि court उस testimony के आधार पर offence committed होने का निष्कर्ष निकालता है।

निष्कर्ष

धारा 32(1) के अनुसार Section 31(1) का Protection Order या Interim Protection Order breach offence cognizable और non-bailable है।

धारा 32(2) के अनुसार aggrieved person की sole testimony के आधार पर भी court यह conclude कर सकता है कि Section 31(1) का offence accused द्वारा किया गया है।

इसलिए Section 31 अपराध और punishment निर्धारित करती है, जबकि Section 32 उस अपराध की cognizability, bail status और proof के लिए विशेष statutory framework प्रदान करती है।
