Juvenile Justice Act 2015 Chapter IX – Other Offences Against Children: Complete Section-wise Explanation

Chapter IX – Other Offences Against Children में Sections 74 से 89 तक provisions हैं। इन provisions का उद्देश्य बच्चों की identity की confidentiality, cruelty, begging, intoxicants, child labour exploitation, illegal adoption, sale and procurement, corporal punishment, use by militant groups, kidnapping, offences against disabled children तथा इन offences की classification और punishment को regulate करना है। Chapter IX का विशेष महत्व इसलिए है क्योंकि इसमें बच्चे को केवल “victim” के रूप में protect नहीं किया गया है, बल्कि child के exploitation में शामिल adults, institutions और organisations के लिए specific penal consequences निर्धारित किए गए हैं।

Section 74 – Prohibition on Disclosure of Identity of Children

Section 74 child की identity protection and confidentiality से संबंधित है।

किसी newspaper, magazine, news-sheet, audio-visual media अथवा communication के किसी अन्य form में ऐसी information प्रकाशित या प्रसारित नहीं की जा सकती जिससे निम्न बच्चे की पहचान हो सके:

Child in Conflict with Law, Child in Need of Care and Protection, अथवा किसी crime का child victim या witness.

ऐसे मामले में बच्चे का name, address, school या कोई अन्य identifying particular disclose नहीं किया जा सकता और बच्चे की photograph भी publish नहीं की जा सकती।

इस prohibition का उद्देश्य publicity के कारण बच्चे को social stigma, humiliation, retaliation, psychological harm और future discrimination से बचाना है।

लेकिन यह prohibition absolute नहीं है। यदि inquiry करने वाला Board या Committee reasons in writing record करके यह माने कि disclosure स्वयं बच्चे के best interest में है, तो disclosure की अनुमति दी जा सकती है।

Section 74(2) Police records के संबंध में भी confidentiality सुनिश्चित करता है। Police बच्चे का record character certificate के purpose से या अन्यथा pending case अथवा ऐसे case में जो closed या disposed of हो चुका है, disclose नहीं कर सकती। 2021 Amendment ने subsection (2) की wording को “pending case or the case which has been closed or disposed of” के रूप में स्पष्ट किया।

Section 74(3) के अनुसार subsection (1) का उल्लंघन करने वाले व्यक्ति को six months तक imprisonment या ₹2 lakh तक fine या दोनों हो सकते हैं।

अर्थात media या अन्य communication में केवल बच्चे का नाम छापना ही नहीं, बल्कि कोई ऐसा combination of particulars देना भी prohibited है जिससे उसकी identity reasonably ascertain की जा सके।

Section 75 – Punishment for Cruelty to Child

Section 75 उस व्यक्ति को punish करता है जिसके पास बच्चे का actual charge या control है और वह बच्चे के साथ cruelty करता है।

Cruelty में child को:

assault करना, abandon करना, abuse करना, expose करना, wilfully neglect करना, अथवा किसी अन्य व्यक्ति से ऐसा assault, abandonment, abuse, exposure या neglect करवाना शामिल है, यदि conduct से बच्चे को unnecessary mental or physical suffering होने की संभावना हो।

सामान्य punishment three years तक imprisonment या ₹1 lakh fine या दोनों है।

Biological Parents and Abandonment

Section 75 का पहला proviso एक महत्वपूर्ण protection देता है।

यदि biological parents द्वारा child का abandonment ऐसी circumstances beyond their control के कारण हुआ है, तो यह presume किया जाएगा कि abandonment wilful नहीं था। ऐसी स्थिति में Section 75 के penal provisions लागू नहीं होंगे।

इसका उद्देश्य genuine helplessness को intentional cruelty से अलग करना है।

Cruelty by Person Managing or Employed in Child-care Organisation

यदि cruelty उस व्यक्ति द्वारा की जाती है जो किसी ऐसी organisation में employed है या organisation को manage करता है जिसे बच्चे की care and protection की responsibility दी गई है, तो punishment अधिक कठोर है।

ऐसे व्यक्ति को rigorous imprisonment up to five years और fine up to ₹5 lakh हो सकता है।

Cruelty Resulting in Serious Consequences

यदि cruelty के परिणामस्वरूप child:

physically incapacitated हो जाता है, mental illness develop करता है, regular tasks perform करने के लिए mentally unfit हो जाता है, अथवा उसके life या limb को risk होता है,

तो punishment rigorous imprisonment minimum three years से लेकर ten years तक हो सकती है और ₹5 lakh तक fine भी लगाया जा सकता है।

2016 Rules में child marriage को भी Section 75 के purpose के लिए cruelty माना गया है। यदि child को marriage में दिए जाने का risk हो, तो Police या authorised officer को child को Committee के सामने produce करके appropriate directions और rehabilitative measures लेने होते हैं।

2022 Model Amendment Rules में Section 75 के offences के संबंध में relevant provisions of the Indian Penal Code, 1860 या अन्य applicable law के application को expressly provide किया गया है।

Section 76 – Employment of Child for Begging

Section 76 child को begging के लिए इस्तेमाल करने को अपराध बनाता है।

जो व्यक्ति किसी child को begging के purpose से employ या use करता है या child को beg करने के लिए causes करता है, उसे five years तक imprisonment और ₹1 lakh तक fine हो सकता है।

Amputation or Maiming for Begging

यदि begging के purpose से child को amputate या maim किया जाता है, तो punishment अत्यंत कठोर है।

ऐसे व्यक्ति को rigorous imprisonment minimum seven years से लेकर ten years तक और ₹5 lakh तक fine हो सकता है।

Guardian or Custodian

यदि जिस व्यक्ति के पास child का actual charge या control है वह subsection (1) के offence का abetment करता है, तो उसे भी वही punishment मिल सकती है।

ऐसा guardian या custodian Section 2(14) के relevant category के अनुसार unfit person माना जाएगा।

सबसे महत्वपूर्ण safeguard यह है कि begging में इस्तेमाल किए गए child को किसी परिस्थिति में Child in Conflict with Law नहीं माना जाएगा

ऐसे child को guardian/custodian के charge से remove करके Committee के सामने produce किया जाएगा ताकि उसके लिए appropriate rehabilitation की जा सके।

2022 Model Amendment Rules में Section 76 के मामले में immediate Police investigation का provision है। Offence established होने पर FIR forthwith register की जानी है। यदि parents ने child को begging में engage किया है तो FIR से पहले investigation की व्यवस्था है। Trafficking, child labour या kidnapping के facts मिलने पर संबंधित अन्य penal laws भी apply हो सकते हैं।

Section 77 – Penalty for Giving Intoxicating Liquor or Narcotic Drug or Psychotropic Substance to a Child

Section 77 child को intoxicating substances देने या दिलाने को punish करता है।

कोई व्यक्ति child को:

intoxicating liquor, narcotic drug, tobacco products या psychotropic substance देता है या दिलवाता है, तो वह offence करता है।

Exception यह है कि यदि ऐसा substance duly qualified medical practitioner के order पर दिया गया है, तो Section 77 लागू नहीं होता।

Punishment है rigorous imprisonment up to seven years और fine up to ₹1 lakh

इस Section का उद्देश्य child को substance abuse और उसके harmful physical तथा psychological effects से protect करना है।

Section 78 – Using a Child for Vending, Peddling, Carrying, Supplying or Smuggling Intoxicants

Section 78 child को intoxicating substances की illegal supply chain में इस्तेमाल करने को offence बनाता है।

यदि कोई व्यक्ति child का use:

vending, peddling, carrying, supplying या smuggling के लिए करता है और substance intoxicating liquor, narcotic drug या psychotropic substance है, तो offence Section 78 के अंतर्गत आएगा।

Punishment है rigorous imprisonment up to seven years और fine up to ₹1 lakh

यह provision Section 77 से अलग है। Section 77 में child को substance देना/दिलाना मुख्य act है, जबकि Section 78 में child को उस substance के illegal trafficking/distribution activity में इस्तेमाल करना मुख्य act है।

Section 79 – Exploitation of a Child Employee

Section 79 child employee के exploitation से संबंधित है।

यदि कोई व्यक्ति ostensibly child को engage करता है और:

child को employment के purpose से bondage में रखता है, child की earnings withhold करता है, अथवा child की earnings को अपने purpose के लिए use करता है,

तो वह Section 79 के तहत punishable है।

Punishment है rigorous imprisonment up to five years और ₹1 lakh तक fine

Meaning of Employment

Section 79 की Explanation employment का scope व्यापक बनाती है।

Employment में economic gain के लिए public places में goods और services selling तथा entertainment भी शामिल है।

अर्थात provision केवल traditional employer-employee relationship तक सीमित नहीं है।

2022 Model Amendment Rules में Section 79 के मामले में immediate Police investigation और offence established होने पर FIR registration का mechanism दिया गया है। यदि child child labour का victim है तो Child and Adolescent Labour (Prohibition and Regulation) Act, 1986 के relevant provisions भी लागू होंगे।

Section 80 – Punitive Measures for Adoption Without Following Prescribed Procedures

Section 80 illegal या unauthorised adoption arrangements के विरुद्ध है।

यदि कोई person या organisation किसी orphan, abandoned या surrendered child को adoption के purpose से offer, give या receive करता है और Act की prescribed provisions/procedure follow नहीं करता, तो offence होता है।

Punishment है:

three years तक imprisonment, या ₹1 lakh fine, या दोनों

Recognised Adoption Agency

यदि offence किसी recognised adoption agency द्वारा किया गया है, तो सामान्य punishment के अतिरिक्त उस agency के day-to-day affairs के लिए responsible persons पर action होगा।

Agency का registration under Section 41 और recognition under Section 65, minimum one year के लिए withdraw किया जाएगा।

इस provision का central principle है कि adoption केवल statutory adoption system के माध्यम से ही किया जा सकता है; private placement, informal transfer या direct exchange of child legally permissible adoption mechanism का substitute नहीं है।

Section 81 – Sale and Procurement of Children for Any Purpose

Section 81 child की sale और purchase/procurement को punish करता है।

जो व्यक्ति किसी भी purpose के लिए child को sells या buys करता है, उसे:

rigorous imprisonment up to five years और ₹1 lakh fine हो सकता है।

Person Having Actual Charge of Child

यदि offence उस व्यक्ति द्वारा किया जाता है जिसके पास child का actual charge है, तो punishment अधिक कठोर है।

ऐसे व्यक्ति में hospital, nursing home या maternity home के employees भी specifically शामिल किए गए हैं।

Punishment minimum three years से लेकर seven years तक imprisonment और ₹1 lakh fine है।

यह provision child trafficking और illegal commercial transfer of children के विरुद्ध महत्वपूर्ण statutory protection है।

Section 82 – Corporal Punishment

Section 82 Child Care Institution में corporal punishment को specifically prohibit करता है।

यदि institution का person-in-charge या employee child को discipline करने के उद्देश्य से corporal punishment देता है, तो पहली conviction पर ₹10,000 fine हो सकता है।

Subsequent offence पर punishment:

three months तक imprisonment, या fine, या दोनों हो सकती है।

Consequences for Employee

यदि institution का employee corporal punishment के offence में convicted होता है, तो वह:

service से dismissal के लिए liable होगा और

भविष्य में बच्चों के साथ directly work करने से debarred होगा।

Non-cooperation by Management

यदि institution में corporal punishment report होती है और management:

inquiry में cooperate नहीं करता या Committee, Board, Court या State Government के orders का compliance नहीं करता,

तो person-in-charge of management को minimum three years imprisonment से लेकर prescribed maximum तथा ₹1 lakh तक fine की liability हो सकती है।

इस provision से स्पष्ट है कि institution में corporal punishment के मामले में केवल individual perpetrator ही नहीं, बल्कि non-cooperative management भी penal consequences का सामना कर सकता है।

Section 83 – Use of Child by Militant Groups or Other Adults

Section 83 child को organised illegal activities में इस्तेमाल किए जाने से protect करता है।

Militant Groups

यदि Central Government द्वारा declared कोई non-State, self-styled militant group or outfit किसी child को recruit या किसी purpose के लिए use करता है, तो group liable होगा।

Punishment है:

rigorous imprisonment up to seven years और ₹5 lakh fine

Adults or Adult Groups

यदि कोई adult या adult group child को illegal activities, individually या gang के रूप में, use करता है तो भी:

rigorous imprisonment up to seven years और ₹5 lakh fine हो सकता है।

यह provision child को criminal gangs, organised illegal activities और militant activities में recruitment या exploitation से protect करने के लिए है।

Section 84 – Kidnapping and Abduction of Child

Section 84 kidnapping और abduction के मामलों के लिए Indian Penal Code के Sections 359 to 369 को applicable बनाता है।

ये provisions इस Act के purpose के लिए mutatis mutandis apply होते हैं।

Section 84 में child या minor की age below eighteen years के रूप में relevant है।

इसका अर्थ है कि kidnapping/abduction से संबंधित IPC framework को JJ Act के child-protection context में लागू किया जाता है।

Section 85 – Offences Committed on Disabled Children

Section 85 disabled child के प्रति किए गए Chapter IX के offences के लिए enhanced punishment का provision करता है।

यदि Chapter IX में referred कोई offence ऐसे child के विरुद्ध किया जाता है जो medical practitioner द्वारा certified रूप से disabled है, तो offender पर उस offence के लिए निर्धारित penalty की twice penalty लागू होगी।

अर्थात disability को aggravating factor माना गया है।

इस Section का उद्देश्य यह recognize करना है कि disabled child vulnerability की अतिरिक्त स्थिति में होता है और इसलिए उसके विरुद्ध अपराध पर सामान्य punishment पर्याप्त नहीं है।

Section 86 – Classification of Offences and Designated Court

Section 86 को Juvenile Justice (Care and Protection of Children) Amendment Act, 2021 द्वारा substitute किया गया और यह substituted provision 1 September 2022 से प्रभावी है।

अब offences की classification punishment की duration के आधार पर की जाती है।

Offence Punishable with More Than Seven Years

यदि JJ Act के किसी offence के लिए punishment more than seven years imprisonment है, तो offence:

cognizable और non-bailable होगा।

Offence Punishable from Three to Seven Years

यदि punishment three years and above लेकिन not more than seven years है, तो offence:

non-cognizable और non-bailable होगा।

Offence Punishable Below Three Years or Fine Only

यदि punishment three years से कम imprisonment या fine only है, तो offence:

non-cognizable और bailable होगा।

Designated Court

Section 86(4) का महत्वपूर्ण effect यह है कि Code of Criminal Procedure, Commission for Protection of Child Rights Act या Protection of Children from Sexual Offences Act में contrary provision होने के बावजूद JJ Act के offences Children’s Court द्वारा triable होंगे

इसलिए examination में Section 86 के लिए cognizable/non-cognizable + bailable/non-bailable + Children's Court तीनों aspects याद रखना आवश्यक है।

Section 87 – Abetment

Section 87 के अनुसार यदि कोई व्यक्ति JJ Act के किसी offence का abetment करता है और abetted act वास्तव में abetment के consequence में committed हो जाता है, तो abettor को उस offence के लिए provided punishment दी जाएगी।

2021 Amendment ने Section 87 की Explanation को replace करके स्पष्ट किया कि “abetment” का वही meaning होगा जो Section 107, Indian Penal Code में दिया गया है।

इसलिए Section 87 को Section 107 IPC के साथ पढ़ना महत्वपूर्ण है।

Section 88 – Alternative Punishment

कभी-कभी एक ही act या omission JJ Act के अंतर्गत भी offence हो सकता है और किसी दूसरे applicable law के अंतर्गत भी।

Section 88 ऐसी overlapping criminal liability की स्थिति को regulate करता है।

यदि act या omission JJ Act और किसी अन्य law दोनों के अंतर्गत punishable है, तो offender को उस law के अंतर्गत punishment मिलेगी जो greater in degree punishment provide करता है।

इसका उद्देश्य एक ही conduct के लिए दो अलग-अलग punishments को mechanically impose करने के बजाय applicable laws में से अधिक गंभीर statutory punishment को लागू करना है।

Section 89 – Offence Committed by Child under this Chapter

Section 89 child द्वारा Chapter IX के किसी offence के commission से संबंधित है।

यदि कोई child स्वयं Chapter IX के अंतर्गत कोई offence commit करता है, तो उसे Child in Conflict with Law माना जाएगा।

इसका अर्थ यह है कि child के साथ सामान्य adult criminal process के अनुसार treatment नहीं किया जाएगा। उसे Act के CCL framework के अंतर्गत Board के सामने deal किया जाएगा।

यह Section Chapter IX के बाकी penal provisions से महत्वपूर्ण रूप से अलग है क्योंकि इसका focus child offender की protection और juvenile justice process पर है।

Chapter IX – Important Distinctions

Section 74 child की identity disclose करने पर रोक लगाता है।

Section 75 child के साथ cruelty को punish करता है।

Section 76 child को begging में employ/use करने को punish करता है।

Section 77 child को liquor, narcotic drug, tobacco product या psychotropic substance देने को punish करता है।

Section 78 child को intoxicating liquor/narcotic/psychotropic substances की vending, carrying, supplying या smuggling में use करने को punish करता है।

Section 79 child employee के bondage और earnings के exploitation को punish करता है।

Section 80 prescribed adoption procedure का पालन किए बिना adoption करने/कराने को punish करता है।

Section 81 child की sale और procurement को punish करता है।

Section 82 Child Care Institution में corporal punishment को prohibit करता है।

Section 83 militant groups तथा adults द्वारा children को illegal activities में use करने को punish करता है।

Section 84 kidnapping और abduction provisions को apply करता है।

Section 85 disabled child के विरुद्ध Chapter IX offence में enhanced, अर्थात twice penalty का provision करता है।

Section 86 offences की cognizable/non-cognizable तथा bailable/non-bailable classification और Children's Court का jurisdiction निर्धारित करता है।

Section 87 abetment को punish करता है।

Section 88 overlapping offences में greater punishment वाले law को लागू करता है।

Section 89 child द्वारा Chapter IX offence किए जाने पर उसे CCL मानता है।

इन statutory punishments और classifications का आधार uploaded Act के current text तथा 2021 Amendment है।

Chapter IX – Core Legal Principle

Chapter IX को केवल “offences and punishments” वाला Chapter समझना पर्याप्त नहीं है। इसका व्यापक उद्देश्य child protection through penal accountability है।

एक ओर Section 74 बच्चे की identity और privacy protect करता है; Sections 75–85 विभिन्न forms of physical, psychological, economic, sexual/exploitative, institutional और organised exploitation के विरुद्ध criminal protection देते हैं। दूसरी ओर Sections 86–89 यह सुनिश्चित करते हैं कि offences का procedural classification स्पष्ट हो, abetment punishable हो, overlapping laws में appropriate punishment लागू हो और यदि offender स्वयं child है तो उसे Child in Conflict with Law के protective juvenile justice framework में रखा जाए।

विशेष रूप से Section 76 और Section 89 को साथ पढ़ना महत्वपूर्ण है: begging में इस्तेमाल किया गया child Section 76 के proviso के अनुसार किसी परिस्थिति में CCL नहीं माना जाएगा और rehabilitation के लिए Committee के सामने जाएगा; जबकि Section 89 सामान्यतः यह निर्धारित करता है कि यदि कोई child Chapter IX का offence commit करता है, तो उसे CCL माना जाएगा।
