Section 152 BNS 2023: Act Endangering Sovereignty, Unity and Integrity of India
Section 152 of the Bharatiya Nyaya Sanhita, 2023 (BNS) Chapter VII “Of Offences Against the State” का एक महत्वपूर्ण provision है। यह ऐसे acts को punish करता है जो secession, armed rebellion, subversive activities, separatist activities को excite/encourage करते हैं या India की sovereignty, unity and integrity को endanger करते हैं।
यह provision विशेष रूप से महत्वपूर्ण है क्योंकि BNS में IPC Section 124A (sedition) को उसी नाम और wording में retain नहीं किया गया; BNS Section 152 ने sovereignty, unity and integrity of India को endanger करने वाले specified conduct के लिए नया statutory framework दिया है। BPR&D के comparative material में भी IPC Section 124A को “omitted” और BNS Section 152 को corresponding new provision के रूप में दिखाया गया है। (BPRD)

Statutory Provision
Section 152 के अनुसार, जो व्यक्ति purposely or knowingly, words—spoken or written—signs, visible representation, electronic communication, financial means या otherwise, द्वारा:
secession को excite या attempt to excite करता है;
armed rebellion को excite या attempt to excite करता है;
subversive activities को excite या attempt to excite करता है;
feelings of separatist activities को encourage करता है;
India की sovereignty को endanger करता है;
India की unity and integrity को endanger करता है; या
ऐसे किसी act में indulge या commit करता है,
वह imprisonment for life, या imprisonment up to seven years, तथा fine से punish किया जा सकता है।

Explanation: Lawful Criticism is Not an Offence
Section 152 की Explanation एक महत्वपूर्ण safeguard देती है।
यदि कोई व्यक्ति Government के measures, administrative action या अन्य action के प्रति disapprobation/असहमति lawful means से alteration प्राप्त करने के उद्देश्य से express करता है, और वह ऐसा करते समय Section 152 में वर्णित activities को excite या attempt to excite नहीं करता, तो ऐसा comment Section 152 के तहत offence नहीं होगा।

Essential Ingredients
Purposely or Knowingly
Section 152 में “purposely or knowingly” शब्द महत्वपूर्ण हैं।
अर्थात prosecution को alleged conduct के संदर्भ में यह establish करना होगा कि accused ने requisite purposeful या knowing state of mind के साथ act किया। केवल accidental, unintended या purely incidental communication को statutory language के आधार पर mechanically Section 152 नहीं माना जा सकता।

Means of Communication or Conduct
Section 152 का scope केवल speeches तक सीमित नहीं है।
Provision expressly निम्न means को cover करता है:

इसलिए electronic communication और financial means को expressly शामिल करना Section 152 की modern statutory reach को दर्शाता है।

Secession
Secession broadly किसी territory या group को India से अलग करने की दिशा में activity को refer करता है।
Section 152 में secession को excite या attempt to excite करना specifically punishable conduct में शामिल किया गया है।
इसलिए actual secession होना आवश्यक नहीं है; statutory wording “excites or attempts to excite” दोनों को cover करती है।

Armed Rebellion
Section 152 armed rebellion को भी expressly cover करता है।
इसका मतलब यह है कि ऐसे conduct को excite या attempt to excite करना, यदि Section 152 के अन्य statutory requirements satisfy होते हैं, offence के scope में आ सकता है।
यह Section 147 के waging war against Government of India से अलग statutory concept है।

Subversive Activities and Separatist Activities
Section 152 में subversive activities और feelings of separatist activities को भी expressly mention किया गया है।
इसलिए Section 152 का scope केवल traditional concept of sedition तक सीमित नहीं है। इसका statutory language sovereignty, unity and integrity तथा specified activities पर केन्द्रित है।

Sovereignty, Unity and Integrity of India
Section 152 के title में ही तीन constitutional-national interests expressly identified हैं:
Sovereignty
Unity
Integrity of India
Provision ऐसे conduct को punish करता है जो इन interests को endanger करता है।
इसका अर्थ यह नहीं कि Government की प्रत्येक criticism या policy disagreement Section 152 के अंतर्गत आ जाएगी। Explanation expressly lawful criticism को protect करती है, provided it does not excite or attempt to excite the prohibited activities.

Punishment under Section 152
Section 152 में दो principal punishment alternatives हैं:

अर्थात Court circumstances के अनुसार life imprisonment अथवा seven years तक imprisonment तथा fine impose कर सकती है।

इसलिए Section 152 एक cognizable, non-bailable और Court of Session triable offence है।

Section 152 and IPC Section 124A: Important Difference
Section 152 को simply “new sedition section” कहना पूरी तरह precise नहीं है।
IPC Section 124A का focus “disaffection towards the Government established by law in India” था, जबकि BNS Section 152 का statutory focus secession, armed rebellion, subversive activities, separatist activities तथा sovereignty, unity and integrity of India को endanger करने वाले acts पर है। BPR&D के official comparative material में भी IPC Section 124A को omitted और BNS Section 152 को अलग provision के रूप में दिखाया गया है। (BPRD)

Supreme Court: Kedar Nath Singh Principle
Kedar Nath Singh v. State of Bihar
Kedar Nath Singh v. State of Bihar, 1962 Supp (2) SCR 769 Section 124A IPC की constitutional validity से संबंधित leading Constitution Bench judgment है।
Supreme Court ने Section 124A को constitutional मानते हुए उसे इस प्रकार read down किया कि केवल ऐसी expressions punishable होंगी जो violence या public disorder की tendency से sufficiently connected हों; mere criticism of Government या strong words अपने-आप sedition नहीं बनते।
यह judgment BNS Section 152 का direct precedent नहीं है, क्योंकि Section 152 का statutory text अलग है। फिर भी freedom of speech और State-security offences के constitutional balance को समझने में यह अत्यंत महत्वपूर्ण predecessor authority है। (Sci API)

Balwant Singh v. State of Punjab
Balwant Singh v. State of Punjab, (1995) 3 SCC 214 में Supreme Court ने IPC Section 124A के context में यह examine किया कि कुछ slogans लगाने मात्र से sedition automatically establish नहीं होता।
Court ने surrounding circumstances, intention, actual impact और public disorder से connection को महत्वपूर्ण माना।
यह भी BNS Section 152 का direct judgment नहीं है, क्योंकि यह IPC Section 124A पर decided case था। लेकिन speech-related State offence की interpretation में यह महत्वपूर्ण Supreme Court authority है।

S.G. Vombatkere v. Union of India
S.G. Vombatkere v. Union of India में Supreme Court ने 2022 में IPC Section 124A से संबंधित pending proceedings में interim directions जारी की थीं। बाद के Supreme Court order में Court ने note किया कि Section 124A की constitutional validity पहले Kedar Nath Singh में uphold की गई थी। (Sci API)
यह case भी BNS Section 152 की direct interpretation नहीं करता। इसलिए Section 152 की prosecution में इसे automatic governing precedent के रूप में treat नहीं करना चाहिए।

Section 152 and Freedom of Speech
Article 19(1)(a) citizens को freedom of speech and expression देता है, लेकिन Article 19(2) के तहत sovereignty and integrity of India, security of the State, public order आदि specified grounds पर reasonable restrictions संभव हैं।
Section 152 इसी constitutional field में operate करता है। लेकिन statutory Explanation यह स्पष्ट करती है कि Government के measures या administrative action की lawful alteration की मांग के लिए disapprobation, यदि prohibited activities को excite नहीं करती, offence नहीं है।
इसलिए Section 152 का analysis करते समय दो aspects को साथ पढ़ना आवश्यक है:

Practical Examples
Example of Lawful Dissent
यदि कोई व्यक्ति Government की किसी policy की आलोचना करता है और lawful democratic means से उस policy को बदलने की मांग करता है, तथा secession, armed rebellion या अन्य prohibited activity को excite नहीं करता, तो Section 152 की Explanation relevant protection देती है।

Example of Prohibited Conduct
यदि कोई व्यक्ति knowingly किसी माध्यम—जैसे speech, written material या electronic communication—से armed rebellion या secession को excite या attempt to excite करता है, तो conduct Section 152 के statutory ingredients के अनुसार examine किया जाएगा।

Important Legal Safeguard
Section 152 को apply करते समय mere criticism, dissent या disagreement और statutory prohibited conduct के बीच distinction अत्यंत महत्वपूर्ण है।
Section की Explanation स्वयं lawful disapprobation को exclude करती है। इसलिए किसी speech, article, social-media post या other communication की criminality निर्धारित करने के लिए केवल isolated words देखना पर्याप्त नहीं होगा; statutory ingredients, context, intention/knowledge और alleged prohibited activity के साथ उसका connection examine करना होगा।
