Section 171 BNS 2023 – Undue Influence at Elections

Section 171 of the Bharatiya Nyaya Sanhita, 2023 (BNS) चुनाव में Undue Influence (अनुचित प्रभाव) से संबंधित provision है। इसका मुख्य उद्देश्य किसी voter या candidate के electoral right के free exercise में voluntary interference, threat या specified spiritual pressure को अपराध बनाना है।

Statutory Provision

“171. Undue influence at elections.—
(1) Whoever voluntarily interferes or attempts to interfere with the free exercise of any electoral right commits the offence of undue influence at an election.

(2) Without prejudice to the generality of the provisions of sub-section (1), whoever—
(a) threatens any candidate or voter, or any person in whom a candidate or voter is interested, with injury of any kind; or
(b) induces or attempts to induce a candidate or voter to believe that he or any person in whom he is interested will become or will be rendered an object of Divine displeasure or of spiritual censure, shall be deemed to interfere with the free exercise of the electoral right of such candidate or voter, within the meaning of sub-section (1).

(3) A declaration of public policy or a promise of public action or the mere exercise or a legal right without intent to interfere with an electoral right, shall not be deemed to be interference within the meaning of this section.”

Meaning of Undue Influence

Section 171 का central expression है:

“free exercise of any electoral right”

यदि कोई व्यक्ति voluntarily किसी candidate या voter के electoral right के free exercise में interfere करता है या interfere करने का attempt करता है, तो Section 171(1) के अंतर्गत undue influence का offence बन सकता है।

यहाँ “electoral right” को अकेले केवल voting तक सीमित नहीं किया जाना चाहिए। Section 169(b) BNS के अनुसार इसमें व्यक्ति का—

  • candidate के रूप में stand करना;

  • candidate के रूप में stand न करना;

  • candidature withdraw करना;

  • vote करना; और

  • vote करने से refrain करना

Section 171(1) के लिए मुख्य elements को इस प्रकार समझा जा सकता है:

इस provision का focus केवल actual interference पर नहीं है; attempt to interfere भी expressly covered है।

Threat to Candidate or Voter

Section 171(2)(a) एक specific statutory illustration/deeming category देता है।

यदि कोई व्यक्ति—

  • candidate को;

  • voter को; या

  • ऐसे person को जिसमें candidate या voter interested है,

“injury of any kind” की threat देता है, तो ऐसी conduct को electoral right के free exercise में interference माना जाता है।

यहाँ statutory language “injury of any kind” है। इसलिए provision केवल physical injury तक शब्दों में सीमित नहीं है।

Threat to a Person in Whom Candidate or Voter is Interested

यह Section 171 का महत्वपूर्ण aspect है।

Threat सीधे voter को ही दिया जाना आवश्यक नहीं है। यदि threat ऐसे व्यक्ति को दिया जाता है जिसमें voter interested है, तो भी Section 171(2)(a) लागू हो सकता है।

इसलिए provision का protection केवल individual voter तक narrowly confined नहीं है।


Divine Displeasure or Spiritual Censure

Section 171(2)(b) एक विशेष प्रकार के influence को भी cover करता है।

यदि कोई व्यक्ति candidate या voter को induce या attempt to induce करता है कि—

  • वह स्वयं, या

  • कोई person in whom he is interested,

“Divine displeasure” या “spiritual censure” का object बनेगा अथवा बनाया जाएगा, तो statutory deeming provision के अनुसार यह free exercise of electoral right में interference माना जाएगा।

इसका उद्देश्य धार्मिक या आध्यात्मिक भय के माध्यम से electoral choice को प्रभावित करने वाली specified conduct को address करना है।

Public Policy and Promise of Public Action

Section 171(3) एक महत्वपूर्ण statutory exception/exclusion देता है।

निम्न अपने-आप Section 171 के अंतर्गत interference नहीं माने जाएंगे:

Declaration of public policy

या

Promise of public action

इसका मतलब है कि सामान्य चुनावी campaign में कोई candidate public policy announce करता है या public action करने का promise करता है, तो केवल इस कारण Section 171 का offence नहीं बनता।

Mere Exercise of Legal Right

Section 171(3) का दूसरा महत्वपूर्ण हिस्सा है:

“the mere exercise of a legal right without intent to interfere with an electoral right”

यदि कोई व्यक्ति केवल अपने legal right का exercise करता है और उसका intention electoral right में interference करने का नहीं है, तो ऐसा mere exercise Section 171 के अर्थ में interference नहीं माना जाएगा।

इसलिए lawful conduct + absence of intent to interfere को provision expressly protect करता है।

Threat to Voter

A, voter को धमकी देता है कि यदि उसने particular candidate को vote नहीं दिया तो उसे नुकसान पहुँचाया जाएगा।

यह conduct voter के free exercise of electoral right में interference का मामला बन सकती है।

Threat to Relative of Voter

A, voter के close family member को injury की threat देता है ताकि voter अपनी electoral choice बदल दे।

Section 171(2)(a) में person in whom the voter is interested expressly included है।

Spiritual Pressure

A, voter को यह विश्वास दिलाने का प्रयास करता है कि particular candidate को vote न देने पर voter divine displeasure या spiritual censure का object बनेगा।

Specified circumstances में यह Section 171(2)(b) के अंतर्गत deemed interference हो सकता है।

Normal Policy Promise

Candidate यह घोषणा करता है कि elected होने पर वह public transport policy में बदलाव करेगा।

केवल यह policy declaration अथवा promise of public action Section 171(3) के अनुसार interference नहीं माना जाता।

Mere Legal Right

कोई व्यक्ति अपने legal right का exercise करता है और electoral right में interference करने का requisite intent नहीं है।

Section 171(3) के अनुसार mere exercise of legal right को interference नहीं माना जाएगा।

Punishment and Classification

Section 171 स्वयं offence को define करता है। इसका punishment Section 174 BNS में prescribed है।

BNSS First Schedule के अनुसार Section 174 – Undue influence or personation at an election के लिए:

अतः article या legal advice में Section 171 = offence और Section 174 = punishment का distinction बनाए रखना चाहिए।


Relation with Representation of the People Act, 1951

Section 171 BNS का विषय election में undue influence है। इसके समान विषय पर Representation of the People Act, 1951, विशेष रूप से Section 123(2), में corrupt practice से संबंधित provisions हैं।

Supreme Court ने election law में “undue influence” को केवल physical coercion तक सीमित न रखते हुए voter के free choice और electoral judgment के context में examine किया है। Shri Baburao Patel v. यह election-law jurisprudence में महत्वपूर्ण Supreme Court decision है। Court ने Section 123(2), Representation of the People Act के context में undue influence और voter के informed electoral choice के प्रश्न पर विचार किया।

Supreme Court, 1967

Supreme Court ने undue influence के election-law context में IPC Section 171-C और Representation of the People Act की corresponding provision पर विचार किया। Court ने यह भी discuss किया कि सामान्य political canvassing और prohibited undue influence के बीच distinction महत्वपूर्ण है। (Indian Kanoon)

Important Legal Principle

Supreme Court की predecessor election jurisprudence में “undue influence” को “proper influence” के समान नहीं माना गया है। Legitimate canvassing और ऐसा interference जो electoral choice की freedom को प्रभावित करे—इन दोनों के बीच distinction महत्वपूर्ण है। Shiv Kirpal Singh v. इसलिए केवल किसी voter को persuade करना अपने-आप Section 171 का offence नहीं माना जा सकता। Statutory test यह देखता है कि क्या conduct voluntary interference with the free exercise of electoral right के स्तर तक पहुँचती है और क्या कोई statutory deeming circumstance लागू होता है।
