Section 129 of the Bharatiya Nyaya Sanhita, 2023 (BNS) “criminal force” की statutory definition देता है। इसका मूल आधार है—जानबूझकर किसी व्यक्ति पर उसकी consent के बिना force का प्रयोग करना, और उसके पीछे offence commit करने या injury, fear अथवा annoyance पैदा करने की prescribed intention/knowledge होना।

Statutory Provision
Section 129 BNS के अनुसार, जो व्यक्ति किसी अन्य व्यक्ति पर intentionally force का प्रयोग करता है, बिना उस व्यक्ति की consent के—
किसी offence को commit करने के उद्देश्य से; या
force के द्वारा injury, fear या annoyance पैदा करने के intention से; या
यह जानते हुए कि ऐसी force से injury, fear या annoyance होना likely है,

इसलिए Section 129 में केवल physical force होना पर्याप्त नहीं है। Force + absence of consent + prescribed intention/knowledge का combination आवश्यक है।

Essential Ingredients
Use of Force
सबसे पहले accused द्वारा force का उपयोग होना चाहिए।
“Force” की definition Section 128 BNS में दी गई है। Section 128 के अनुसार force में motion, change of motion या cessation of motion पैदा करना तथा prescribed circumstances में किसी substance के माध्यम से ऐसा effect उत्पन्न करना शामिल है। Force अपने bodily power से, substance के माध्यम से या animal को induce करके भी हो सकता है।
इसलिए Section 129 को independently नहीं बल्कि Section 128 read with Section 129 BNS के रूप में समझना अधिक उचित है।

Intention
Force का use intentionally होना चाहिए।
Accidental contact अपने-आप Section 129 का criminal force नहीं बन जाता। Prosecution को circumstances से यह establish करना होगा कि accused ने force का intentional use किया था।

Force victim की consent के बिना इस्तेमाल किया गया होना चाहिए।

Criminal Purpose or Specified Intention/Knowledge
Section 129 में दो alternative mental situations महत्वपूर्ण हैं।
पहला, force का use in order to the committing of any offence हो।

Meaning of Injury, Fear and Annoyance
Section 129 में “injury, fear or annoyance” तीन अलग consequences के रूप में दिखाई देते हैं।
Injury का अर्थ केवल physical injury तक सीमित नहीं समझना चाहिए; BNS Section 2 में “injury” को किसी person के body, mind, reputation या property को illegally cause किए गए harm के रूप में define किया गया है।
Fear victim में apprehension या डर की स्थिति को refer करता है।
Annoyance ऐसी conduct को cover कर सकता है जिससे victim को legally relevant irritation, disturbance या discomfort हो।
इन concepts का exact application facts और evidence पर निर्भर करेगा।

Boat Example
Z एक moored boat में बैठा है। A boat की moorings खोल देता है, जिससे boat stream में drift करने लगती है।
A ने substance/boat की motion के माध्यम से Z में motion cause किया। यदि यह Z की consent के बिना offence commit करने या injury, fear अथवा annoyance cause करने की prescribed intention/knowledge के साथ किया गया है, तो यह criminal force हो सकता है।

Z chariot पर riding कर रहा है। A उसके horses को lash करता है और horses की गति बढ़ जाती है।

Stopping a Palanquin
Z palanquin में जा रहा है। A pole पकड़कर palanquin को रोक देता है और ऐसा Z को rob करने के उद्देश्य से करता है।

A street में Z को intentionally push करता है।

A ऐसा stone throw करता है जिसके Z या Z के clothes/carrying article से contact होने की intention या knowledge है।

Pulling a Woman's Veil
A बिना consent किसी woman का veil intentionally खींचता है और उसे injury, fear या annoyance होने की intention/knowledge रखता है। Section 129 के illustration के अनुसार यह criminal force है।

A ऐसा boiling water डालता है जिससे वह Z के शरीर के contact में आता है और A जानता है कि इससे injury, fear या annoyance likely है।
यह भी criminal force का statutory illustration है।

Inciting a Dog
A बिना Z की consent के dog को Z पर spring करने के लिए incite करता है और injury, fear या annoyance cause करने का intention रखता है।
Section 129 इसे भी criminal force के रूप में recognise करता है।

Difference Between Force and Criminal Force
यह distinction अत्यंत महत्वपूर्ण है।
Section 128 — Force: यह force की basic statutory definition है।
Section 129 — Criminal Force: इसमें Section 128 वाला force होने के अतिरिक्त intentional use, absence of consent और prescribed criminal purpose/intention/knowledge आवश्यक है।
इसलिए हर force criminal force नहीं है।
उदाहरण के लिए, किसी व्यक्ति से accidental contact हो जाना ordinarily Section 129 के लिए पर्याप्त नहीं होगा क्योंकि intentional use of force का ingredient missing हो सकता है।

Difference Between Criminal Force and Assault
Section 129 और Section 130 को भी अलग-अलग समझना आवश्यक है।
Criminal force — Section 129: actual statutory force का use होता है।
Assault — Section 130: gesture या preparation ऐसा होना चाहिए जिससे उपस्थित व्यक्ति को यह apprehension हो कि उसके विरुद्ध criminal force use किया जाने वाला है। Mere words alone assault नहीं हैं, हालांकि words gesture/preparation को required meaning दे सकते हैं।
इसलिए assault में actual criminal force का use आवश्यक नहीं है, जबकि criminal force में Section 128 के अर्थ में force का use आवश्यक है।

Section 129 Is a Definition Provision
एक महत्वपूर्ण legal point यह है कि Section 129 स्वयं सामान्य punishment provision नहीं है।
यह criminal force की definition देता है। Criminal force के अलग-अलग punishable forms के लिए BNS में subsequent provisions हैं।
उदाहरण के लिए:
Section 131 — assault or criminal force otherwise than on grave and sudden provocation;
Section 132 — public servant को deter करने के लिए assault/criminal force;
Section 133 — dishonour करने के intent से assault/criminal force;
Section 134 — theft attempt में assault/criminal force;
Section 135 — wrongful confinement के attempt में assault/criminal force;
Section 136 — grave and sudden provocation पर assault/criminal force।

Punishment for Criminal Force
Section 129 definition देता है; सामान्य criminal force की punishment Section 131 में आती है।
Section 131 के अनुसार, जो व्यक्ति किसी व्यक्ति पर grave and sudden provocation के अलावा assault या criminal force करता है, उसे:
Imprisonment: अधिकतम 3 महीने
Fine: अधिकतम ₹1,000
या दोनों
हो सकते हैं।
इस offence को BNSS First Schedule के अनुसार non-cognizable, bailable और Any Magistrate द्वारा triable classify किया गया है।

Grave and Sudden Provocation
Section 131 में grave and sudden provocation का exception-like mitigating provision है।
लेकिन Explanation 1 के अनुसार provocation punishment को mitigate नहीं करेगा यदि:
provocation offender ने स्वयं excuse के रूप में sought या voluntarily provoked किया हो;
provocation law के obedience में किए गए act या public servant के lawful exercise of power से आया हो; या
provocation lawful exercise of right of private defence से किए गए act से आया हो।
क्या provocation वास्तव में grave and sudden था, यह question of fact है।

Other Offences Involving Criminal Force
Section 74 BNS
यदि किसी woman पर assault या criminal force इस intention से किया गया है कि उसकी modesty outrage हो, या accused को knowledge है कि ऐसा likely है, तो Section 74 लागू हो सकता है। इसमें punishment minimum 1 year से maximum 5 years imprisonment और fine है।

Woman को disrobe करने या naked करने के intent से assault या criminal force करने पर Section 76 लागू होता है। Punishment minimum 3 years से maximum 7 years imprisonment और fine है।

यदि criminal force किसी public servant के execution of duty को deter करने के लिए किया जाता है, तो Section 132 लागू होता है। Punishment up to 2 years imprisonment, fine, or both है।

हालाँकि, consent का प्रश्न offence-specific और fact-specific होता है। जहाँ BNS का कोई special provision अधिक specific protection देता है—जैसे woman के विरुद्ध modesty/disrobing से जुड़े offences—वहाँ केवल Section 129 पर निर्भर करने के बजाय उस specific provision की ingredients भी देखनी होंगी।

Criminal force का use केवल हाथ से मारने या धक्का देने तक सीमित नहीं है।
Statutory illustrations के अनुसार:
