Section 181 BNS 2023 – Making, Buying, Selling or Possessing Machinery, Die, Instrument or Material for Counterfeiting
Section 181 of the Bharatiya Nyaya Sanhita, 2023 (BNS) counterfeiting के लिए इस्तेमाल होने वाली machinery, die, instrument या material से संबंधित preparatory conduct को गंभीर अपराध बनाता है। यह Section केवल actual counterfeit currency या stamp बनाने पर नहीं, बल्कि counterfeiting के लिए उपयोग किए जाने वाले साधनों से संबंधित specified acts पर भी लागू होता है।
Statutory Provision
“181. Whoever makes or mends, or performs any part of the process of making or mending, or buys or sells or disposes of, or has in his possession, any machinery, die, or instrument or material for the purpose of being used, or knowing or having reason to believe that it is intended to be used, for forging or counterfeiting any coin, stamp issued by Government for the purpose of revenue, currency-note or bank-note, shall be punished with imprisonment for life, or with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.”

Object of Section 181
Section 181 का उद्देश्य counterfeiting के tools, equipment और materials को criminal law के ambit में लाना है।
इसका scope Section 178 से अलग है:
Section 178 – counterfeit coin, Government revenue stamp, currency-note या bank-note बनाना/counterfeiting process;
Section 181 – ऐसी counterfeiting के लिए machinery, die, instrument या material को बनाना, repair करना, खरीदना, बेचना, dispose करना या possess करना, subject to statutory requirements।

Making
किसी ऐसी machinery, die, instrument या material को make करना, जिसका statutory counterfeiting-purpose connection है, Section 181 के scope में है।

Mending
ऐसी machinery, die, instrument या material को mend करना भी covered है।
अर्थात existing counterfeiting equipment की repair या restoration-type conduct भी statutory provision के ambit में आ सकती है, यदि Section की prescribed purpose/knowledge requirement satisfied हो।

Performing Part of the Process
Section केवल complete making या mending तक सीमित नहीं है।
यदि कोई व्यक्ति:
“performs any part of the process of making or mending”
करता है, तो भी provision लागू हो सकता है।
इसका उद्देश्य counterfeiting equipment की manufacture/repair process में partial participation को भी cover करना है।

Buying
Section 181 में ऐसी machinery, die, instrument या material को buy करना भी expressly covered है।
लेकिन purchase तभी Section 181 के scope में आएगा जब statutory requirement के अनुसार वह counterfeiting के लिए use होने वाला या intended होने वाला हो और prescribed mental element मौजूद हो।

Selling
ऐसे machinery, die, instrument या material को sell करना भी punishable conduct में expressly शामिल है।
यहाँ भी statutory counterfeiting-purpose तथा knowledge/reason to believe का element महत्वपूर्ण है।

Disposing
Section 181 में “disposes of” भी expressly शामिल है।
इसलिए provision केवल sale तक सीमित नहीं है। Counterfeiting-purpose से संबंधित machinery, die, instrument या material को अन्य तरीके से dispose करना भी statutory wording में covered है।

Possession
Section 181 का एक महत्वपूर्ण aspect है:
“has in his possession”
अर्थात specified machinery, die, instrument या material का possession भी offence का basis बन सकता है, यदि Section में prescribed purpose या knowledge/reason to believe मौजूद हो।

Section 181 की wording में दो महत्वपूर्ण alternatives हैं:
“for the purpose of being used”
या
“knowing or having reason to believe that it is intended to be used”

Section 181 and Preparatory Acts
Section 181 की खासियत यह है कि law counterfeiting के final result की प्रतीक्षा नहीं करता।
यदि कोई व्यक्ति prescribed machinery/die/instrument/material के संबंध में Section में expressly mentioned conduct करता है और statutory counterfeiting-purpose/knowledge requirement satisfy होती है, तो conduct independently punishable हो सकता है।

Punishment
Section 181 के तहत punishment:
