Section 161 BNS 2023: Abetment of Assault on Superior Officer

Section 161 of the Bharatiya Nyaya Sanhita, 2023 (BNS) Army, Navy or Air Force के किसी officer, soldier, sailor या airman द्वारा अपने superior officer, जो अपने official duty के execution में हो, उस पर assault करने के लिए abetment को punish करता है। इस Section में assault का actual commission आवश्यक नहीं है; actual assault हो जाने पर अधिक गंभीर provision Section 162 BNS लागू होता है।

Statutory Provision

Section 161 BNS के अनुसार:

“Whoever abets an assault by an officer, soldier, sailor or airman, in the Army, Navy or Air Force of the Government of India, on any superior officer being in the execution of his office, shall be punished with imprisonment of either description for a term which may extend to three years, and shall also be liable to fine.”

इस provision का मूल उद्देश्य Armed Forces में military discipline, chain of command और superior officer की authority की सुरक्षा करना है। इसका focus उस व्यक्ति पर है जो किसी officer, soldier, sailor या airman को उसके superior officer पर assault करने के लिए abet करता है।

Meaning of Abetment

Section 161 में “abets” शब्द को अकेले नहीं पढ़ना चाहिए। BNS में abetment का general framework Sections 45 onwards में दिया गया है। BNS में abetment मुख्यतः instigation, conspiracy तथा intentional aid के माध्यम से हो सकता है।

BNS Section 49 यह भी बताता है कि जब abetted act abetment के consequence में committed हो और उस abetment के लिए कोई express punishment provision न हो, तब general rule लागू होता है। लेकिन Section 161 स्वयं specific punishment प्रदान करता है, इसलिए Section 161 को उसके विशेष statutory framework में पढ़ना होगा।

Who Can Be the Principal Offender?

Section 161 में जिस व्यक्ति द्वारा assault किया जाना abetted है, वह निम्न में से होना चाहिए:

  • Officer

  • Soldier

  • Sailor

  • Airman

और वह Government of India की Army, Navy या Air Force में होना चाहिए।

इसलिए केवल किसी civilian व्यक्ति को किसी superior सरकारी अधिकारी पर assault करने के लिए उकसाना Section 161 का offence नहीं बनाता। Section 161 की language specifically Armed Forces personnel से जुड़ी है।

Meaning of “Superior Officer”

जिस व्यक्ति पर assault abet किया जा रहा है, वह principal actor का superior officer होना चाहिए।

यह केवल सामान्य रूप से senior व्यक्ति होने का प्रश्न नहीं है; provision military hierarchy और official authority से जुड़ा हुआ है। इसलिए prosecution को facts के आधार पर यह establish करना होगा कि जिस व्यक्ति को assault का target बनाया गया वह संबंधित officer का superior officer था।

“Being in the Execution of His Office”

यह Section 161 का एक महत्वपूर्ण ingredient है।

Superior officer केवल superior rank का व्यक्ति होना पर्याप्त नहीं है। वह उस समय “in the execution of his office” भी होना चाहिए।

अर्थात् assault का संबंध उस superior officer के official functions/duties के execution से होना चाहिए।

Example

मान लीजिए एक superior military officer disciplinary duty perform कर रहा है और कोई व्यक्ति subordinate soldier को उस officer पर हमला करने के लिए instigate करता है। यदि अन्य statutory ingredients establish होते हैं, तो Section 161 attract हो सकता है।

इसके विपरीत, यदि dispute पूरी तरह private और official duty से unrelated है, तो “being in the execution of his office” का ingredient अलग से carefully examine करना होगा।

Is Actual Assault Necessary?

Section 161 के लिए actual assault का commission आवश्यक नहीं है।

यह Section abetment of assault को punish करता है। इसलिए यदि कोई व्यक्ति Armed Forces के किसी member को superior officer पर assault करने के लिए instigate करता है या statutory meaning में intentional aid/conspiracy करता है, तो Section 161 का प्रश्न उठ सकता है, भले actual assault अंततः न हुआ हो।

लेकिन यदि abetted assault वास्तव में consequence of the abetment में committed हो जाता है, तो BNS ने उसके लिए अलग और अधिक गंभीर provision बनाया है—Section 162 BNS।

BNSS First Schedule के अनुसार Section 161 cognizable, non-bailable है और इसका trial Magistrate of the First Class द्वारा किया जाता है।

Section 161 and General Law of Abetment

Supreme Court ने पुराने IPC के general abetment provisions की व्याख्या करते हुए स्पष्ट किया है कि abetment एक स्वतंत्र criminal concept है और उसकी nature इस बात पर निर्भर करती है कि abetment instigation, conspiracy या intentional aid के किस रूप में किया गया है।

Jamuna Singh v. State of Bihar, 1967 AIR 553, Supreme Court में Supreme Court ने समझाया कि instigation या conspiracy के द्वारा abetment का offence उस point पर complete हो सकता है जब requisite instigation/conspiracy स्थापित हो; प्रत्येक प्रकार के abetment के लिए principal offence का actual completion आवश्यक नहीं होता। (Indian Kanoon)

यह principle Section 161 को समझने में relevant है क्योंकि Section 161 स्वयं “abets an assault” को criminalise करता है, जबकि actual assault होने पर Section 162 की specific consequence provision सामने आती है।

Supreme Court Judgment on Section 161 Specifically

BNS Section 161 1 July 2024 से लागू नया statutory numbering provision है और इसका predecessor IPC Section 133 था। BNS Section 161 का text IPC Section 133 से लगभग identical है। (IndiaCode by eCourtsIndia)

मेरी उपलब्ध Supreme Court search में BNS Section 161 पर सीधे interpretation देने वाला कोई प्रमुख Supreme Court judgment अभी उपलब्ध नहीं मिला। इसलिए किसी पुराने case को Section 161 का direct Supreme Court precedent बताना उचित नहीं होगा।

Supreme Court ने abetment के तीन recognised modes—instigation, conspiracy और intentional aid—और principal offender के acquittal के abettor पर प्रभाव को स्पष्ट किया। (Indian Kanoon)

Faguna Kanta Nath v. State of Assam

Faguna Kanta Nath v. State of Assam, 1959 AIR 673; 1959 Supp (2) SCR 1, Supreme Court ने abetment by intentional aid और principal offence के relationship पर महत्वपूर्ण principles दिए। Court ने facts के context में कहा कि यदि alleged principal offence itself establish नहीं होता, तो intentional aid वाले abetment की liability पर उसका प्रभाव पड़ सकता है। (Indian Kanoon)

इन judgments को Section 161 का direct precedent नहीं बल्कि BNS के abetment concept को समझने के लिए predecessor/general-law authorities के रूप में cite करना अधिक legally accurate होगा।

Section 161 को पढ़ते समय BNS के general abetment provisions भी महत्वपूर्ण हैं:

यदि actual assault abetment के consequence में committed हो जाता है, तो Section 162 BNS का specific provision examine किया जाएगा।

Punishment

Section 161 के तहत:

Imprisonment: either description का imprisonment, up to 3 years

Fine: भी लगाया जा सकता है।

इसमें “imprisonment of either description” का अर्थ rigorous या simple imprisonment में से कोई हो सकता है, जैसा कानून के अनुसार Court determine करे।

Section 161 में death penalty या life imprisonment का provision नहीं है। इसकी तुलना Section 160 BNS से करने पर distinction स्पष्ट होता है, क्योंकि Section 160 में mutiny के actual commission के consequence में punishment काफी अधिक गंभीर है।

अर्थात् Section 161 cognizable और non-bailable offence है, लेकिन इसका trial Court of Session में नहीं बल्कि Magistrate of the First Class के समक्ष होता है।

Conclusion

Section 161 BNS Armed Forces की chain of command और discipline को protect करने वाला specific offence है। इसका essential focus यह है कि कोई व्यक्ति Armed Forces के किसी member को उसके superior officer, जो अपने official office के execution में है, उस पर assault करने के लिए abet न करे। Actual assault के बिना भी Section 161 लागू हो सकता है, जबकि actual assault abetment के consequence में हो जाने पर Section 162 की अधिक गंभीर liability सामने आती है।
