Section 138 BNS 2023: Abduction – Meaning, Essential Ingredients and Leading Supreme Court Judgments

Section 138 of the Bharatiya Nyaya Sanhita, 2023 (BNS) “abduction” की statutory definition देता है। इसके अनुसार जब कोई व्यक्ति force से किसी व्यक्ति को जाने के लिए compel करता है, या deceitful means से उसे किसी place से जाने के लिए induce करता है, तो वह उस व्यक्ति को abduct करता है।

महत्वपूर्ण बात यह है कि Section 138 स्वयं punishment provision नहीं है। यह abduction को define करता है; punishment तब किसी दूसरे substantive provision के माध्यम से आती है, जब abduction किसी विशेष criminal purpose से किया गया हो, जैसे Section 140.

Statutory Provision

Section 138 BNS कहता है:

“Whoever by force compels, or by any deceitful means induces, any person to go from any place, is said to abduct that person.”

इस definition में दो alternative modes हैं:

By force compels — force का प्रयोग करके व्यक्ति को किसी place से जाने के लिए compel करना।

By deceitful means induces — deceitful means का उपयोग करके व्यक्ति को किसी place से जाने के लिए induce करना।

Essential Ingredients

Section 138 के लिए निम्न statutory ingredients महत्वपूर्ण हैं।

A Person Must Be Made to Go from a Place

सबसे पहले किसी व्यक्ति का किसी place से go करना आवश्यक statutory component है।

Section 138 में “any person” का प्रयोग हुआ है। इसलिए definition किसी particular age, sex या relationship तक सीमित नहीं है।

Force or Deceitful Means

दूसरा essential element है कि व्यक्ति को जाने के लिए:

  • force से compel किया गया हो; या

  • deceitful means से induce किया गया हो।

दोनों alternative हैं। Prosecution को facts के अनुसार इनमें से applicable mode establish करना होगा।

Force Must Cause Compulsion

यदि abduction force के आधार पर alleged है, तो केवल accused और victim के साथ-साथ चले जाने से Section 138 establish नहीं होता।

यह establish करना आवश्यक है कि force ने victim को जाने के लिए compel किया

Meaning of “Force”

BNS Section 138 में “force” का उपयोग abduction की definition के context में हुआ है। इसका practical question यह होगा कि alleged conduct ने व्यक्ति को compel किया या नहीं।

यदि व्यक्ति अपनी free volition से किसी place से चला गया और prosecution force का sufficient evidence establish नहीं कर पाती, तो केवल movement अपने-आप abduction नहीं बन जाता।

Deceitful Means

Section 138 का दूसरा mode deceitful means है।

यहाँ केवल persuasion या request पर्याप्त नहीं है। Prosecution को establish करना होगा कि victim को deceitful means के द्वारा induce किया गया था।

Supreme Court ने Vinod Chaturvedi में Section 362 IPC के context में कहा कि यदि alleged victim accused के persuasion पर स्वयं घर के अंदर गया और फिर properly dressed होकर उनके साथ चला गया, तो उपलब्ध evidence के आधार पर उस conduct को Section 362 के तहत abduction नहीं माना जा सकता था। (Indian Kanoon)

Abduction Is Different from Kidnapping

Section 137 और Section 138 को एक साथ पढ़ना अत्यंत महत्वपूर्ण है।

Kidnapping under Section 137 में दो statutory categories हैं—kidnapping from India और kidnapping from lawful guardianship। Lawful guardianship वाली category में child/person of unsound mind को lawful guardian की keeping से takes or entices करना relevant है।

Abduction under Section 138 में किसी भी person को force या deceitful means से किसी place से जाने के लिए compel/induce करना आवश्यक है।

इसलिए दोनों offences के statutory ingredients अलग हैं।

Important Difference: Kidnapping Is Complete, Abduction Is Contextual

Kidnapping और abduction के बीच एक महत्वपूर्ण conceptual difference यह है कि abduction ordinarily अपने आप में complete punishable offence नहीं है

Section 138 केवल यह बताता है कि किस conduct को “abduction” कहा जाएगा। किसी व्यक्ति को abduct करने के बाद यदि accused ने कोई specific criminal purpose रखा, तो संबंधित substantive penal provision apply हो सकता है।

उदाहरण के लिए, Section 140(1) kidnapping or abduction with intent to murder को punish करता है। Section 140(3) kidnapping or abduction with intent to cause secret and wrongful confinement को punish करता है।

Intention Becomes Important in Punishable Abduction Offences

जब Section 138 की definition किसी aggravated offence के साथ read की जाती है, तब accused की intention अत्यंत महत्वपूर्ण हो सकती है।

उदाहरण के लिए Section 140(1) में केवल abduction पर्याप्त नहीं है; kidnapping या abduction in order that such person may be murdered होना चाहिए।

Vinod Chaturvedi v. State of Madhya Pradesh

Vinod Chaturvedi & Others v. State of Madhya Pradesh, (1984) 2 SCC 350; AIR 1984 SC 911, Supreme Court of India Section 362 IPC—अब BNS Section 138 के corresponding provision—के interpretation के लिए प्रमुख Supreme Court authority है। (Sci API)

Case में prosecution allegation था कि deceased को jeep में एक village से दूसरे village ले जाया गया। Supreme Court ने evidence examine करते हुए पाया कि witnesses के अनुसार deceased accused persons की persuasion पर अपने घर के अंदर गया, properly dressed होकर बाहर आया और उनके साथ गया।

Supreme Court ने कहा कि ऐसे circumstances में Section 362 IPC की definition के अनुसार abduction establish नहीं हुई, क्योंकि force से compulsion या deceitful means से inducement statutory requirement के अनुसार prove नहीं हुआ। (Indian Kanoon)

Kavita Chandrakant Lakhani v. State of Maharashtra & Another, (2018) 6 SCC 664, Supreme Court of India में Supreme Court ने abduction के ingredients और Section 366 IPC के aggravated purpose को examine किया। (Indian Kanoon)

Court ने स्पष्ट किया कि केवल abduction establish हो जाना किसी aggravated offence जैसे IPC Section 366 को automatically establish नहीं करता। Prosecution को additional statutory intent भी prove करना होता है।

यह principle BNS के संदर्भ में विशेष रूप से relevant है क्योंकि Section 138 definition देता है जबकि Sections 140 आदि particular purposes के साथ kidnapping/abduction को punish करते हैं।

Sita Raut & Others v. इस line of authority से यह स्पष्ट होता है कि abduction का allegation तभी sustainable होगा जब prosecution statutory definition में prescribed force या deceitful means को evidence से establish करे।

Section 138 and Section 140

यह सबसे महत्वपूर्ण practical distinction है।

Section 138 केवल abduction को define करता है।

Section 140 विभिन्न aggravated purposes के साथ kidnapping/abduction को punish करता है, जैसे:

  • murder के लिए kidnapping/abduction;

  • ransom के लिए kidnapping/abduction;

  • secret and wrongful confinement के लिए kidnapping/abduction;

  • grievous hurt, slavery या unnatural lust के लिए kidnapping/abduction.

इसलिए FIR या charge में केवल “abduction” शब्द पर्याप्त analysis नहीं है। यह देखना आवश्यक है कि abduction किस specific substantive offence के लिए alleged है और उसका statutory purpose क्या है।

Section 138 and Section 139

Section 139 child को begging के purposes के लिए kidnap करने या custody obtain करने से संबंधित special offence है। इसमें very severe punishment prescribed है।

Section 138 स्वयं child-specific provision नहीं है। Abduction की definition any person पर लागू हो सकती है, जबकि Section 139 का focus specifically child और begging purpose पर है।

Is Section 138 Cognizable or Bailable?

Section 138 एक standalone punishable offence नहीं बल्कि definition provision है। इसलिए इसे अलग से cognizable/non-cognizable या bailable/non-bailable classify करना technically उचित नहीं होगा।

जिस substantive offence में Section 138 की abduction definition लागू होती है, उसकी BNSS First Schedule classification उस specific penal Section के अनुसार निर्धारित होगी।

उदाहरण के लिए, Section 140 के अलग-अलग sub-sections की classification उनके prescribed punishment और statutory entry के अनुसार देखी जाएगी।

Practical Legal Test

Section 138 की applicability examine करते समय Court/prosecution को broadly इन questions पर ध्यान देना होगा:

क्या victim को किसी place से जाने के लिए compel किया गया?

यदि हाँ, तो क्या compulsion force के कारण था?

या

क्या victim को किसी place से जाने के लिए deceitful means से induce किया गया?

यदि neither force nor deceitful inducement establish होता है, तो Section 138 की statutory definition satisfy करने में difficulty होगी।

इसके बाद यह देखना होगा कि alleged abduction किस substantive penal provision के purpose के लिए किया गया था।

Section 138 and Voluntary Movement

किसी व्यक्ति का accused के साथ किसी दूसरी जगह चले जाना, अपने-आप abduction नहीं है।

यदि evidence से यह दिखता है कि व्यक्ति अपनी इच्छा से गया और prosecution force या deceitful means establish नहीं कर पाती, तो Section 138 का ingredient missing हो सकता है। Vinod Chaturvedi इसका महत्वपूर्ण illustration है। (Indian Kanoon)

हालाँकि, voluntary movement का allegation अपने-आप prosecution case समाप्त नहीं करता; Court को पूरे circumstances और alleged force/deception के evidence का assessment करना होगा।

Section 138 and Consent

Section 138 की language में “consent” शब्द express रूप से नहीं है। इसके बजाय statute force द्वारा compulsion या deceitful means द्वारा inducement पर focus करता है।

इसलिए consent का legal effect facts और उस particular substantive offence पर depend कर सकता है जिसके लिए Section 138 की definition invoke की गई है।

BNS Section 138 का corresponding provision IPC Section 362 था।

दोनों में मूल statutory formula यही है:

Force → compulsion → going from a place

या

Deceitful means → inducement → going from a place

इस substantial continuity के कारण IPC Section 362 के Supreme Court precedents—विशेषकर Vinod Chaturvedi—BNS Section 138 की interpretation में महत्वपूर्ण हैं। लेकिन इन्हें technically BNS-era judgments नहीं कहा जाना चाहिए क्योंकि वे IPC के तहत decided हुए थे। (Sci API)

Conclusion

Section 138 BNS, 2023 abduction की definition प्रदान करता है। इसके दो essential modes हैं—force द्वारा compulsion और deceitful means द्वारा inducement। किसी person का केवल एक place से दूसरे place जाना Section 138 के लिए पर्याप्त नहीं है; statutory force/deceitful means और उससे उत्पन्न compulsion/inducement को facts और evidence के आधार पर establish करना आवश्यक है।
