Section 137 BNS 2023: Kidnapping from India and Lawful Guardianship
Section 137 of the Bharatiya Nyaya Sanhita, 2023 (BNS) kidnapping को define करता है और kidnapping को दो categories में विभाजित करता है—kidnapping from India तथा kidnapping from lawful guardianship। इसके लिए अधिकतम 7 वर्ष का imprisonment और fine prescribed है।

Statutory Provision
Section 137(1) के अनुसार kidnapping दो प्रकार की है:
Kidnapping from India — जब कोई व्यक्ति किसी person को उसकी consent या उसकी ओर से consent देने के लिए legally authorised person की consent के बिना India की limits से बाहर convey करता है।
Kidnapping from lawful guardianship — जब कोई व्यक्ति किसी child या person of unsound mind को उसके lawful guardian की keeping से, guardian की consent के बिना, takes या entices करता है।
Section 137(2) के अनुसार कोई व्यक्ति यदि किसी person को India से या lawful guardianship से kidnap करता है, तो उसे imprisonment of either description up to 7 years and fine से punish किया जा सकता है।

Kidnapping from India
Section 137(1)(a) में kidnapping from India के लिए तीन प्रमुख बातें महत्वपूर्ण हैं:
किसी person को India की territorial limits से बाहर ले जाना;
उस person की consent का अभाव; और
यदि वह स्वयं consent नहीं दे सकता, तो उसकी ओर से legally authorised person की consent का अभाव।
Statutory language के अनुसार act “conveys any person beyond the limits of India” होना चाहिए।
इस category में victim का child होना आवश्यक नहीं है। Section 137(1)(a) में “any person” का प्रयोग किया गया है।

Kidnapping from Lawful Guardianship
Section 137(1)(b) अधिक महत्वपूर्ण और frequently litigated category है।
इसके लिए निम्न elements आवश्यक हैं:
victim child या person of unsound mind हो;
accused ने उसे उसके lawful guardian की keeping से लिया या entice किया हो;
taking या enticing guardian की consent के बिना हुआ हो।
यहाँ एक महत्वपूर्ण बात है कि Section 137(1)(b) में child या person of unsound mind को guardian की keeping से बाहर ले जाना statutory ingredient है।

Who is a Child under BNS?
BNS Section 2 की definition के अनुसार “child” means any person below the age of eighteen years.
इसलिए BNS के तहत Section 137(1)(b) में “child” की threshold 18 years से कम है। यह पुराने IPC Section 361 की wording से महत्वपूर्ण बदलाव है, क्योंकि IPC में male minor के लिए अलग age threshold थी। BNS ने child को general statutory definition के माध्यम से below 18 years रखा है।

Meaning of “Takes” and “Entices”
Section 137(1)(b) में “takes or entices” दो अलग expressions हैं।
Taking का अर्थ केवल physical force से किसी child को ले जाना नहीं है। Supreme Court ने IPC Section 361 की interpretation में कहा है कि “takes” का अर्थ broadly child को guardian की keeping से बाहर जाने के लिए cause करना हो सकता है।
Enticement में inducement, allurement या ऐसा influence शामिल हो सकता है जिससे child guardian की keeping से बाहर जाने के लिए तैयार हो जाए।
BNS Section 137(1)(b) की language IPC Section 361 के corresponding concept को substantially carry forward करती है।

S. Varadarajan v. State of Madras
S. Varadarajan v. State of Madras, AIR 1965 SC 942; (1965) 1 SCR 243, Supreme Court of India lawful guardianship से kidnapping के law का leading judgment है।
Supreme Court ने examine किया कि क्या minor का accused के साथ स्वयं जाना हर circumstance में accused द्वारा “taking” माना जाएगा।
Court ने स्पष्ट किया कि taking or enticing out of the keeping of lawful guardian is an essential ingredient. यदि minor ने completely independently और बिना accused की inducement या influence के guardian की keeping छोड़ी हो, तो केवल बाद में accused के साथ चले जाने से हर case में kidnapping establish नहीं होती। (Indian Kanoon)
यह principle Section 137(1)(b) के interpretation में महत्वपूर्ण है, क्योंकि BNS में भी statutory expression “takes or entices” है।

Thakorlal D. Vadgama v. State of Gujarat
Thakorlal D. Vadgama v. State of Gujarat, (1973) 2 SCC 413, Supreme Court of India में Supreme Court ने “taking” और “enticing” के scope पर महत्वपूर्ण principles दिए। (Indian Kanoon)
Court ने explain किया कि “taking” necessarily force का use नहीं मांगता। यदि accused की persuasion, promise, inducement या allurement ने minor के guardian की keeping छोड़ने के decision में भूमिका निभाई, तो kidnapping from lawful guardianship का ingredient establish हो सकता है। (Indian Kanoon)
यह judgment Section 137 के लिए विशेष रूप से relevant है क्योंकि BNS Section 137(1)(b) में वही basic statutory concepts—taking, enticing, lawful guardian और keeping—retained हैं।

Minor’s Consent and Guardian’s Consent
Kidnapping from lawful guardianship में guardian की consent statutory importance रखती है।
Supreme Court ने IPC Section 361 के context में repeatedly यह principle apply किया कि minor की willingness या consent अपने-आप accused को offence से बाहर नहीं करती यदि accused ने minor को lawful guardian की keeping से take or entice किया है। (Indian Kanoon)
इसलिए Section 137(1)(b) में Court को केवल यह question नहीं देखना चाहिए कि child voluntarily accused के साथ गया था या नहीं; यह भी examine करना होगा कि accused की ओर से कोई taking or enticement था या नहीं।

Meaning of Lawful Guardian
Section 137 का Explanation expressly बताता है कि “lawful guardian” में वह person भी शामिल है जिसे child या अन्य person की care या custody lawfully entrusted की गई हो।
इसका अर्थ है कि lawful guardian का concept केवल biological parents तक restricted नहीं है। यदि किसी व्यक्ति को lawfully care या custody entrusted की गई है, तो statutory definition के अनुसार वह relevant lawful guardian हो सकता है।

Statutory Exception
Section 137(1)(b) में एक important exception भी दिया गया है।
यह clause उस act तक extend नहीं करता जहाँ कोई person good faith में यह believe करता है कि वह illegitimate child का father है, या good faith में यह believe करता है कि वह child की lawful custody का entitled है।
लेकिन यह exception उपलब्ध नहीं होगा यदि act immoral या unlawful purpose के लिए किया गया हो।
इसलिए केवल subjective claim of parentage पर्याप्त नहीं है; statutory requirements of good faith और absence of immoral/unlawful purpose भी relevant हैं।

Section 137(2) के तहत kidnapping from India या lawful guardianship के लिए:

Section 137 and Section 138 — Difference
Section 137 और Section 138 को अलग समझना आवश्यक है।
Section 137 kidnapping को define और punish करता है। इसमें kidnapping from India और kidnapping from lawful guardianship शामिल हैं।
Section 138 abduction को define करता है। इसके अनुसार जब कोई व्यक्ति force से compel करता है या deceitful means से induce करता है कि कोई person किसी place से जाए, तो वह उस person को abduct करता है।
इस प्रकार kidnapping और abduction के statutory ingredients अलग हैं।

Kidnapping and Abduction Are Not Identical
Kidnapping under Section 137 में statutory categories specifically prescribed हैं।
दूसरी ओर, abduction under Section 138 में force या deceitful means essential है।
इसलिए प्रत्येक kidnapping necessarily abduction नहीं है और प्रत्येक abduction necessarily kidnapping नहीं है। Facts के आधार पर दोनों offences के ingredients separately examine किए जाने चाहिए।

Section 137 and Section 140
Section 137 सामान्य kidnapping offence को deal करता है।
यदि kidnapping या abduction के पीछे specific aggravated purpose हो, तो Section 140 apply हो सकता है। उदाहरण के लिए Section 140(1) kidnapping/abduction in order that the person may be murdered या danger of murder में डालने से संबंधित है। Section 140(2) kidnapping for ransom आदि को cover करता है और इसमें death या imprisonment for life तथा fine का punishment prescribed है।
इसलिए aggravated kidnapping के cases में केवल Section 137 पर analysis समाप्त नहीं होता; Section 140 के specific ingredients भी examine करने होंगे।

Section 137 and Section 139
Section 139 एक special aggravated offence है जिसमें child को begging के purpose से kidnap करना या custody obtain करना शामिल है।
Section 139(1) में minimum 10 years rigorous imprisonment, which may extend to life imprisonment, and fine prescribed है।
इसलिए यदि facts में Section 139 के specific purpose के ingredients मौजूद हैं, तो general Section 137 के साथ उसकी applicability अलग से examine करनी होगी।

Important Evidence Issues
Section 137 के prosecution में facts के अनुसार निम्न matters महत्वपूर्ण हो सकते हैं:
victim की exact age;
lawful guardian की identity;
guardian की custody/keeping;
guardian की consent;
accused द्वारा taking या enticing का conduct;
inducement, promise, persuasion या allurement;
child का accused के साथ जाने का circumstances;
travel या movement के relevant records;
electronic communications और other admissible evidence.
Age का determination विशेष रूप से महत्वपूर्ण है क्योंकि Section 137(1)(b) expressly child या person of unsound mind को cover करता है।

Important Supreme Court Principles

सबसे महत्वपूर्ण principles हैं:

Conclusion
Section 137 BNS, 2023 kidnapping का principal provision है। यह kidnapping from India और kidnapping from lawful guardianship दोनों को cover करता है। Lawful guardianship वाले cases में child/person of unsound mind, lawful guardian की keeping, guardian की consent और accused द्वारा taking या enticing सबसे महत्वपूर्ण statutory elements हैं।
Section 137(2) के तहत maximum punishment 7 years imprisonment and fine है और BNSS First Schedule के अनुसार यह cognizable, bailable तथा Magistrate of the First Class द्वारा triable offence है।
