Section 19 — Residence Orders कब दिया जा सकता है DV Act 2005

 

घरेलू हिंसा अधिनियम, 2005 की धारा 19 — Residence Orders

Protection of Women from Domestic Violence Act, 2005 की धारा 19 पीड़ित महिला को shared household में उसके निवास की रक्षा तथा परिस्थितियों के अनुसार वैकल्पिक आवास या किराये की व्यवस्था दिलाने के लिए Magistrate को Residence Order पारित करने की शक्ति देती है। यह धारा Section 17 में दिए गए right to reside को प्रभावी judicial remedy प्रदान करती है। [DV Act, 2005, ss.17, 19]

धारा 19 का मूल उद्देश्य

Section 17 यह substantive right देता है कि domestic relationship में रहने वाली महिला को shared household में रहने का अधिकार है, चाहे उस property में उसका कोई ownership, title या beneficial interest न हो। उसे respondent द्वारा shared household से बेदखल या exclude नहीं किया जा सकता, सिवाय कानून द्वारा स्थापित procedure के। [DV Act, 2005, s.17]

Section 19 इसी right को enforce करने के लिए Magistrate को विभिन्न प्रकार के residence orders देने की शक्ति देता है। Act में “residence order” को specifically Section 19(1) के तहत दिया गया order माना गया है। [DV Act, 2005, s.2(p)]

Section 19(1) — Residence Order कब दिया जा सकता है

Section 19(1) के अनुसार Section 12(1) की application dispose करते समय Magistrate, domestic violence होने से satisfied होने पर, residence order पारित कर सकता है। [DV Act, 2005, s.19(1)]

यहाँ एक महत्वपूर्ण अंतर Section 18 से है। Section 18 में Magistrate को prima facie satisfaction कि domestic violence हुई है या likely है, पर्याप्त है; Section 19(1) में statutory language “on being satisfied that domestic violence has taken place” है। [DV Act, 2005, ss.18–19]

Section 19(1)(a) — बेदखली से सुरक्षा

Magistrate respondent को aggrieved person को shared household से:

dispossess करने, या

किसी अन्य तरीके से उसके possession को disturb करने

से रोक सकता है।

महत्वपूर्ण बात यह है कि यह protection इस बात पर निर्भर नहीं करती कि respondent के पास shared household में legal या equitable interest है या नहीं। [DV Act, 2005, s.19(1)(a)]

अर्थात Section 19(1)(a) का focus ownership नहीं बल्कि residence और protection है।

Section 19(1)(b) — Respondent को Shared Household से हटाना

Magistrate respondent को shared household से स्वयं remove होने का direction दे सकता है। [DV Act, 2005, s.19(1)(b)]

लेकिन इस clause के साथ एक स्पष्ट statutory limitation है:

किसी महिला के विरुद्ध Section 19(1)(b) के तहत respondent को remove करने का order नहीं दिया जा सकता।

अर्थात यदि respondent महिला है, तो उसके विरुद्ध इस particular clause के तहत removal order पारित नहीं किया जा सकता। [DV Act, 2005, s.19(1), proviso]

यह limitation केवल Section 19(1)(b) पर है; इसका अर्थ यह नहीं कि female relative के विरुद्ध अन्य appropriate relief उपलब्ध नहीं हैं।

Section 19(1)(c) — Shared Household के Particular Portion में प्रवेश पर रोक

Magistrate respondent या उसके किसी relative को उस portion of shared household में प्रवेश करने से restrain कर सकता है जहाँ aggrieved person रहती है। [DV Act, 2005, s.19(1)(c)]

यह provision विशेष रूप से तब उपयोगी है जब shared household में अलग-अलग portions में रहने की व्यवस्था हो।

उदाहरण के लिए, यदि महिला घर के एक निर्धारित हिस्से में रहती है और respondent या उसके relatives का वहाँ आना domestic violence या disturbance का कारण बनता है, तो Court उस particular portion में प्रवेश पर restraint लगा सकता है।

Section 19(1)(d) — Property को बेचने या Encumber करने से रोकना

Magistrate respondent को shared household को:

alienate करने

dispose off करने

या

encumber करने

से रोक सकता है। [DV Act, 2005, s.19(1)(d)]

“Encumber” का सामान्य legal अर्थ property पर ऐसा financial/legal burden create करना है जो property के उपयोग, title या transfer को प्रभावित करे, जैसे mortgage या अन्य charge।

इस provision का उद्देश्य यह है कि pending domestic violence dispute के दौरान respondent shared household को बेचकर, transfer करके या उस पर financial liability create करके महिला के residence right को practically defeat न कर सके।

Section 19(1)(e) — Shared Household में अपने Rights छोड़ने पर रोक

Magistrate respondent को shared household में अपने rights renounce करने से रोक सकता है, जब तक Magistrate की leave प्राप्त न हो। [DV Act, 2005, s.19(1)(e)]

इसका practical उद्देश्य यह है कि respondent जानबूझकर अपने property rights किसी अन्य व्यक्ति को transfer या relinquish करके महिला के residence-related protection को निष्प्रभावी न कर सके।

Section 19(1)(f) — Alternate Accommodation या Rent

यह Section 19 का अत्यंत महत्वपूर्ण provision है।

यदि circumstances require करते हैं, तो Magistrate respondent को निर्देश दे सकता है कि वह aggrieved person के लिए:

shared household में प्राप्त residence के समान स्तर का alternate accommodation secure करे, या

उस alternate accommodation के लिए rent pay करे।

[DV Act, 2005, s.19(1)(f)]

यहाँ statutory expression “same level of alternate accommodation” है। इसलिए alternate accommodation केवल नाममात्र का या असुरक्षित accommodation नहीं होना चाहिए; Court परिस्थितियों के अनुसार पहले residence के level और facilities को ध्यान में रख सकता है।

Supreme Court ने Section 19(1)(f) को Section 2(s), Section 17 और Section 19 के संयुक्त framework में समझा है। [Satish Chander Ahuja v. Sneha Ahuja, 2020, Supreme Court] 

Section 19(2) — Additional Conditions और Directions

Section 19(2) Magistrate को additional conditions लगाने या ऐसी अन्य directions देने की व्यापक power देता है जो aggrieved person या उसके child की:

protection

या

safety

के लिए reasonably necessary हों। [DV Act, 2005, s.19(2)]

इसलिए Section 19 की relief केवल clauses (a) से (f) तक mechanical रूप से सीमित नहीं है। Case की परिस्थितियों के अनुसार Court additional protective directions दे सकता है।

Section 19(3) — Bond with or without Sureties

Magistrate respondent से domestic violence की commission को prevent करने के लिए bond execute करने की मांग कर सकता है, जो sureties के साथ या बिना sureties के हो सकता है। [DV Act, 2005, s.19(3)]

यह preventive mechanism है।

Section 19(4) — Chapter VIII CrPC के अनुसार Bond

Section 19(3) के तहत दिया गया bond order Chapter VIII of the Code of Criminal Procedure, 1973 के तहत order माना जाता है और उसी के अनुसार deal किया जाता है। [DV Act, 2005, s.19(4)]

Section 19(5) — Police Protection और Implementation

Residence order pass करते समय Court nearest police station के officer-in-charge को:

aggrieved person को protection देने, या

order के implementation में assistance देने

का direction दे सकता है। [DV Act, 2005, s.19(5)]

इसका महत्व विशेष रूप से तब होता है जब respondent order के बावजूद महिला को घर में प्रवेश करने नहीं देता या residence order के implementation में obstruction करता है।

Section 19(6) — Rent और अन्य Payments

Magistrate Section 19(1) के तहत order pass करते समय respondent पर rent और other payments discharge करने की obligations भी impose कर सकता है।

ऐसा करते समय Court parties की:

financial needs

और

financial resources

को ध्यान में रखेगा। [DV Act, 2005, s.19(6)]

इस provision का Section 19(1)(f) से सीधा संबंध है।

Section 19(7) — Police Assistance

Magistrate उस police station के officer-in-charge को भी direction दे सकता है जिसके jurisdiction में Magistrate से approach किया गया है, ताकि protection order के implementation में assistance दी जा सके। [DV Act, 2005, s.19(7)]

यह Section 19 के residence-related protection को practical enforcement mechanism देता है।

Section 19(8) — Stridhan और Property की वापसी

Section 19(8) के तहत Magistrate respondent को aggrieved person को:

उसका stridhan

या

ऐसी अन्य property अथवा valuable security जिस पर वह entitled है

वापस करने का direction दे सकता है। [DV Act, 2005, s.19(8)]

यह provision Section 18(e) से अलग है। Section 18(e) assets, bank lockers/accounts और stridhan के alienation/operation को restrain करने की protective power देता है, जबकि Section 19(8) actual return/restoration of possession का specific direction देने की power देता है।

“Shared Household” का अर्थ

Section 19 को समझने के लिए Section 2(s) सबसे महत्वपूर्ण provisions में से एक है।

“Shared household” में वह household शामिल हो सकता है जहाँ aggrieved woman:

रहती है, या

domestic relationship के दौरान किसी stage पर रही है,

और इसमें jointly या singly owned/tenanted household तथा कुछ परिस्थितियों में joint family household भी शामिल है। [DV Act, 2005, s.2(s)]

इसलिए केवल यह तथ्य कि property महिला के नाम पर नहीं है, अपने-आप Section 19 की remedy को समाप्त नहीं करता।

Supreme Court — Satish Chander Ahuja v. Sneha Ahuja

Satish Chander Ahuja v. Sneha Ahuja, 2020, Supreme Court Section 19 और “shared household” के संबंध में सबसे महत्वपूर्ण Constitutionally relevant Supreme Court authorities में से एक है। तीन-न्यायाधीशों की Bench ने स्पष्ट किया कि shared household को केवल उस घर तक सीमित नहीं किया जा सकता जो husband के नाम पर हो या जिसमें husband का ownership interest हो। 

Supreme Court ने यह भी स्पष्ट किया कि Section 2(s) की definition के अनुसार shared household वह household हो सकता है जहाँ woman domestic relationship में presently या past में permanence के साथ रही हो। केवल fleeting या casual residence पर्याप्त नहीं है। 

इस judgment ने S.R. Batra v. Taruna Batra, 2007, Supreme Court में दी गई restrictive interpretation को सही law नहीं माना और उसे overrule किया। 

इसलिए आज Section 19 को समझते समय S.R. Batra के पुराने restrictive principle के बजाय Satish Chander Ahuja का बाद का three-judge Bench judgment controlling authority है।

Supreme Court — V.D. Bhanot v. Savita Bhanot

V.D. Bhanot v. Savita Bhanot, 2012, Supreme Court में Supreme Court ने Sections 18 और 19 के residence-related relief को प्रभावी रूप से लागू करते हुए wife के residence और suitable accommodation की व्यवस्था पर विचार किया। Court ने परिस्थितियों के अनुसार पत्नी के लिए residence और alternative accommodation/rent से संबंधित directions को स्वीकार किया। [V.D. Bhanot v. Savita Bhanot, 2012, Supreme Court]

यह judgment Section 19 की remedial और protective character को समझने के लिए leading authority है।

Section 19 और Section 17 में अंतर

Section 17 महिला को shared household में रहने का substantive right देता है।

Section 19 Magistrate को उस right को protect और enforce करने के लिए judicial residence orders देने की power देता है।

[DV Act, 2005, ss.17, 19]

इसलिए Section 17 को right और Section 19 को उस right की remedial enforcement mechanism के रूप में समझना अधिक सटीक है।

Section 19 और Section 18 में अंतर

Section 18 Protection Order मुख्यतः respondent को domestic violence या specified conduct से restrain करता है।

Section 19 Residence Order मुख्यतः shared household में residence, possession, removal, entry restrictions, alienation और alternate accommodation से संबंधित है।

[DV Act, 2005, ss.18–19]

एक ही proceeding में Section 18 और Section 19 दोनों reliefs मांगे जा सकते हैं।

Rules के Form II में भी Section 18 के Protection Order और Section 19 के Residence Order को अलग-अलग reliefs के रूप में expressly रखा गया है।

Section 19 और Alternate Accommodation

Section 19(1)(f) के तहत alternate accommodation का उद्देश्य महिला को केवल कोई भी दूसरा घर देना नहीं है।

Statute specifically कहता है:

“same level of alternate accommodation”

अर्थात Court को circumstances के अनुसार उस accommodation के level को देखना होगा जिसमें महिला shared household में रह रही थी। [DV Act, 2005, s.19(1)(f)]

Supreme Court ने भी Section 19(1)(f) को इसी statutory framework में recognise किया है। (Sci API)

Section 19 और Ownership का प्रश्न

Section 19(1)(a) expressly कहता है कि respondent को महिला को shared household से dispossess करने से restrain किया जा सकता है “whether or not the respondent has a legal or equitable interest” in the shared household. [DV Act, 2005, s.19(1)(a)]

इसलिए Section 19 की proceeding में ownership और residence right को एक ही चीज नहीं माना जा सकता।

Supreme Court ने Satish Chander Ahuja में स्पष्ट किया कि woman का Section 17/19 residence right उसके property में legal title होने पर निर्भर नहीं है। 

Section 19 की Application में क्या Relief मांगी जा सकती है

Protection of Women from Domestic Violence Rules, 2006 के Form II में Section 19 के लिए specifically निम्न प्रकार के reliefs दिखाए गए हैं:

shared household से dispossession रोकना,

उस portion में respondent का entry रोकना जहाँ aggrieved person रहती है,

shared household को alienate/dispose/encumber करने से रोकना,

shared household में respondent के rights renounce करने पर रोक,

personal effects तक continued access,

respondent को shared household से remove करना,

और

same level की alternate accommodation या rent उपलब्ध कराना। [DV Rules, 2006, Form II]

यह Form II Section 19 की practical pleading structure को समझने में विशेष रूप से उपयोगी है।

Safety Plan और Section 19

Protection of Women from Domestic Violence Rules, 2006 के Form V — Safety Plan में Protection Officer, Police Officer या service provider महिला के साथ consultation करके violence, उसके consequences, future apprehension, safety measures और Court से मांगे जाने वाले orders का विवरण तैयार कर सकता है। [DV Rules, 2006, Rule 8(1)(iv), Form V]

यदि residence-related danger मौजूद है, तो यह material Section 19 के appropriate relief के लिए relevant हो सकता है।

Section 23 के तहत Interim Residence Order

Section 19 की relief केवल final disposal तक सीमित नहीं है।

Section 23(1) Magistrate को proceedings के दौरान interim order pass करने की power देता है।

Section 23(2) के तहत prima facie domestic violence या उसके likelihood से satisfied होने पर Magistrate Section 19 सहित Sections 18, 20, 21 और 22 के तहत ex parte order भी pass कर सकता है, prescribed affidavit के आधार पर। [DV Act, 2005, s.23]

इसलिए तत्काल residence protection की आवश्यकता होने पर Section 23 के साथ Section 19 का उपयोग किया जा सकता है।

Section 26 के तहत अन्य Proceedings में भी Relief

Section 26 के अनुसार Sections 18, 19, 20, 21 और 22 में उपलब्ध reliefs किसी civil court, family court या criminal court के सामने चल रही ऐसी legal proceeding में भी मांगे जा सकते हैं जो aggrieved person और respondent को affect करती है। [DV Act, 2005, s.26]

इसलिए Section 19 की residence relief केवल स्वतंत्र DV proceeding तक सीमित नहीं है।

Jurisdiction और Enforcement

Section 27 के अनुसार Judicial Magistrate First Class या Metropolitan Magistrate को jurisdiction प्राप्त हो सकती है जहाँ:

aggrieved person permanently या temporarily रहती है,

respondent रहता या काम करता है,

या cause of action arise हुआ है।

और Act के तहत बनाया गया order पूरे भारत में enforceable है। [DV Act, 2005, s.27]

Section 28 के अनुसार Sections 12, 18, 19, 20, 21, 22 और 23 की proceedings सामान्यतः CrPC के provisions द्वारा governed होती हैं, subject to the Act's specific procedure. [DV Act, 2005, s.28]

Section 19 की मुख्य कानूनी संरचना

Section 19(1)(a) → बेदखली और possession disturb करने से protection

Section 19(1)(b) → respondent को shared household से remove करना

Section 19(1)(c) → महिला के occupied portion में respondent/relative का प्रवेश रोकना

Section 19(1)(d) → shared household की alienation/disposal/encumbrance रोकना

Section 19(1)(e) → shared household में respondent के rights renounce करने पर रोक

Section 19(1)(f) → same-level alternate accommodation या rent

Section 19(2) → additional safety/protection directions

Section 19(3) → bond with or without sureties

Section 19(5) → Police protection/implementation assistance

Section 19(6) → rent और other payments की obligation

Section 19(7) → Police assistance

Section 19(8) → stridhan/property/valuable security की वापसी

निष्कर्ष

Section 19 का केंद्रीय उद्देश्य महिला को केवल घर में रहने का abstract right देना नहीं, बल्कि उस right को judicially enforceable बनाना है। Section 17 right to residence देता है और Section 19 Magistrate को उस right की रक्षा के लिए specific residence orders देने की power देता है। [DV Act, 2005, ss.17, 19]

सबसे महत्वपूर्ण Supreme Court authority Satish Chander Ahuja v. Sneha Ahuja, 2020, Supreme Court है, जिसमें shared household की व्यापक statutory interpretation स्वीकार की गई और S.R. Batra v. Taruna Batra, 2007 की restrictive interpretation को overrule किया गया।

इसके अतिरिक्त V.D. Bhanot v. Savita Bhanot, 2012, Supreme Court Section 19 के residence और suitable accommodation-related relief की remedial nature को समझने के लिए leading authority है। 

व्यावहारिक रूप से Section 19 की सबसे महत्वपूर्ण बात यह है कि महिला का residence right केवल ownership title पर निर्भर नहीं है; Court परिस्थितियों के अनुसार उसे shared household में protection, respondent की removal, entry restraint, property protection अथवा same-level alternate accommodation/rent प्रदान कर सकता है। [DV Act, 2005, ss.2(s), 17, 19]
