Section 191 BNS 2023 – Rioting: Complete Legal Explanation, Ingredients, Punishment and Supreme Court Judgments

Section 191 BNS, 2023 rioting को define और punish करता है। इसका आधार यह है कि जब an unlawful assembly अपने common object की prosecution में force या violence का प्रयोग करती है, तो उस assembly के प्रत्येक member पर rioting की liability आ सकती है।

Section 191 BNS 2023 – Rioting

Statutory Provision

“191. (1) Whenever force or violence is used by an unlawful assembly, or by any member thereof, in prosecution of the common object of such assembly, every member of such assembly is guilty of the offence of rioting.

(2) Whoever is guilty of rioting, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.

(3) Whoever is guilty of rioting, being armed with a deadly weapon or with anything which, used as a weapon of offence, is likely to cause death, shall be punished with imprisonment of either description for a term which may extend to five years, or with fine, or with both.”

Nature of Section 191

Section 191 में तीन अलग-अलग components हैं:

Meaning of Rioting

Rioting के लिए केवल पाँच या अधिक लोगों का इकट्ठा होना पर्याप्त नहीं है।

Section 189 BNS unlawful assembly की foundation देता है और Section 191 उस assembly द्वारा common object की prosecution में force या violence के use को rioting बनाता है।

Essential Ingredients

Section 191(1) के essential ingredients निम्न हैं:

Unlawful Assembly

सबसे पहले पाँच या अधिक persons की ऐसी assembly होनी चाहिए जो Section 189 BNS के अनुसार unlawful assembly हो।

Section 189 में unlawful assembly के लिए विभिन्न common objects निर्धारित किए गए हैं, जिनमें criminal force से Government को overawe करना, law या legal process का resistance, offence करना तथा force के माध्यम से property या rights से संबंधित उद्देश्यों को प्राप्त करना शामिल है।

Five or More Persons

Unlawful assembly की statutory foundation कम-से-कम पाँच persons हैं।

Common Object

Assembly का कोई ऐसा common object होना चाहिए जो Section 189 के scope में आता हो।

Use of Force or Violence

Assembly या उसके किसी member द्वारा force अथवा violence का प्रयोग होना चाहिए।

Connection with Common Object

Force या violence का प्रयोग assembly के common object की prosecution में होना चाहिए।

Membership

Section 191(1) के अनुसार common object की prosecution में force या violence use होने पर assembly के प्रत्येक member को rioting का guilty माना जाता है।

Force or Violence

Section 191 में force या violence दोनों expressions महत्वपूर्ण हैं।

Supreme Court की Section 146 IPC jurisprudence—जिसका statutory structure BNS Section 191(1) में substantially carried forward हुआ है—के अनुसार force या violence का प्रयोग common object की prosecution में होना आवश्यक है। यह आवश्यक नहीं कि force या violence के परिणामस्वरूप common object वास्तव में पूरा भी हो जाए। [Vinubhai Ranchhodbhai Patel v. अर्थात:

Common object achieve न होने पर भी, यदि statutory requirements satisfy होती हैं, rioting का offence complete हो सकता है।

Section 191(2) – Simple Rioting

Section 191(2) provides:

“Whoever is guilty of rioting, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.”

इसमें maximum punishment:

  • imprisonment up to 2 years, या

  • fine, या

  • दोनों।

BNSS First Schedule के अनुसार Section 191(2) का offence cognizable, bailable है और इसका trial Any Magistrate द्वारा किया जा सकता है।

Section 191(3) – Rioting Armed with Deadly Weapon

Section 191(3) aggravated form of rioting को punish करता है।

“Whoever is guilty of rioting, being armed with a deadly weapon or with anything which, used as a weapon of offence, is likely to cause death, shall be punished with imprisonment of either description for a term which may extend to five years, or with fine, or with both.”

यहाँ दो conditions महत्वपूर्ण हैं:

इसलिए केवल unlawful assembly में किसी weapon की presence पर्याप्त नहीं है। जिस accused पर Section 191(3) लगाया जा रहा है, उसके being armed होने का element महत्वपूर्ण है।

BNSS First Schedule के अनुसार Section 191(3) cognizable और bailable है तथा इसका trial Magistrate of the first class द्वारा किया जाता है।

दोनों provisions को साथ पढ़ना उपयोगी है।

इसलिए Section 190 और Section 191 को interchangeable नहीं समझना चाहिए।

Mere Presence and Rioting

केवल किसी स्थान पर उपस्थित होना automatically Section 191 की liability establish नहीं करता।

Supreme Court ने unlawful assembly jurisprudence में repeatedly यह principle अपनाया है कि Court को यह determine करना होता है कि accused वास्तव में unlawful assembly का member था या केवल bystander/passive spectator था। Common object circumstances और surrounding conduct से infer किया जा सकता है।

Masalti v. State of U.P., AIR 1965 SC 202 में Constitution Bench ने Section 149 IPC के context में membership और common object के determination पर leading principles दिए थे। बाद के Supreme Court decisions ने इन्हें follow किया है। (Order Law Storage)

Overt Act of Every Member Not Necessary

Section 191(1) में statutory language है कि force or violence “by an unlawful assembly, or by any member thereof” use किया जाए और फिर every member guilty of rioting हो सकता है।

इसका अर्थ यह नहीं कि प्रत्येक member को स्वयं मारपीट या force का अलग act करना आवश्यक है।

Supreme Court ने Vinubhai Ranchhodbhai Patel v. Ravibhai Dudabhai Patel में Section 146 IPC के संदर्भ में स्पष्ट किया कि unlawful assembly द्वारा common object की prosecution में force या violence होने पर प्रत्येक member पर rioting का principle लागू हो सकता है। (Indian Kanoon)

लेकिन यह principle तभी लागू होगा जब prosecution पहले यह establish करे कि accused वास्तव में relevant unlawful assembly का member था।

Common Object कैसे Determine होगा?

Common object को केवल किसी एक accused के individual overt act से determine नहीं किया जाना चाहिए।

Relevant circumstances में शामिल हो सकते हैं:

  • assembly का nature;

  • persons की संख्या;

  • weapons carried;

  • place of occurrence;

  • assembly के पहले और बाद का conduct;

  • attack का manner;

  • किस प्रकार का force/violence use हुआ;

  • members का collective conduct।

Supreme Court ने Lalji v. State of U.P., (1989) 1 SCC 437 में common object को assembly की nature, arms और conduct से infer करने का principle स्वीकार किया। इसी principle को subsequent cases में भी apply किया गया है। (Indian Kanoon)

Deadly Weapon – Section 191(3)

Section 191(3) का aggravated liability तभी आती है जब व्यक्ति:

पहले rioting का participant हो, और

उसके पास deadly weapon अथवा ऐसा object हो जो weapon की तरह इस्तेमाल होने पर death cause करने की संभावना रखता हो।

इसलिए Section 191(3) का analysis दो stages में होगा:

Supreme Court की पुराने Section 148 IPC की jurisprudence में यह distinction महत्वपूर्ण माना गया है कि सामान्य rioting और deadly weapon के साथ rioting अलग statutory offences हैं। Vinubhai Ranchhodbhai Patel में Court ने इसी distinction को explain किया। (Indian Kanoon)

यह unlawful assembly/common object jurisprudence का leading Constitution Bench authority है। Court ने स्पष्ट किया कि common object और membership के determination के लिए circumstances को collectively examine किया जाना चाहिए। 

Lalji v. State of Uttar Pradesh

Practical Example

मान लें 6 लोग एक व्यक्ति को जबरन उसकी property से हटाने के common object से एकत्र होते हैं। वे unlawful assembly constitute करते हैं। Assembly का एक member victim पर हमला करता है और अन्य members force का प्रयोग करते हैं।

यदि force/violence common object की prosecution में है:

Section 191(1) → Rioting

यदि इनमें से किसी accused के पास deadly weapon है:

Section 191(3) → Rioting armed with deadly weapon

यदि उसी घटना में किसी member द्वारा अलग substantive offence भी common object की prosecution में किया गया है, तो Section 190 का question भी arise हो सकता है।

Conclusion

Section 191 BNS, 2023 का central principle यह है कि unlawful assembly द्वारा उसके common object की prosecution में force या violence का use होने पर rioting का offence बनता है। Section 191(2) सामान्य rioting के लिए अधिकतम दो वर्ष की imprisonment, fine या दोनों प्रदान करता है, जबकि Section 191(3) deadly weapon के साथ rioting को aggravated form मानते हुए अधिकतम पाँच वर्ष की imprisonment, fine या दोनों का provision करता है।
