Section 20 — मौद्रिक राहत (Monetary Reliefs) DV Act 2005

Law a to z 0

(Monetary Reliefs)

[DV Act, 2005, s.20(1)]

धारा में प्रयुक्त शब्द “may include, but not limited to” महत्वपूर्ण हैं। [DV Act, 2005, s.20(1)]

Loss of Earnings — Section 20(1)(a)

[DV Act, 2005, s.20(1)(a)]

Protection of Women from Domestic Violence Rules, 2006 के Form II में Section 20 के monetary relief section में “Loss of earnings” को expressly claimable head के रूप में रखा गया है।

Medical Expenses — Section 20(1)(b)

Property Damage — Section 20(1)(c)

[DV Act, 2005, s.3]

Maintenance — Section 20(1)(d)

Magistrate:

[DV Act, 2005, s.20(1)(d)]

इस maintenance को Section 125 CrPC के तहत मिलने वाली maintenance के under or in addition to भी दिया जा सकता है।

Monetary relief:

adequate,

fair,

reasonable, और

aggrieved person जिस standard of living की accustomed है, उसके consistent

[DV Act, 2005, s.20(2)]

Court को case की circumstances और parties के financial position तथा applicable standard of living को consider करना होता है।

Supreme Court ने Rajnesh v. Neha, 2020, Supreme Court में maintenance determination के लिए व्यापक guidelines दीं और income, financial status, liabilities, needs तथा standard of living जैसे relevant factors पर structured approach अपनाने की आवश्यकता बताई।

Section 20(3) — Lump Sum या Monthly Maintenance

monthly payments of maintenance

Copy

Section 20(5) — Payment

Direct Recovery

debtor

Interim Monetary Relief

[DV Act, 2005, s.23]

Protection of Women from Domestic Violence Rules,

Practical Application

Protection of Women from Domestic Violence Rules,

loss of earnings,

medical expenses,

destruction/damage/removal of property से loss, और

food, clothes, medicines and basic necessities,

school fees and related expenses,

household expenses, और

other expenses

[DV Act, 2005, s.20]

Section 22 injuries, including mental torture and emotional distress,

Section 125 CrPC

Section 20(1)(d) expressly कहता है कि DV Act के तहत maintenance Section 125 CrPC या किसी अन्य law के तहत maintenance order के under or in addition to हो सकती है। [DV Act, 2005, s.20(1)(d)]

Supreme Court का leading judgment Rajnesh v.

साथ ही, Court ने maintenance proceedings में disclosure of assets and liabilities तथा overlapping maintenance claims को properly account करने के लिए guidelines निर्धारित कीं।

Relief

[DV Act, 2005, s.26]

Section 26(2) यह स्पष्ट करता है कि ऐसी relief किसी अन्य available relief के addition to and along with भी मांगी जा सकती है। [DV Act, 2005, s.26(2)]

[DV Act, 2005, s.26(3)]

Section 20 की Enforcement

Supreme Court — Rajnesh v. Neha

Rajnesh v.

Section 20 maintenance प्रदान करता है;

maintenance Section 125 CrPC के order के additional हो सकती है;

Section 20(3) lump sum अथवा monthly payment की अनुमति देता है;

Supreme Court — Juveria Abdul Majid Patni v. Atif Iqbal Mansoori

Juveria Abdul Majid Patni v.

[DV Act, 2005, s.20]

इसमें loss of earnings, medical expenses और property-related financial loss भी शामिल हो सकते हैं। [DV Act, 2005, s.20(1)(a)–(c)]

[DV Act, 2005, s.20(1)(d)]

Relief adequate, fair, reasonable और accustomed standard of living के consistent होनी चाहिए। [DV Act, 2005, s.20(2)]

[DV Act, 2005, s.20]

इसकी चार मूल categories हैं—loss of earnings, medical expenses, property loss/damage और maintenance। [DV Act, 2005, s.20(1)]
