Section 177 BNS 2023 – Failure to Keep Election Accounts

Section 177 of the Bharatiya Nyaya Sanhita, 2023 (BNS) election expenses के accounts को maintain करने के statutory obligation के उल्लंघन से संबंधित है। यदि किसी व्यक्ति पर लागू law या rule having the force of law election expenditure के accounts रखने का दायित्व डालता है और वह accounts नहीं रखता, तो Section 177 लागू होता है।

Statutory Provision

“177. Whoever being required by any law for the time being in force or any rule having the force of law to keep accounts of expenses incurred at or in connection with an election fails to keep such accounts shall be punished with fine which may extend to five thousand rupees.”

Object of Section 177

Section 177 का उद्देश्य election से संबंधित expenditure की accountability और record-keeping सुनिश्चित करना है।

इस Section में मुख्य focus expenditure की legality पर नहीं, बल्कि उस expenditure के accounts को रखने के legal obligation पर है।

Section 177 के offence के लिए निम्न elements महत्वपूर्ण हैं:

Requirement Must Come from Law or Rule Having Force of Law

Section 177 का सबसे महत्वपूर्ण feature यह है कि accounts रखने का obligation किसी सामान्य expectation से नहीं, बल्कि:

“any law for the time being in force”

या

“any rule having the force of law”

से arise होना चाहिए।

इसलिए Section 177 के लिए पहले यह establish करना आवश्यक होगा कि संबंधित व्यक्ति पर applicable legal framework के तहत election accounts maintain करने की वास्तविक statutory/regulatory duty थी।

Accounts of Election Expenses

Section 177 उन accounts से संबंधित है जो:

“expenses incurred at or in connection with an election”

के हैं।

इसमें दो aspects दिखाई देते हैं:

  • expenses at an election; और

  • expenses in connection with an election.

इसलिए provision केवल polling-day expenditure तक सीमित नहीं है; statutory language election से connected expenses को भी expressly include करती है।

Failure to Keep Accounts

Section 177 में operative expression है:

“fails to keep such accounts”

अर्थात offence का central element है accounts maintain करने में failure।

इस provision का focus यह है कि जहाँ law/rule accounts रखने की duty impose करता है, वहाँ required accounts वास्तव में maintain किए गए या नहीं।

Mens Rea

Section 177 की language में bribery या false statement की तरह कोई separate express phrase जैसे “with intent”, “knowingly” या “dishonestly” नहीं है।

Statutory provision का express requirement है कि व्यक्ति:

  1. accounts रखने के लिए legally required हो; और

  2. fails to keep such accounts.

इसलिए Section 177 के interpretation में statutory duty और actual failure को प्राथमिकता से examine करना होगा।

यह कहना उचित नहीं होगा कि हर accounting irregularity automatically Section 177 offence है; provision specifically failure to keep the required accounts को address करता है।

Examples

Accounts Not Maintained

मान लीजिए किसी व्यक्ति पर applicable law के तहत election expenses के accounts maintain करने का obligation है, लेकिन वह required accounts रखता ही नहीं।

→ यदि statutory ingredients satisfy होते हैं, तो Section 177 लागू हो सकता है।

Mere Accounting Error

यदि किसी व्यक्ति ने legally required accounts बनाए हैं, लेकिन उनमें कोई particular entry गलत या incomplete है, तो केवल इस तथ्य से Section 177 का offence automatically establish नहीं माना जाना चाहिए।

Section 177 की statutory language specifically “fails to keep such accounts” पर केंद्रित है। किसी particular accounting defect की legal consequence applicable election law/rules और facts पर निर्भर करेगी।

Supreme Court Position

Section 177 BNS पर direct BNS-specific Supreme Court judgment उपलब्ध नहीं है। इसलिए किसी पुराने IPC/election-law decision को Section 177 का direct BNS precedent बताना उचित नहीं होगा।

इस provision के application में मुख्य प्रश्न statutory text से निकलते हैं:

  • क्या व्यक्ति पर accounts रखने की legal duty थी?

  • वह duty किस law या rule से उत्पन्न हुई?

  • accounts किस प्रकार के election expenses के लिए required थे?
