Section 26 — अन्य वादों और कानूनी कार्यवाहियों में राहत DV Act 2005

 

घरेलू हिंसा अधिनियम, 2005 की धारा 26 — अन्य वादों और कानूनी कार्यवाहियों में राहत

धारा 26 DV Act की एक अत्यंत महत्वपूर्ण enabling provision है, जिसके द्वारा aggrieved person Sections 18, 19, 20, 21 और 22 में उपलब्ध राहतें केवल DV Act की अलग proceeding में ही नहीं, बल्कि लंबित या बाद में शुरू की गई अन्य civil, family या criminal proceeding में भी मांग सकती है। [DV Act, 2005, s.26]

धारा 26 का मूल उद्देश्य

सामान्यतः DV Act के अंतर्गत Protection Order, Residence Order, Monetary Relief, Custody Order और Compensation Order के लिए Section 12 की proceeding Magistrate के समक्ष लाई जाती है।

लेकिन Legislature ने Section 26 के माध्यम से यह सुनिश्चित किया कि यदि aggrieved person और respondent के बीच पहले से कोई अन्य legal proceeding चल रही है—जैसे matrimonial proceeding, civil suit या criminal proceeding—तो महिला को समान relief पाने के लिए हर बार अलग DV proceeding शुरू करने की आवश्यकता न हो। [DV Act, 2005, s.26(1)]

Supreme Court ने Juveria Abdul Majid Patni v. Atif Iqbal Mansoori, 2014, Supreme Court में स्पष्ट किया कि Sections 18–22 की राहत केवल DV Act की proceeding में ही प्राप्त की जा सकती है, ऐसा नहीं है; Section 26 के कारण ये reliefs अन्य legal proceedings में भी मांगी जा सकती हैं। 

Section 26(1) — किन राहतों की मांग की जा सकती है

Section 26(1) के अनुसार निम्न statutory reliefs अन्य legal proceedings में भी मांगी जा सकती हैं:

Section 18 — Protection Order

Section 19 — Residence Order

Section 20 — Monetary Relief

Section 21 — Custody Order

Section 22 — Compensation Order

इसलिए Section 26 में Section 17 का “right to reside” सीधे listed relief नहीं है; residence-related judicial relief Section 19 के माध्यम से मांगी जाती है।

इसी प्रकार maintenance/monetary relief Section 20 के अंतर्गत और mental torture/emotional distress सहित compensation Section 22 के अंतर्गत मांगी जाती है।

Civil Court के समक्ष राहत

Section 26(1) expressly कहता है कि Sections 18–22 की relief civil court के समक्ष pending legal proceeding में मांगी जा सकती है। [DV Act, 2005, s.26(1)]

इसका एक महत्वपूर्ण Supreme Court example Vaishali Abhimanyu Joshi v. Nanasaheb Gopal Joshi, 2017, Supreme Court है।

उस मामले में एक civil suit के भीतर महिला ने Section 19 के तहत residence-related relief के लिए counter-claim किया था। Supreme Court ने Section 26 को विशेष provision मानते हुए ऐसी relief को अन्य legal proceeding में claim करने की statutory scheme को स्वीकार किया।

Family Court के समक्ष राहत

Section 26(1) में Family Court का भी express reference है। [DV Act, 2005, s.26(1)]

इसलिए यदि पति-पत्नी के बीच divorce, restitution of conjugal rights या अन्य matrimonial proceeding Family Court में pending है, तो facts के अनुसार aggrieved person उसी proceeding में Sections 18–22 की applicable relief मांग सकती है।

Supreme Court ने Juveria Abdul Majid Patni में expressly कहा कि Sections 18–22 की relief Civil Court और Family Court के समक्ष भी मांगी जा सकती है। 

Criminal Court के समक्ष राहत

Section 26(1) में criminal court भी expressly included है। [DV Act, 2005, s.26(1)]

इसका अर्थ यह है कि यदि aggrieved person और respondent के बीच ऐसी criminal proceeding चल रही है जो दोनों को affect करती है, तो statutory requirements पूरी होने पर Sections 18–22 की relief उस proceeding में भी sought की जा सकती है।

Supreme Court ने Juveria Abdul Majid Patni v. Atif Iqbal Mansoori, 2014 में इसी principle को recognise किया और कहा कि reliefs केवल DV Act proceeding तक सीमित नहीं हैं। 

Proceeding पहले शुरू हुई हो या बाद में

Section 26(1) का एक महत्वपूर्ण हिस्सा है:

“whether such proceeding was initiated before or after the commencement of this Act.” [DV Act, 2005, s.26(1)]

अर्थात जिस अन्य legal proceeding में relief मांगी जा रही है, वह:

DV Act के commencement से पहले शुरू हुई हो,

या

DV Act के commencement के बाद शुरू हुई हो,

दोनों परिस्थितियों में Section 26 लागू हो सकता है, subject to statutory requirements.

यह provision DV Act को केवल future proceedings तक सीमित नहीं करता।

Section 26(2) — अन्य राहत के साथ-साथ DV Relief

Section 26(2) अत्यंत महत्वपूर्ण है।

इसके अनुसार Section 26(1) में उल्लिखित relief “in addition to and along with” किसी अन्य relief के साथ भी मांगी जा सकती है। [DV Act, 2005, s.26(2)]

अर्थात aggrieved person को यह चुनाव करने की आवश्यकता नहीं है कि वह:

केवल matrimonial relief मांगे,

या

केवल DV relief मांगे।

यदि facts और law अनुमति देते हैं, तो उसी legal proceeding में दोनों प्रकार की reliefs मांगी जा सकती हैं।

“In Addition To” का अर्थ

Section 26(2) यह स्पष्ट करता है कि DV Act की relief supplementary nature की हो सकती है।

उदाहरण के लिए matrimonial proceeding में divorce की relief के साथ appropriate circumstances में:

Protection Order

Residence Order

Monetary Relief

Custody Order

या

Compensation

की मांग की जा सकती है। [DV Act, 2005, ss.18–22, 26]

इसका अर्थ यह नहीं कि हर court हर प्रकार की relief स्वतः देगी; Court को उस relief के लिए statutory requirements और अपनी jurisdiction देखनी होगी।

Section 26(3) — पहले से मिली राहत की सूचना देना

Section 26(3) aggrieved person पर एक महत्वपूर्ण statutory obligation डालता है।

यदि उसने DV Act के अलावा किसी अन्य proceeding में कोई relief प्राप्त कर ली है, तो उसे Magistrate को उस relief के grant की जानकारी देना अनिवार्य है। [DV Act, 2005, s.26(3)]

यह provision विशेष रूप से overlapping reliefs और multiple proceedings में महत्वपूर्ण है।

इसका उद्देश्य यह है कि Magistrate के सामने पूरी जानकारी रहे कि किसी अन्य Court ने पहले से क्या relief प्रदान की है।

Section 26(3) का Practical Importance

मान लीजिए aggrieved person ने matrimonial proceeding में maintenance प्राप्त कर लिया और बाद में DV proceeding में Section 20 के तहत monetary relief मांगती है।

ऐसी स्थिति में Section 26(3) के अनुसार पहले से मिली relief की जानकारी Magistrate को देनी होगी। [DV Act, 2005, s.26(3)]

यह disclosure Court को overlapping reliefs के प्रभाव को उचित रूप से consider करने में सहायता करता है।

Supreme Court ने Rajnesh v. Neha, 2020, Supreme Court में विभिन्न maintenance proceedings के overlap को address करते हुए disclosure of previous maintenance proceedings/orders की आवश्यकता पर महत्वपूर्ण directions दिए हैं। यह principle Section 20 और Section 26 के practical application में अत्यंत relevant है।

Section 26 और Section 36 का संबंध

Section 36 कहता है कि DV Act के provisions “in addition to, and not in derogation of” अन्य laws के provisions हैं।

Section 26 इसी legislative scheme को practical effect देता है।

अर्थात DV Act की remedies अन्य matrimonial, civil और criminal remedies को सामान्यतः replace नहीं करतीं।

Section 26 → Other proceedings में DV relief

Section 36 → Other laws के अतिरिक्त DV Act

दोनों provisions को साथ पढ़ना आवश्यक है।

Section 26 और Section 12 में अंतर

यह एक बहुत महत्वपूर्ण distinction है।

Section 12 Magistrate के समक्ष DV Act की मुख्य application का provision है। [DV Act, 2005, s.12]

Section 26 यह बताता है कि Sections 18–22 की reliefs अन्य legal proceedings में भी मांगी जा सकती हैं। [DV Act, 2005, s.26]

इसलिए:

Section 12 → DV Act proceeding before Magistrate

Section 26 → Other legal proceedings में DV relief

Supreme Court ने Juveria Abdul Majid Patni में इसी distinction को recognise किया है।

Section 26 और Section 18 — Protection Order

यदि matrimonial या अन्य eligible legal proceeding किसी competent Court के समक्ष pending है, तो Section 26 के तहत Section 18 की protection relief भी sought की जा सकती है। [DV Act, 2005, ss.18, 26]

Section 18 में respondent को domestic violence करने, aiding/abetting करने, workplace में प्रवेश करने, communication करने, assets/stridhan से संबंधित specified acts करने आदि से restrain करने की power है।

Section 26 और Section 19 — Residence Order

Section 19 की residence relief Section 26 में विशेष practical importance रखती है।

Vaishali Abhimanyu Joshi v. Nanasaheb Gopal Joshi, 2017, Supreme Court में महिला ने एक civil suit में Section 19 की residence relief claim की थी। Supreme Court ने Section 26 की व्यापक statutory language को स्वीकार किया और उस legal proceeding में DV Act की residence relief के claim को recognise किया।

इस judgment में Supreme Court ने Section 26 को special provision के रूप में भी consider किया। 

Section 26 और Section 20 — Monetary Relief

Section 20 monetary relief में:

loss of earnings

medical expenses

property loss/damage

और

maintenance

शामिल हो सकते हैं। [DV Act, 2005, s.20]

Section 26 के कारण ऐसी monetary relief अन्य eligible legal proceedings में भी मांगी जा सकती है। [DV Act, 2005, s.26(1)]

Maintenance के multiple proceedings होने की स्थिति में Rajnesh v. Neha, 2020, Supreme Court का disclosure और adjustment-related framework विशेष रूप से relevant है।

Section 26 और Section 21 — Custody

Section 21 child की temporary custody और respondent के visitation arrangements से संबंधित है।

Section 26(1) में Section 21 expressly शामिल है। इसलिए eligible civil, family या criminal proceeding में Section 21 की relief भी sought की जा सकती है। [DV Act, 2005, ss.21, 26]

लेकिन Section 21 की statutory requirement—विशेष रूप से child के interest और harmful visitation से संबंधित proviso—फिर भी लागू रहेगी।

Section 26 और Section 22 — Compensation

Section 22 के तहत domestic violence से हुई injuries, जिसमें mental torture और emotional distress भी शामिल हैं, के लिए compensation और damages का order किया जा सकता है।

Section 26(1) के कारण Section 22 की relief भी अन्य eligible legal proceeding में sought की जा सकती है। [DV Act, 2005, ss.22, 26]

Supreme Court — Juveria Abdul Majid Patni v. Atif Iqbal Mansoori

Juveria Abdul Majid Patni v. Atif Iqbal Mansoori, 2014, Supreme Court Section 26 पर सबसे direct leading Supreme Court authority में से एक है।

Supreme Court ने स्पष्ट किया कि Sections 18, 19, 20, 21 और 22 की relief केवल DV Act proceeding में ही नहीं मांगी जानी चाहिए; Section 26 के कारण ऐसी relief Civil Court, Family Court या Criminal Court के समक्ष चल रही legal proceeding में भी मांगी जा सकती है। 

यह Section 26(1) की statutory scope को directly establish करता है।

Supreme Court — Vaishali Abhimanyu Joshi v. Nanasaheb Gopal Joshi

Vaishali Abhimanyu Joshi v. Nanasaheb Gopal Joshi, 2017, Supreme Court Section 26 की practical application पर अत्यंत महत्वपूर्ण authority है।

मामले में daughter-in-law ने pending civil suit में Section 19 के तहत residence-related counter-claim किया था।

Supreme Court ने Section 26 की special statutory scheme को recognise करते हुए यह स्वीकार किया कि Section 19 की relief अन्य legal proceeding में claim की जा सकती है।

इस judgment का citation है:

Supreme Court — S. Vanitha v. Deputy Commissioner

S. Vanitha v. Deputy Commissioner, 2020, Supreme Court में Section 26(3) का विशेष महत्व सामने आया।

इस case में Supreme Court ने Senior Citizens Act और DV Act के overlapping claims को harmoniously interpret किया और यह भी स्पष्ट किया कि यदि aggrieved woman ने अन्य statutory proceeding में shared household से संबंधित relief प्राप्त की है, तो Section 26(3) के अनुसार Magistrate को उस relief की जानकारी देना आवश्यक है। 

यह judgment Section 26 को अन्य special statutes के साथ पढ़ने में महत्वपूर्ण है।

क्या Section 26 के तहत अलग DV Case आवश्यक है?

Section 26 के उद्देश्य के अनुसार, यदि उपयुक्त legal proceeding पहले से किसी competent civil, family या criminal court में pending है, तो Sections 18–22 की relief उसी proceeding में sought की जा सकती है। [DV Act, 2005, s.26(1)]

इसलिए केवल DV relief प्राप्त करने के लिए हर situation में अलग Section 12 proceeding ही एकमात्र रास्ता नहीं है।

यही principle Juveria Abdul Majid Patni और Vaishali Abhimanyu Joshi में Supreme Court ने recognise किया है। 

क्या Section 26 केवल Pending Proceedings पर लागू होती है?

Section 26(1) में language “any legal proceeding” है और proceeding Act के commencement से पहले या बाद में instituted हो सकती है। [DV Act, 2005, s.26(1)]

इसलिए provision को केवल उस proceeding तक सीमित नहीं किया जा सकता जो DV Act के बाद शुरू हुई हो।

Section 26 और Rules, 2006

Protection of Women from Domestic Violence Rules, 2006 में Section 26 के नाम से कोई अलग standalone procedural rule नहीं है।

लेकिन Rule 6(1) के अनुसार Section 12 के अंतर्गत aggrieved person की application Form II या उसके as nearly as possible होनी चाहिए।

Form II में Sections 18–22 के अलग-अलग reliefs को identify किया गया है, जैसे:

Protection Order,

Residence Order,

Maintenance/Monetary Relief,

Custody Order,

Compensation Order,

और अन्य orders।

Section 26 में जब इन्हीं statutory reliefs को अन्य proceeding में claim किया जाता है, तो संबंधित Court को उस relief के governing substantive provision—Section 18, 19, 20, 21 या 22—के requirements को देखना होगा।

Rules में Protection Officer की भूमिका

Rules में Protection Officer को Act और Rules के अंतर्गत forwarded reports और documents का record maintain करने का duty दिया गया है। Rule 8(1)(xi) में Sections 9, 12, 20, 21, 22, 23 और अन्य provisions के documents/reports के records का उल्लेख है।

Section 26 की relief अन्य Court में sought होने पर भी statutory record और information management महत्वपूर्ण रहता है।

Section 26 और Double Recovery

Section 26 का उद्देश्य multiple recovery या contradictory orders को बढ़ावा देना नहीं है।

इसीलिए Section 26(3) previous relief की disclosure को mandatory बनाता है। [DV Act, 2005, s.26(3)]

विशेष रूप से maintenance matters में Rajnesh v. Neha, 2020, Supreme Court के अनुसार विभिन्न proceedings में प्राप्त या claimed maintenance की disclosure और appropriate adjustment आवश्यक है।

इसलिए Section 26 को “एक ही relief दो बार प्राप्त करने का अधिकार” नहीं माना जा सकता।

Section 26 का Procedural Framework

अन्य civil/family/criminal proceeding मौजूद है

वह proceeding aggrieved person और respondent को affect करती है

Sections 18–22 में उपलब्ध appropriate relief identify की जाती है

उसी legal proceeding में relief मांगी जा सकती है

Relief अन्य relief के addition to और along with हो सकती है

यदि किसी अन्य proceeding में पहले से relief मिल चुकी है → Magistrate को disclosure

Section 26 की सबसे महत्वपूर्ण बातें

Section 26(1) → Sections 18–22 की relief Civil, Family या Criminal Court की अन्य legal proceeding में भी मांगी जा सकती है। [DV Act, 2005, s.26(1)]

Section 26(2) → ये reliefs अन्य reliefs के addition to and along with मांगी जा सकती हैं। [DV Act, 2005, s.26(2)]

Section 26(3) → किसी अन्य proceeding में relief मिल चुकी हो तो aggrieved person को Magistrate को इसकी जानकारी देना अनिवार्य है। [DV Act, 2005, s.26(3)]

Section 26 में केवल Sections 18–22 की relief expressly listed हैं; Section 17 का right to reside स्वयं Section 26 की listed relief नहीं है, बल्कि residence-related judicial remedy Section 19 के माध्यम से आती है। [DV Act, 2005, ss.17, 19, 26]

निष्कर्ष

धारा 26 DV Act की “multiple proceedings” वाली महत्वपूर्ण enabling provision है। इसका उद्देश्य यह सुनिश्चित करना है कि aggrieved woman को Protection, Residence, Monetary, Custody और Compensation जैसे statutory remedies प्राप्त करने के लिए हर बार अलग DV proceeding पर निर्भर न रहना पड़े। [DV Act, 2005, s.26]

इसके तहत Sections 18, 19, 20, 21 और 22 की relief Civil Court, Family Court या Criminal Court के समक्ष चल रही उस legal proceeding में भी मांगी जा सकती है जो aggrieved person और respondent को affect करती है। ये reliefs अन्य available reliefs के addition to and along with भी मांगी जा सकती हैं। [DV Act, 2005, s.26(1)–(2)]

लेकिन यदि किसी अन्य proceeding में relief पहले ही प्राप्त हो चुकी है, तो Section 26(3) के तहत Magistrate को उसका disclosure करना अनिवार्य है। [DV Act, 2005, s.26(3)]

Section 26 पर सबसे महत्वपूर्ण Supreme Court authorities हैं Juveria Abdul Majid Patni v. Atif Iqbal Mansoori, 2014, Vaishali Abhimanyu Joshi v. Nanasaheb Gopal Joshi, 2017, और overlapping statutory remedies के संदर्भ में S. Vanitha v. Deputy Commissioner, 2020।
