Section 164 BNS 2023: Harbouring Deserter
Section 164 of the Bharatiya Nyaya Sanhita, 2023 (BNS) Armed Forces के उस officer, soldier, sailor या airman को harbour करने को punish करता है जिसके बारे में आरोपी को knowledge या reason to believe हो कि वह service से desert कर चुका है। इस Section में deserter की spouse द्वारा harbouring को expressly exception दिया गया है।
Statutory Provision
Section 164 BNS में कहा गया है:
“Whoever, except as hereinafter excepted, knowing or having reason to believe that an officer, soldier, sailor or airman, in the Army, Navy or Air Force of the Government of India, has deserted, harbours such officer, soldier, sailor or airman, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine or with both.
Exception.—This provision does not extend to the case in which the harbour is given by the spouse of the deserter.”

Object of Section 164
इस Section का उद्देश्य Armed Forces में discipline और service obligations को protect करना है। यदि कोई Armed Forces personnel desertion कर चुका है और कोई दूसरा व्यक्ति उसे knowingly या reason to believe के आधार पर shelter या harbour करता है, तो ऐसा conduct Section 164 के अंतर्गत punishable हो सकता है।
Section 163 और Section 164 में स्पष्ट अंतर है:
Section 163 — desertion को abet करना।
Section 164 — deserter को harbour करना।

Who Can Be a Deserter?
Section 164 specifically निम्न personnel को cover करता है:
Officer
Soldier
Sailor
Airman
और वह व्यक्ति Government of India की Army, Navy या Air Force में होना चाहिए।
इसलिए Section 164 किसी सामान्य employee द्वारा अपनी नौकरी छोड़ने के मामले में लागू होने वाला सामान्य offence नहीं है।
Meaning of Harbouring
Section 164 में “harbours” शब्द का उपयोग किया गया है।
सामान्य criminal-law context में harbouring का अर्थ किसी ऐसे व्यक्ति को जानबूझकर shelter, protection या छिपने की सुविधा देना हो सकता है जिससे वह lawful apprehension या consequences से बच सके।
लेकिन Section 164 के context में केवल यह साबित करना पर्याप्त नहीं होगा कि आरोपी और deserter एक ही स्थान पर मौजूद थे। Prosecution को statutory requirements—विशेषकर knowledge या reason to believe तथा harbouring—को facts और evidence से establish करना होगा।
Knowledge or Reason to Believe
Section 164 का यह सबसे महत्वपूर्ण mental element है।
Statutory language है:
“knowing or having reason to believe”
इसका अर्थ है कि prosecution को establish करना होगा कि accused:
या तो जानता था कि संबंधित Armed Forces personnel ने desert किया है,
या circumstances ऐसे थे कि उसे reason to believe था कि वह व्यक्ति deserter है।
केवल यह fact कि accused ने किसी व्यक्ति को shelter दिया, अपने-आप Section 164 establish नहीं करता; statutory knowledge/reason-to-believe requirement भी महत्वपूर्ण है।

Section 164 में जिस व्यक्ति को harbour किया गया है, उसके बारे में statutory requirement है कि उसने “deserted” किया हो।
इसलिए Section 164 और सामान्य absence without leave या किसी अन्य service misconduct को automatically identical नहीं माना जा सकता।
किसी particular case में यह determine करना होगा कि संबंधित conduct applicable Armed Forces law के अनुसार वास्तव में desertion है या कोई अलग disciplinary/service offence।
Exception: Spouse of the Deserter
Section 164 का सबसे महत्वपूर्ण statutory exception है:
“This provision does not extend to the case in which the harbour is given by the spouse of the deserter.”
अर्थात् यदि deserter को harbouring उसके spouse द्वारा दी जाती है, तो Section 164 का provision उस situation पर extend नहीं होता।

applies may applyयह एक specific statutory exception है। इसलिए इसे broadly सभी relatives या family members तक extend नहीं किया जाना चाहिए।

दोनों provisions को confuse नहीं करना चाहिए।

Section 164 vs Section 165
Section 165 एक अलग situation से संबंधित है—merchant vessel पर deserter का concealment और master/person in charge की negligence।

Section 165 में master/person in charge की liability का basis neglect of duty या want of discipline है, जबकि Section 164 में मुख्यतः knowledge/reason to believe + harbouring का requirement है।
Section 164 vs Section 158
Section 158 भी harbouring से संबंधित है, लेकिन वहाँ subject matter State prisoner or prisoner of war है।
Section 164 में subject matter deserter from the Army, Navy or Air Force है।
इसलिए दोनों provisions को अलग statutory situations में apply किया जाता है।
Punishment
Section 164 के तहत punishment है:
Imprisonment: either description का imprisonment, जिसकी अवधि 2 years तक हो सकती है;
या Fine;
या Both.
अर्थात Court circumstances के अनुसार imprisonment, fine या दोनों impose कर सकती है।
Nature of Offence
BNSS First Schedule के अनुसार Section 164 है:

इसलिए Section 164 cognizable और bailable offence है तथा इसका trial Any Magistrate द्वारा किया जा सकता है।
Practical Example
मान लीजिए A Government of India की Army का soldier है और applicable service law के अनुसार उसने desertion किया है।
B को यह पता है कि A deserted है। इसके बावजूद B जानबूझकर A को अपने घर में छिपने के लिए जगह देता है ताकि A authorities से बच सके।
यदि prosecution आवश्यक ingredients establish करती है, तो B का conduct Section 164 के तहत examine किया जा सकता है।
लेकिन यदि B को वास्तव में यह knowledge नहीं थी और circumstances में उसके पास यह believe करने का भी reasonable basis नहीं था कि A deserter है, तो Section 164 का “knowing or having reason to believe” ingredient महत्वपूर्ण हो जाएगा।
Spouse Example
यदि वही deserter अपनी spouse के residence पर रहता है और spouse उसे harbour करती है, तो Section 164 की express spousal exception लागू होगी।
ध्यान दें कि statutory exception केवल spouse के लिए है। Section 164 के text में parents, siblings, children या अन्य relatives के लिए ऐसी general exception नहीं दी गई है।
Supreme Court Judgments
Section 164 BNS पर उपलब्ध materials में कोई ऐसा leading Supreme Court judgment identified नहीं है जो सीधे BNS Section 164 की interpretation करता हो।
इसी प्रकार predecessor IPC provision पर भी ऐसा Supreme Court authority confidently identify नहीं किया जा सकता जिसे Section 164 BNS का direct precedent कहा जाए।
इसलिए Section 164 के संबंध में किसी general harbouring या military disciplinary case को बिना qualification के “Supreme Court judgment on Section 164 BNS” बताना उचित नहीं होगा।
General criminal-law principles लागू करते समय यह distinction बनाए रखना आवश्यक है कि:
direct BNS precedent ≠ predecessor IPC precedent ≠ general criminal-law precedent.
IPC Corresponding Provision
Section 164 BNS का corresponding predecessor IPC Section 136 था।
दोनों provisions का basic subject matter है:
deserter को harbour करना, जहाँ harbour करने वाले व्यक्ति को यह knowledge या reason to believe हो कि संबंधित Armed Forces personnel deserted है।
BNS में इसे Section 164 के रूप में रखा गया है।

Section 163 और Section 164 में मुख्य अंतर है—abetment of desertion बनाम harbouring an already-deserted person।
Section 165 merchant vessel पर deserter के concealment से संबंधित अलग provision है।
उपलब्ध materials में Section 164 BNS पर direct leading Supreme Court precedent identified नहीं है।
Conclusion
Section 164 BNS का मुख्य उद्देश्य ऐसे deserter को harbour करने वाले व्यक्ति को punish करना है जिसे यह knowledge या reason to believe हो कि Armed Forces का संबंधित personnel desert कर चुका है। इसका punishment अधिकतम 2 years imprisonment, fine, or both है और BNSS First Schedule के अनुसार offence cognizable, bailable तथा Any Magistrate triable है।
सबसे महत्वपूर्ण point इसका spousal exception है—deserter की spouse द्वारा दिया गया harbour Section 164 के express exception के कारण इस provision के अंतर्गत नहीं आता।
