Section 170 BNS, 2023 – Bribery at Elections

Section 170 of the Bharatiya Nyaya Sanhita, 2023 (BNS) निर्वाचन में Bribery (रिश्वत) से संबंधित मुख्य penal provision है। इसका उद्देश्य electoral right को किसी gratification के माध्यम से प्रभावित करने वाले कार्यों को अपराध बनाना है।

Statutory Provision

Section 170 BNS का पूरा statutory text इस प्रकार है:

“170. (1) Whoever—
(i) gives a gratification to any person with the object of inducing him or any other person to exercise any electoral right or of rewarding any person for having exercised any such right; or
(ii) accepts either for himself or for any other person any gratification as a reward for exercising any such right or for inducing or attempting to induce any other person to exercise any such right,
commits the offence of bribery:
Provided that a declaration of public policy or a promise of public action shall not be an offence under this section.

(2) A person who offers, or agrees to give, or offers or attempts to procure, a gratification shall be deemed to give a gratification.

(3) A person who obtains or agrees to accept or attempts to obtain a gratification shall be deemed to accept a gratification, and a person who accepts a gratification as a motive for doing what he does not intend to do, or as a reward for doing what he has not done, shall be deemed to have accepted the gratification as a reward.”

Meaning of Bribery under Section 170

Section 170 को समझने के लिए पहले Section 169 BNS में दी गई “electoral right” की definition महत्वपूर्ण है।

Section 169 के अनुसार electoral right में किसी व्यक्ति का—

  • candidate के रूप में खड़ा होना;

  • candidate के रूप में खड़ा न होना;

  • candidature वापस लेना;

  • vote देना; तथा

  • vote न देना

शामिल है।

इसलिए Section 170 केवल “vote खरीदने” तक सीमित नहीं है। किसी व्यक्ति को candidate बनने, candidate न बनने, candidature वापस लेने, vote देने या vote न देने के लिए gratification देना या लेना भी इसके ambit में आ सकता है।

Essential Ingredients

Section 170 के offence को broadly दो प्रमुख प्रकारों में समझा जा सकता है:

Giving Gratification

Section 170(1)(i) के अंतर्गत निम्न परिस्थितियों में bribery बन सकती है—

Gratification → किसी व्यक्ति को दी गई → उद्देश्य electoral right को प्रभावित करना

उदाहरण के लिए किसी voter को इस उद्देश्य से कोई लाभ देना कि वह किसी candidate को vote दे, electoral bribery का उदाहरण हो सकता है।

इसी प्रकार किसी व्यक्ति को candidate के रूप में चुनाव न लड़ने या candidature वापस लेने के लिए gratification देना भी provision के ambit में आ सकता है।

Accepting Gratification

Section 170(1)(ii) दूसरी तरफ acceptance को अपराध बनाता है।

यदि कोई व्यक्ति—

  • अपने लिए gratification स्वीकार करता है; या

  • किसी अन्य व्यक्ति के लिए gratification स्वीकार करता है,

और वह gratification electoral right के exercise के बदले reward के रूप में है, अथवा किसी अन्य व्यक्ति को electoral right exercise करने के लिए induce करने या attempt करने के लिए है, तो bribery का offence बन सकता है।

Offers and Attempts are Also Covered

Section 170(2) एक महत्वपूर्ण deeming provision है।

यदि कोई व्यक्ति केवल—

  • gratification offer करता है;

  • gratification देने के लिए agree करता है;

  • gratification procure करने का offer करता है; या

  • gratification procure करने का attempt करता है,

तो उसे gratification “give” करने वाला माना जाएगा।

इसका अर्थ यह है कि actual delivery को ही प्रत्येक स्थिति में आवश्यक मानकर provision को सीमित नहीं किया गया है।

Acceptance की Deeming Provision

इसी प्रकार Section 170(3) में acceptance से संबंधित deeming rule है।

यदि कोई व्यक्ति gratification—

  • obtain करता है;

  • accept करने के लिए agree करता है;

  • obtain करने का attempt करता है,

तो उसे gratification accept करने वाला माना जाता है।

इसके अतिरिक्त, यदि कोई व्यक्ति ऐसी चीज gratification के रूप में स्वीकार करता है जो उस कार्य को करने के लिए motive है जिसे वह वास्तव में करने का इरादा नहीं रखता, या ऐसे कार्य के reward के रूप में है जिसे उसने किया ही नहीं, तो उसे भी statutory language के अनुसार gratification as a reward स्वीकार करना माना जाएगा।

Public Policy Declaration is Not Bribery

Section 170 का proviso एक महत्वपूर्ण distinction करता है।

“a declaration of public policy or a promise of public action shall not be an offence under this section.”

अर्थात केवल किसी public policy की घोषणा अथवा public action का promise अपने-आप Section 170 के अंतर्गत bribery नहीं बनता।

इसलिए election campaign में सामान्य policy घोषणा और किसी specific electoral right को gratification के माध्यम से प्रभावित करने के बीच distinction आवश्यक है।

Section 170(2) और 170(3) के कारण offer, agreement और attempt भी statutory deeming provisions के माध्यम से cover होते हैं।


What is “Gratification”?

Section 170 में “gratification” शब्द का प्रयोग हुआ है। इसे केवल सीधे cash payment तक सीमित करके नहीं देखना चाहिए।

Predecessor IPC provision की judicial discussion में भी bribery के संदर्भ में gratification को केवल monetary payment तक सीमित नहीं माना गया है। Karnataka High Court ने 2024–2026 के मामलों में IPC Section 171B की चर्चा करते हुए इसी principle को दोहराया है। (Indian Kanoon)

Section 171 में voluntary interference या attempt to interfere with free exercise of electoral right offence है। Threat या divine displeasure/spiritual censure का inducement भी specified circumstances में undue influence माना गया है।

इसलिए bribery = gratification-based influence, जबकि undue influence = coercive/interfering influence का statutory distinction समझना उपयोगी है।


Punishment and Classification

एक महत्वपूर्ण बात यह है कि Section 170 स्वयं bribery का definition offence देता है, जबकि उसका punishment Section 173 BNS में दिया गया है।

BNSS की First Schedule के अनुसार Section 173 में bribery के लिए—

  • imprisonment up to 1 year, या

  • fine, या

  • दोनों,

का प्रावधान है।

लेकिन “treating only” की स्थिति में fine only का classification दिया गया है। यह classification BNSS First Schedule में Section 173 के लिए दिया गया है।

Relation with Representation of the People Act, 1951

Election bribery को केवल BNS के perspective से देखना पर्याप्त नहीं है। जहाँ parliamentary या State legislative elections का प्रश्न हो, वहाँ Representation of the People Act, 1951 के provisions भी relevant हो सकते हैं।

Supreme Court ने election disputes में bribery को corrupt practice के रूप में Section 123(1), Representation of the People Act के context में consider किया है। Jamuna Prasad Mukhariya v. Lachhi Ram में Supreme Court के समक्ष election bribery का प्रश्न आया था। (Sci API)

इसी प्रकार Raj Narain v. Indira Nehru Gandhi में Supreme Court ने election petition में alleged bribery/gift allegations की legal sufficiency पर विचार किया और यह स्पष्ट किया कि केवल सामान्य assertions पर्याप्त नहीं होते; relevant material facts और particulars का महत्व है। (Sci API)

यह ध्यान रखना चाहिए कि ये decisions BNS Section 170 के direct interpretation cases नहीं हैं, क्योंकि BNS बाद में enacted हुआ। ये predecessor election-bribery provisions और election law principles के संदर्भ में persuasive/interpretive relevance रखते हैं।


Leading Supreme Court Judgments

Jamuna Prasad Mukhariya v. Lachhi Ram

Supreme Court ने election bribery के आरोपों से संबंधित election petition में statutory requirements और bribery के allegations पर विचार किया। यह election bribery jurisprudence का महत्वपूर्ण पुराना Supreme Court authority है। (Sci API)

Raj Narain v. Indira Nehru Gandhi

Nishant Deshdipak Varma v. Election Commission of India

यह Supreme Court judgment नहीं बल्कि Gujarat High Court का decision है, इसलिए इसे leading Supreme Court judgment के रूप में नहीं, बल्कि persuasive High Court authority के रूप में ही देखना चाहिए। इसमें IPC Section 171B और Representation of the People Act की bribery provisions की तुलना की गई थी। (Indian Kanoon)


Practical Examples

Example – Vote के लिए cash

A voter को ₹5,000 इस उद्देश्य से देता है कि वह B candidate को vote दे।

→ Electoral right को gratification के माध्यम से influence करने का उद्देश्य है।
→ Section 170 का issue arise हो सकता है।

Example – Candidature वापस लेने के लिए benefit

एक candidate को monetary benefit इस शर्त पर offer किया जाता है कि वह election से अपना candidature withdraw कर ले।

→ “electoral right” में candidature withdraw करने का right भी शामिल है।
→ इसलिए Section 169(b) read with Section 170 relevant होगा।

Example – केवल Policy Promise

Candidate कहता है कि elected होने पर वह एक particular public policy लागू करेगा।

→ Section 170 का proviso expressly कहता है कि declaration of public policy या promise of public action अपने-आप इस Section के अंतर्गत offence नहीं है।
