Section 190 BNS, 2023: Liability of Members of Unlawful Assembly for Offences Committed in Prosecution of Common Object

Section 190 BNS, 2023, unlawful assembly के प्रत्येक सदस्य पर constructive/vicarious criminal liability लागू करने वाला महत्वपूर्ण प्रावधान है। इसका मूल सिद्धान्त यह है कि यदि unlawful assembly का कोई सदस्य उसके common object को आगे बढ़ाते हुए कोई offence करता है, तो निर्धारित परिस्थितियों में उस समय assembly में मौजूद प्रत्येक सदस्य उस offence के लिए liable हो सकता है।

Statutory Provision

“190. If an offence is committed by any member of an unlawful assembly in prosecution of the common object of that assembly, or such as the members of that assembly knew to be likely to be committed in prosecution of that object, every person who, at the time of the committing of that offence, is a member of the same assembly, is guilty of that offence.”

यह provision BNS के Chapter XI – “OF OFFENCES AGAINST THE PUBLIC TRANQUILLITY” में unlawful assembly से संबंधित provisions का हिस्सा है।


Meaning of Section 190

Section 190 का उद्देश्य उस स्थिति में criminal liability निर्धारित करना है जब पाँच या उससे अधिक व्यक्तियों की unlawful assembly में से किसी एक सदस्य द्वारा कोई offence किया जाता है।

इस Section में दो परिस्थितियाँ महत्वपूर्ण हैं:

Section 190 में liability उस व्यक्ति पर आती है जो offence किए जाने के समय उसी unlawful assembly का member था।


Essential Ingredients

Section 190 को लागू करने के लिए निम्नलिखित elements महत्वपूर्ण हैं:

Unlawful Assembly

सबसे पहले यह establish होना चाहिए कि पाँच या अधिक व्यक्तियों की assembly Section 189 BNS के अर्थ में unlawful assembly थी।

Section 189 में common object की विभिन्न categories दी गई हैं, जैसे criminal force द्वारा Government को overawe करना, law या legal process का प्रतिरोध करना, offence करना, property/right of way आदि पर force से कब्जा करना या किसी व्यक्ति को ऐसा कार्य करने अथवा न करने के लिए compel करना।

Five or More Persons

Assembly में कम-से-कम पाँच व्यक्ति होने चाहिए।

Common Object

Assembly का कोई unlawful common object होना आवश्यक है।

Commission of an Offence

Assembly के किसी member द्वारा offence किया जाना चाहिए।

Connection with Common Object

Offence या तो:

  • common object की prosecution में किया गया हो; या

  • ऐसा offence हो जिसे assembly के members उस common object की prosecution में committed होने की संभावना के रूप में जानते थे।

Membership at the Time of Offence

जिस व्यक्ति पर Section 190 की liability लगाई जा रही है, वह offence किए जाने के समय assembly का member होना चाहिए।

Vicarious/Constructive Liability

उस member को उस offence के लिए liable माना जा सकता है, भले ही उसने स्वयं physical act न किया हो।


Common Object और Common Intention में Difference

Section 190 को समझने के लिए common object और common intention के बीच अंतर महत्वपूर्ण है।

Supreme Court ने पुराने IPC Section 149 के संदर्भ में स्पष्ट किया है कि common object के लिए prior concert या prior meeting of minds आवश्यक नहीं है। Common object circumstances, conduct, weapons, language और incident के overall course से निर्धारित किया जा सकता है। यह jurisprudence BNS Section 190 को समझने में comparative assistance देती है। (Sci API)


Mere Presence is Not Sufficient

Section 190 का एक अत्यंत महत्वपूर्ण principle यह है कि किसी व्यक्ति का केवल घटनास्थल पर उपस्थित होना अपने-आप उसे उस offence के लिए liable नहीं बनाता।

Supreme Court ने Section 149 IPC की व्याख्या करते हुए कहा है कि prosecution को unlawful assembly, requisite number, common object, unlawfulness और उस object से connected offence जैसे आवश्यक factors establish करने होते हैं। केवल presence को mechanically liability में बदलना उचित नहीं है। (Sci API)

लेकिन इसका दूसरा पहलू भी महत्वपूर्ण है।

हर member द्वारा अलग-अलग overt act करना आवश्यक नहीं है।

यदि unlawful assembly और उसका common object सिद्ध हो जाता है तथा offence उस common object की prosecution में किया गया है, तो प्रत्येक member द्वारा अलग physical assault या overt act सिद्ध करना आवश्यक नहीं हो सकता। Supreme Court ने इस principle को Section 149 IPC के संदर्भ में बार-बार स्वीकार किया है। (Sci API)


“Knew to be Likely” का अर्थ

Section 190 की दूसरी limb विशेष रूप से महत्वपूर्ण है।

Statutory language है:

“such as the members of that assembly knew to be likely to be committed in prosecution of that object”

इसका अर्थ यह है कि यदि actual offence assembly के common object का express object न भी हो, लेकिन परिस्थितियों से यह सिद्ध हो कि assembly के members को यह knowledge थी कि common object को आगे बढ़ाते समय ऐसा offence likely हो सकता है, तो Section 190 की liability arise हो सकती है।

उदाहरण के लिए:

मान लें पाँच या अधिक व्यक्ति किसी व्यक्ति को जबरन उसके property/right से हटाने के common object से एकत्रित होते हैं। Assembly के members weapons लेकर जाते हैं और परिस्थितियाँ ऐसी हैं कि गंभीर हिंसा होने की likelihood उनके knowledge में थी। यदि उसी course में कोई member गंभीर offence करता है, तो अन्य members की liability केवल इस आधार पर समाप्त नहीं होगी कि उन्होंने स्वयं वह physical act नहीं किया।

Masalti v. State of Uttar Pradesh

यह Constitution Bench decision unlawful assembly और Section 149 IPC के context में leading authority है।

Supreme Court ने स्पष्ट किया कि प्रत्येक member द्वारा कोई specific overt act किया जाना आवश्यक नहीं है। यदि common object और unlawful assembly establish हो जाती है, तो constructive liability का principle लागू हो सकता है। बाद के Supreme Court decisions ने Masalti के इस principle को लगातार follow किया है। (Sci API)

इसलिए Section 190 की liability का आधार केवल “कौन मारा?” नहीं है, बल्कि यह भी है कि assembly का common object क्या था और committed offence उस object से किस प्रकार जुड़ा था।

Burden on Prosecution

Section 190 के मामले में prosecution को सामान्यतः यह establish करना होगा कि:

  • unlawful assembly अस्तित्व में थी;

  • accused उस assembly का member था;

  • accused offence के समय उस assembly का member था;

  • assembly का common object क्या था;

  • offence common object की prosecution में किया गया था; या

  • ऐसा offence था जिसे members उस object की prosecution में likely जानते थे।

Supreme Court ने Section 149 IPC के समान principle पर यह स्पष्ट किया है कि constructive liability लगाने के कारण prosecution को foundational facts पर्याप्त रूप से establish करने होते हैं। (Sci API)


Punishment under Section 190

Section 190 स्वतंत्र punishment provision नहीं देता।

इसका practical effect यह है कि यदि Section 190 की conditions satisfy होती हैं, तो concerned member को उस offence के लिए guilty माना जा सकता है जो assembly के member द्वारा किया गया था।

इसलिए punishment उस underlying offence के अनुसार निर्धारित होगी।

Section 190 BNS, 2023 unlawful assembly के context में constructive/vicarious criminal liability का महत्वपूर्ण statutory mechanism है। इसका application तभी उचित होगा जब prosecution unlawful assembly, common object, accused की membership और committed offence के common object से requisite connection को establish करे।
