Section 182 BNS, 2023 – Making or Using Documents Resembling Currency-Notes or Bank-Notes
Section 182 Bharatiya Nyaya Sanhita, 2023 ऐसे दस्तावेजों के निर्माण, उपयोग या वितरण को दंडित करता है जो currency-note या bank-note जैसे दिखाई देते हैं और जिनसे deception हो सकती है। इसमें printer/person responsible के नाम का खुलासा न करने तथा statutory presumption का भी प्रावधान है।
Statutory Provision
“182. (1) Whoever makes, or causes to be made, or uses for any purpose whatsoever, or delivers to any person, any document purporting to be, or in any way resembling, or so nearly resembling as to be calculated to deceive, any currency-note or bank-note shall be punished with fine which may extend to three hundred rupees.
(2) If any person, whose name appears on a document the making of which is an offence under sub-section (1), refuses, without lawful excuse, to disclose to a police officer on being so required the name and address of the person by whom it was printed or otherwise made, he shall be punished with fine which may extend to six hundred rupees.
(3) Where the name of any person appears on any document in respect of which any person is charged with an offence under sub-section (1) or on any other document used or distributed in connection with that document it may, until the contrary is proved, be presumed that the person caused the document to be made.”

Nature and Object of Section 182
इस Section का उद्देश्य वास्तविक currency-note या bank-note की नकल/सदृश दस्तावेजों के कारण जनता में deception की संभावना को रोकना है।
यह ध्यान रखना महत्वपूर्ण है कि Section 182 का अपराध आवश्यक रूप से counterfeit currency बनाने का अपराध नहीं है। Section 178 में actual counterfeiting से संबंधित गंभीर अपराध है, जबकि Section 182 ऐसे document को बनाना, उपयोग करना या किसी को देना दंडनीय बनाता है जो currency-note या bank-note जैसा हो और “calculated to deceive” हो।
Section 178 और Section 182 का मूल अंतर: Section 178 वास्तविक coin, Government revenue stamp, currency-note या bank-note को counterfeit करने पर लागू होता है; Section 182 ऐसे document पर केंद्रित है जो currency-note या bank-note जैसा दिखाई देता है।

Meaning of “Resembling” and “Calculated to Deceive”
Section में केवल इतना पर्याप्त नहीं है कि कोई document currency-note से थोड़ा-बहुत मिलता-जुलता हो। Statutory language है:
“so nearly resembling as to be calculated to deceive”
इसका अर्थ यह है कि resemblance का ऐसा स्तर होना चाहिए जिससे document को देखकर किसी व्यक्ति के deceive होने की संभावना हो।
इसलिए किसी सामान्य design, educational specimen या artistic representation और Section 182 के अपराध के बीच factual distinction महत्वपूर्ण हो सकता है। Court को document की appearance, surrounding circumstances, purpose और उसकी संभावित deceptive character को देखना पड़ सकता है।

Acts Covered Under Section 182(1)
Section 182(1) केवल document बनाने तक सीमित नहीं है। इसमें चार अलग-अलग प्रकार के conduct expressly covered हैं:

Section 182(1)अर्थात केवल maker ही नहीं, बल्कि ऐसा document use करने वाला या deliver करने वाला व्यक्ति भी circumstances के अनुसार Section 182(1) के scope में आ सकता है।

Section 182(2) – Failure to Disclose Printer’s Details
Sub-section (2) एक अलग प्रकार का offence बनाता है।
यदि:
किसी document पर किसी व्यक्ति का नाम दिखाई देता है;
उस document का making Section 182(1) के तहत offence है;
police officer उस व्यक्ति से document को print/make करने वाले व्यक्ति का name and address बताने को कहता है; और
वह व्यक्ति without lawful excuse ऐसा disclosure करने से refuse करता है,
तो Section 182(2) लागू हो सकता है।
इसके लिए maximum punishment ₹600 fine है।

Important Point
“Without lawful excuse” शब्द महत्वपूर्ण हैं। इसलिए हर refusal automatically offence नहीं बनता; statutory language स्वयं lawful excuse के लिए exception रखती है।
Section 182(3) – Statutory Presumption
Sub-section (3) evidentiary significance रखता है।
यदि किसी ऐसे document पर किसी व्यक्ति का नाम दिखाई देता है जिसके संबंध में Section 182(1) का charge है, अथवा उस document से connected किसी अन्य used/distributed document पर उसका नाम है, तो:
“it may, until the contrary is proved, be presumed that the person caused the document to be made.”
अर्थात यह rebuttable presumption है।

Cognizable, Bailable and Triable Nature
BNSS First Schedule के अनुसार Section 182 के दोनों punishable parts की classification इस प्रकार है:

BNSS की First Schedule में Section 182(1) को “Making or using documents resembling currency-notes or bank-notes” तथा Section 182(2) को printer का नाम/address disclose करने से refusal के रूप में वर्गीकृत किया गया है।

इस comparison से स्पष्ट है कि Section 182 comparatively अलग factual situation को address करता है—यह necessarily counterfeit currency के possession या circulation का मामला नहीं है।
Supreme Court Judgments
Section 182 BNS, 2023 पर प्रत्यक्ष Supreme Court precedent अभी उपलब्ध statutory-history के संदर्भ में सीमित है। इसका कारण यह भी है कि BNS ने 1 July 2024 से IPC को replace किया है। इसलिए पुराने IPC provision के judgments को comparative/predecessor-law authorities के रूप में देखना चाहिए, न कि उन्हें सीधे BNS Section 182 पर decided case मानना चाहिए।
Section 182 का predecessor provision IPC Section 489E था, जिसका subject matter भी “Making or using documents resembling currency-notes or bank-notes” था। पुराने provision में भी document के currency-note/bank-note से resemblance और deception की language थी।

Supreme Court ने IPC Sections 489A–489E के context में “currency note” और “bank note” की statutory scope पर विचार किया। Court ने माना कि relevant provisions केवल Indian currency तक सीमित नहीं थे और statutory language को उसके व्यापक अर्थ में पढ़ा जाना चाहिए। (Indian Kanoon)
यह judgment Section 182 BNS के हर factual element पर direct authority नहीं है, लेकिन Chapter X के predecessor provisions की interpretation समझने के लिए comparative relevance रखता है।
Important: इस judgment को Section 182 BNS पर direct precedent के रूप में cite नहीं किया जाना चाहिए; इसे IPC predecessor provision के interpretation के लिए cite करना अधिक उचित है।
