Section 23 — Interim और Ex Parte Orders DV Act 2005

 

घरेलू हिंसा अधिनियम, 2005 की धारा 23 — Interim और Ex Parte Orders

धारा 23 Magistrate को Domestic Violence Act की कार्यवाही के दौरान तत्काल राहत देने की शक्ति प्रदान करती है। इसके अंतर्गत Magistrate एक ओर interim order पारित कर सकता है और दूसरी ओर, prima facie domestic violence के आधार पर, prescribed affidavit के आधार पर ex parte order भी पारित कर सकता है। [DV Act, 2005, s.23]

धारा 23 का उद्देश्य

Domestic violence के मामलों में कई बार अंतिम आदेश तक प्रतीक्षा करने से aggrieved person को निरंतर हिंसा, आर्थिक कठिनाई, निवास की समस्या या बच्चों से संबंधित खतरा हो सकता है।

इसी कारण Section 23 Magistrate को proceeding के दौरान तत्काल और अस्थायी judicial protection देने की शक्ति देता है। Section 23(1) interim order के लिए है और Section 23(2) ex parte order के लिए। [DV Act, 2005, s.23]

Section 23(1) — Interim Order

Section 23(1) के अनुसार:

“In any proceeding before him under this Act, the Magistrate may pass such interim order as he deems just and proper.” [DV Act, 2005, s.23(1)]

इस provision में तीन बातें महत्वपूर्ण हैं।

पहली, यह power किसी भी proceeding under the Act में exercise की जा सकती है।

दूसरी, order का उद्देश्य Court को तत्काल परिस्थितियों के अनुसार relief देने की flexibility प्रदान करना है।

तीसरी, Magistrate वही interim order पारित कर सकता है जिसे वह circumstances में “just and proper” समझता है। [DV Act, 2005, s.23(1)]

Interim Order का अर्थ

Interim order ऐसा temporary judicial order है जो मुख्य proceeding के अंतिम निर्णय तक parties की स्थिति को regulate या protect करता है।

Section 23(1) किसी एक प्रकार के interim order तक सीमित नहीं है। Act की अन्य relief provisions के साथ पढ़ने पर interim protection में facts के अनुसार:

Protection Order

Residence Order

Monetary Relief

Custody Order

या

Compensation Order

से संबंधित interim relief शामिल हो सकती है। [DV Act, 2005, ss.18–23]

Rules के Form IV में भी यह स्पष्ट किया गया है कि prescribed reliefs में से appropriate relief interim basis पर complaint और application प्रस्तुत करने के बाद दी जा सकती है।

Section 23(2) — Ex Parte Order

Section 23(2) Section 23 की सबसे महत्वपूर्ण provision है।

यदि Magistrate satisfied है कि application prima facie disclose करती है कि respondent:

domestic violence कर रहा है, या

domestic violence कर चुका है, या

respondent द्वारा domestic violence किए जाने की likelihood है,

तो Magistrate aggrieved person के prescribed form में affidavit के आधार पर ex parte order grant कर सकता है। [DV Act, 2005, s.23(2)]

“Prima Facie Discloses” का महत्व

Section 23(2) में Magistrate को यह देखना है कि application prima facie क्या disclose करती है।

अर्थात इस stage पर Court को final trial की तरह पूरे case का अंतिम determination करने की आवश्यकता नहीं होती।

Court के सामने प्रस्तुत application और prescribed affidavit से यह prima facie दिखाई देना चाहिए कि:

domestic violence हो रही है, या

हो चुकी है, या

उसके होने की likelihood है।

[DV Act, 2005, s.23(2)]

यह immediate protective jurisdiction का आधार है।

Ex Parte का अर्थ

Ex parte order का अर्थ है ऐसा order जो दूसरे पक्ष को उस stage पर prior hearing दिए बिना पारित किया जा सकता है।

Section 23(2) में यह power इसलिए दी गई है ताकि urgent circumstances में aggrieved person को पहले protection मिले और केवल इस कारण relief न रुके कि respondent की prior hearing पूरी नहीं हुई है। [DV Act, 2005, s.23(2)]

लेकिन ex parte order का अर्थ यह नहीं है कि respondent को हमेशा के लिए hearing से वंचित कर दिया जाता है।

यह interim protective mechanism है, final adjudication नहीं।

किन Sections के तहत Ex Parte Order दिया जा सकता है

Section 23(2) specifically निम्न provisions को शामिल करता है:

Section 18 — Protection Order

Section 19 — Residence Order

Section 20 — Monetary Relief

Section 21 — Custody Order

Section 22 — Compensation Order

इसलिए Section 23(2) के तहत केवल Protection Order ही नहीं, बल्कि residence, monetary, custody और compensation से संबंधित appropriate ex parte relief भी दी जा सकती है।

Section 23(2) में Affidavit अनिवार्य

Section 23(2) स्पष्ट रूप से कहता है कि ex parte order aggrieved person के prescribed form में affidavit के आधार पर दिया जा सकता है। [DV Act, 2005, s.23(2)]

Rules ने इस affidavit के लिए विशेष form निर्धारित किया है।

Rule 6(4) — Affidavit in Form III

Protection of Women from Domestic Violence Rules, 2006 के Rule 6(4) के अनुसार Section 23(2) के तहत filed होने वाला affidavit Form III में होना चाहिए।

इसलिए Section 23(2) के ex parte relief के लिए Form III statutory prescribed format है।

Rule 7 — Ex Parte Order के लिए Affidavit

Rules का Rule 7 specifically कहता है कि Section 23(2) के तहत ex parte order प्राप्त करने के लिए प्रत्येक affidavit prescribed Form में filed किया जाएगा।

अर्थात:

Section 23(2) → Affidavit required

Rule 6(4) और Rule 7 → Form III

यह Section 23 की procedural structure है।

Form III में क्या बताया जाता है

Form III “Affidavit under Section 23(2)” के रूप में prescribed है।

इस affidavit में applicant द्वारा case से संबंधित facts और urgent circumstances का verification किया जाता है।

Form III में यह भी state किया जाता है कि applicant को respondent द्वारा domestic violence की repetition की apprehension है।

इसके अतिरिक्त affidavit में urgency का आधार बताया जाता है, जैसे relief न मिलने पर applicant को:

great financial hardship

या

threat of repetition/escalation of domestic violence

का सामना करना पड़ सकता है।

इस प्रकार Form III केवल formal affidavit नहीं है; यह ex parte relief की urgency और prima facie basis को Court के सामने रखने का prescribed mechanism है।

Section 23(1) और Section 23(2) में अंतर

Section 23(1) Magistrate को सामान्य interim order देने की power देता है जिसे वह just and proper समझता है। [DV Act, 2005, s.23(1)]

Section 23(2) विशेष परिस्थितियों में ex parte order देने की power देता है, जब application prima facie domestic violence या उसकी likelihood disclose करती है और prescribed affidavit प्रस्तुत किया जाता है। [DV Act, 2005, s.23(2)]

इसलिए:

Section 23(1) → Interim Order

Section 23(2) → Ex Parte Order

हर interim order आवश्यक रूप से ex parte नहीं होता।

Section 23 और Section 18

Section 18 Protection Order का substantive provision है।

Section 23(2) उस Protection Order को ex parte basis पर तत्काल प्राप्त करने का procedural mechanism प्रदान करता है। [DV Act, 2005, ss.18, 23]

उदाहरण के लिए, यदि application prima facie बताती है कि respondent महिला को लगातार धमका रहा है और domestic violence दोहराने की संभावना है, तो Magistrate Section 18 के protective directions को Section 23(2) के तहत ex parte basis पर दे सकता है।

Section 23 और Section 19

Section 19 shared household से संबंधित Residence Orders देता है।

Section 23(2) के कारण urgent circumstances में Section 19 का appropriate residence relief ex parte भी दिया जा सकता है। [DV Act, 2005, ss.19, 23(2)]

Rules के Form IV में residence-related interim protection में respondent को घर से दूर रहने, residence/workplace से stay away करने तथा अन्य protective measures का उल्लेख है।

Section 23 और Section 20

Section 20 monetary relief का मुख्य provision है।

Section 23(2) expressly Section 20 को शामिल करता है। इसलिए prima facie domestic violence और urgency की appropriate circumstances में Magistrate ex parte monetary relief दे सकता है। [DV Act, 2005, ss.20, 23(2)]

Rules के Form IV में interim monetary relief के अंतर्गत:

maintenance

medical expenses

loss of earnings

physical injury compensation

mental torture और emotional distress

और

property destruction/damage/removal से loss

जैसे heads का उल्लेख है।

Section 23 और Section 21

Section 21 child की temporary custody से संबंधित है।

Section 23(2) Section 21 को भी expressly शामिल करता है। इसलिए appropriate case में Magistrate ex parte temporary custody order दे सकता है। [DV Act, 2005, ss.21, 23(2)]

यह विशेष रूप से relevant हो सकता है जब बच्चे को domestic violence के continuing environment से तत्काल protection की आवश्यकता हो।

Section 23 और Section 22

Section 22 injury, mental torture और emotional distress के लिए compensation/damages का provision है।

Section 23(2) expressly Section 22 को भी cover करता है। इसलिए appropriate prima facie case में ex parte compensation order की statutory possibility मौजूद है। [DV Act, 2005, ss.22, 23(2)]

Protection Officer की भूमिका

Rules के Rule 8 के अनुसार Protection Officer का duty है कि वह aggrieved person को:

Section 12 application

Section 23(2) application

और Act/Rules के अन्य provisions के तहत application तैयार करने में assistance दे।

Protection Officer को Safety Plan भी तैयार करना होता है, जिसमें further domestic violence को prevent करने के measures शामिल होते हैं। यह aggrieved person के consultation के साथ Form V में तैयार किया जाता है। [DV Rules, 2006, Rule 8(1)(iv)]

Rule 10 — Ex Parte Interim Relief के लिए Home Visit

Rule 10(1)(a) के अनुसार यदि Magistrate written direction देता है, तो Protection Officer:

shared household premises का home visit

कर सकता है और preliminary enquiry कर सकता है, यदि Court को aggrieved person को ex parte interim relief देने के संबंध में clarification चाहिए।

यह Section 23 की practical implementation में महत्वपूर्ण safeguard है।

Rule 10 — Assets और Financial Information

Rule 10(1)(b) के अनुसार Magistrate की written direction पर Protection Officer:

emoluments

assets

bank accounts

या

अन्य directed documents

के संबंध में appropriate enquiry करके report file कर सकता है।

यह Section 23 के तहत monetary relief या property-related interim orders के factual assessment में उपयोगी हो सकता है।

Rule 10 — Child Custody

Rule 10(1)(d) Protection Officer को Court के direction पर aggrieved person को:

children की custody regain करने

और

Court की supervision में visitation rights secure करने

में सहायता करने का दायित्व देता है।

इसका Section 23(2) के ex parte custody order से सीधा practical connection है।

Section 23 और Section 24

Section 24 के अनुसार Magistrate द्वारा Act के तहत कोई order pass होने पर उसकी copy free of cost:

parties

concerned police officer

और

local jurisdiction में स्थित service provider

को दी जानी है; यदि किसी service provider ने DIR register की है, तो उसे भी copy दी जाती है। [DV Act, 2005, s.24]

इसलिए Section 23 के तहत interim या ex parte order पारित होने के बाद Section 24 order communication और implementation के लिए महत्वपूर्ण है।

Section 23 और Section 25

Section 25(2) के अनुसार यदि circumstances में change हो और किसी order में:

alteration

modification

या

revocation

की आवश्यकता हो, तो aggrieved person या respondent की application पर Magistrate reasons in writing record करके appropriate order कर सकता है। [DV Act, 2005, s.25(2)]

इसलिए Section 23 के तहत प्राप्त interim/ex parte order circumstances बदलने पर आगे judicial consideration के अधीन हो सकता है।

Section 23 और Section 28

Section 28(1) के अनुसार Sections 12, 18, 19, 20, 21, 22 और 23 की proceedings सामान्यतः Code of Criminal Procedure, 1973 के provisions द्वारा governed होती हैं, subject to the DV Act. [DV Act, 2005, s.28(1)]

Section 28(2) Magistrate को Section 12 application तथा Section 23(2) application के disposal के लिए अपनी procedure निर्धारित करने की अनुमति देता है। [DV Act, 2005, s.28(2)]

यह Section 23(2) की speedy और effective nature के लिए विशेष रूप से महत्वपूर्ण है।

Section 23 और Domestic Incident Report

Section 23(2) का statutory text यह नहीं कहता कि ex parte order देने से पहले Domestic Incident Report (DIR) का होना अनिवार्य prerequisite है।

Section 23(2) का express test है:

application prima facie domestic violence disclose करे, या

उसकी likelihood disclose करे,

और prescribed affidavit के आधार पर Court appropriate ex parte order दे। [DV Act, 2005, s.23(2)]

इसलिए केवल Section 23 के text के आधार पर DIR को ex parte order की absolute statutory precondition नहीं कहा जा सकता।

Section 23 और Urgency

Ex parte relief का केंद्रीय विचार urgency और immediate protection है।

Form III में भी यह बताया जाता है कि relief urgent है और यदि ex parte ad-interim basis पर relief नहीं दी गई तो applicant को financial hardship या repetition/escalation of domestic violence का खतरा हो सकता है।

इसलिए Section 23(2) application में urgency को specific facts के साथ demonstrate करना practical रूप से महत्वपूर्ण है।

Section 23 का उदाहरण

मान लीजिए respondent द्वारा aggrieved person के विरुद्ध लगातार physical violence की जा रही है और application से prima facie यह दिखाई देता है कि violence दोबारा होने की वास्तविक likelihood है।

ऐसी स्थिति में Magistrate Section 23(2) के तहत prescribed Form III affidavit के आधार पर respondent को domestic violence से रोकने वाला ex parte Protection Order under Section 18 दे सकता है। [DV Act, 2005, ss.18, 23]

इसी प्रकार facts के अनुसार residence, monetary, custody या compensation relief भी Section 23(2) के framework में दी जा सकती है।

Section 23 का Enforcement Context

यदि Section 23(2) के तहत Protection Order या interim Protection Order दिया गया और respondent उसका breach करता है, तो Section 31 के तहत breach एक offence है। इसके लिए imprisonment या fine या दोनों का statutory provision है। [DV Act, 2005, s.31]

Rules के Rule 15 के अनुसार protection order या interim protection order के breach की report local police station को की जा सकती है और enforcement mechanism लागू होता है।

इसलिए Section 23 का interim/ex parte protection order केवल advisory protection नहीं है।


Section 23 के लिए सबसे प्रत्यक्ष authorities स्वयं:

Section 23(1) — Interim Order

Section 23(2) — Ex Parte Order

Rule 6(4) — Form III Affidavit

Rule 7 — Affidavit for Ex Parte Order

Rule 8 — Protection Officer की assistance

और

Rule 10 — Ex Parte Interim Relief में Home Visit/Enforcement Assistance

हैं।

Section 23 की पूरी संरचना

Section 23(1)
Magistrate किसी भी DV Act proceeding में just and proper interim order दे सकता है।

Section 23(2)
Application prima facie domestic violence या उसकी likelihood disclose करे तो Magistrate prescribed affidavit के आधार पर ex parte order दे सकता है।

Ex Parte Relief किन Sections में
Sections 18, 19, 20, 21 और 22

Prescribed Affidavit
Form III, under Rule 6(4) and Rule 7।

Protection Officer
Section 23(2) application तैयार कराने में assistance, Safety Plan और आवश्यक preliminary enquiry/implementation assistance। [DV Rules, 2006, Rules 8, 10]

Section 28(2)
Court Section 23(2) application के disposal के लिए अपनी procedure निर्धारित कर सकता है।

निष्कर्ष

धारा 23 DV Act की तत्काल राहत की केंद्रीय procedural provision है। Section 23(1) Magistrate को किसी भी proceeding में just and proper interim order देने की शक्ति देता है। [DV Act, 2005, s.23(1)]

Section 23(2) इससे भी महत्वपूर्ण है। यदि application prima facie यह disclose करती है कि respondent domestic violence कर रहा है, कर चुका है या domestic violence करने की likelihood है, तो Magistrate prescribed affidavit के आधार पर Sections 18, 19, 20, 21 या 22 के तहत ex parte order दे सकता है। [DV Act, 2005, s.23(2)]

Rules के अनुसार यह affidavit Form III में होना चाहिए और Protection Officer application तैयार करने, Safety Plan बनाने तथा आवश्यकता होने पर ex parte interim relief के लिए home visit और अन्य assistance देने में भूमिका निभाता है।
