Protection of Women from Domestic Violence Act, 2005
धारा 1 Chapter I — Preliminary की पहली धारा है। यह धारा तीन मूल बातें निर्धारित करती है—अधिनियम का नाम, उसका territorial extent और उसका commencement। आपके द्वारा उपलब्ध कराई गई मूल Act की प्रति में यही संरचना दी गई है।
धारा 1(1) — Short Title
धारा 1(1) के अनुसार इस अधिनियम का नाम है:
“The Protection of Women from Domestic Violence Act, 2005”
यह Act No. 43 of 2005 है और अधिनियम की enactment date 13 September 2005 है।
Short Title का अर्थ
“Short title” का उद्देश्य किसी कानून को उसके आधिकारिक संक्षिप्त नाम से identify करना है। इसलिए legal pleadings, judgments, applications और अन्य proceedings में इसे Protection of Women from Domestic Violence Act, 2005 अथवा सामान्यतः DV Act, 2005 कहा जाता है।
धारा 1(2) — Extent
धारा 1(2) में कहा गया है कि Act का विस्तार पूरे भारत में है।
मूल Act में इस provision में Jammu and Kashmir के संबंध में exception था। आपके उपलब्ध Act text में footnote स्पष्ट करता है कि “except the State of Jammu and Kashmir” शब्द Act 34 of 2019, Section 95 और Fifth Schedule के माध्यम से 31 October 2019 से omit किए गए।
इसलिए वर्तमान statutory position में DV Act का territorial extent whole of India है। [DV Act s.1(2)]
धारा 1(3) — Commencement
धारा 1(3) कहती है कि Act उस तारीख से लागू होगा जिसे Central Government Official Gazette में notification द्वारा appoint करेगी।
इसका अर्थ है कि Act के enactment और उसके commencement को Act ने अलग-अलग रखा।
Act 13 September 2005 को enacted हुआ, लेकिन धारा 1(3) के अनुसार actual commencement notification के माध्यम से हुआ।
आपके Act की copy के footnote में स्पष्ट है कि commencement date 26 October 2006 थी, जिसे Central Government ने S.O. 1776(E), dated 17 October 2006 द्वारा notify किया।
अतः:

Commencement: 26 October 2006
DV Rules, 2006 के साथ संबंध
DV Act की धारा 1 के commencement के साथ Rules का commencement भी महत्वपूर्ण है।
Protection of Women from Domestic Violence Rules, 2006 का Rule 1(1) Rules का नाम निर्धारित करता है और Rule 1(2) के अनुसार Rules 26 October 2006 से लागू हुए।
इसलिए Act और Rules की practical implementation के लिए 26 October 2006 महत्वपूर्ण commencement date है।
धारा 1 और Section 37 का संबंध
धारा 1 केवल Act के नाम, extent और commencement को निर्धारित करती है। Rules बनाने की authority बाद में Section 37 में दी गई है।
Section 37 के तहत Central Government ने Rules बनाए और इन्हीं के आधार पर Protection Officers, Service Providers, Domestic Incident Report, applications, notices, counselling और अन्य procedural mechanisms prescribed किए गए।
इसलिए statutory structure इस प्रकार है:

धारा 1 का Practical Legal Importance
धारा 1 को केवल introductory provision मानकर छोड़ना उचित नहीं है। इसके तीन अलग-अलग legal consequences हैं।
Short Title यह निर्धारित करता है कि कानून को किस नाम से cite किया जाएगा।
Extent यह निर्धारित करता है कि Act का territorial application कहाँ है।
Commencement यह निर्धारित करता है कि Act statutory रूप से किस तारीख से operative हुआ।
इसलिए किसी DV Act proceeding में “Act कब लागू हुआ?” और “Act कहाँ लागू है?” जैसे प्रारंभिक jurisdictional/statutory questions का उत्तर Section 1 से मिलता है।
Important Dates
13 September 2005 — Protection of Women from Domestic Violence Act, 2005 enacted.
17 October 2006 — Central Government का commencement notification जारी हुआ।
26 October 2006 — DV Act commenced; इसी date से DV Rules, 2006 भी लागू हुए।
31 October 2019 — Jammu and Kashmir वाला exception Section 1(2) से omit हुआ।
