Section 153 BNS 2023: Waging War Against Government of a Foreign State at Peace with India

BNS Section 153 उस व्यक्ति को दंडित करता है जो भारत सरकार के साथ शांति में रहने वाले किसी विदेशी State की Government के विरुद्ध war करता है, ऐसा war करने का attempt करता है, या ऐसे war को abet करता है। यह provision मुख्यतः India की foreign relations और friendly foreign States की security से संबंधित है।

यह Section पुराने IPC Section 125 के निकटवर्ती प्रावधान को नए रूप में जारी करता है, लेकिन “Asiatic Power” जैसी पुरानी सीमा को हटाकर “any foreign State at peace with the Government of India” शब्दावली अपनाता है।

Statutory Provision

BNS Section 153 के अनुसार—

“Whoever wages war against the Government of any foreign State at peace with the Government of India or attempts to wage such war, or abets the waging of such war…”

ऐसे व्यक्ति को निम्न में से दंड दिया जा सकता है:

  • Imprisonment for life, और fine भी लगाया जा सकता है; या

  • Imprisonment up to 7 years, और fine भी लगाया जा सकता है; या

  • Fine.

Simple Meaning

सरल शब्दों में, यदि कोई व्यक्ति भारत के साथ शांति में रहने वाले किसी foreign State की Government के विरुद्ध युद्ध छेड़ता है, युद्ध करने का प्रयास करता है या उस युद्ध को सहायता/उकसावा देता है, तो Section 153 लागू हो सकता है।

Essential Ingredients

Section 153 में prosecution को मुख्यतः निम्न elements स्थापित करने होते हैं:

इसलिए केवल किसी विदेशी Government के विरुद्ध political disagreement, criticism या सामान्य विरोध अपने-आप Section 153 का offence नहीं बनता। Statutory language specifically “wages war”, “attempts to wage such war” या “abets the waging of such war” की मांग करती है। [BNS s.153]

What is “Waging War”?

BNS Section 153 में “waging war” की अलग statutory definition नहीं दी गई है। इसलिए इस expression को समझने के लिए predecessor IPC provisions और Supreme Court द्वारा विकसित “waging war” jurisprudence महत्वपूर्ण हो सकती है।

Supreme Court ने IPC Section 121 के संदर्भ में स्पष्ट किया कि “waging war” को केवल सामान्य disturbance या ordinary public disorder के अर्थ में अत्यधिक विस्तृत नहीं किया जाना चाहिए। War-like operation का object, purpose और use of force महत्वपूर्ण considerations हैं। [State (NCT of Delhi) v. यह principle Section 153 के context में सावधानी से लागू किया जाना चाहिए, क्योंकि Section 153 का subject matter foreign State की Government है, जबकि Navjot Sandhu में मुख्य प्रश्न Government of India के विरुद्ध waging war से संबंधित था।

Three Forms of Liability

Section 153 तीन अलग-अलग forms को expressly cover करता है:

Waging War

यदि व्यक्ति भारत के साथ peace में रहने वाले foreign State की Government के विरुद्ध वास्तविक war करता है, तो substantive offence बन सकता है।

Attempting to Wage War

War वास्तव में पूरा न हुआ हो, लेकिन व्यक्ति ने उसे करने की दिशा में legally relevant attempt किया हो, तो Section 153 का दूसरा limb लागू हो सकता है।

Abetting Waging of War

व्यक्ति स्वयं war न करे, लेकिन उसके commission को abet करे, तो भी Section 153 लागू हो सकता है।

इस प्रकार provision का coverage केवल completed war तक सीमित नहीं है। [BNS s.153]

Punishment

Section 153 में punishment का structure महत्वपूर्ण है:

Bare Act का operative text punishment को एक combined provision के रूप में prescribe करता है—life imprisonment, to which fine may be added; or imprisonment up to seven years, to which fine may be added; or fine. [BNS s.153]

BNSS की First Schedule में Section 153 को इसी प्रकार classify किया गया है।

इसका practical consequence यह है कि offence की investigation और arrest के संबंध में police powers सामान्यतः cognizable-offence framework के अंतर्गत आती हैं, जबकि bail के लिए offence non-bailable है।

BNS Section 153 and IPC Section 125

BNS Section 153 का predecessor provision IPC Section 125 था। IPC Section 125 में “Government of any Asiatic Power in alliance or at peace with the Government of India” language प्रयुक्त होती थी। (India Code)

BNS ने इसे बदलकर किया:

इसलिए BNS की language में “Asiatic Power” की geographical limitation नहीं है। इसी प्रकार “in alliance” वाली language भी हटाई गई है। BPR&D के comparative material में भी BNS Section 153 को IPC Section 125 के corresponding provision के रूप में दिखाया गया है। (S3WAAS)

यह बदलाव महत्वपूर्ण है क्योंकि BNS Section 153 का textual scope केवल Asian States तक सीमित नहीं है।

Supreme Court Judgments

Supreme Court ने IPC Section 121 के context में “waging war” की nature पर विस्तार से विचार किया। Court ने कहा कि केवल disturbance या ordinary acts को automatically “waging war” नहीं माना जा सकता। War-like activity का object and purpose, तथा Government machinery के विरुद्ध force/arms का उपयोग महत्वपूर्ण factors हैं। (Indian Kanoon)

यह BNS Section 153 का direct interpretation नहीं है, लेकिन “waging war” expression को समझने के लिए predecessor jurisprudence का महत्वपूर्ण authority है।

इस judgment में Court ने Navjot Sandhu में Supreme Court द्वारा विकसित “waging war” principles को discuss किया और intention, purpose तथा Government authority के विरुद्ध force के nature को relevant माना। (Indian Kanoon)

यह authority भी BNS Section 153 पर direct Supreme Court ruling नहीं है; इसे केवल interpretive background के रूप में पढ़ना चाहिए।

C.C.B. Bangalore v. Mehdi Masroor Biswas

इस case में IPC Section 121 और 125 दोनों allegations पर consideration हुआ। Court ने Section 121 के संदर्भ में यह देखा कि mere online statements या ideological material पर्याप्त नहीं थे जब prosecution war-like acts, force/arms और Government troops के विरुद्ध actual offensive conduct establish नहीं कर सकी। (Indian Kanoon)

Section 153 vs Section 154

इन दोनों Sections को अलग रखना आवश्यक है:

इसके बाद Section 155 knowingly ऐसी property receive करने को punish करता है जो Sections 153 या 154 के offences में ली गई हो। [BNS s.155]
