Section 176 BNS 2023 – Illegal Payments in Connection with Elections

Section 176 of the Bharatiya Nyaya Sanhita, 2023 (BNS) election से जुड़े कुछ illegal payments को punishable बनाता है। यह Chapter IX, “Of Offences Relating to Elections” का हिस्सा है और Section 177 के साथ election expenditure/accounting से संबंधित provisions की statutory scheme को आगे बढ़ाता है।

Statutory Provision

“176. Whoever without the sanction of the State Government incurs or authorises expenses on account of the holding of any public meeting, or upon any advertisement, circular or publication, or in any other way whatsoever for the purpose of promoting or procuring the election of any candidate, shall be punished with fine which may extend to ten thousand rupees.”

Object of Section 176

Section 176 का focus election में candidate की electoral promotion के लिए किए जाने वाले कुछ expenses/payments पर statutory control स्थापित करना है।

Provision में विशेष रूप से State Government की sanction के बिना किए या authorise किए गए expenditure को target किया गया है, जब उसका purpose किसी candidate के election को:

  • promote करना; या

  • procure करना

हो।

इसलिए Section 176 में केवल “payment” होना पर्याप्त नहीं है। Statutory ingredients को साथ पढ़ना आवश्यक है।

Essential Ingredients

Section 176 को निम्न ingredients में समझा जा सकता है:

Meaning of “Without the Sanction of the State Government”

Section 176 की शुरुआत ही इस condition से होती है:

“without the sanction of the State Government”

इसका अर्थ है कि provision के ambit में आने वाले expenditure के संबंध में State Government sanction का statutory requirement महत्वपूर्ण है।

अतः केवल यह तथ्य कि expenditure candidate के election से related था, अपने-आप Section 176 का complete offence establish नहीं करता; sanction से संबंधित statutory condition भी relevant है।

What Kind of Expenses are Covered?

Section 176 तीन specific categories expressly mention करता है और उसके बाद एक व्यापक residual expression भी इस्तेमाल करता है।

Public Meeting

Candidate के election को promote/procure करने के उद्देश्य से public meeting आयोजित करने पर होने वाला expenditure provision के ambit में expressly आता है।

Advertisement

Candidate की election prospects को promote/procure करने के लिए किया गया advertisement expenditure भी expressly covered है।

Circular or Publication

Circular या publication पर किया गया expenditure भी Section 176 में specifically mentioned है।

Any Other Way Whatsoever

Provision इसके बाद व्यापक expression इस्तेमाल करता है:

“or in any other way whatsoever”

इसका effect यह है कि provision केवल public meeting, advertisement, circular और publication तक mechanically limited नहीं है; statutory language अन्य forms of expenditure को भी cover करती है, यदि बाकी ingredients satisfy हों।

Purpose Requirement

Section 176 में expenditure का purpose अत्यंत महत्वपूर्ण है।

Expense ऐसा होना चाहिए जो:

“for the purpose of promoting or procuring the election of any candidate”

किया गया हो।

इसलिए following connection establish होना आवश्यक है:

“Incurs or Authorises Expenses”

Section 176 केवल उस व्यक्ति तक सीमित नहीं है जो personally payment करता है।

Statutory language दो अलग forms को recognise करती है:

  • incurs expenses; और

  • authorises expenses.

इसलिए expenditure के actual incurrence के साथ-साथ expenditure को authorise करने की conduct भी provision में expressly included है।

Examples

Public Meeting

A बिना required State Government sanction के candidate B के election को promote करने के उद्देश्य से public meeting पर expenditure करता है।

यदि Section 176 के अन्य ingredients भी satisfy होते हैं, तो Section 176 attract हो सकता है।

Advertisement

A candidate के election को promote करने के लिए advertisement पर expenditure करता है और statutory sanction requirement satisfied नहीं है।

Section 176 and Section 173 – Important Distinction

दोनों provisions election-related financial conduct से जुड़े हो सकते हैं, लेकिन उनका legal subject अलग है।

Supreme Court Position

Section 176 BNS पर direct BNS-specific Supreme Court precedent अभी उपलब्ध नहीं है। इसलिए किसी पुराने IPC/election-law case को Section 176 BNS का direct precedent बताना उचित नहीं होगा।

इस provision के interpretation में मुख्यतः statutory language पर ध्यान देना आवश्यक है—विशेषकर:

  • State Government sanction;

  • incurring or authorising expenses;

  • public meeting;

  • advertisement;

  • circular/publication;

  • “any other way whatsoever”; और

  • purpose of promoting or procuring the election of a candidate.
