धारा 27 यह निर्धारित करती है कि Protection of Women from Domestic Violence Act, 2005 के अंतर्गत Protection Order, अन्य राहतों तथा Act के offences की सुनवाई के लिए कौन-सा Magistrate Court competent होगा। साथ ही, इस धारा की उपधारा (2) यह सुनिश्चित करती है कि DV Act के अंतर्गत पारित कोई भी order पूरे भारत में enforceable होगा। [DV Act, 2005, s.27]
धारा 27 का मूल प्रावधान
Section 27(1) के अनुसार Judicial Magistrate First Class (JMFC) या, जहाँ लागू हो, Metropolitan Magistrate का Court competent Court होगा, यदि उसके local limits में निम्न में से कोई एक jurisdictional condition पूरी होती है:
aggrieved person permanently या temporarily रहती है, business करती है या employed है;
respondent रहता है, business करता है या employed है;
या
cause of action arise हुआ है।
[DV Act, 2005, s.27(1)]
इसलिए Section 27 jurisdiction को एक ही स्थान तक सीमित नहीं करता। Statute ने jurisdiction के तीन independent connecting grounds दिए हैं।
Section 27(1)(a) — Aggrieved Person का Residence, Business या Employment
पहला jurisdictional ground स्वयं aggrieved person से जुड़ा है।
यदि aggrieved person:
permanently रहती है, या
temporarily रहती है, या
business करती है, या
employed है,
तो उस स्थान के local jurisdiction वाला competent Magistrate Court Section 27 के तहत proceeding entertain कर सकता है। [DV Act, 2005, s.27(1)(a)]
यह provision विशेष रूप से महत्वपूर्ण है क्योंकि महिला को केवल respondent के residence वाले स्थान पर जाकर proceeding शुरू करने की आवश्यकता नहीं है।
यदि वह किसी दूसरे स्थान पर temporarily रह रही है, तो भी statutory jurisdiction उपलब्ध हो सकती है।
Permanent Residence और Temporary Residence
Section 27(1)(a) में Legislature ने “permanently or temporarily resides” दोनों को expressly शामिल किया है। [DV Act, 2005, s.27(1)(a)]
इसका practical महत्व बहुत अधिक है।
उदाहरण के लिए, यदि महिला matrimonial home छोड़कर अपने मायके या किसी दूसरे शहर में temporarily रह रही है, तो केवल temporary residence होने के कारण Section 27 का jurisdiction समाप्त नहीं होता।
Temporary residence भी statutory jurisdiction का स्वतंत्र आधार है।
Business या Employment के आधार पर Jurisdiction
Section 27(1)(a) residence के अतिरिक्त aggrieved person के:
business
या
employment
को भी jurisdictional connecting factor मानता है। [DV Act, 2005, s.27(1)(a)]
अर्थात यदि महिला किसी स्थान पर employed है, तो उस स्थान के local jurisdiction में competent Magistrate के समक्ष DV Act की proceeding लाई जा सकती है, subject to other statutory requirements.
यह provision महिला को practical access to justice प्रदान करने की दृष्टि से महत्वपूर्ण है।
Section 27(1)(b) — Respondent का Residence, Business या Employment
दूसरा jurisdictional ground respondent से संबंधित है।
यदि respondent:
रहता है
business करता है
या
employed है
तो उस स्थान के local jurisdiction वाला JMFC/Metropolitan Magistrate competent Court हो सकता है। [DV Act, 2005, s.27(1)(b)]
इसलिए jurisdiction केवल aggrieved person के location पर निर्भर नहीं है।
Respondent का statutory connection भी independent jurisdictional basis है।
Section 27(1)(c) — Cause of Action
तीसरा ground है:
“the cause of action has arisen”
[DV Act, 2005, s.27(1)(c)]
यदि domestic violence से संबंधित cause of action किसी particular territorial jurisdiction में arise हुआ है, तो उस jurisdiction का competent Magistrate Court proceeding entertain कर सकता है।
यह provision विशेष रूप से तब महत्वपूर्ण है जब parties अलग-अलग स्थानों पर रहते हों।
“Any One” Jurisdictional Ground
Section 27(1) में clauses (a), (b) और (c) को alternative grounds के रूप में रखा गया है।
अर्थात jurisdiction establish करने के लिए इन तीनों conditions का एक साथ मौजूद होना आवश्यक नहीं है।
यदि:
aggrieved person उस jurisdiction में temporarily रहती है,
तो यह अपने-आप Section 27(1)(a) का jurisdictional basis हो सकता है।
इसी प्रकार respondent का residence या cause of action भी independent basis हो सकता है। [DV Act, 2005, s.27(1)]
कौन-सा Court Competent है?
Section 27 में competent Court के रूप में:
Judicial Magistrate of the First Class
या
Metropolitan Magistrate
का उल्लेख है। [DV Act, 2005, s.27(1)]
इसलिए DV Act की original jurisdiction किसी सामान्य civil court के पास Section 27 के तहत नहीं दी गई है।
Section 27 specifically Magistrate Court को competence प्रदान करती है।
“Local Limits” का महत्व
Section 27 में बार-बार “within the local limits” की अवधारणा आती है। [DV Act, 2005, s.27(1)]
इसका अर्थ है कि Magistrate Court का territorial jurisdiction संबंधित geographical area से निर्धारित होगा।
इसलिए application दाखिल करते समय यह establish करना महत्वपूर्ण है कि:
महिला कहाँ permanently/temporarily रहती है,
वह कहाँ business या employment करती है,
respondent कहाँ रहता/काम करता है,
या domestic violence से संबंधित cause of action कहाँ arise हुआ।
Section 27 और Section 12 का संबंध
Section 12 के तहत aggrieved person, Protection Officer या उसकी ओर से कोई अन्य person Magistrate के समक्ष application प्रस्तुत कर सकता है। [DV Act, 2005, s.12]
Section 27 यह निर्धारित करता है कि कौन-सा Magistrate Court उस application को entertain करने के लिए territorially competent है।
इसलिए:
Section 12 → Application का substantive/procedural gateway
Section 27 → Territorial jurisdiction
दोनों provisions को साथ पढ़ना आवश्यक है।
Section 27 और Section 18 से Section 23 तक की Reliefs
Section 27(1) में competent Court को “protection order and other orders under this Act” grant करने की power दी गई है। [DV Act, 2005, s.27(1)]
इसलिए competent Magistrate facts और statutory requirements के अनुसार:
Section 18 — Protection Order
Section 19 — Residence Order
Section 20 — Monetary Relief
Section 21 — Custody Order
Section 22 — Compensation Order
और
Section 23 — Interim/Ex Parte Orders
से संबंधित reliefs grant कर सकता है। [DV Act, 2005, ss.18–23]
Section 27 और Offences
Section 27(1) केवल civil-type protective reliefs तक सीमित नहीं है।
Statutory language competent Court को “to try offences under this Act” की power भी देती है। [DV Act, 2005, s.27(1)]
इसका विशेष महत्व Section 31 के संदर्भ में है।
Section 31 के अनुसार Protection Order या Interim Protection Order का breach respondent द्वारा किया जाना offence है। [DV Act, 2005, s.31]
Section 27 competent Magistrate को Act के offences की trial jurisdiction भी प्रदान करता है।
Section 27(2) — पूरे भारत में Enforcement
Section 27(2) का अत्यंत महत्वपूर्ण प्रावधान है:
“Any order made under this Act shall be enforceable throughout India.” [DV Act, 2005, s.27(2)]
इसका अर्थ है कि DV Act के अंतर्गत किसी competent Court द्वारा पारित order की enforceability केवल उसी territorial jurisdiction तक सीमित नहीं रहती जहाँ order pass हुआ था।
यह nationwide enforceability का statutory rule है।
Nationwide Enforcement का Practical महत्व
मान लीजिए किसी Magistrate Court ने Delhi में Section 18 का Protection Order पारित किया और बाद में respondent किसी दूसरे State में चला जाता है।
Section 27(2) के कारण वह order केवल Delhi तक सीमित नहीं रहेगा।
वह पूरे भारत में enforceable रहेगा। [DV Act, 2005, s.27(2)]
इससे respondent के दूसरे State में चले जाने के कारण protection order ineffective होने की स्थिति से बचा जा सकता है।
Section 27(2) और Section 31
Section 31 के तहत Protection Order का breach offence है।
यदि protection order पूरे भारत में enforceable है, तो respondent का दूसरे State में चले जाना अपने-आप उसे order की binding force से मुक्त नहीं करता। [DV Act, 2005, ss.27(2), 31]
Protection Order के breach की reporting और enforcement के लिए Rules का Rule 15 भी महत्वपूर्ण है। इसके अनुसार aggrieved person breach की complaint Protection Officer, Magistrate या Police को कर सकती है।
Section 27 और Section 29 — Appeal
Section 27 original jurisdiction से संबंधित है।
इसके बाद यदि Magistrate कोई order pass करता है, तो Section 29 के तहत उस order के विरुद्ध Court of Session में appeal का statutory remedy उपलब्ध है।
Appeal 30 दिनों के भीतर करनी होती है, जिसकी गणना order की service की तारीख से होती है—aggrieved person या respondent, जिस पर service बाद में हुई हो, उसके अनुसार। [DV Act, 2005, s.29]
इसलिए:
Section 27 → Original jurisdiction
Section 29 → Appellate remedy
Section 27 और Section 28
Section 28 procedure से संबंधित है।
Section 28(1) के अनुसार Sections:

की proceedings तथा Section 31 के offences, सामान्यतः Code of Criminal Procedure, 1973 के provisions द्वारा governed होते हैं, subject to the provisions of the DV Act। [DV Act, 2005, s.28(1)]
Section 28(2) Court को Section 12 और Section 23(2) की applications dispose करने के लिए अपना procedure lay down करने से नहीं रोकता। [DV Act, 2005, s.28(2)]
इसलिए Section 27 jurisdiction और Section 28 procedure को अलग-अलग समझना चाहिए।
Section 27 और Protection Officer
Protection Officer की appointment State Government द्वारा Section 8 के तहत होती है और उसके duties Section 9 में निर्धारित हैं।
Section 9(1) में Protection Officer को Magistrate की सहायता करने तथा domestic incident report, legal aid, shelter, medical examination, monetary relief execution आदि से संबंधित duties दी गई हैं। [DV Act, 2005, s.9]
Rules के Rule 10 में भी Protection Officer को Magistrate के written direction पर:
shared household का home visit
financial documents की inquiry
personal effects की restoration
children की custody regain कराने में assistance
और
Court orders के enforcement
में सहायता करने की भूमिका दी गई है।
इसलिए jurisdiction establish होने के बाद Protection Officer Court proceedings के implementation में महत्वपूर्ण भूमिका निभाता है।
Section 27 और Temporary Residence
Section 27 का सबसे practical aspect temporary residence है।
कई domestic violence मामलों में aggrieved woman violence के बाद matrimonial/shared household छोड़कर किसी अन्य स्थान पर रहने लगती है।
Section 27(1)(a) में temporary residence को expressly recognise किया गया है। [DV Act, 2005, s.27(1)(a)]
इसलिए केवल यह argument कि महिला उस शहर की permanent resident नहीं है, अपने-आप Section 27 jurisdiction को समाप्त नहीं करता।
Section 27 और Cause of Action
यदि domestic violence के relevant acts किसी jurisdiction में हुए हैं, तो Section 27(1)(c) के आधार पर उस jurisdiction में proceeding लाई जा सकती है। [DV Act, 2005, s.27(1)(c)]
यह उन situations में विशेष रूप से उपयोगी है जहाँ:
aggrieved person एक शहर में रहती है,
respondent दूसरे शहर में रहता है,
और domestic violence का relevant incident किसी तीसरे स्थान पर हुआ है।
ऐसी स्थिति में Section 27 में दिए गए statutory connecting factors में से appropriate ground के आधार पर jurisdiction निर्धारित किया जा सकता है।
क्या Rules में Section 27 के लिए अलग Rule है?
Protection of Women from Domestic Violence Rules, 2006 में Section 27 के लिए कोई अलग standalone “Rule 27” नहीं है।
Rules मुख्यतः Protection Officers, Service Providers, Domestic Incident Report, notices, counselling, safety plan, service of orders और enforcement से संबंधित procedures प्रदान करते हैं।
Section 27 का मूल jurisdictional framework स्वयं Act में निर्धारित है।
Section 27 और Form II
Rules का Form II Section 12 की application का prescribed format है।
इसमें applicant को Court के समक्ष यह बताने की व्यवस्था है कि वह किस प्रकार की relief चाहती है—Protection Order, Residence Order, Maintenance/Monetary Relief, Custody Order, Compensation Order आदि।
Application में jurisdictional facts को स्पष्ट रूप से बताना practical दृष्टि से महत्वपूर्ण है, विशेषकर:
current temporary/permanent residence
respondent का residence
employment/business
और
domestic violence की घटना का स्थान।
ये facts Section 27 की jurisdiction establish करने में relevant हैं।
Section 27 का उदाहरण
मान लीजिए महिला का matrimonial home जयपुर में है, लेकिन domestic violence के बाद वह अपने माता-पिता के साथ दिल्ली में temporarily रह रही है।
Respondent जयपुर में रहता है।
Domestic violence का मुख्य incident जयपुर में हुआ।
ऐसी स्थिति में Section 27(1)(a) के तहत दिल्ली में महिला का temporary residence jurisdictional basis हो सकता है और Section 27(1)(b)/(c) के तहत Jaipur भी relevant jurisdiction हो सकता है। [DV Act, 2005, s.27(1)]
इसलिए statute ने aggrieved woman को jurisdiction के संबंध में practical alternatives दिए हैं।
Section 27 का Judicial महत्व
Section 27 को DV Act की access-to-justice provision के रूप में समझना उचित है क्योंकि Legislature ने jurisdiction को केवल respondent के residence तक सीमित नहीं किया है।
विशेष रूप से temporary residence of the aggrieved person को expressly jurisdictional ground बनाना DV Act की protective nature को reflect करता है। [DV Act, 2005, s.27(1)(a)]
Prabha Tyagi v. Kamlesh Devi, 2022, Supreme Court DV Act की remedial scheme और Section 12 proceedings के संदर्भ में महत्वपूर्ण judgment है। लेकिन Section 27 के specific territorial-jurisdiction question पर इसे direct leading authority के रूप में प्रस्तुत करना उचित नहीं होगा।
इसलिए Section 27 की specific interpretation के लिए मुख्य आधार स्वयं Section 27 का statutory text है।
Section 27 और वर्तमान Criminal Procedure Framework
एक महत्वपूर्ण statutory point यह है कि Section 27 का मूल text competent Magistrate और CrPC framework को refer करता है। [DV Act, 2005, s.27]
आपके उपलब्ध मूल DV Act document में Section 27 अभी भी Code of Criminal Procedure, 1973 के संदर्भ में framed है, और Section 28 भी उसी Code को refer करता है।
इसलिए source-based study में Section 27 को उसके statutory text के अनुसार ही पढ़ना चाहिए।
Section 27 की मुख्य बातें
Section 27(1) → competent Court JMFC या Metropolitan Magistrate है।
Section 27(1)(a) → aggrieved person का permanent/temporary residence, business या employment jurisdiction देता है।
Section 27(1)(b) → respondent का residence, business या employment jurisdiction देता है।
Section 27(1)(c) → cause of action जहाँ arise हुआ, वहाँ jurisdiction हो सकती है।
Section 27(1) → Court Protection Order, अन्य DV Act orders और Act के offences की trial के लिए competent है।
Section 27(2) → DV Act के अंतर्गत पारित हर order पूरे भारत में enforceable है।
निष्कर्ष
Section 27 DV Act की jurisdictional backbone है। यह निर्धारित करती है कि Protection Order और अन्य statutory reliefs के लिए कौन-सा Magistrate Court competent होगा।
महिला को केवल respondent के residence वाले स्थान पर ही proceeding शुरू करने की आवश्यकता नहीं है। Section 27(1)(a) उसके permanent या temporary residence, business अथवा employment को स्वतंत्र jurisdictional ground बनाता है। Respondent का residence/business/employment और cause of action का स्थान भी अलग-अलग jurisdictional grounds हैं। [DV Act, 2005, s.27(1)]
सबसे महत्वपूर्ण बात Section 27(2) है—DV Act के तहत पारित order पूरे भारत में enforceable है।
