Section 163 BNS 2023: Abetment of Desertion of Soldier, Sailor or Airman
Section 163 of the Bharatiya Nyaya Sanhita, 2023 (BNS) Armed Forces के किसी officer, soldier, sailor या airman को desertion के लिए abet करने को punish करता है। इस offence में desertion का actual commission Section 163 की statutory language में अलग से condition नहीं बनाया गया है; provision स्वयं abetment of desertion को punish करता है।
Statutory Provision
Section 163 BNS में कहा गया है:
“Whoever abets the desertion of any officer, soldier, sailor or airman, in the Army, Navy or Air Force of the Government of India, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.”

यह provision Armed Forces में discipline, duty और service obligation को protect करने के लिए बनाया गया है। इसका corresponding provision पुराने IPC में Section 135 था।
Object of Section 163
Armed Forces में personnel का duty से अनुपस्थित होना केवल individual employment matter नहीं है, बल्कि military discipline और operational effectiveness को प्रभावित कर सकता है।
इसी कारण law केवल actual deserter को ही target नहीं करता, बल्कि उस व्यक्ति को भी punish करता है जो किसी officer, soldier, sailor या airman को desertion करने के लिए abet करता है।
Section 163 का emphasis therefore abetment of desertion पर है।
Essential Ingredients
Section 163 के मुख्य ingredients निम्न हैं:

Who is Covered?
Section 163 specifically निम्न categories के personnel को cover करता है:
Officer
Soldier
Sailor
Airman
और संबंधित व्यक्ति Government of India की Army, Navy या Air Force में होना चाहिए।
इसलिए Section 163 का application किसी सामान्य civilian employee द्वारा नौकरी छोड़ने या duty से absent होने की situation पर नहीं किया जा सकता।
Meaning of Desertion
“Desertion” Armed Forces law का एक technical concept है। सामान्य रूप से इसका संबंध service/duty को छोड़ने और service से वापस न लौटने के requisite intention से होता है।
लेकिन Section 163 BNS में Legislature ने “desertion” की अलग statutory definition इस Section के भीतर नहीं दी है। इसलिए किसी particular case में यह देखना आवश्यक होगा कि संबंधित Armed Forces law और facts के अनुसार conduct वास्तव में desertion constitute करता है या केवल temporary absence, leave violation या अन्य disciplinary misconduct है।
इस distinction को केवल सामान्य भाषा के आधार पर तय नहीं किया जाना चाहिए।
Meaning of “Abets”
Section 163 में “abets” शब्द का अर्थ BNS के general abetment provisions के साथ पढ़ा जाना चाहिए।

Section 163 BNSइसलिए किसी व्यक्ति का conduct केवल physical assistance तक सीमित होना आवश्यक नहीं है। Facts के अनुसार instigation, conspiracy अथवा intentional aid abetment का रूप ले सकती है।
Is Actual Desertion Necessary?
Section 163 का text महत्वपूर्ण है:
“Whoever abets the desertion…”
इसके विपरीत Section 162 BNS में Legislature ने expressly कहा है कि assault “if such assault be committed in consequence of that abetment” तो Section 162 लागू होगा। Section 163 में ऐसी express wording नहीं है।
इसलिए statutory text के आधार पर Section 163 को actual desertion की express statutory condition वाला offence नहीं माना जाना चाहिए।
अर्थात् focus abetment itself पर है।
हालाँकि, prosecution को यह establish करना होगा कि accused का conduct वास्तव में desertion को abet करने की statutory requirements को satisfy करता है। केवल किसी service member से सामान्य बातचीत या सामान्य सहायता अपने-आप Section 163 नहीं बनाती।
Causal Connection
Section 163 और Section 162 में एक महत्वपूर्ण drafting difference है।
Section 162
Section 162 में expressly:
“if such assault be committed in consequence of that abetment”
लिखा गया है।
इसलिए Section 162 में abetment और actual assault के बीच statutory causal consequence आवश्यक है।
Section 163
Section 163 में ऐसी कोई express phrase नहीं है कि desertion “in consequence of that abetment” actually committed होना चाहिए।
इसलिए Section 163 का statutory focus abetment of desertion पर है।
Section 163 and General Abetment Provisions
BNS के general abetment provisions को Section 163 के साथ पढ़ना जरूरी है। BNS Section 49 में “act committed in consequence of abetment” की general formulation दी गई है, लेकिन जहाँ Legislature ने किसी specific offence के लिए अलग provision बनाया है, उस specific provision की language महत्वपूर्ण रहती है।
इसलिए Section 163 में analysis करते समय पहले यह देखना होगा कि accused ने desertion को abet किया या नहीं।

मान लीजिए A जानता है कि B Government of India की Army में soldier है। A लगातार B को service छोड़कर वापस न लौटने के लिए encourage करता है और उसे desertion के लिए instigate करता है।
यदि facts और evidence से B को desertion के लिए abetment establish होता है, तो A की liability Section 163 के तहत examine की जा सकती है।

यदि A केवल B से कहता है कि “यदि तुम service में खुश नहीं हो तो legal procedure के अनुसार resignation या discharge के लिए apply करो”, तो यह अपने-आप Section 163 का abetment नहीं बनता।
क्योंकि lawful discharge/resignation और desertion अलग concepts हैं।

यदि कोई व्यक्ति जानबूझकर ऐसी assistance देता है जिसका purpose Armed Forces के member को service से desert करने में सहायता करना है, तो facts के अनुसार intentional aid के रूप में abetment का प्रश्न उठ सकता है।

इन दोनों Sections में महत्वपूर्ण distinction है:

Section 164 specifically उस व्यक्ति को punish करता है जो यह जानते हुए या reason to believe करते हुए कि officer, soldier, sailor या airman deserted है, उसे harbour करता है। साथ ही spouse के harbouring के लिए express exception है।

Section 163 इसलिए Section 162 की तरह consequence-based assault provision नहीं है; यह desertion को abet करने को independently punish करता है।
Punishment
Section 163 के तहत Court निम्न में से कोई punishment दे सकती है:
Imprisonment: either description का imprisonment, जिसकी अवधि 2 years तक हो सकती है;
या Fine;
या Both imprisonment and fine.
इसमें तीन alternatives हैं:

अर्थात् Section 163 cognizable और bailable offence है तथा इसका trial Any Magistrate द्वारा किया जा सकता है।
यह Section 162 से महत्वपूर्ण procedural distinction है, क्योंकि Section 162 non-bailable है, जबकि Section 163 bailable है।

BNS Section 163 का corresponding old provision IPC Section 135 था:

इसलिए Section 163 में इस aspect पर कोई major substantive enhancement दिखाई नहीं देता; मुख्यतः यह नए criminal code में corresponding provision का renumbering है।

Conclusion
Section 163 BNS का मुख्य उद्देश्य Armed Forces के personnel को desertion के लिए abet करने वाले व्यक्ति को criminally liable बनाना है। इसकी punishment Section 162 की तुलना में कम है और procedural classification भी अलग है—Section 163 cognizable, bailable और Any Magistrate triable offence है।
