Section 125 BNS 2023: Act Endangering Life or Personal Safety of Others

Section 125 of the Bharatiya Nyaya Sanhita, 2023 (BNS)

Statutory Provision

Section 125 BNS

Essential Ingredients

Rash or Negligent Act

Bhalchandra alias Bapu & Anr. v. State of Maharashtra, AIR 1968 SC 1319 में criminal negligence को reasonable and proper care तथा precaution न लेने के गंभीर स्तर से जोड़ा था। (Indian Kanoon)

Section 125 BNS

Endangerment of Human Life or Personal Safety

Act का ऐसा होना आवश्यक है कि उससे human life या personal safety of others endangered हो।

Section 125 BNS

Causal Connection

Ravi Kapur v. State of Rajasthan, (2012) 9 SCC 284 में Court ने कहा कि rashness और negligence को facts and circumstances के context में examine किया जाना चाहिए और केवल accident का होना पर्याप्त नहीं है। (Indian Kanoon)

Section 125 BNS

Meaning of Rashness and Negligence

Criminal Rashness

Mohammed Aynuddin alias Miyam v. State of Andhra Pradesh, (2000) 7 SCC 72, (Indian Kanoon)

Section 125 BNS

Criminal Negligence

Jacob Mathew v. State of Punjab, (2005) 6 SCC (Indian Kanoon)

Section 125 BNS

Section 125(a): Where Hurt Is Caused

Punishment:

Imprisonment:
Fine:

Section 125(a) BNS

Section 125(b): Where Grievous Hurt Is Caused

Punishment:

Imprisonment:
Fine:

Section 125(b) BNS

Difference Between Section 125 and Section 106 BNS

दूसरी ओर, Section 106 BNS specifically causing death by negligence से संबंधित है। (Indian Kanoon)

Section 125 & Section 106 BNS

Difference Between Section 125 and Section 281 BNS

Section 281 BNS specifically rash driving or riding on a public way

Section 125 & Section 281 BNS

Cognizable, Bailable and Trial

ProvisionNatureBailabilityTrial
Section 125CognizableBailableAny Magistrate
Section 125(a)CognizableBailableAny Magistrate
Section 125(b)CognizableBailableAny Magistrate

Compounding of Offence

Leading Supreme Court Judgments

Bhalchandra alias Bapu & Anr. v. State of Maharashtra

AIR 1968 SC 1319

(Indian Kanoon)

Section 125 BNS

Mohammed Aynuddin alias Miyam v. State of Andhra Pradesh

(2000) 7 SCC 72

(Indian Kanoon)

Section 125 BNS

Jacob Mathew v. State of Punjab

(2005) 6 SCC 1

(Indian Kanoon)

Section 125 BNS

Ravi Kapur v. State of Rajasthan

(2012) 9 SCC 284

Supreme Court ने rash and negligent conduct को facts and circumstances के आधार पर determine करने पर जोर दिया। (Indian Kanoon)

Section 125 BNS

Practical Examples

Section 125 BNS

Section 125(a) BNS

Section 125(b) BNS

(Indian Kanoon)

Section 125 BNS

Key Takeaway

तीनों offences cognizable, bailable और Any Magistrate द्वारा triable हैं।

(Indian Kanoon)
