Section 196 BNS – Promoting Enmity Between Different Groups and Acts Prejudicial to Harmony
Section 196 of the Bharatiya Nyaya Sanhita, 2023 (BNS) विभिन्न धार्मिक, नस्लीय, भाषायी, क्षेत्रीय, जातिगत या सामुदायिक समूहों के बीच disharmony, enmity, hatred या ill-will को बढ़ावा देने अथवा ऐसे acts करने से संबंधित है जो समूहों के बीच harmony को प्रभावित करते हैं और public tranquillity को disturb करते हैं।
इस Section में electronic communication सहित विभिन्न माध्यमों से किए गए कृत्यों को भी शामिल किया गया है। इसकी उपधारा (2) place of worship आदि में किए गए संबंधित offence के लिए अधिक कठोर punishment निर्धारित करती है।
Statutory Provision
“196. (1) Whoever—(a) by words, either spoken or written, or by signs or by visible representations or through electronic communication or otherwise, promotes or attempts to promote, on grounds of religion, race, place of birth, residence, language, caste or community or any other ground whatsoever, disharmony or feelings of enmity, hatred or ill-will between different religious, racial, language or regional groups or castes or communities; or
(b) commits any act which is prejudicial to the maintenance of harmony between different religious, racial, language or regional groups or castes or communities, and which disturbs or is likely to disturb the public tranquillity; or
(c) organises any exercise, movement, drill or other similar activity intending that the participants in such activity shall use or be trained to use criminal force or violence or knowing it to be likely that the participants in such activity will use or be trained to use criminal force or violence, or participates in such activity intending to use or be trained to use criminal force or violence or knowing it to be likely that the participants in such activity will use or be trained to use criminal force or violence, against any religious, racial, language or regional group or caste or community and such activity for any reason whatsoever causes or is likely to cause fear or alarm or a feeling of insecurity amongst members of such religious, racial, language or regional group or caste or community,
shall be punished with imprisonment of either description which may extend to three years, or with fine, or with both.
(2) Whoever commits an offence specified in sub-section (1) in any place of worship or in any assembly engaged in the performance of religious worship or religious ceremonies, shall be punished with imprisonment of either description which may extend to five years and shall also be liable to fine.”

Object of Section 196
इस Section का उद्देश्य विभिन्न समूहों के बीच सामाजिक सद्भाव बनाए रखना और ऐसे conduct को punish करना है जो enmity, hatred, ill-will या communal tension को बढ़ावा देता है अथवा public tranquillity को प्रभावित करता है।
Section 196 के अंतर्गत मुख्य रूप से तीन categories हैं:
Section 196(1)(a): Words, signs, visible representations या electronic communication द्वारा groups के बीच disharmony या enmity को बढ़ावा देना अथवा उसका प्रयास करना।
Section 196(1)(b): ऐसा act करना जो groups के बीच harmony के maintenance के प्रतिकूल हो और public tranquillity को disturb करे या disturb करने की संभावना रखता हो।
Section 196(1)(c): Criminal force या violence के उपयोग अथवा training से संबंधित specified activity को organise करना या उसमें participate करना, statutory intention/knowledge और fear, alarm या insecurity की आवश्यक conditions के साथ।
Essential Ingredients of Section 196(1)(a)
इस clause के मुख्य ingredients निम्न हैं:

महत्वपूर्ण: किसी कथन का केवल विवादास्पद, आलोचनात्मक या अप्रिय होना अपने-आप Section 196 का offence स्थापित नहीं करता। यह देखना आवश्यक है कि statutory ingredients उस conduct पर लागू होते हैं या नहीं।
Section 196(1)(b): Acts Prejudicial to Harmony
इस clause में ऐसा act शामिल है जो विभिन्न groups के बीच harmony के maintenance के प्रतिकूल हो और public tranquillity को disturb करे या disturb करने की संभावना रखता हो।
इसलिए इस clause में दो महत्वपूर्ण aspects हैं:
Act का groups के बीच harmony के maintenance के प्रतिकूल होना।
Public tranquillity पर actual या likely disturbance का होना।
केवल किसी व्यक्ति के साथ व्यक्तिगत विवाद होना पर्याप्त नहीं है; relevant statutory elements को facts के आधार पर establish करना आवश्यक है।
Section 196(1)(c): Organising or Participating in Certain Activities
यह clause उन specified exercises, movements, drills या similar activities से संबंधित है जिनमें criminal force या violence का उपयोग अथवा training शामिल हो।
इसमें statutory intention या knowledge के साथ-साथ यह condition भी महत्वपूर्ण है कि activity के कारण किसी संबंधित group के members में fear, alarm या feeling of insecurity पैदा हो या ऐसा होने की संभावना हो।

इस clause को केवल किसी सामान्य meeting, march, exercise या gathering पर mechanically लागू नहीं किया जा सकता। Statutory intention/knowledge तथा अन्य आवश्यक conditions का परीक्षण करना होगा।

Section 196(2) तब लागू होता है जब Section 196(1) में specified offence किसी place of worship या religious worship/religious ceremonies में लगे assembly में किया जाता है। इस उपधारा में पांच वर्ष तक imprisonment के साथ fine भी निर्धारित है।

Sub-section (2) के लिए केवल place of worship का उल्लेख पर्याप्त नहीं है। यह स्थापित करना होगा कि Sub-section (1) में specified offence उस उपधारा में वर्णित place या assembly में किया गया था।
Practical Examples
Example – Electronic communication: यदि कोई व्यक्ति electronic communication के माध्यम से किसी धार्मिक या भाषायी समूह के विरुद्ध hatred या enmity को promote करता है, तो Section 196(1)(a) के ingredients की जाँच की जा सकती है।
Example – Group-directed violence training: यदि कोई व्यक्ति किसी समुदाय के विरुद्ध criminal force/violence के उपयोग या training से संबंधित activity organise करता है, तो Section 196(1)(c) के intention/knowledge और fear, alarm या insecurity से संबंधित elements की जाँच आवश्यक होगी।
Example – Place of worship: यदि Section 196(1) का offence किसी place of worship में किया जाता है, तो facts और evidence के आधार पर Section 196(2) की applicability भी देखी जाएगी।
ये केवल illustrative examples हैं; वास्तविक liability statutory ingredients और evidence पर निर्भर करेगी।
