Section 139 BNS 2023: Kidnapping or Maiming a Child for Purposes of Begging

Section 139 of the Bharatiya Nyaya Sanhita, 2023 (BNS) बच्चों को begging के लिए kidnap करने, उनकी custody प्राप्त करने, या उन्हें begging के लिए maim करने से संबंधित एक गंभीर offence है। इसमें Section 139(1) के तहत कम-से-कम 10 वर्ष का rigorous imprisonment, जो life imprisonment तक हो सकता है, और fine तथा Section 139(2) में कम-से-कम 20 वर्ष का imprisonment, जो natural life के remainder तक extend हो सकता है, और fine prescribed है।

Statutory Provision

Section 139 में चार महत्वपूर्ण sub-sections हैं:

Section 139(1) — किसी child को kidnap करना, या lawful guardian न होते हुए उसकी custody प्राप्त करना, इस उद्देश्य से कि child को begging के लिए employ या use किया जाए।

Section 139(2) — किसी child को इस उद्देश्य से maim करना कि उसे begging के लिए employ या use किया जाए।

Section 139(3) — यदि lawful guardian न होने वाला व्यक्ति child को begging के लिए employ या use करता है, तो एक statutory presumption operate करती है कि उसने child को begging के उद्देश्य से kidnap या उसकी custody प्राप्त की थी, जब तक contrary prove न हो।

Section 139(4) — “begging” की विस्तृत statutory definition दी गई है।

Object and Scope

Section 139 का focus केवल सामान्य kidnapping पर नहीं है। इसके लिए kidnapping/custody/maiming का connection begging के specific purpose से होना आवश्यक है।

इसलिए prosecution को facts के अनुसार यह establish करना होगा कि child को begging के लिए employ या use करने का उद्देश्य था।

यह Section विशेष रूप से महत्वपूर्ण है क्योंकि BNS ने ऐसे conduct के लिए बहुत कठोर minimum punishments prescribe किए हैं।

Section 139(1): Kidnapping or Obtaining Custody of Child

Section 139(1) दो alternative situations को cover करता है:

  • कोई व्यक्ति child को kidnap करता है; या

  • कोई व्यक्ति lawful guardian न होते हुए child की custody obtain करता है;

और यह act इस purpose से होना चाहिए कि child को begging के लिए employed or used किया जाए।

इसलिए केवल child की custody में होना अपने-आप Section 139(1) का offence नहीं है। Custody और begging purpose के बीच statutory connection आवश्यक है।

Child की Age

BNS में “child” का अर्थ सामान्यतः 18 वर्ष से कम आयु का व्यक्ति है।

इसलिए Section 139 में IPC Section 363A की तरह male और female minors के लिए अलग-अलग age thresholds नहीं हैं। BNS ने child के लिए एक uniform age concept अपनाया है।

Kidnapping and Obtaining Custody

Section 139(1) में “kidnaps any child” के साथ-साथ “not being the lawful guardian of such child, obtains the custody of the child” भी expressly शामिल है।

इसका practical importance यह है कि prosecution का case केवल traditional kidnapping तक सीमित नहीं है। यदि lawful guardian न होने वाला व्यक्ति child की custody प्राप्त करता है और statutory begging purpose establish होता है, तो Section 139(1) लागू हो सकता है।

यहाँ Section 137 की kidnapping provisions भी relevant हो सकती हैं क्योंकि Section 137 lawful guardianship से kidnapping को define करता है।

Specific Purpose of Begging

Section 139(1) का सबसे महत्वपूर्ण ingredient purpose of begging है।

Statutory wording के अनुसार child को:

“employed or used for the purposes of begging”

किया जाना चाहिए या ऐसा purpose kidnapping/custody obtaining के समय मौजूद होना चाहिए।

इसलिए prosecution को kidnapping या custody और begging purpose के बीच necessary connection establish करना होगा।

Section 139(2): Maiming a Child for Begging

Section 139(2) एक और अधिक गंभीर form of offence को punish करता है।

यदि कोई व्यक्ति किसी child को maim करता है और उद्देश्य यह है कि child को begging के लिए employ या use किया जाए, तो उसे:

  • कम-से-कम 20 वर्ष का imprisonment;

  • जो life imprisonment तक extend हो सकता है, जहाँ life का अर्थ उस व्यक्ति के natural life के remainder से है; और

  • fine

से punish किया जा सकता है।

यहाँ “maiming” का element केवल ordinary injury से अलग है। Prosecution को facts के अनुसार यह establish करना होगा कि conduct statutory sense में maiming था और उसका connection begging purpose से था।

BNSS First Schedule में दोनों sub-sections को cognizable और non-bailable classify किया गया है, लेकिन trial court अलग है। (Uttar Pradesh Police)

Section 139(3): Statutory Presumption

Section 139(3) एक महत्वपूर्ण presumption clause है।

यदि कोई person:

  • child का lawful guardian नहीं है; और

  • child को begging के purposes के लिए employs or uses करता है,

तो Court यह presume करेगी कि उस व्यक्ति ने child को begging के purpose से kidnap या otherwise obtain custody किया था, unless the contrary is proved.

इस provision का evidentiary significance महत्वपूर्ण है क्योंकि यह prosecution और accused के evidentiary positions को प्रभावित करता है।

Presumption Does Not Remove Every Prosecution Requirement

Section 139(3) को यह समझना आवश्यक है कि statutory presumption केवल उसके expressly specified circumstances में operate करती है।

पहले यह establish होना आवश्यक होगा कि:

व्यक्ति lawful guardian नहीं है + child को begging के लिए employ/use किया गया।

इसके बाद statutory presumption arise होती है कि child को begging purpose से kidnap या custody में obtain किया गया था।

इसलिए केवल किसी व्यक्ति का child के साथ दिखाई देना या child की custody में होना अपने-आप Section 139(3) की presumption activate नहीं करता।

Meaning of Begging

Section 139(4) में “begging” की detailed definition दी गई है। इसमें निम्न acts शामिल हैं:

Soliciting or Receiving Alms in a Public Place

Public place में alms solicit या receive करना begging है, चाहे यह:

  • singing,

  • dancing,

  • fortune telling,

  • performing tricks,

  • selling articles,

या किसी अन्य pretence/mode के माध्यम से हो।

Entering Private Premises

किसी private premises में alms solicit या receive करने के purpose से enter करना भी statutory definition में begging है।

Exhibiting Sore, Wound, Injury or Deformity

Alms obtain या extort करने के object से किसी sore, wound, injury, deformity या disease को expose या exhibit करना भी begging में शामिल है।

यह स्वयं व्यक्ति, किसी दूसरे person या animal से संबंधित हो सकता है।

Using Child as an Exhibit

Child को alms solicit या receive करने के purpose से exhibit के रूप में use करना भी begging की statutory definition में expressly शामिल है।

यह provision विशेष रूप से महत्वपूर्ण है क्योंकि बहुत छोटे child को स्वयं alms solicit करने में सक्षम न होने पर भी उसे exhibit के रूप में use किया जा सकता है।

Punishment under Section 139

Section 139 में punishment अत्यंत कठोर है।

Section 139(1): minimum 10 years rigorous imprisonment, extendable to life imprisonment, plus fine.

Section 139(2): minimum 20 years imprisonment, extendable to life imprisonment meaning imprisonment for the remainder of natural life, plus fine.

यहाँ Section 139(2) में “life” को expressly define किया गया है, जिससे यह सामान्य remission/term assumptions से अलग statutory formulation बनता है।

Section 139 and Section 137 — Difference

Section 137 general kidnapping offence है और kidnapping from India तथा kidnapping from lawful guardianship को cover करता है।

Section 139 एक special aggravated offence है क्योंकि kidnapping/custody का specific purpose begging होना आवश्यक है और punishment Section 137 की तुलना में substantially अधिक है।

इसलिए जहाँ facts Section 139 के specific ingredients satisfy करते हैं, वहाँ केवल general kidnapping provision पर analysis समाप्त नहीं किया जाना चाहिए।

Section 139 and Section 140 — Difference

Section 140 kidnapping/abduction के specific aggravated purposes से संबंधित है, जैसे:

  • murder;

  • ransom;

  • secret and wrongful confinement;

  • grievous hurt;

  • slavery आदि।

Section 139 का specific purpose begging है।

इसलिए दोनों Sections में kidnapping/abduction common factual background हो सकता है, लेकिन purpose or object अलग है।

S. Varadarajan v. State of Madras, AIR 1965 SC 942, Supreme Court of India kidnapping from lawful guardianship के concept में “taking or enticing” की interpretation के लिए leading authority है।

Supreme Court ने स्पष्ट किया कि केवल यह तथ्य कि minor accused के साथ चली गई, हर case में kidnapping establish नहीं करता; prosecution को accused द्वारा taking or enticing out of the keeping of lawful guardian का ingredient establish करना होता है।

यह authority Section 139 के kidnapping component को समझने में relevant है, लेकिन Section 139 के begging-specific purpose पर direct ruling नहीं है।

Available Supreme Court material में Section 363A IPC पर ऐसा कोई Supreme Court judgment नहीं मिला जिसे Section 139 के begging-specific ingredients पर leading, direct Supreme Court authority के रूप में confidently cite किया जा सके। इसलिए kidnapping principles के Supreme Court precedents को Section 139 के begging-specific ingredients का direct ratio बताना उचित नहीं होगा।

यह distinction legal research में महत्वपूर्ण है।

Evidence and Presumption

Section 139(3) के कारण evidence का assessment विशेष महत्व रखता है।

Prosecution को facts के अनुसार establish करना होगा कि child को वास्तव में begging के purposes के लिए employ/use किया गया। यदि यह foundational fact establish हो जाता है और accused lawful guardian नहीं है, तो statutory presumption under Section 139(3) become relevant हो सकती है।

इसलिए child की age, custody, begging activity, accused का status as lawful guardian या non-guardian, और begging purpose से संबंधित evidence महत्वपूर्ण हो सकता है।

Is Section 139 Compoundable?

BNSS Section 359 की compounding table में Section 139 BNS listed नहीं है। Table में जिन BNS offences को compoundable बनाया गया है, उनमें Section 139 शामिल नहीं है।

इसलिए Section 139 को BNSS Section 359 के तहत compoundable offence नहीं माना जाता

Important Legal Points

Begging purpose is essential: Section 139(1) में kidnapping/custody और begging purpose के बीच statutory connection आवश्यक है।

Child is the protected person: BNS में child की general definition Section 2 में relevant है।

Lawful guardian exception matters: Section 139(1) expressly उस व्यक्ति को target करता है जो child का lawful guardian नहीं है और custody obtain करता है।
