Section 156 BNS 2023: Public Servant Voluntarily Allowing Prisoner of State or War to Escape

Section 156 of the Bharatiya Nyaya Sanhita, 2023 (BNS) public servant द्वारा State prisoner या prisoner of war को उसकी lawful custody से voluntarily escape करने देने को अपराध बनाता है। इसमें life imprisonment या 10 वर्ष तक imprisonment और fine का प्रावधान है।

Statutory Provision

Section 156 BNS provides:

“Whoever, being a public servant and having the custody of any State prisoner or prisoner of war, voluntarily allows such prisoner to escape from any place in which such prisoner is confined, shall be punished with imprisonment for life, or imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine.”

इस Section का focus केवल prisoner के escape पर नहीं, बल्कि custody में मौजूद State prisoner या prisoner of war को public servant द्वारा voluntarily escape करने देने पर है।

Object of Section 156

यह provision उन prisoners की custody को विशेष महत्व देता है जिनका संबंध State security, foreign relations या war-related circumstances से हो सकता है।

Section 156 को Sections 157 और 158 के साथ पढ़ने पर legislative scheme स्पष्ट होती है:

Section 156 में voluntary allowance, Section 157 में negligent suffering, और Section 158 में दूसरे व्यक्ति द्वारा knowingly aiding/rescuing/harbouring को अलग-अलग offences बनाया गया है।

Essential Ingredients

Section 156 के offence के मुख्य ingredients निम्न हैं:

Meaning of “Public Servant”

Section 156 तभी लागू होता है जब accused public servant हो। इसके अतिरिक्त केवल public servant होना पर्याप्त नहीं है; उस public servant के पास संबंधित State prisoner या prisoner of war की custody भी होनी चाहिए।

इसलिए सामान्य व्यक्ति द्वारा किसी prisoner को escape कराने का conduct Section 156 के बजाय circumstances के अनुसार Section 158 या किसी अन्य applicable provision के अंतर्गत आ सकता है।

Meaning of “Voluntarily Allows”

Section 156 में legislature ने “voluntarily allows” शब्दों का प्रयोग किया है।

इसका practical significance यह है कि Section 156 का conduct mere negligence से अलग है।

Public servant negligently suffers escape.

इस distinction को इस प्रकार समझ सकते हैं:

Meaning of State Prisoner

Section 156 में “State prisoner” एक technical expression है। इसे सामान्य convicted prisoner या undertrial prisoner के समान नहीं समझना चाहिए।

Section 156 की statutory context में State prisoner और prisoner of war दोनों को अलग category के रूप में identify किया गया है।

इसलिए Section 156 का सामान्य जेल escape provisions से comparison करते समय यह देखना आवश्यक है कि prisoner वास्तव में उस special statutory category में आता है या नहीं।

Meaning of Prisoner of War

Prisoner of war (POW) का concept ordinary criminal prisoner से अलग है। यह war-related status से जुड़ा हुआ है।

इसलिए Section 156 का application किसी सामान्य criminal accused के जेल से escape के प्रत्येक case में automatically नहीं होगा।

Section 156 में गंभीर punishment prescribed है:

Section 156 vs Section 158

Section 158 भी State prisoner या prisoner of war से संबंधित है, लेकिन दोनों Sections में accused की स्थिति अलग है।

Section 156:
Accused स्वयं public servant having custody है और वह prisoner को voluntarily escape करने देता है।

Section 158:
कोई व्यक्ति knowingly prisoner को escape करने में aid/assist करता है, rescue करता है, harbour या conceal करता है, अथवा recapture के विरुद्ध resistance करता है।

Section 156 vs Ordinary Prisoner Escape

BNS में ordinary prisoners के escape से संबंधित अलग provisions भी हैं। इसलिए Section 156 को हर प्रकार के jail escape case पर लागू नहीं किया जा सकता।

Section 156 की special conditions हैं:

Public servant + custody + State prisoner/prisoner of war + voluntary allowance of escape

यदि इनमें से statutory requirement absent है, तो किसी अन्य applicable provision की examination आवश्यक होगी।

IPC Section 128 and BNS Section 156

Section 156 BNS का predecessor Section 128 IPC था। दोनों provisions की language लगभग identical है। IPC Section 128 भी public servant द्वारा State prisoner या prisoner of war को custody से voluntarily escape करने देने से संबंधित था।

BNS Section 156 1 July 2024 से in force है। 

Supreme Court Judgments

Section 156 BNS स्वयं नया provision है और इसके text पर अभी ऐसा कोई direct leading Supreme Court judgment identified नहीं है जो Section 156 के ingredients की authoritative interpretation करता हो।

क्योंकि Section 156 substantially IPC Section 128 को carry forward करता है, पुराने Section 128 IPC के authorities theoretically relevant हो सकते हैं। लेकिन उपलब्ध research में ऐसा कोई प्रमुख Supreme Court judgment नहीं मिला जिसे Section 128/156 की direct interpretation का leading authority सुरक्षित रूप से कहा जा सके।

इसलिए Section 156 के लिए unrelated Supreme Court cases को direct precedent के रूप में cite करना उचित नहीं होगा।

एक महत्वपूर्ण distinction यह भी है कि Section 130 IPC / Section 158 BNS से संबंधित judicial decisions को Section 156 का direct precedent नहीं माना जाना चाहिए, क्योंकि Section 158 का statutory offence अलग है। उदाहरण के लिए State of Gujarat v. Hafizhusain @ Adnan @ Jaid Tajjudin में Gujarat High Court ने Section 130 IPC के ingredients और “knowledge” requirement पर discussion किया था; यह Section 156 का Supreme Court precedent नहीं है। (Indian Kanoon)
