Section 192 BNS 2023 – Wantonly Giving Provocation with Intent to Cause Riot

Section 192 BNS, 2023 उस व्यक्ति की liability से संबंधित है जो जानबूझकर या लापरवाहीपूर्वक किसी illegal act द्वारा ऐसी provocation देता है, जिसका उद्देश्य या knowledge यह हो कि उससे rioting होने की संभावना है। इसमें punishment इस बात पर निर्भर करती है कि उस provocation के परिणामस्वरूप riot वास्तव में हुआ या नहीं।

Statutory Provision

“192. Whoever malignantly, or wantonly by doing anything which is illegal, gives provocation to any person intending or knowing it to be likely that such provocation will cause the offence of rioting to be committed, shall, if the offence of rioting be committed in consequence of such provocation, be punished with imprisonment of either description for a term which may extend to one year, or with fine, or with both; and if the offence of rioting be not committed, with imprisonment of either description for a term which may extend to six months, or with fine, or with both.”

Nature of Section 192

Section 192 का मुख्य उद्देश्य provocation देने वाले व्यक्ति को punish करना है, जब उसका conduct riot को provoke करने के उद्देश्य या knowledge के साथ किया गया हो।

यहाँ दो अलग situations हैं:

Essential Ingredients

Section 192 को लागू करने के लिए निम्न elements महत्वपूर्ण हैं:

Provocation

Accused द्वारा किसी person को provocation दिया जाना चाहिए।

Malignantly or Wantonly

Provocation maliciously या wantonly दिया गया हो।

Illegal Act

Provocation किसी ऐसे act को करके दी गई हो जो illegal है।

Accused:

  • riot cause करने का intention रखता हो; या
  • यह जानता हो कि उसके act से riot होने की संभावना है।

Meaning of “Provocation”

Provocation का सामान्य legal meaning ऐसा conduct है जो किसी व्यक्ति या group को ऐसी प्रतिक्रिया के लिए उकसाता है जिससे riot होने की संभावना उत्पन्न हो।

लेकिन Section 192 में केवल कोई unpleasant, offensive या irritating conduct पर्याप्त नहीं है।

Statutory requirements को collectively देखना होगा:

Illegal act + provocative nature + intention/knowledge regarding likelihood of riot.

इसलिए prosecution को केवल यह नहीं दिखाना चाहिए कि accused ने कोई illegal act किया; उसे यह भी establish करना होगा कि उस act का relevant connection riot को provoke करने से था।

“Malignantly” and “Wantonly”

Section 192 में legislature ने दो महत्वपूर्ण expressions use किए हैं:

Malignantly

इसका संकेत ऐसे conduct की ओर है जिसमें harmful या hostile purpose का element मौजूद हो।

Wantonly

इसका अर्थ ऐसा conduct है जो बिना उचित justification के जानबूझकर किया गया हो और जिसके संभावित consequences की परवाह न की गई हो।

लेकिन किसी particular act को इन expressions के अंतर्गत लाने के लिए circumstances और evidence का assessment आवश्यक होगा। केवल allegation कि accused ने provocation दी थी, अपने आप Section 192 की guilt establish नहीं करता।

Intention or Knowledge

Section 192 में mens rea का विशेष महत्व है।

Statutory language दो alternatives देती है:

“intending or knowing it to be likely”

अर्थात prosecution को establish करना होगा कि accused:

या तो riot cause करने का intention रखता था;

या उसे knowledge था कि उसके act से riot होने की likelihood है।

इसलिए actual riot का occurrence अकेले यह establish नहीं करता कि accused के पास Section 192 में required intention या knowledge भी था।

Circumstances से mens rea infer किया जा सकता है, लेकिन वह inference evidence पर आधारित होना चाहिए।


Riot Must be a Consequence of Provocation

Section 192 में सबसे महत्वपूर्ण causal requirement है:

“if the offence of rioting be committed in consequence of such provocation”

इसका अर्थ है कि जहाँ riot वास्तव में हुआ है, prosecution को provocation और subsequent rioting के बीच causal connection establish करना होगा।

When Rioting is Committed

यदि accused ने qualifying provocation दी और उसी provocation के consequence में rioting committed हुआ, तो maximum punishment:

Imprisonment up to 1 year, or fine, or both.

BNSS First Schedule इसे:

  • Cognizable
  • Bailable
  • Any Magistrate

के रूप में classify करता है। BNSS 2023


When Rioting is Not Committed

यदि accused ने requisite provocation दी लेकिन riot वास्तव में committed नहीं हुआ, तो Section 192 फिर भी offence create करता है।

Maximum punishment:

Imprisonment up to 6 months, or fine, or both.

इसका उद्देश्य केवल completed riot को punish करना नहीं है; बल्कि ऐसी unlawful provocation को भी punish करना है जो riot कराने की requisite intention/knowledge के साथ की गई हो, भले riot ultimately हुआ न हो। BHARATIYA NYAYA SANHITA, 2023

अर्थात:

  • Section 189 → unlawful assembly;
  • Section 190 → common-object based liability;

Difference from Abetment

Section 192 को सामान्य abetment के साथ automatically equate नहीं करना चाहिए।

यह एक specific statutory offence है जो riot को provoke करने वाले particular conduct को separately punish करता है।

इसलिए prosecution को Section 192 के specific statutory ingredients establish करने होंगे।

Illustrative Example

मान लें A जानबूझकर एक unlawful confrontation को provoke करने के उद्देश्य से एक illegal act करता है। A जानता है कि इससे उपस्थित persons में ऐसा reaction हो सकता है जिससे riot हो जाए।

यदि उस provocation के consequence में riot होता है:

Section 192 → punishment up to 1 year.

यदि persons react नहीं करते और riot नहीं होता:

Section 192 → punishment up to 6 months.

लेकिन दोनों situations में prosecution को intention/knowledge तथा statutory causal connection establish करना होगा।


Leading Supreme Court Judgments

पुराने IPC में इसका corresponding provision Section 153 IPC था—“Wantonly giving provocation with intent to cause riot—if rioting be committed; if not committed.”

Section 192 BNS का statutory language उसी subject matter को substantially carry forward करता है।

Conclusion
