Section 194 BNS – Affray: Meaning, Ingredients, Punishment and Legal Position

Section 194 of the Bharatiya Nyaya Sanhita, 2023 (BNS) “affray” अर्थात सार्वजनिक स्थान पर दो या दो से अधिक व्यक्तियों के आपस में लड़ने और उससे public peace disturb होने से संबंधित है। यह Section public tranquillity के विरुद्ध offences की श्रृंखला में आता है।

Statutory Provision

“194. (1) When two or more persons, by fighting in a public place, disturb the public peace, they are said to commit an affray.

(2) Whoever commits an affray, shall be punished with imprisonment of either description for a term which may extend to one month, or with fine which may extend to one thousand rupees, or with both.”

Meaning of Affray

Section 194 के अनुसार Affray तब बनता है जब:

Two or more persons

Fight with each other

Fight takes place in a public place

↓

Public peace is disturbed

↓

इसलिए केवल दो व्यक्तियों के बीच मारपीट होना पर्याप्त नहीं है। Section 194 के लिए लड़ाई का public place में होना और उससे public peace disturb होना आवश्यक statutory ingredients हैं।

Essential Ingredients

Section 194(1) के essential ingredients को इस प्रकार समझा जा सकता है:

इनमें से किसी आवश्यक ingredient के अभाव में Section 194 के तहत affray का offence establish करना कठिन होगा।

Two or More Persons

Statutory language expressly “two or more persons” का प्रयोग करती है।

इसलिए affray के लिए unlawful assembly जैसी five persons की requirement नहीं है।

इसे इस प्रकार याद किया जा सकता है:

Affray → Minimum 2 persons

Unlawful Assembly → Minimum 5 persons

Section 189 BNS में unlawful assembly के लिए पाँच या अधिक persons की requirement है, जबकि Section 194 में दो या अधिक persons का fighting करना पर्याप्त starting point है।

Fighting Must Be Mutual

Affray की statutory concept में “fighting” महत्वपूर्ण शब्द है। इसका सामान्य अर्थ केवल एक व्यक्ति द्वारा दूसरे पर unilateral assault करना नहीं है, बल्कि persons के बीच लड़ाई होना है।

इसलिए प्रत्येक case में यह factual question महत्वपूर्ण होगा कि क्या वास्तव में parties के बीच fighting हुई थी और क्या उस fighting ने public peace को disturb किया।

Public Place

Section 194 specifically कहता है कि fighting “in a public place” होनी चाहिए।

अर्थात केवल private place में दो व्यक्तियों का आपस में लड़ना, यदि public place की statutory condition और public peace disturbance का element स्थापित नहीं होता, तो केवल उस आधार पर Section 194 automatically attract नहीं होगा।

यहाँ “public place” का assessment facts और circumstances के आधार पर किया जाएगा।

Disturbance of Public Peace

यह Section 194 का अत्यंत महत्वपूर्ण ingredient है।

केवल public place में fight होना पर्याप्त नहीं है। Fighting के कारण public peace disturbed होना चाहिए।

Example

मान लीजिए A और B सड़क पर आपस में लड़ते हैं और उनकी लड़ाई से राहगीरों में भय/अशांति उत्पन्न होती है तथा public order/peace disturb होती है।

तो statutory ingredients broadly इस प्रकार होंगे:

इसके विपरीत, यदि fighting public place में हुई ही नहीं, तो Section 194 का specific offence establish नहीं होगा।

Punishment under Section 194(2)

Section 194(2) के तहत affray करने वाले व्यक्ति को:

  • Imprisonment of either description up to 1 month, या

  • Fine up to ₹1,000, या

  • Both

से दंडित किया जा सकता है।

यहाँ imprisonment either description है, अर्थात statutory language के अनुसार imprisonment rigorous या simple imprisonment के रूप में हो सकती है।

Section 194 and Section 191: Important Distinction

Section 194 को Section 191 BNS के साथ confuse नहीं करना चाहिए।

Section 191(1) expressly कहता है कि unlawful assembly या उसके member द्वारा common object के prosecution में force या violence का उपयोग होने पर rioting का offence बनता है।

इसलिए:

5+ persons + unlawful assembly + force/violence → Section 191

जबकि:

2+ persons + fighting + public place + disturbance of public peace → Section 194

Section 194 and Section 193: Difference

Section 193 land owner/occupier तथा संबंधित persons की liability से संबंधित है, जबकि Section 194 actual affray को punish करता है।

यदि इनमें से fighting, public place, अथवा disturbance of public peace का आवश्यक element absent है, तो Section 194 के application पर प्रश्न उठ सकता है।

Key Legal Principle

Section 194 का core principle इस formula से समझा जा सकता है:

“Fighting + Two or More Persons + Public Place + Disturbance of Public Peace = Affray.”

केवल assault और affray समान नहीं हैं। Affray के लिए statutory requirements collectively satisfy होना आवश्यक है।

Conclusion

Section 194 BNS public places में ऐसी आपसी fighting को criminalise करता है जिससे public peace disturb होती है। इसका offence Section 189 की unlawful assembly या Section 191 की rioting से अलग है। Section 194 के लिए विशेष रूप से दो या अधिक persons, fighting, public place और disturbance of public peace को ध्यान में रखना आवश्यक है।

BNSS First Schedule के अनुसार यह cognizable, bailable और Any Magistrate द्वारा triable offence है तथा punishment अधिकतम एक माह का imprisonment, ₹1,000 तक fine, या दोनों है।
