Section 178 BNS 2023 – Counterfeiting Coin, Currency-Notes, Bank-Notes and Government Stamps
Section 178 of the Bharatiya Nyaya Sanhita, 2023 (BNS) Chapter X का प्रारंभिक और महत्वपूर्ण provision है। यह coin, Government revenue stamp, currency-note और bank-note की counterfeiting तथा counterfeiting की process के किसी भाग को knowingly करने को गंभीर criminal offence बनाता है।
Statutory Provision
“178. Whoever counterfeits, or knowingly performs any part of the process of counterfeiting, any coin, stamp issued by Government for the purpose of revenue, currency-note or bank-note, shall be punished with imprisonment for life, or with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.
Explanation.—For the purposes of this Chapter,—
(1) the expression “bank-note” means a promissory note or engagement for the payment of money to bearer on demand issued by any person carrying on the business of banking in any part of the world, or issued by or under the authority of any State or Sovereign Power, and intended to be used as equivalent to, or as a substitute for money;
(2) “coin” shall have the same meaning as assigned to it in section 2 of the Coinage Act, 2011 and includes metal used for the time being as money and is stamped and issued by or under the authority of any State or Sovereign Power intended to be so used;
(3) a person commits the offence of “counterfeiting Government stamp” who counterfeits by causing a genuine stamp of one denomination to appear like a genuine stamp of a different denomination;
(4) a person commits the offence of counterfeiting coin who intending to practise deception, or knowing it to be likely that deception will thereby be practised, causes a genuine coin to appear like a different coin; and
(5) the offence of “counterfeiting coin” includes diminishing the weight or alteration of the composition, or alteration of the appearance of the coin.”

Chapter X – Scope
Section 178 से Chapter X शुरू होता है:
“OF OFFENCES RELATING TO COIN, CURRENCY-NOTES, BANK-NOTES, AND GOVERNMENT STAMPS”
इसलिए Section 178 को केवल ordinary forgery provision के रूप में नहीं, बल्कि monetary instruments और Government revenue stamps की authenticity तथा integrity को protect करने वाले special offence के रूप में पढ़ना चाहिए।

Serious criminal offenceइसलिए किसी व्यक्ति द्वारा केवल final counterfeit instrument बनाना ही relevant नहीं है। यदि वह knowingly counterfeiting process के किसी part को perform करता है, तो भी Section 178 लागू हो सकता है।

Meaning of “Bank-Note”
Section 178 की Explanation clause (1) में bank-note की statutory definition दी गई है।
इसके अनुसार bank-note में ऐसा:
promissory note या
engagement for payment of money to bearer on demand
शामिल है, जो:
banking business करने वाले व्यक्ति द्वारा issued हो; या
किसी State/Sovereign Power द्वारा या उसकी authority के तहत issued हो; और
money के equivalent या substitute के रूप में इस्तेमाल किया जाना intended हो।

Meaning of “Coin”
Explanation clause (2) के अनुसार coin का वही meaning है जो Section 2, Coinage Act, 2011 में assigned है।
इसके अतिरिक्त BNS Explanation में coin के संदर्भ में उस metal को भी include किया गया है जो उस समय money के रूप में इस्तेमाल होता है और जिसे किसी State या Sovereign Power द्वारा या उसकी authority के तहत stamp और issue किया गया हो।

Counterfeiting Government Stamp
Section 178 Explanation clause (3) Government stamp के counterfeiting को specifically explain करती है।
यदि कोई व्यक्ति:
genuine Government stamp लेता है;
उसकी denomination को बदलकर;
उसे दूसरी denomination के genuine stamp जैसा appear कराता है,
तो statutory Explanation के अनुसार यह counterfeiting Government stamp है।

Counterfeiting Coin
Explanation clause (4) coin counterfeiting के लिए deception-related mental element बताती है।
यदि कोई व्यक्ति:
deception practise करने के intention से; या
यह जानते हुए कि deception likely है,
किसी genuine coin को किसी different coin जैसा appear कराता है, तो यह counterfeiting coin है।
इसलिए coin counterfeiting में mere physical alteration के साथ Explanation में specified intention/knowledge relating to deception महत्वपूर्ण है।

Diminishing Weight or Altering Composition/Appearance
Explanation clause (5) अत्यंत महत्वपूर्ण है।
“Counterfeiting coin” में केवल coin को किसी दूसरे coin जैसा दिखाना ही शामिल नहीं है। Statutory Explanation expressly कहती है कि counterfeiting coin में निम्न भी शामिल हैं:
coin का weight diminish करना;
उसकी composition alter करना;
उसकी appearance alter करना।

Mens Rea under Section 178
Section 178 के main provision में “knowingly performs any part of the process of counterfeiting” phrase महत्वपूर्ण है।
इसका मतलब है कि counterfeiting process के किसी part को perform करने वाले व्यक्ति के conduct के साथ statutory knowledge जुड़ी हुई है।
इसके अलावा coin counterfeiting के specific Explanation में:
“intending to practise deception”
या
“knowing it to be likely that deception will thereby be practised”
का requirement दिया गया है।
इसलिए Section 178 को केवल innocent alteration या accidental similarity के आधार पर mechanically apply नहीं किया जा सकता; relevant statutory mental elements facts के अनुसार examine होंगे।
Punishment
Section 178 अत्यंत गंभीर punishment prescribe करता है:

अर्थात Court के पास life imprisonment अथवा imprisonment up to 10 years के साथ fine impose करने की statutory power है।

Nature of Imprisonment
Section 178 में phrase है:
“imprisonment of either description”
BNS Section 4 के अनुसार imprisonment दो descriptions की है:
Rigorous imprisonment, यानी hard labour;
Simple imprisonment.
इसलिए जहाँ Section 178 “imprisonment of either description” कहता है, वहाँ statutory imprisonment framework के अंतर्गत appropriate form of imprisonment Court द्वारा determine की जा सकती है।

Section 179 specifically उस व्यक्ति को target करता है जो forged/counterfeit coin, stamp, currency-note या bank-note को knowing/having reason to believe कि वह counterfeit है, genuine के रूप में use या traffic करता है।

Counterfeiting a Coin
यदि कोई व्यक्ति genuine coin को इस प्रकार alter करता है कि वह किसी different coin जैसा appear हो और Explanation में prescribed deception-related mental element मौजूद है, तो Section 178 का counterfeiting provision relevant होगा।

यदि genuine Government stamp को इस प्रकार counterfeit किया जाता है कि वह different denomination का genuine stamp दिखाई दे, तो Explanation (3) के अनुसार यह counterfeiting Government stamp है।

Supreme Court Position
Section 178 BNS पर direct BNS-specific Supreme Court precedent उपलब्ध नहीं है। इसलिए Section 178 की direct interpretation के रूप में किसी पुराने IPC judgment को प्रस्तुत करना उचित नहीं होगा।
हालाँकि counterfeit currency/coin और संबंधित predecessor provisions पर Supreme Court के पुराने decisions मौजूद हैं। यदि उनका comparative study किया जाए, तो उन्हें predecessor-law authorities के रूप में clearly identify करना चाहिए; वे BNS Section 178 के direct precedents नहीं हैं।
