अध्याय IV — राहत के आदेश प्राप्त करने की प्रक्रिया
Protection of Women from Domestic Violence Act, 2005 का Chapter IV धारा 12 से धारा 29 तक है। यह Chapter DV Act की वास्तविक remedial machinery है, जिसमें Magistrate के समक्ष application, notice, counselling, residence, protection, monetary relief, custody, compensation, interim/ex parte orders, jurisdiction, procedure और appeal की व्यवस्था की गई है।
Protection of Women from Domestic Violence Rules, 2006 में Chapter IV से विशेष रूप से Rule 6, Rule 7, Rule 12, Rule 13 और Rule 14 महत्वपूर्ण हैं। इनके साथ Form II, Form III और Form VII का विशेष महत्व है।
धारा 12 — Magistrate के समक्ष Application
धारा 12 के अंतर्गत aggrieved person, Protection Officer अथवा aggrieved person की ओर से कोई अन्य व्यक्ति Magistrate के समक्ष application प्रस्तुत कर सकता है और Act के अंतर्गत एक या अधिक reliefs मांग सकता है।
इस application में Protection Order under Section 18, Residence Order under Section 19, Monetary Relief under Section 20, Custody Order under Section 21, Compensation under Section 22 तथा Interim/Ex parte relief under Section 23 मांगे जा सकते हैं। Rules में Form II में इन reliefs को अलग-अलग specify करने की व्यवस्था है।
Domestic Incident Report का महत्व
धारा 12 के proviso के अनुसार Magistrate application पर कोई order पारित करने से पहले Protection Officer अथवा Service Provider से प्राप्त Domestic Incident Report को consideration में लेगा।
लेकिन इसका अर्थ यह नहीं है कि aggrieved person की Section 12 application केवल DIR होने पर ही maintainable है। Supreme Court ने DV Act की remedial scheme को व्यापक रूप से समझाया है और Section 12 application को statutory relief mechanism माना है। [Shaurabh Kumar Tripathi v. Compensation और Damages
Section 12(2) के तहत compensation/damages की relief मांगी जा सकती है और यह अलग से compensation/damages suit के अधिकार को समाप्त नहीं करती। यदि किसी अन्य court ने compensation/damages का decree दे दिया है, तो DV Act के तहत मिलने वाली राशि का appropriate set-off किया जाएगा। [DV Act s.12(2)]
Hearing और Disposal
Magistrate को application प्राप्त होने के बाद first date of hearing सामान्यतः तीन दिनों से अधिक आगे नहीं रखनी चाहिए और application को first hearing से 60 दिनों के भीतर dispose करने का endeavour करना है। [DV Act s.12(4)-(5)]
Rule 6 — Form II
Rule 6 के अनुसार Section 12 की application Form II या उसके यथासंभव निकट होगी। Aggrieved person Protection Officer की सहायता से application तैयार कर सकती है। यदि वह illiterate है, तो Protection Officer application को पढ़कर उसकी सामग्री समझाएगा। Section 23(2) के affidavit के लिए Form III prescribed है।
Form II में protection, residence, monetary, custody और compensation reliefs के साथ previous litigation और आवश्यक assistance का विवरण भी लिया जाता है।
धारा 13 — Notice की Service
Section 12 application पर hearing date तय होने के बाद Magistrate उस date की notice Protection Officer को देगा।
Protection Officer को prescribed manner में notice respondent तथा Magistrate द्वारा directed किसी अन्य व्यक्ति पर serve करानी होती है।
यह service सामान्यतः notice प्राप्त होने से दो दिनों के भीतर होनी चाहिए, अथवा Magistrate द्वारा दी गई reasonable further time के भीतर। Protection Officer की declaration of service, contrary proved होने तक, service का proof मानी जाती है। [DV Act s.13]
Rule 12 — Notice की Service
Rule 12 के अनुसार notice में alleged domestic violence करने वाले व्यक्ति का नाम, domestic violence की nature तथा identification में सहायक अन्य details होनी चाहिए।
Notice Protection Officer अथवा उसके द्वारा authorised व्यक्ति respondent के ordinarily residing address अथवा gainful employment के address पर serve कर सकता है। Notice responsible person को दिया जा सकता है और ऐसा संभव न होने पर premises के conspicuous place पर paste किया जा सकता है।
Rule 12 यह भी अनुमति देता है कि service के लिए, as far as practicable, Order V CPC अथवा Chapter VI CrPC की procedure अपनाई जाए। Court proceedings को expedite करने के लिए additional directions भी दे सकता है।
Form VII
Rules में Form VII Section 13(1) के notice का prescribed format है। इसमें respondent को Court के समक्ष निर्धारित date और time पर personally अथवा duly authorised counsel के माध्यम से उपस्थित होने और relief के विरुद्ध show cause करने के लिए कहा जाता है। अनुपस्थिति की स्थिति में Court ex parte proceed कर सकता है।
धारा 14 — Counselling
Magistrate proceedings के किसी भी stage पर respondent या aggrieved person को, अकेले या jointly, counselling के लिए direct कर सकता है।
Counselling Service Provider के ऐसे member द्वारा की जानी चाहिए जिसके पास prescribed qualification और counselling experience हो।
यदि counselling का direction दिया गया है, तो Magistrate को next date सामान्यतः दो महीने से अधिक आगे नहीं रखनी चाहिए। [DV Act s.14]
Rule 13 — Counsellor की Appointment
Protection Officer द्वारा forwarded available Counsellors की list में से Counsellor नियुक्त किया जा सकता है।
ऐसा व्यक्ति Counsellor नहीं बन सकता जो dispute से interested या connected हो, parties से related हो, अथवा respondent की ओर से उसी या connected proceedings में legal practitioner के रूप में appear कर चुका हो, जब तक prescribed written waiver न हो।
जहाँ तक possible हो Counsellor महिला होनी चाहिए। [DV Rules, 2006, Rule 13]
Rule 14 — Counselling की Procedure
Counsellor Court अथवा Protection Officer की general supervision में काम करता है।
Counselling का उद्देश्य केवल “समझौता कराना” नहीं है। Rules के अनुसार इसका प्रमुख उद्देश्य यह assurance प्राप्त करना है कि domestic violence दोबारा न हो।
Respondent से undertaking ली जा सकती है कि वह domestic violence नहीं करेगा और appropriate cases में aggrieved person से मिलने अथवा telephone, letter, e-mail या अन्य माध्यम से communication नहीं करेगा, सिवाय counselling proceedings अथवा lawfully permitted communication के।
यदि aggrieved person चाहती है तो Counsellor settlement के प्रयास कर सकता है। Settlement का focus aggrieved person की grievances को समझना और उनके उचित redressal के measures विकसित करना होना चाहिए।
Counsellor को Indian Evidence Act, CPC या CrPC से उसी प्रकार bound नहीं किया गया है; उसे fairness और justice के principles के अनुसार कार्य करना है और report Magistrate को expeditiously देनी है।
यदि settlement हो जाता है तो terms record करके parties से endorse कराए जाते हैं। यदि settlement नहीं होता, तो Counsellor failure report Court को देता है और Court Act के अनुसार proceedings आगे बढ़ाता है। [DV Rules, 2006, Rule 14]
धारा 15 — Welfare Expert की Assistance
Magistrate किसी भी proceeding में अपनी functions discharge करने के लिए किसी welfare expert की services ले सकता है।
ऐसा person preferably woman हो सकता है और वह aggrieved person से related हो या unrelated। Family welfare promotion से जुड़े व्यक्ति की services भी ली जा सकती हैं। [DV Act s.15]
इस provision का उद्देश्य Magistrate को केवल adversarial litigation के दृष्टिकोण से नहीं बल्कि domestic violence के social, familial और welfare dimensions को समझने में assistance देना है।
धारा 16 — In Camera Proceedings
यदि circumstances warrant करते हैं और किसी भी party को ऐसी आवश्यकता महसूस होती है, तो Magistrate proceedings को in camera कर सकता है। [DV Act s.16]
Domestic violence proceedings में privacy और dignity को देखते हुए यह provision विशेष महत्व रखता है।
धारा 17 — Shared Household में रहने का अधिकार
Section 17 DV Act का अत्यंत महत्वपूर्ण substantive right है।
Domestic relationship में प्रत्येक woman को shared household में रहने का अधिकार है, चाहे उसके पास उस house में कोई:
right, title या beneficial interest हो या न हो।
Aggrieved person को respondent द्वारा shared household से evict अथवा exclude नहीं किया जा सकता, सिवाय procedure established by law के। [DV Act s.17]
Satish Chander Ahuja का सिद्धांत
Satish Chander Ahuja v. Sneha Ahuja, 2020, Supreme Court में Supreme Court ने Section 2(s) के “shared household” concept की व्यापक व्याख्या की और S.R. Batra v. Taruna Batra की restrictive interpretation को सही law नहीं माना। Court ने स्पष्ट किया कि shared household केवल ऐसा घर नहीं है जिसमें husband का ownership/share हो। [Satish Chander Ahuja, 2020, Supreme Court]
Prabha Tyagi का सिद्धांत
Prabha Tyagi v. Kamlesh Devi, 2022, Supreme Court में Court ने Section 17(1) और Section 19 के scope को व्यापक रूप से समझाया। Court ने माना कि woman का Section 17 का right केवल इस आधार पर समाप्त नहीं हो जाता कि जिस व्यक्ति के विरुद्ध relief मांगी गई है, उसके साथ वह उस समय physically residing नहीं थी। [Prabha Tyagi, 2022, Supreme Court] (Live Law)
धारा 18 — Protection Order
Magistrate, aggrieved person और respondent को hearing का opportunity देने के बाद, यदि prima facie satisfied है कि domestic violence हुई है या होने की संभावना है, तो Protection Order pass कर सकता है। [DV Act s.18]
Protection Order द्वारा respondent को domestic violence करने से रोका जा सकता है।
उसे domestic violence में aid या abet करने से रोका जा सकता है।
उसे aggrieved person के workplace में प्रवेश करने से रोका जा सकता है तथा यदि aggrieved person child है तो school अथवा उस स्थान पर जाने से रोका जा सकता है जहाँ वह ordinarily जाती है।
Respondent को personal, oral, written, electronic अथवा telephone communication करने से रोका जा सकता है।
Respondent को jointly held assets, bank lockers, bank accounts, stridhan अथवा अन्य property को Magistrate की permission के बिना alienate करने से रोका जा सकता है।
Aggrieved person के dependants, relatives या उसकी सहायता करने वाले persons के विरुद्ध violence करने से भी respondent को रोका जा सकता है। [DV Act s.18(a)-(g)]
Form II में Section 18 के लिए इसी प्रकार के reliefs को specifically seek करने की व्यवस्था है।
धारा 19 — Residence Orders
Section 19 Magistrate को shared household के संबंध में विस्तृत protective powers देता है।
Magistrate respondent को aggrieved person को shared household से dispossess करने या उसकी possession disturb करने से रोक सकता है।
Magistrate respondent को shared household से remove होने का direction दे सकता है।
Respondent अथवा उसके relatives को उस portion में प्रवेश करने से रोका जा सकता है जहाँ aggrieved person रहती है।
Shared household को alienate, dispose अथवा encumber करने पर restraint लगाया जा सकता है।
Respondent को shared household में अपने rights renounce करने से रोका जा सकता है।
Circumstances warrant करने पर respondent को समान level की alternate accommodation secure करने अथवा उसका rent pay करने का direction दिया जा सकता है। Section 19(1)(b) के तहत किसी woman के विरुद्ध respondent को shared household से remove करने का order नहीं दिया जा सकता। [DV Act s.19]
Magistrate safety के लिए additional conditions लगा सकता है और respondent से bond with or without sureties भी execute करा सकता है। Police को order implement करने में सहायता करने का direction भी दिया जा सकता है। Stridhan अथवा अन्य property वापस करने का direction भी Section 19(8) के तहत दिया जा सकता है।
Satish Chander Ahuja v. Sneha Ahuja, 2020, Supreme Court Section 19 के residence relief को समझने का leading authority है। Supreme Court ने स्पष्ट किया कि DV Act का shared household concept ownership-centric नहीं है।
धारा 20 — Monetary Reliefs
Section 20 के तहत Magistrate domestic violence के परिणामस्वरूप aggrieved person और उसके children को हुए expenses और losses को पूरा करने के लिए monetary relief दे सकता है। [DV Act s.20]
इसमें loss of earnings, medical expenses, property destruction/damage/removal से हुई loss तथा aggrieved person और children की maintenance शामिल हो सकती है।
Maintenance Section 125 CrPC के order के अतिरिक्त भी हो सकती है। [DV Act s.20(1)(d)]
Monetary relief adequate, fair and reasonable होना चाहिए और उस standard of living के consistent होना चाहिए जिसकी aggrieved person accustomed थी। Magistrate lump sum अथवा monthly payment का order कर सकता है।
यदि respondent monetary relief का payment नहीं करता, तो Magistrate respondent के employer अथवा debtor को उसके wages, salary अथवा debt में से appropriate amount सीधे aggrieved person को देने अथवा Court में deposit करने का direction दे सकता है। [DV Act s.20(6)]
Rajnesh v. Neha
Rajnesh v. Neha, 2020, Supreme Court maintenance adjudication में disclosure of assets and liabilities, overlapping maintenance proceedings, quantum और enforcement के लिए महत्वपूर्ण leading judgment है। DV Act के Section 20 monetary relief को अन्य maintenance remedies के साथ पढ़ते समय Supreme Court के directions अत्यंत महत्वपूर्ण हैं। [Rajnesh v. धारा 21 — Custody Orders
Magistrate proceedings के किसी भी stage पर child या children की temporary custody aggrieved person अथवा उसकी ओर से application करने वाले व्यक्ति को दे सकता है।
Respondent के visitation rights भी Court specify कर सकता है।
लेकिन यदि Magistrate को लगता है कि respondent की visit child के हित के लिए harmful होगी, तो ऐसी visitation refuse की जानी चाहिए। [DV Act s.21]
Form II में Section 21 के तहत child की custody aggrieved person को देने की specific prayer उपलब्ध है।
धारा 22 — Compensation Orders
Section 22 के अंतर्गत Magistrate अन्य reliefs के अतिरिक्त respondent को compensation और damages देने का order कर सकता है।
यह compensation domestic violence से हुई injuries, mental torture और emotional distress के लिए भी दी जा सकती है। [DV Act s.22]
इसलिए Section 20 और Section 22 में महत्वपूर्ण distinction है। Section 20 मुख्यतः expenses और losses की monetary relief से संबंधित है, जबकि Section 22 injury, mental torture और emotional distress के लिए compensation/damages पर केंद्रित है।
धारा 23 — Interim और Ex Parte Orders
Section 23(1) Magistrate को किसी भी proceeding में interim order pass करने की power देता है। [DV Act s.23(1)]
Section 23(2) के तहत यदि application prima facie disclose करती है कि respondent domestic violence कर रहा है, कर चुका है अथवा domestic violence करने की likelihood है, तो Magistrate aggrieved person के affidavit के आधार पर ex parte order pass कर सकता है।
यह ex parte order Sections 18, 19, 20, 21 और 22 के reliefs के संबंध में हो सकता है। [DV Act s.23(2)]
Rule 7 — Affidavit
Rule 7 के अनुसार Section 23(2) के ex parte order के लिए affidavit Form III में filed किया जाता है। Form III में applicant domestic violence के repetition की apprehension, respondent की threats और urgent relief की आवश्यकता को affirm कर सकती है।
Rule 10 और Ex Parte Assistance
यदि Magistrate आवश्यक समझे तो Protection Officer को shared household का home visit, preliminary inquiry, assets/bank accounts/emoluments की report, stridhan/personal effects की restoration और custody-related assistance के लिए direct कर सकता है। [DV Rules, 2006, Rule 10]
धारा 24 — Orders की Free Copies
Magistrate द्वारा Act के अंतर्गत order pass किए जाने पर उसकी copy free of cost parties को दी जानी है।
Copy concerned police station के officer-in-charge को और jurisdiction में स्थित Service Provider को भी दी जाती है। यदि Service Provider ने DIR register की है, तो उसे भी copy दी जानी है। [DV Act s.24]
धारा 25 — Duration, Alteration और Revocation
Section 18 का Protection Order तब तक force में रहता है जब तक aggrieved person discharge के लिए application नहीं करती। [DV Act s.25(1)]
यदि circumstances में change हो गया है और order को alter, modify या revoke करने की आवश्यकता है, तो aggrieved person या respondent application कर सकता है।
Magistrate को reasons record करके appropriate alteration, modification या revocation का order करना होता है। [DV Act s.25(2)]
Rules में भी यह महत्वपूर्ण safeguard है कि Court Section 25 का order तभी pass करे जब उसे satisfaction हो कि application force, fraud, coercion अथवा अन्य improper factor से vitiated नहीं है और reasons लिखित रूप में record किए जाएँ। [DV Rules, 2006, Rule 14]
धारा 26 — अन्य Suits और Legal Proceedings में Relief
Section 26 का बहुत व्यापक practical महत्व है।
Sections 18, 19, 20, 21 और 22 के reliefs केवल DV Act की Section 12 proceeding तक सीमित नहीं हैं। ये reliefs किसी pending legal proceeding में:
Civil Court, Family Court अथवा Criminal Court
के समक्ष भी मांगे जा सकते हैं, यदि वह proceeding aggrieved person और respondent को affect करती है। [DV Act s.26]
ये reliefs अन्य available reliefs के addition to and along with भी मांगे जा सकते हैं।
यदि किसी अन्य proceeding में aggrieved person ने कोई relief प्राप्त किया है, तो उसे Magistrate को इसकी जानकारी देना आवश्यक है। [DV Act s.26(2)-(3)]
Shaurabh Kumar Tripathi का महत्वपूर्ण clarification
Shaurabh Kumar Tripathi v. Vidhi Rawal, 2025, Supreme Court ने स्पष्ट किया कि Section 26 अन्य Courts को Sections 18–22 के reliefs देने की अनुमति देता है, लेकिन Section 26 उन Courts को स्वतंत्र Section 12 application entertain करने की jurisdiction नहीं देता। Section 12 की jurisdiction Section 27 के अनुसार Judicial Magistrate First Class अथवा Metropolitan Magistrate के पास रहती है। [Shaurabh Kumar Tripathi, 2025, Supreme Court]
धारा 27 — Territorial Jurisdiction
Section 27 के तहत competent Court है:
Judicial Magistrate First Class अथवा Metropolitan Magistrate
जिसकी local limits में aggrieved person permanently या temporarily reside करती है, business करती है या employed है; अथवा respondent reside, business या employment करता है; अथवा cause of action wholly या partly arise हुआ है। [DV Act s.27]
इसका विशेष महत्व यह है कि aggrieved woman को केवल matrimonial home के स्थान पर जाकर proceedings initiate करने के लिए बाध्य नहीं किया जाता।
Section 27(2) के अनुसार Act के अंतर्गत बनाया गया order पूरे भारत में enforceable है।
Shaurabh Kumar Tripathi v. Vidhi Rawal, 2025, Supreme Court में Supreme Court ने Section 27 के jurisdictional scheme को स्पष्ट करते हुए कहा कि Section 12 application entertain करने की jurisdiction JMFC/Metropolitan Magistrate के पास है।
धारा 28 — Procedure
Section 28(1) के अनुसार Sections 12, 18, 19, 20, 21, 22 और 23 की proceedings तथा Section 31 के offences सामान्यतः CrPC के provisions द्वारा governed होंगी।
लेकिन Section 28(2) बहुत महत्वपूर्ण exception देता है।
Court Section 12 application तथा Section 23(2) application के disposal के लिए अपनी procedure lay down कर सकता है।
Kunapareddy का सिद्धांत
Kunapareddy @ Nookala Shanka Balaji v. Kunapareddy Swarna Kumari, 2016, Supreme Court में Supreme Court ने DV Act proceedings को predominantly civil nature का माना और यह स्वीकार किया कि Act की remedial purpose को प्रभावी बनाने के लिए Court को procedural flexibility प्राप्त है। Court ने appropriate circumstances में complaint/application amendment की power को भी स्वीकार किया। [Kunapareddy, 2016, Supreme Court] (Indian Kanoon)
Shaurabh Kumar Tripathi का वर्तमान clarification
2025 में Supreme Court ने स्पष्ट किया कि Section 12 proceedings Magistrate के समक्ष criminal court में चलती हैं और Section 28(2) Court को Section 12 तथा Section 23(2) के disposal के लिए अपनी procedure निर्धारित करने की overriding procedural power देता है।
इसलिए DV Act proceedings को केवल “ordinary criminal complaint” की तरह mechanically treat करना सही नहीं है।
धारा 29 — Appeal
Magistrate द्वारा किए गए order के विरुद्ध Court of Session में appeal lie करती है।
Appeal 30 दिनों के भीतर file की जानी है, जिसकी गणना उस date से होगी जिस date को Magistrate का order aggrieved person अथवा respondent को serve हुआ, जो भी बाद की हो। [DV Act s.29]
इस provision के कारण Chapter IV में Magistrate के आदेश के विरुद्ध statutory appellate remedy उपलब्ध है।
Chapter IV और Rules का आपसी संबंध
Chapter IV को केवल Sections 12–29 पढ़कर पूरी तरह नहीं समझा जा सकता।
Section 12 + Rule 6 + Form II Section 12 application की procedural structure बनाते हैं। Form II में Protection, Residence, Monetary, Custody और Compensation reliefs की prayers शामिल हैं।
Section 13 + Rule 12 + Form VII respondent को notice और service mechanism निर्धारित करते हैं।
Section 14 + Rule 13 + Rule 14 Counsellor की appointment तथा counselling की पूरी procedure निर्धारित करते हैं।
Section 23(2) + Rule 7 + Form III ex parte interim relief के लिए affidavit mechanism निर्धारित करते हैं। Form III में urgency और domestic violence की repetition की apprehension को specifically plead किया जाता है।
Supreme Court के Leading Principles
Kunapareddy @ Nookala Shanka Balaji v. Kunapareddy Swarna Kumari, 2016, Supreme Court — DV Act proceedings predominantly civil nature की हैं और Court को Act की remedial purpose को प्रभावी बनाने के लिए appropriate procedural flexibility प्राप्त है। (Indian Kanoon)
Satish Chander Ahuja v. Sneha Ahuja, 2020, Supreme Court — “shared household” का concept केवल husband के ownership/share वाले घर तक सीमित नहीं है; Section 17 और 19 के residence rights को व्यापक रूप से समझना होगा।

इस प्रकार Chapter IV DV Act का मुख्य remedial chapter है। Section 12 proceeding शुरू करता है, Sections 13–16 fair and protective procedure देते हैं, Sections 17–22 substantive reliefs प्रदान करते हैं, Section 23 immediate interim protection देता है और Sections 24–29 order की implementation, alteration, concurrent remedies, jurisdiction, procedure तथा appeal का framework पूरा करते हैं।
