Section 165 BNS 2023: Deserter Concealed on Board Merchant Vessel Through Negligence of Master
Section 165 of the Bharatiya Nyaya Sanhita, 2023 (BNS) merchant vessel के master या person in charge पर liability डालता है, जब Government of India की Army, Navy या Air Force का कोई deserter merchant vessel पर concealed हो और master/person in charge की neglect of duty या want of discipline के कारण उसे concealment का पता चल सकता था।
यह provision actual knowledge पर आधारित नहीं है; Section expressly कहता है कि master/person in charge “though ignorant of such concealment” होने पर भी liable हो सकता है। (BPRD)
Statutory Provision
Section 165 BNS provides:
“The master or person in charge of a merchant vessel, on board of which any deserter from the Army, Navy or Air Force of the Government of India is concealed, shall, though ignorant of such concealment, be liable to a penalty not exceeding three thousand rupees, if he might have known of such concealment but for some neglect of his duty as such master or person in charge, or but for some want of discipline on board of the vessel.”

Object of Section 165
Section 165 का उद्देश्य merchant vessel के master या person in charge की supervisory responsibility और discipline को enforce करना है।
यदि कोई military deserter merchant vessel पर छिपा हुआ है और master/person in charge ने अपने duties का उचित पालन किया होता या vessel पर पर्याप्त discipline maintain किया होता, तो concealment का पता चल सकता था, ऐसी स्थिति में ignorance liability से पूर्ण defence नहीं बनती।
इसलिए यह provision मुख्यतः negligent failure of supervision को address करता है।
Essential Ingredients
Section 165 के मुख्य ingredients निम्न हैं:

Who Can Be Liable?
Section 165 specifically दो categories को cover करता है:
Master of the merchant vessel
या
Person in charge of the merchant vessel
इसलिए liability केवल उस व्यक्ति तक mechanically limited नहीं है जिसे ship का “master” कहा जाता है। यदि facts में कोई अन्य person legally/in fact vessel के charge में है, तो Section 165 की applicability examine की जा सकती है।
What Is a Merchant Vessel?
Section 165 specifically merchant vessel से संबंधित है।
इसलिए provision का application किसी भी vessel पर automatically नहीं होता। Statutory language merchant vessel को expressly specify करती है।
Who Is the Deserter?
जिस व्यक्ति को vessel पर concealed पाया जाता है, वह:
Army का officer/soldier,
Navy का sailor/personnel, या
Air Force का airman
होना चाहिए और Government of India की संबंधित Armed Force से संबंधित होना चाहिए।
Section 165 का statutory focus ऐसे military deserter के concealment पर है।
Actual Knowledge Is Not Necessary
Section 165 की सबसे महत्वपूर्ण विशेषता है:
“though ignorant of such concealment”
इसका अर्थ है कि master या person in charge को वास्तव में concealment की जानकारी न होने पर भी liability हो सकती है।
लेकिन इसका अर्थ यह नहीं है कि master/person in charge हर परिस्थिति में automatically liable होगा।
Statutory condition यह है कि:
concealment हुआ हो; और
master/person in charge might have known of it;
लेकिन वह knowledge उसके neglect of duty या vessel पर want of discipline के कारण नहीं हो सकी।
इसलिए Section 165 में liability का foundation negligence है, mere ignorance नहीं।
Neglect of Duty
Section 165 में पहला negligence-based ground है:
“some neglect of his duty as such master or person in charge”
इसका अर्थ है कि master/person in charge ने अपने official duties का उचित पालन नहीं किया और उसी neglect के कारण उसे deserter के concealment का पता नहीं चल सका।
Example
मान लीजिए merchant vessel पर crew और passengers की supervision के लिए सामान्य inspection आवश्यक थी, लेकिन master/person in charge ने अपने relevant duty को पूरी तरह neglect किया। उसी कारण military deserter लंबे समय तक vessel पर concealed रहा।
यदि evidence establish करता है कि proper performance of duty से concealment का पता चल सकता था, तो Section 165 लागू हो सकता है।
Want of Discipline on Board
Section 165 में दूसरा statutory ground है:
“some want of discipline on board of the vessel”
अर्थात vessel पर पर्याप्त discipline नहीं था और उसी lack of discipline के कारण deserter का concealment detect नहीं हो पाया।
इसलिए Section 165 केवल individual negligence तक सीमित नहीं है; Legislature ने want of discipline on board को भी independent statutory basis के रूप में recognise किया है।

Section 165 को Sections 163 और 164 से अलग समझना आवश्यक है।
Section 164 में accused के बारे में “knowing or having reason to believe” की requirement है। इसके विपरीत Section 165 master/person in charge की actual knowledge के अभाव में भी negligence-based liability प्रदान करता है।
इसलिए Section 165 का central question यह नहीं है कि master को निश्चित रूप से deserter के बारे में पता था या नहीं, बल्कि यह भी है कि:
क्या वह अपने duty के उचित पालन या vessel में adequate discipline होने पर concealment के बारे में जान सकता था?

इन तीन provisions का sequence भी महत्वपूर्ण है:

Punishment
Section 165 में imprisonment का provision नहीं है।
इसके तहत:
Penalty: अधिकतम ₹3,000
हो सकती है।
यहाँ statutory language “penalty not exceeding three thousand rupees” है। इसलिए ₹3,000 maximum है; प्रत्येक case में ₹3,000 impose होना mandatory नहीं है।
Nature of Offence
BNSS First Schedule के अनुसार Section 165:

अर्थात Section 165 non-cognizable और bailable offence है तथा इसका trial Any Magistrate द्वारा किया जाता है।
IPC Section 137 and BNS Section 165
Section 165 BNS का corresponding predecessor Section 137 IPC था।
IPC Section 137 में इसी प्रकार merchant vessel पर Armed Forces के deserter के concealment और master/person in charge की negligence से संबंधित liability थी। IPC में maximum penalty ₹500 थी, जबकि BNS Section 165 में इसे ₹3,000 किया गया है।

इस प्रकार Section 165 में मुख्य substantive change monetary penalty का enhancement है। IndiaCode-based comparison भी BNS Section 165 को IPC Section 137 का corresponding provision बताता है।
Supreme Court Judgments
Section 165 BNS के specific interpretation पर कोई leading Supreme Court judgment directly interpreting BNS Section 165 उपलब्ध materials में identified नहीं हुआ है।
इसका एक प्रमुख कारण यह भी है कि BNS Section 165 नया provision है और इसका predecessor IPC Section 137 एक comparatively narrow offence था।
इसलिए किसी सामान्य negligence, maritime law या military discipline case को बिना qualification के “Supreme Court judgment on Section 165 BNS” बताना उचित नहीं होगा।
Relevant legal position: BNS Section 165 को समझने के लिए predecessor IPC Section 137 की statutory language और BNS/BNSS classification useful हैं, लेकिन direct BNS Supreme Court precedent के रूप में कोई case cite नहीं किया जाना चाहिए जब तक उसका direct authority establish न हो।
Practical Illustration
मान लीजिए एक merchant vessel में Government of India की Army का एक deserter छिपा हुआ है।
Master को personally उसके छिपे होने की जानकारी नहीं है।
लेकिन facts से यह establish होता है कि:
master ने अपनी required supervisory duties का पालन नहीं किया;
vessel पर basic discipline maintain नहीं था;
proper supervision या discipline होता तो deserter के concealment का पता चल जाता।
ऐसी स्थिति में Section 165 के statutory ingredients examine किए जा सकते हैं।
दूसरी ओर, यदि master ने सभी reasonable duties और discipline requirements का पालन किया और concealment ऐसी परिस्थितियों में हुआ जिसे ordinary supervision से भी detect करना संभव नहीं था, तो केवल deserter के vessel पर पाए जाने से Section 165 की liability automatically establish नहीं होती।
Important Points

Statutory test में यह महत्वपूर्ण है कि वह concealment के बारे में जान सकता था, लेकिन neglect of duty या want of discipline के कारण नहीं जान पाया।
Section 165 में imprisonment का provision नहीं है।
Maximum penalty ₹3,000 है।
BNSS First Schedule के अनुसार offence non-cognizable और bailable है।
Trial Any Magistrate द्वारा होता है।
Corresponding old provision IPC Section 137 था।
IPC में penalty ₹500 थी, जिसे BNS में ₹3,000 किया गया है।
Section 164 और Section 165 में प्रमुख distinction यह है कि Section 164 conscious harbouring से और Section 165 negligent failure of supervision/discipline से संबंधित है।
Conclusion
Section 165 BNS एक narrow negligence-based military offence है। इसका उद्देश्य merchant vessel के master या person in charge को उस स्थिति के लिए liable बनाना है जहाँ Armed Forces का deserter vessel पर concealed हो और proper duty या discipline के अभाव के कारण concealment detect नहीं हो सका।
सबसे महत्वपूर्ण बात यह है कि actual knowledge न होने पर भी liability संभव है, लेकिन केवल deserter के vessel पर पाए जाने से liability स्वतः नहीं बनती; statutory neglect of duty या want of discipline की requirement को establish करना आवश्यक है।
