Section 151 BNS 2023: Assaulting President or Governor with Intent to Compel or Restrain Lawful Power
Section 151 of the Bharatiya Nyaya Sanhita, 2023 (BNS) Chapter VII, “Of Offences Against the State”, में स्थित provision है। इसका उद्देश्य President of India या किसी State के Governor को उनके lawful constitutional powers का exercise करने या न करने के लिए assault, wrongful restraint या criminal force के माध्यम से compel/induce करने वाले conduct को punish करना है।

Statutory Provision
Section 151 के अनुसार, यदि कोई व्यक्ति President of India या किसी State के Governor को उनकी lawful powers को किसी manner में exercise करने या exercise न करने के लिए induce या compel करने के intention से:
assaults करता है;
wrongfully restrains करता है;
wrongfully restrain करने का attempt करता है;
criminal force या उसके show के माध्यम से overawe करता है; या
ऐसा overawe करने का attempt करता है,
तो उसे imprisonment of either description up to 7 years और fine से punish किया जाएगा।

Section 151 केवल दो categories के persons को expressly protect करता है:
President of India
और
Governor of any State
इसलिए provision का target कोई सामान्य public servant नहीं है। Statutory language specifically President और Governor तक सीमित है।

Section 151 में “lawful powers” शब्द अत्यंत महत्वपूर्ण हैं।
Accused का intention President या Governor को उनकी lawful power को exercise करने या exercise न करने के लिए induce या compel करने का होना चाहिए।
इसलिए provision का focus constitutional office-holder के lawful powers के exercise को criminal means से influence करने पर है।

Specific Intention
Section 151 एक specific-intent offence है।
Accused के पास यह intention होना चाहिए कि वह President या Governor को:
exercise any lawful power
या
refrain from exercising any lawful power
के लिए induce या compel करे।
इसलिए केवल assault या wrongful restraint का होना Section 151 के लिए पर्याप्त नहीं है। Prosecution को prescribed intention भी establish करनी होगी।

Wrongful Restraint
BNS Section 126 के अनुसार, जो व्यक्ति voluntarily किसी person को इस प्रकार obstruct करता है कि वह उस direction में आगे न जा सके जिसमें उसे जाने का right है, वह wrongfully restrains करता है।
इसलिए Section 151 में wrongful restraint के allegation को समझने के लिए BNS Section 126 का framework relevant हो सकता है।

Criminal Force and Overawing
Section 151 में criminal force या show of criminal force द्वारा President/Governor को “overawe” करना भी expressly included है।
यहाँ केवल physical assault ही relevant नहीं है; statutory wording show of criminal force को भी separately recognise करती है।
