Section 124 BNS 2023: Acid Attack, Punishment, Procedure and Supreme Court Judgments
Section 124 of the Bharatiya Nyaya Sanhita, 2023 (BNS) विशेष रूप से acid attack तथा acid अथवा अन्य साधनों से ऐसी गंभीर शारीरिक क्षति पहुँचाने को अपराध बनाता है, जिससे व्यक्ति के शरीर पर स्थायी या आंशिक damage, deformity, burns, maiming, disfigurement, disability अथवा grievous hurt हो।
यह provision पुराने IPC Section 326A और 326B के समान acid attack के substantive offences को नए BNS framework में समाहित करता है।
Section 124 BNS – Statutory Provision
Section 124 को दो भागों में समझना आवश्यक है।
Section 124(1) – Causing Grievous Hurt by Acid
Section 124(1) के अंतर्गत अपराध तब बनता है जब कोई व्यक्ति—
किसी व्यक्ति के शरीर के किसी भाग को permanent या partial damage पहुँचाता है;
deformity करता है;
burns करता है;
maims करता है;
disfigures करता है;
disables करता है;
acid फेंककर या acid administer करके grievous hurt करता है;
किसी अन्य means का प्रयोग इस intention या knowledge के साथ करता है कि ऐसी injury या hurt होने की संभावना है; या
किसी व्यक्ति को permanent vegetative state में पहुँचा देता है।
ऐसे अपराध के लिए कम-से-कम 10 वर्ष का imprisonment निर्धारित है, जो imprisonment for life तक बढ़ सकता है, तथा fine भी लगाया जाएगा।
Fine and Victim Compensation
Section 124(1) की विशेषता यह है कि fine केवल सामान्य monetary penalty नहीं है।
कानून के अनुसार fine ऐसा just and reasonable होना चाहिए जिससे victim के medical treatment के expenses पूरे हो सकें और imposed fine victim को दिया जाना है।
इस प्रकार Section 124(1) में punishment का उद्देश्य केवल offender को दंडित करना नहीं बल्कि victim के medical treatment और rehabilitation को भी आर्थिक सहायता देना है।
Section 124(2) – Attempt to Throw or Administer Acid
Section 124(2) उस स्थिति में लागू होता है जहाँ actual grievous injury होना आवश्यक नहीं है।
यदि कोई व्यक्ति—
acid फेंकता है;
acid फेंकने का attempt करता है;
किसी व्यक्ति को acid administer करने का attempt करता है; या
किसी अन्य means का उपयोग करने का attempt करता है,
और उसका intention permanent/partial damage, deformity, burns, maiming, disfigurement, disability अथवा grievous hurt करने का है, तो Section 124(2) लागू हो सकता है।
इस अपराध के लिए punishment है:
Imprisonment – minimum 5 years, maximum 7 years + fine.
अर्थात actual injury पूरी तरह न होने पर भी attempt अपने आप में punishable offence है।
Meaning of Acid
Section 124 की Explanation 1 के अनुसार “acid” का अर्थ केवल सामान्य laboratory acid तक सीमित नहीं है।
इसमें ऐसा substance शामिल है जिसमें—
acidic character;
corrosive character; या
burning nature
हो और जो bodily injury पैदा करने में सक्षम हो, जिससे scars, disfigurement या temporary/permanent disability हो सकती है।
इससे provision का scope केवल पारंपरिक “acid” तक सीमित नहीं रहता, बल्कि अन्य corrosive या burning substances भी circumstances के अनुसार इसके अंतर्गत आ सकते हैं।
Irreversibility of Injury Not Necessary
Section 124 की Explanation 2 एक महत्वपूर्ण बात स्पष्ट करती है।
Permanent या partial damage, deformity अथवा permanent vegetative state का irreversible होना आवश्यक नहीं है।
अर्थात यदि medical treatment से injury में बाद में सुधार की संभावना हो, तो केवल इस आधार पर Section 124 की applicability समाप्त नहीं हो जाती।
Essential Ingredients
Section 124(1) के prosecution में सामान्यतः निम्न elements महत्वपूर्ण होंगे:
Actus Reus: आरोपी द्वारा acid अथवा अन्य covered means का प्रयोग करके specified bodily injury/hurt करना।
Nature of Injury: permanent/partial damage, deformity, burns, maiming, disfigurement, disability, grievous hurt अथवा permanent vegetative state जैसी injury का होना।
Mens Rea: आरोपी का intention अथवा ऐसा knowledge कि उसके act से ऐसी injury/hurt होने की संभावना है।
Causal Connection: आरोपी के act और victim की injury के बीच causal connection स्थापित होना।
Section 124 की statutory language intention के साथ-साथ knowledge को भी recognize करती है। इसलिए केवल direct intention का proof ही प्रत्येक मामले में आवश्यक नहीं होगा; facts के आधार पर requisite knowledge भी relevant हो सकती है।
Nature of Offence
BNSS की First Schedule के अनुसार Section 124 के दोनों offences गंभीर और कठोर रूप से punishable हैं।

इसका practical consequence यह है कि police without warrant arrest कर सकती है क्योंकि offence cognizable है, जबकि accused को bail as of right नहीं मिलती क्योंकि offence non-bailable है।
Recording of Information under BNSS
Section 124 के मामलों में BNSS का procedural protection भी महत्वपूर्ण है।
BNSS Section 173 में specifically Section 124 BNS को उन offences में शामिल किया गया है जिनमें यदि information किसी महिला द्वारा दी जाती है तो उसे woman police officer या woman officer द्वारा record किया जाना है। यदि victim temporarily या permanently mentally/physically disabled है, तो information उसके residence या उसकी choice के convenient place पर interpreter/special educator की उपस्थिति में record की जानी है और recording को videographed किया जाना है।
इसी प्रकार investigation के दौरान BNSS Section 180 के अंतर्गत ऐसी महिला victim का statement भी woman police officer या woman officer द्वारा record किया जाना है।
Leading Supreme Court Judgments
Laxmi v. Union of India
[Laxmi v. Union of India, (2014) 4 SCC 427, Supreme Court]
यह acid attack jurisprudence का सबसे महत्वपूर्ण Supreme Court judgment है।
Supreme Court ने acid attack victims की गंभीर medical और rehabilitation needs को ध्यान में रखते हुए State/UTs को प्रत्येक acid attack victim को कम-से-कम ₹3 lakh compensation उपलब्ध कराने का निर्देश दिया था। Court ने ₹1 lakh को तत्काल medical attention के लिए 15 दिनों के भीतर देने और balance ₹2 lakh को शीघ्रता से देने की दिशा में निर्देश दिया।
यह judgment बाद में acid attack victims के compensation framework का प्रमुख आधार बना।
Laxmi v. Union of India – 2015 Order

Supreme Court ने पुनः स्पष्ट किया कि minimum ₹3 lakh compensation की direction का States/UTs द्वारा पालन किया जाना चाहिए और State Legal Services Authorities को implementation सुनिश्चित करने की भूमिका दी। Court ने acid attack victims को proper treatment और rehabilitation उपलब्ध कराने पर भी जोर दिया।
Parivartan Kendra v. Union of India

Supreme Court ने acid attack victims के after-care and rehabilitation पर विशेष emphasis दिया और ₹3 lakh minimum compensation की दिशा को reinforce किया। Court ने compensation के immediate component तथा subsequent rehabilitation support पर भी निर्देश दिए।
Ravada Sasikala v. State of Andhra Pradesh

यह judgment sentencing के दृष्टिकोण से अत्यंत महत्वपूर्ण है।
मामले में acid attack के लिए trial court ने one-year rigorous imprisonment दिया था, लेकिन High Court ने sentence को period already undergone—लगभग 30 days—तक reduce कर दिया। Supreme Court ने इस approach को स्वीकार नहीं किया और trial court की sentence restore कर दी।
Supreme Court ने acid attack को अत्यंत गंभीर और heartless crime मानते हुए undue leniency या misplaced sympathy के विरुद्ध महत्वपूर्ण observations किए। साथ ही victim को compensation देने का आदेश भी दिया गया।
यह principle Section 124 BNS के sentencing मामलों में अत्यंत relevant रहेगा, विशेषकर जब Court punishment की proportionality और victim impact पर विचार करेगा।
Relationship with Old IPC
BNS के लागू होने से पहले acid attack के लिए प्रमुख provisions थे:
IPC Section 326A – voluntarily causing grievous hurt by use of acid आदि;
IPC Section 326B – voluntarily throwing or attempting to throw acid.
अब corresponding provisions BNS Section 124(1) और Section 124(2) में हैं।
Supreme Court ने 2026 के एक judgment में भी स्पष्ट रूप से note किया कि IPC repeal होकर BNS लागू हुआ है और BNS Section 124(2) acid throwing/attempt के संबंध में पूर्व Section 326B के समान statutory framework प्रदान करता है। [Shaheen Malik v. Union of India, Supreme Court, 2026]

Section 124 BNS केवल “acid throwing” को punish नहीं करता। इसका scope व्यापक है। Actual offence में permanent/partial damage, deformity, burns, maiming, disfigurement, disability, grievous hurt या permanent vegetative state जैसी गंभीर consequences शामिल हैं।
सबसे महत्वपूर्ण distinctions हैं:
Section 124(1): Actual specified injury/hurt — 10 years to life imprisonment + fine.
Section 124(2): Acid attack का attempt — 5 to 7 years + fine.
दोनों offences cognizable, non-bailable और Court of Session triable हैं।
इसके अतिरिक्त, Section 124(1) का fine victim के medical expenses के लिए just and reasonable होना चाहिए और victim को दिया जाना है। यह provision victim-centric criminal justice approach को स्पष्ट रूप से दर्शाता है।
Conclusion
Section 124 BNS 2023 acid attack तथा उससे होने वाली गंभीर bodily injuries के विरुद्ध कठोर penal provision है। इसकी विशेषता केवल minimum 10-year imprisonment और life imprisonment तक punishment नहीं है, बल्कि victim के medical treatment, compensation और rehabilitation को भी statutory तथा judicial protection मिलना है।
Laxmi, Parivartan Kendra और Ravada Sasikala जैसे Supreme Court decisions यह स्थापित करते हैं कि acid attack मामलों में victim dignity, adequate compensation, medical treatment और proportionate sentencing को अत्यधिक महत्व दिया जाना चाहिए।
