अध्याय V — विविध प्रावधान
Protection of Women from Domestic Violence Act, 2005 का Chapter V “Miscellaneous” है और इसमें धारा 30 से धारा 37 तक के प्रावधान हैं। यह Chapter मुख्यतः Protection Officers और Service Providers की legal status, protection order के breach को criminal offence बनाने, Protection Officer की failure पर penalty, good-faith protection, अन्य कानूनों के साथ DV Act का संबंध तथा Central Government की rule-making power से संबंधित है।
Protection of Women from Domestic Violence Rules, 2006 में Chapter V के enforcement से सबसे महत्वपूर्ण प्रावधान Rule 15 — Breach of Protection Orders है। इसके अतिरिक्त Rules 8, 9 और 10 Protection Officer की duties, emergency response और Court orders के enforcement को practically लागू करते हैं।
Protection Officers और Service Providers का Public Servant होना
धारा 30 के अनुसार Protection Officer तथा Service Provider के members, जब वे DV Act, Rules अथवा Court orders के अंतर्गत कार्य कर रहे हों या ऐसा करने का दावा करते हुए कार्य कर रहे हों, public servants माने जाएंगे।
यह status उनके प्रत्येक निजी या असंबंधित कार्य को public service में परिवर्तित नहीं करता। यह statutory protection और accountability उस कार्य से जुड़ी है जो वे Act, Rules या orders के अनुसार discharge करते हैं। [DV Act s.30]
इस provision का practical महत्व इसलिए है क्योंकि Protection Officer DV proceedings में केवल एक administrative intermediary नहीं है। वह complaint, Domestic Incident Report, Magistrate के orders, medical assistance, shelter, legal aid, police coordination तथा enforcement में statutory role निभाता है।
Rules भी Protection Officer को विस्तृत duties देते हैं। Rule 8 के तहत Protection Officer को aggrieved person को complaint बनाने, Section 12 और Section 23(2) की applications में सहायता करने, Safety Plan तैयार करने, legal aid दिलाने, medical facility तथा shelter तक पहुंचाने और police तथा service providers के बीच liaison करने का दायित्व दिया गया है।
Protection Order के Breach की Criminal Liability
धारा 31 Chapter V का सबसे महत्वपूर्ण penal provision है।
यदि respondent Protection Order अथवा Interim Protection Order का breach करता है, तो वह DV Act के अंतर्गत offence है।
इस offence के लिए punishment है:
एक वर्ष तक का imprisonment, अथवा ₹20,000 तक fine, अथवा दोनों।

इसका महत्वपूर्ण point यह है कि Section 31 केवल उस conduct को punish करता है जो Court द्वारा दिए गए Protection Order या Interim Protection Order का breach हो। हर domestic violence अपने-आप Section 31 का offence नहीं बनती; Section 31 के लिए protection/interim protection order और उसके breach का प्रश्न सामने आता है।
Section 31 की Trial Jurisdiction
धारा 31(2) के अनुसार Section 31(1) का offence, as far as practicable, उसी Magistrate द्वारा try किया जाना चाहिए जिसने वह Protection Order pass किया था जिसका breach alleged है। [DV Act s.31(2)]
इस व्यवस्था का उद्देश्य continuity और effective enforcement है। जिस Magistrate ने original protection order pass किया है, वही उसके terms और alleged breach के context से परिचित होता है।
Section 31 और अन्य Criminal Offences
धारा 31(3) Magistrate को यह power देता है कि Section 31 के charge को frame करते समय, यदि facts disclose करते हैं कि अन्य offence भी committed हुआ है, तो Magistrate उस offence का charge भी frame कर सकता है।
Original Act में इसके लिए विशेष रूप से Section 498A IPC, IPC की अन्य provisions तथा Dowry Prohibition Act, 1961 का reference दिया गया है। [DV Act s.31(3)]
इसका practical effect यह है कि protection order का breach और उसी factual transaction से उत्पन्न अन्य criminal offence अलग-अलग legal consequences पैदा कर सकते हैं।
Breach के लिए Cognizable और Non-Bailable Offence
धारा 32 Section 31 offence को विशेष criminal character देती है।
Section 31(1) का offence, CrPC में किसी विपरीत provision के बावजूद, cognizable और non-bailable है। [DV Act s.32(1)]
अर्थात Protection Order के breach को legislature ने केवल civil disobedience की तरह नहीं माना है बल्कि उसे statutory criminal offence बनाया है।
Aggrieved Person की Sole Testimony
धारा 32(2) अत्यंत महत्वपूर्ण evidentiary provision है।
Court केवल aggrieved person की sole testimony के आधार पर यह conclude कर सकता है कि Section 31(1) का offence accused द्वारा committed हुआ है। [DV Act s.32(2)]
इसका अर्थ यह नहीं है कि conviction automatically हो जाएगी। इसका अर्थ यह है कि कानून में ऐसा कोई mandatory rule नहीं है कि Section 31 breach साबित करने के लिए aggrieved person की testimony के अतिरिक्त independent witness अनिवार्य हो।
यदि aggrieved person की testimony Court को विश्वसनीय और पर्याप्त लगती है, तो वह अकेले testimony के आधार पर finding दे सकता है।
Rule 15 — Protection Order के Breach की Procedure
Protection of Women from Domestic Violence Rules, 2006 में Rule 15 Section 31 और 32 को practically implement करने वाला सबसे महत्वपूर्ण rule है।
यदि Protection Order अथवा Interim Protection Order का breach होता है, तो aggrieved person Protection Officer को इसकी report कर सकती है।
Rule 15(2) के अनुसार breach की report written और duly signed होनी चाहिए।
Protection Officer को breach complaint की copy और जिस Protection Order का breach alleged है उसकी copy concerned Magistrate को appropriate orders के लिए forward करनी होती है।
लेकिन aggrieved person केवल Protection Officer तक सीमित नहीं है। यदि वह चाहती है तो breach की complaint directly Magistrate या Police को भी दे सकती है। [DV Rules, 2006, Rule 15(4)]
यह महत्वपूर्ण statutory choice है।
Breach के बाद Protection Officer की Immediate Assistance
यदि Protection Order breach होने के बाद aggrieved person Protection Officer की assistance मांगती है, तो Protection Officer को local police station से सहायता लेकर उसे immediately rescue करने तथा appropriate cases में local police authorities के समक्ष report lodge कराने में सहायता करनी है। [DV Rules, 2006, Rule 15(5)]
इस provision को Rule 8 के broader duty framework के साथ पढ़ना चाहिए, जिसके अनुसार Protection Officer को aggrieved person और children को victimisation अथवा pressure से बचाने के लिए all possible assistance देनी है।
Breach और अन्य Criminal Case की Separate Trial
Rule 15(6) एक practical procedural situation को address करता है।
यदि Section 31 के साथ Section 498A IPC अथवा कोई अन्य ऐसा offence भी charged है जो summarily triable नहीं है, तो Court उन offences की trial को applicable criminal procedure के अनुसार अलग कर सकता है और Section 31 breach को summary procedure के अनुसार try कर सकता है। [DV Rules, 2006, Rule 15(6)]
Uploaded 2006 Rules में इस संदर्भ में CrPC और IPC की terminology प्रयुक्त है, क्योंकि Rules notification के समय वही statutory framework लागू था।
Resistance to Enforcement भी Breach
Rule 15(7) बहुत महत्वपूर्ण है।
Court के order को enforce करने में respondent या उसके behalf पर act करने वाले किसी अन्य person द्वारा resistance को भी Protection Order अथवा Interim Protection Order का breach माना जाएगा। [DV Rules, 2006, Rule 15(7)]
इसका practical significance यह है कि केवल original prohibited act ही नहीं, बल्कि Court के protective order के enforcement में बाधा डालना भी Rule 15 के framework में breach बन सकता है।
Police को Immediate Reporting
Rule 15(8) के अनुसार Protection Order अथवा Interim Protection Order का breach immediately local police station को report किया जाना है और इसे Sections 31 और 32 के अनुसार cognizable offence के रूप में deal किया जाना है।
इसलिए Section 31 और Rule 15 को साथ पढ़ने पर enforcement mechanism इस प्रकार बनता है: Court order → alleged breach → Protection Officer/Police/Magistrate को report → criminal proceedings under Section 31.
Bail के समय Protective Conditions
Rule 15(9) Court को bail देते समय aggrieved person की safety और accused की Court में presence सुनिश्चित करने के लिए protective conditions impose करने की अनुमति देता है।
ऐसी conditions में respondent को domestic violence करने या threat देने से रोकना, aggrieved person को harass या telephone/contact करने से रोकना, residence से दूर रहने का direction, firearm अथवा dangerous weapon की possession/use पर restraint और alcohol/drugs के consumption पर restraint जैसी conditions शामिल हो सकती हैं।
यह provision Section 31 prosecution के साथ-साथ victim-protection को भी maintain करता है।
Protection Officer की Duty में Failure
धारा 33 Protection Officer की statutory accountability तय करती है।
यदि Protection Officer, बिना sufficient cause, Magistrate द्वारा Protection Order में directed duties को discharge करने में fail या refuse करता है, तो उसे:
एक वर्ष तक imprisonment, अथवा ₹20,000 तक fine, अथवा दोनों
की punishment हो सकती है। [DV Act s.33]
यह Section 31 से fundamentally अलग है।
Section 31 में respondent द्वारा Court order का breach punish होता है।
Section 33 में Protection Officer द्वारा assigned statutory duty का failure/refusal punish होता है।
Protection Officer के विरुद्ध Prosecution के लिए Previous Sanction
धारा 34 Protection Officer को एक procedural safeguard देती है।
Protection Officer के विरुद्ध prosecution अथवा कोई अन्य legal proceeding तभी लाई जा सकती है जब State Government या उसके द्वारा authorised officer की previous sanction के साथ complaint filed हो। [DV Act s.34]
इस provision को Section 33 के साथ पढ़ना आवश्यक है। Section 33 accountability देता है, जबकि Section 34 prosecution initiate करने से पहले statutory sanction requirement रखता है।
Good Faith में किए गए कार्यों की Protection
धारा 35 के अनुसार Protection Officer के विरुद्ध किसी damage के लिए suit, prosecution अथवा अन्य legal proceeding नहीं होगी यदि वह कार्य:
good faith में किया गया हो, या
good faith में किया जाना intended हो, और वह Act, Rules अथवा order के अंतर्गत किया गया हो। [DV Act s.35]
इस protection का आधार “good faith” है। इसलिए Section 35 को Protection Officer के लिए blanket immunity के रूप में नहीं पढ़ा जाना चाहिए; statutory language स्वयं good faith और Act/Rules/order के connection पर आधारित है।
Act का अन्य Laws के साथ संबंध
धारा 36 का principle अत्यंत महत्वपूर्ण है।
DV Act की provisions किसी अन्य लागू कानून के provisions के स्थान पर नहीं हैं बल्कि उनके अतिरिक्त हैं।
अर्थात DV Act generally अन्य statutory remedies को exclude नहीं करता। [DV Act s.36]
इसी principle को Chapter IV की Section 26 के साथ पढ़ने पर स्पष्ट होता है कि aggrieved person DV Act के reliefs के साथ अन्य civil, family अथवा criminal proceedings में उपलब्ध remedies भी pursue कर सकती है। [DV Act ss.26, 36]
Kunapareddy @ Nookala Shanka Balaji v. Kunapareddy Swarna Kumari, 2016, Supreme Court में Supreme Court ने DV Act की remedial character और उसके protective purpose को महत्वपूर्ण माना है। Court ने proceedings को rigidly ordinary criminal prosecution के रूप में treat करने के बजाय Act के protective object को प्रभावी बनाने वाली procedural approach को स्वीकार किया। [Kunapareddy, 2016, Supreme Court]
Rules बनाने की Central Government की Power
धारा 37 Central Government को notification द्वारा Act को implement करने के लिए Rules बनाने की power देती है। [DV Act s.37(1)]
Section 37(2) specifically बताता है कि Rules किन matters के लिए बनाए जा सकते हैं।
इसमें Protection Officer की qualifications और experience, terms and conditions of service, Domestic Incident Report का form और manner, Protection Officer की applications और complaints, Service Providers का registration, Section 12 application का prescribed form, notice की service, declaration of service, Counsellor की qualifications और Section 23(2) affidavit का form शामिल हैं। [DV Act s.37(2)]
इसी statutory power के आधार पर Central Government ने Protection of Women from Domestic Violence Rules, 2006 notify किए। Rules 26 October 2006 से लागू हुए।
Chapter V के साथ जुड़े महत्वपूर्ण Rules
Chapter V को Rules के साथ पढ़ते समय Rule 8 महत्वपूर्ण है क्योंकि यह Protection Officer की statutory functions को operationalise करता है। इसमें complaint और applications में assistance, Safety Plan, legal aid, medical aid, shelter, police coordination और victimisation से protection जैसी duties हैं।
Rule 9 emergency situations में immediate police assistance का mechanism देता है। यदि Protection Officer या Service Provider को telephone, e-mail अथवा अन्य माध्यम से reliable information मिलती है कि domestic violence हो रही है या likely है, तो police की immediate assistance लेकर place of occurrence पर जाना और DIR तैयार करके Magistrate को appropriate orders के लिए प्रस्तुत करना है।
Rule 10 Court के direction पर Protection Officer को home visit, preliminary inquiry, assets/emoluments/bank accounts की report, personal effects/stridhan की restoration, child custody और Court orders के enforcement में सहायता करने की power/duty देता है।
Rule 15 Chapter V का सबसे direct enforcement rule है, क्योंकि यह Protection Order और Interim Protection Order के breach की reporting, police assistance, cognizable treatment, enforcement resistance और bail conditions को specifically regulate करता है।
Chapter V और Section 31 का मूल अंतर
Chapter V को समझने के लिए तीन अलग-अलग liabilities को अलग रखना आवश्यक है।
Respondent की liability तब आती है जब वह Protection Order या Interim Protection Order का breach करता है। यह Section 31 का offence है और Section 32 के कारण cognizable तथा non-bailable है। [DV Act ss.31–32]
Protection Officer की liability तब आती है जब वह Magistrate के Protection Order में directed duty को sufficient cause के बिना discharge करने में fail या refuse करता है। यह Section 33 के अंतर्गत punishable है। [DV Act s.33]
Protection Officer की procedural protection Section 34 और Section 35 में है—Section 34 previous sanction की requirement रखता है और Section 35 good-faith statutory action को protection देता है।
Supreme Court के Leading Principles
Kunapareddy @ Nookala Shanka Balaji v. Kunapareddy Swarna Kumari, 2016, Supreme Court — DV Act का protective और remedial character महत्वपूर्ण है; proceedings को Act के उद्देश्य को प्रभावी बनाने वाली procedural approach के साथ समझना चाहिए।

Chapter V के Sections 30–37 में Section 31 और Section 32 सबसे महत्वपूर्ण penal provisions हैं, जबकि Section 33 Protection Officer की accountability, Sections 34–35 statutory safeguards, Section 36 concurrent remedies, और Section 37 Rules बनाने की enabling provision है। Rules में इन provisions का practical enforcement मुख्यतः Rules 8, 9, 10 और विशेष रूप से Rule 15 के माध्यम से होता है।
