Section 136 BNS 2023: Assault or Criminal Force on Grave and Sudden Provocation
Section 136 of the Bharatiya Nyaya Sanhita, 2023 (BNS) उस स्थिति से संबंधित है जब कोई व्यक्ति किसी अन्य व्यक्ति द्वारा दी गई grave and sudden provocation के कारण उस व्यक्ति पर assault या criminal force करता है। इस Section में सामान्य assault की तुलना में कम punishment prescribed है।
Statutory Provision
Section 136 BNS provides that जो व्यक्ति किसी व्यक्ति द्वारा दी गई grave and sudden provocation पर उस व्यक्ति के विरुद्ध assault या criminal force करता है, उसे simple imprisonment up to one month, या fine up to ₹1,000, या दोनों से punish किया जा सकता है।
Section 136 का Explanation कहता है कि यह Section Section 131 के same Explanation के अधीन है।

Meaning of Section 136
Section 136 को समझने के लिए इसका comparison Section 131 से करना महत्वपूर्ण है।
Section 131 BNS उस assault या criminal force को punish करता है जो grave and sudden provocation के अलावा किया गया हो।
इसके विपरीत, Section 136 BNS specifically उस assault या criminal force को deal करता है जो grave and sudden provocation given by that person के कारण किया गया हो।
इस प्रकार Section 136 में provocation कोई incidental circumstance मात्र नहीं है; वह offence की statutory description का हिस्सा है।

Essential Ingredients
Assault or Criminal Force
पहला essential ingredient यह है कि accused ने किसी person पर assault या criminal force किया हो।
BNS Section 130 assault को define करता है। Assault में ऐसा gesture या preparation भी शामिल हो सकता है जिससे उस gesture या preparation को करने वाला व्यक्ति यह intention या knowledge रखता हो कि उससे सामने वाले व्यक्ति को यह apprehension हो सकती है कि criminal force use किया जाने वाला है।
इसलिए Section 136 केवल actual physical beating तक सीमित नहीं है; alleged conduct को Section 130 की statutory definition के अनुसार examine किया जाएगा।

Grave and Sudden Provocation
दूसरा और सबसे महत्वपूर्ण ingredient है grave and sudden provocation।
Provocation उसी person द्वारा दी गई होनी चाहिए जिसके विरुद्ध assault या criminal force किया गया है।
इसलिए केवल accused का यह कहना कि वह angry था या उसे किसी बात का बुरा लगा, Section 136 के लिए पर्याप्त नहीं है। Provocation को statutory sense में grave और sudden होना आवश्यक है।

Connection Between Provocation and Assault
Assault या criminal force और provocation के बीच proximate connection होना आवश्यक है।
यदि provocation काफी पहले हुई और उसके बाद accused ने सोच-विचार करके या revenge की भावना से assault किया, तो Section 136 की applicability पर गंभीर प्रश्न उठ सकता है।
Supreme Court ने grave and sudden provocation के broader criminal-law context में यह स्पष्ट किया है कि Court को यह देखना होता है कि accused को self-control खोने के लिए वास्तविक और reasonable provocation मिली थी या नहीं और क्या reaction passion के continuing influence में हुआ था। [Dauvaram Nirmalkar v. What is “Grave and Sudden” Provocation?
BNS Section 136 स्वयं “grave and sudden provocation” की अलग definition नहीं देता। Section 131 का Explanation इस concept के application में महत्वपूर्ण है।
Section 131 Explanation 2 के अनुसार यह question कि provocation grave and sudden enough थी या नहीं, question of fact है।
अर्थात Court प्रत्येक case के facts, circumstances, conduct of the parties और surrounding circumstances को देखकर determination करेगा।

When Provocation Will Not Mitigate the Offence
Section 136 का Explanation इसे Section 131 के Explanation से subject करता है। Section 131 के Explanation 1 के अनुसार grave and sudden provocation punishment को mitigate नहीं करेगी यदि:
provocation offender द्वारा स्वयं sought or voluntarily provoked की गई हो as an excuse for the offence;
provocation किसी ऐसे act से मिली हो जो law के obedience में किया गया हो या public servant द्वारा उसके lawful powers के exercise में किया गया हो; या
provocation किसी ऐसे act से मिली हो जो lawful exercise of right of private defence में किया गया हो।
इसका practical effect यह है कि accused केवल अपने conduct को justify करने के लिए स्वयं situation create करके बाद में Section 136 की protection claim नहीं कर सकता।

Question of Fact
“Grave and sudden” provocation का determination primarily question of fact है।
इसका मतलब है कि Court को केवल accused के assertion पर निर्भर नहीं रहना चाहिए। उपलब्ध evidence और surrounding circumstances से यह examine किया जाएगा कि alleged provocation वास्तव में grave और sudden थी या नहीं।
BNS की statutory language स्वयं इस determination को question of fact बनाती है।

Supreme Court Test on Grave and Sudden Provocation
K.M. Nanavati v. State of Maharashtra
K.M. Nanavati v. State of Maharashtra, 1962, Supreme Court of India grave and sudden provocation के law की leading authority है।
इस line of authorities में Supreme Court ने यह principle विकसित किया कि provocation की assessment करते समय Court को यह देखना चाहिए कि circumstances में एक reasonable person, accused के समान situation और relevant social background में, self-control खोने की स्थिति में आ सकता था या नहीं।

यह judgment Section 136 BNS पर directly decided नहीं हुआ था; यह IPC Section 300 Exception 1 के संदर्भ में था। इसलिए इसे grave and sudden provocation के general legal principles के लिए precedent के रूप में समझना चाहिए।

B.D. Khunte v. Union of India
B.D. Khunte v. Union of India, (2015) 1 SCC 286, Supreme Court of India में Supreme Court ने grave and sudden provocation के लिए यह महत्वपूर्ण distinction किया कि provocation के बाद accused को cool down होने का पर्याप्त time मिला हो, तो बाद की retaliatory act को केवल earlier provocation के आधार पर grave and sudden provocation नहीं माना जा सकता। (Order)
Court ने यह भी emphasise किया कि past humiliation या anger बाद में motive for revenge बन सकता है, लेकिन इससे automatically grave and sudden provocation establish नहीं होती।
यह principle Section 136 के लिए particularly relevant है क्योंकि Section 136 में provocation और assault के बीच temporal and factual proximity महत्वपूर्ण होगी।

Dauvaram Nirmalkar v. State of Chhattisgarh
Dauvaram Nirmalkar v. State of Chhattisgarh, 2022, Supreme Court of India में Supreme Court ने grave and sudden provocation के principles को विस्तृत रूप से consider किया।
Court ने कहा कि provocation और loss of self-control actual and reasonable होने चाहिए। Court intervening period को भी देख सकता है कि क्या accused को passion cool होने और self-control regain करने का opportunity मिला था। (Indian Kanoon)
Court ने यह भी explain किया कि previous acts और background circumstances relevant हो सकते हैं, लेकिन final provocative act, word या gesture identifiable होना चाहिए और reaction का connection उस provocation से establish होना चाहिए। (Indian Kanoon)
यह Section 136 की interpretation में सबसे उपयोगी recent Supreme Court authorities में से एक है, यद्यपि यह decision IPC Section 300 Exception 1 के context में था।

B.D. Khunte Principle and Section 136
Section 136 में एक common factual issue यह हो सकता है कि accused ने provocation के तुरंत बाद assault किया या कुछ समय बाद।

Provocation → immediate reaction → assault
तो Section 136 की applicability पर consideration हो सकती है।

Section 136 में punishment comparatively low है:

Is Section 136 Compoundable?
हाँ। BNSS Section 359 की compounding table में Section 136 specifically included है। इसे उस person द्वारा compound किया जा सकता है जिसे assault किया गया या जिस पर criminal force का प्रयोग किया गया।
इसलिए Section 136, procedural दृष्टि से Section 134 और Section 135 से अलग है, क्योंकि Section 134 और 135 Section 359 की उक्त table में listed नहीं हैं।

Section 136 and Section 131 — Difference
यह सबसे महत्वपूर्ण distinction है।
Section 131 BNS — assault/criminal force otherwise than on grave and sudden provocation.
Section 136 BNS — assault/criminal force on grave and sudden provocation.
Section 131 में punishment maximum three months imprisonment, ₹1,000 fine, or both है; Section 136 में maximum one month simple imprisonment, ₹1,000 fine, or both है।
इस प्रकार Section 136 में grave and sudden provocation statutory circumstance है जिसके कारण अलग और comparatively lower punishment prescribed है।

Section 136 and Section 133 — Difference
Section 133 में assault/criminal force victim को dishonour करने के intention से होना चाहिए और act grave and sudden provocation के अलावा होना चाहिए।
Section 136 में dishonour करने की intention आवश्यक नहीं है; इसका essential feature grave and sudden provocation है।
इसलिए दोनों provisions के ingredients materially different हैं।

Section 136 and Section 122
Section 122 BNS voluntarily causing hurt or grievous hurt on grave and sudden provocation से संबंधित है, जबकि Section 136 assault या criminal force पर लागू होता है।
यदि conduct से केवल assault/criminal force का offence बनता है, Section 136 relevant हो सकता है। यदि accused ने voluntarily hurt या grievous hurt cause किया है, तो facts के अनुसार Section 122 की applicability separately examine होगी।

Corresponding IPC Provision
Section 136 BNS का corresponding provision IPC Section 358 था। IPC Section 358 भी “Assault or criminal force on grave provocation” से संबंधित था। BNS ने इस provision को substantially carry forward किया है, लेकिन fine को ₹200 से बढ़ाकर ₹1,000 किया गया है।
इसलिए 1 July 2024 से पहले किए गए acts के लिए IPC Section 358 relevant रहेगा, जबकि BNS लागू होने के बाद के relevant conduct के लिए Section 136 BNS applicable होगा।

Important Legal Principles
Section 136 के cases में निम्न points विशेष रूप से महत्वपूर्ण हैं:
Provocation must be grave: केवल ordinary irritation, annoyance या disagreement पर्याप्त नहीं है।
Provocation must be sudden: accused को self-control regain करने का पर्याप्त opportunity मिलने के बाद किया गया deliberate retaliation Section 136 के लिए problematic हो सकता है।
Provocation must be given by the person assaulted: statutory language इसी requirement को expressly state करती है।
Self-created provocation is excluded: Section 131 Explanation, जिसे Section 136 adopt करता है, offender द्वारा sought या voluntarily provoked provocation को mitigation से बाहर करता है।
It is a question of fact: provocation grave और sudden थी या नहीं, यह facts और evidence पर determined होगा।
Conclusion
Section 136 BNS, 2023 grave and sudden provocation के कारण किए गए assault या criminal force को specifically punish करता है। इसकी maximum punishment one month simple imprisonment, ₹1,000 fine, or both है। BNSS First Schedule के अनुसार यह non-cognizable, bailable और Any Magistrate द्वारा triable offence है।
Section 136 में “grave and sudden provocation” की determination case-specific question of fact है। Supreme Court के K.M. Nanavati, B.D. Khunte और Dauvaram Nirmalkar जैसे judgments से यह principle स्पष्ट होता है कि Court provocation की gravity, suddenness, accused के loss of self-control, intervening time और surrounding circumstances को carefully examine करता है। ये judgments IPC provisions के context में हैं, इसलिए इन्हें BNS Section 136 के direct BNS-era decisions के रूप में नहीं बल्कि continuing interpretative principles on grave and sudden provocation के रूप में cite करना उचित है।
