Section 150 BNS 2023: Concealing with Intent to Facilitate Design to Wage War

Section 150 of the Bharatiya Nyaya Sanhita, 2023 (BNS) Government of India के विरुद्ध war wage करने के design को जानबूझकर conceal करने से संबंधित offence है। इसमें केवल design की जानकारी होना पर्याप्त नहीं है; concealment के साथ यह intention या knowledge भी आवश्यक है कि concealment से war को facilitate किया जाएगा या likely है कि वह facilitate होगा।

Statutory Provision

Section 150 BNS के अनुसार, यदि कोई व्यक्ति किसी act या illegal omission द्वारा Government of India के विरुद्ध war wage करने के design के existence को conceal करता है और उसका उद्देश्य इस concealment से war को facilitate करना है, अथवा उसे knowledge है कि concealment से war facilitate होने की संभावना है, तो उसे imprisonment of either description up to 10 years and fine से punish किया जाएगा।

Essential Ingredients

Existence of a Design to Wage War

सबसे पहले एक design to wage war against the Government of India होना आवश्यक है।

अर्थात prosecution को केवल सामान्य हिंसक activity या Government के विरुद्ध विरोध दिखाना पर्याप्त नहीं होगा। जिस design को conceal करने का आरोप है, वह ऐसा design होना चाहिए जो Government of India के विरुद्ध war wage करने से संबंधित हो।

Concealment by Act or Illegal Omission

Section 150 में concealment दो प्रकार से हो सकता है:

Act द्वारा concealment

या

Illegal omission द्वारा concealment

इसलिए provision केवल किसी positive act से information छिपाने तक सीमित नहीं है; statutory language illegal omission को भी expressly include करती है।

Intention or Knowledge

Section 150 में mental element अत्यंत महत्वपूर्ण है।

दो alternative मानसिक अवस्थाएँ हैं:

Section 150 में legislature ने “intending” और “knowing” दोनों alternatives का इस्तेमाल किया है।

Punishment under Section 150

Section 150 में prescribed punishment है:

Imprisonment of either description up to 10 years + fine.

“Imprisonment of either description” का अर्थ है कि applicable imprisonment rigorous imprisonment या simple imprisonment हो सकती है।

Section 150 में life imprisonment या death penalty prescribed नहीं है

Section 149 और Section 150 दोनों war-related preparatory offences हैं, लेकिन दोनों का conduct अलग है।

State (NCT of Delhi) v. Navjot Sandhu @ Afsan Guru

Section 150 BNS का corresponding predecessor IPC Section 123 था। Supreme Court ने State (NCT of Delhi) v. Navjot Sandhu @ Afsan Guru, (2005) 11 SCC 600 में IPC Section 123 के संदर्भ में concealment offence को consider किया।

इस case में Supreme Court ने Shaukat Hussain Guru के संबंध में Section 123 IPC की conviction को sustain किया। Court के सामने यह issue था कि war के design की knowledge/concealment के ingredients अलग से establish किए जा सकते हैं, भले ही more serious conspiracy charges का outcome अलग हो। (IndiaCode by eCourtsIndia)

Shoukat Hussain Guru v. State (NCT of Delhi)

इस Supreme Court decision में Court ने स्पष्ट रूप से Section 121 और Section 123 IPC के बीच distinction समझाया। Section 121 में prosecution को waging/attempt/abetment of war establish करना था, जबकि Section 123 में war के design के existence का concealment, तथा concealment के पीछे requisite intention या knowledge establish करना था। (Indian Kanoon)

Section 150 and Mere Knowledge

एक महत्वपूर्ण distinction यह है कि mere knowledge of a design और Section 150 का offence identical नहीं हैं।

Statutory language के अनुसार concealment होना चाहिए और concealment के संबंध में:

  • intention to facilitate war, या

  • knowledge that concealment is likely to facilitate war

होना चाहिए।

Practical Example

मान लीजिए A को reliable information है कि कुछ persons Government of India के विरुद्ध war wage करने का design बना रहे हैं। A उस design के existence को जानबूझकर conceal करता है और उसका उद्देश्य यह है कि concealment के कारण proposed war को facilitate किया जा सके।

ऐसे facts में statutory ingredients इस प्रकार examine होंगे:

लेकिन केवल किसी व्यक्ति के पास ऐसी information होने से automatically criminal liability conclude नहीं की जा सकती। Actual prosecution में design, knowledge, concealment और required mental element evidence से establish करना होगा।

Relationship with IPC Section 123

IPC 123 को BNS के लागू होने के बाद repeal-and-savings framework के अधीन पढ़ना होगा; BNS Section 358 IPC को repeal करता है, जबकि पुराने offences के लिए savings clause लागू रहता है।
