Section 186 BNS: Prohibition of Fictitious Stamps

Bharatiya Nyaya Sanhita, 2023 का Section 186 fictitious stamps अर्थात Government द्वारा postage rate दर्शाने के लिए जारी किए गए stamps के झूठे रूप, imitation अथवा representation से संबंधित conduct को अपराध बनाता है।
यह provision fictitious stamp बनाने, बेचने, इस्तेमाल करने, possession रखने तथा उसे बनाने के लिए die, plate या materials रखने को regulate करता है।

Statutory Provision

**“186. (1) Whoever—
(a) makes, knowingly utters, deals in or sells any fictitious stamp, or knowingly uses for any postal purpose any fictitious stamp; or
(b) has in his possession, without lawful excuse, any fictitious stamp; or
(c) makes or, without lawful excuse, has in his possession any die, plate, instrument or materials for making any fictitious stamp,
shall be punished with fine which may extend to two hundred rupees.

(2) Any such stamp, die, plate, instrument or materials in the possession of any person for making any fictitious stamp may be seized and, if seized shall be forfeited.

(3) In this section “fictitious stamp” means any stamp falsely purporting to be issued by Government for the purpose of denoting a rate of postage, or any facsimile or imitation or representation, whether on paper or otherwise, of any stamp issued by Government for that purpose.

(4) In this section and also in sections 178 to 181 (both inclusive), and sections 183 to 185 (both inclusive) the word “Government”, when used in connection with, or in reference to any stamp issued for the purpose of denoting a rate of postage, shall, notwithstanding anything in clause (12) of section 2, be deemed to include the person or persons authorised by law to administer executive Government in any part of India or in any foreign country.”**

Object of Section 186

Section 186 का उद्देश्य ऐसे stamps के circulation और use को रोकना है जो Government द्वारा postage rate दर्शाने के लिए वास्तव में जारी नहीं किए गए हैं, लेकिन देखने में Government-issued postage stamp जैसे दिखाई देते हैं।

इसलिए Section 186 केवल actual counterfeit stamp तक सीमित नहीं है। Statutory definition में—

  • falsely purporting stamp,

  • facsimile,

  • imitation, और

  • representation

भी शामिल हैं।

Meaning of Fictitious Stamp

Section 186(3) के अनुसार “fictitious stamp” का अर्थ है:

ऐसा stamp जो falsely यह purport करे कि वह Government द्वारा rate of postage denote करने के लिए issued है।

इसके अतिरिक्त Government द्वारा उस purpose के लिए issued stamp का—

  • facsimile,

  • imitation, या

  • representation,

चाहे वह paper पर हो या किसी अन्य form में, भी fictitious stamp की definition में आता है।

Simple Example

यदि कोई व्यक्ति ऐसा paper stamp तैयार करता है जो इस प्रकार प्रस्तुत किया गया है कि वह Government का postage stamp है, जबकि Government ने उसे issue नहीं किया है, तो statutory definition के अनुसार वह fictitious stamp हो सकता है।


Offences Covered under Section 186(1)

Section 186(1) को तीन प्रमुख categories में विभाजित किया गया है।

Making, Uttering, Dealing, Selling or Using

Section 186(1)(a) निम्न conduct को cover करता है:

  • fictitious stamp बनाना;

  • उसे knowingly utter करना;

  • उसमें deal करना;

  • उसे sell करना;

  • fictitious stamp को knowingly किसी postal purpose के लिए use करना।

यहाँ “knowingly” विशेष रूप से महत्वपूर्ण है, क्योंकि statutory language कुछ conduct के साथ knowledge को expressly attach करती है।

Possession of Fictitious Stamp

Section 186(1)(b) के अंतर्गत किसी fictitious stamp को without lawful excuse possession में रखना offence है।

इसलिए possession के मामले में statute expressly lawful excuse की absence को ingredient बनाता है।

Die, Plate, Instrument or Materials

Section 186(1)(c) उन instruments और materials को भी cover करता है जो fictitious stamp बनाने के लिए इस्तेमाल हो सकते हैं।

Punishment

Section 186(1) के अंतर्गत punishment:

Fine which may extend to ₹200

अर्थात Section 186(1) के लिए statutory punishment maximum ₹200 fine है।

यहाँ imprisonment prescribed नहीं है।

Seizure and Forfeiture

Section 186(2) एक महत्वपूर्ण consequential provision देता है।

यदि किसी व्यक्ति के possession में fictitious stamp बनाने के लिए कोई—

  • stamp,

  • die,

  • plate,

  • instrument, या

  • materials

मिलते हैं, तो ऐसे articles seized किए जा सकते हैं और यदि seized किए गए हैं तो forfeited होंगे।

इस प्रकार Section 186 केवल व्यक्ति के conduct को punish नहीं करता, बल्कि offence से संबंधित instrumentalities के seizure और forfeiture का भी statutory mechanism देता है।

Mens Rea and Lawful Excuse

Section 186 में mens rea का application conduct के अनुसार अलग-अलग दिखाई देता है।

Section 186(1)(a) में “knowingly” का express use है, विशेषकर uttering/dealing/selling और postal purpose के लिए use के संदर्भ में।

Section 186(1)(b) में possession तभी punishable है जब वह without lawful excuse हो।

Section 186(1)(c) में die, plate, instrument या materials की possession भी without lawful excuse होने पर covered है।

इसलिए Section 186 के प्रत्येक prosecution में alleged conduct और उसके साथ statutory mental element को अलग-अलग examine करना आवश्यक है।

Special Meaning of “Government”

Section 186(4) एक special deeming provision है।

Section 186 में तथा Sections 178 to 181 और 183 to 185 में, जब “Government” शब्द ऐसे stamp के संबंध में इस्तेमाल होता है जो rate of postage denote करने के लिए issued है, तो “Government” में वह person या persons भी शामिल माने जाएंगे जिन्हें law द्वारा India या किसी foreign country में executive Government administer करने के लिए authorised किया गया है।

Section 186(4)

यह provision इसलिए महत्वपूर्ण है क्योंकि Section 186 की application में “Government-issued postage stamp” की statutory understanding को विस्तृत किया गया है।

Difference Between Section 184 and Section 186

Section 184 में focus है Government revenue stamp जो पहले इस्तेमाल हो चुका है, उसका fraudulent/intentional reuse।

Section 186 में focus है fictitious postage stamp, अर्थात ऐसा stamp जो Government-issued postage stamp होने का झूठा representation करता है या उसका imitation/facsimile है।

इसलिए दोनों में “stamp” शब्द common होने के बावजूद statutory purpose अलग है:
