Section 149 BNS 2023: Collecting Arms, etc., with Intention of Waging War Against Government of India
Section 149 of the Bharatiya Nyaya Sanhita, 2023 (BNS) Government of India के विरुद्ध war wage करने की तैयारी से संबंधित offence है। यह तब लागू होता है जब कोई व्यक्ति men, arms or ammunition collect करता है या otherwise prepares to wage war, और उसकी intention Government of India के विरुद्ध war wage करने या उसके लिए prepared रहने की हो।

Statutory Provision
Section 149 BNS के अनुसार:
“Whoever collects men, arms or ammunition or otherwise prepares to wage war with the intention of either waging or being prepared to wage war against the Government of India…”
ऐसे व्यक्ति को imprisonment for life या imprisonment of either description for a term not exceeding ten years, तथा fine से punish किया जाएगा।
इस provision का मुख्य focus actual war wage करने से पहले की preparation पर है।

Essential Ingredients
Collection of Men
Section 149 में सबसे पहले “collects men” शब्दों का प्रयोग किया गया है।
इसका मतलब केवल यह नहीं है कि कुछ लोग किसी स्थान पर मौजूद हैं। Statutory context में collection of men का संबंध ऐसी preparation से होना चाहिए जिसका उद्देश्य Government of India के विरुद्ध war wage करना या war के लिए prepared रहना हो।
इसलिए mere gathering of persons अपने-आप Section 149 establish नहीं करता; requisite intention भी prosecution को establish करना होगा।

Collection of Arms or Ammunition
Provision specifically arms or ammunition के collection को भी cover करता है।
लेकिन केवल arms या ammunition का possession अपने-आप Section 149 का offence नहीं बनाता। Statutory requirement यह है कि collection war against the Government of India के requisite intention से connected हो।
इस distinction को समझना महत्वपूर्ण है:

“Otherwise Prepares to Wage War”
Section 149 केवल men, arms और ammunition तक सीमित नहीं है।
Provision में “or otherwise prepares to wage war” भी expressly शामिल है। इसका अर्थ है कि यदि conduct war की preparation से संबंधित है, तो preparation का form केवल men, arms या ammunition collection तक restricted नहीं है।
इसलिए Section 149 में दो broad categories हैं:

Intention is the Key Requirement
Section 149 का सबसे महत्वपूर्ण ingredient intention है।
Accused की intention इनमें से किसी एक से संबंधित होनी चाहिए:
Waging war against Government of India
या
Being prepared to wage war against Government of India
Statutory wording में “with the intention” expressly मौजूद है। इसलिए prosecution को केवल preparation दिखाना पर्याप्त नहीं होगा; उस preparation का required intention से connection establish करना होगा।

Section 147 और Section 149 के बीच distinction अत्यंत महत्वपूर्ण है।

Section 147 में waging, attempt या abetment मुख्य conduct है, जबकि Section 149 का statutory focus preparatory conduct coupled with specified intention पर है।

Punishment under Section 149
Section 149 में दो principal imprisonment alternatives हैं:

अर्थात Court circumstances के अनुसार life imprisonment अथवा दस वर्ष तक imprisonment impose कर सकती है, और fine भी applicable है।

Cognizable and Non-Bailable Offence
BNSS First Schedule के अनुसार Section 149 का offence:

इसलिए Section 149 में police को cognizable-offence framework के अनुसार warrant के बिना arrest करने की power हो सकती है, और bail का determination non-bailable offence के applicable provisions के अनुसार होगा। BNSS Section 2(g) cognizable offence की definition देता है।

Section 149 and Mere Possession of Arms
यह distinction practical importance रखता है।
Mere possession of arms ≠ automatically Section 149.
Section 149 में arms/ammunition collection के साथ Government of India के विरुद्ध war wage करने या उसके लिए prepared रहने की intention आवश्यक है।
इसलिए किसी prosecution में Court को circumstances, evidence और accused की alleged intention को examine करना होगा।
यदि arms का possession किसी अन्य applicable law का offence है, तो उस offence की liability अलग statutory provisions के तहत independently arise हो सकती है।

Section 149 and Section 147: Legal Distinction
Supreme Court ने पुराने IPC Section 121 के संदर्भ में “waging war” की interpretation करते हुए यह स्पष्ट किया है कि प्रत्येक violent act या unlawful activity को “waging war” नहीं माना जा सकता। State (NCT of Delhi) v. Navjot Sandhu, (2005) 11 SCC 600 तथा Nazir Khan v. State of Delhi, (2003) 8 SCC 461 में Court ने conduct की nature, objective और surrounding circumstances पर ध्यान देने की आवश्यकता बताई।
ये judgments BNS Section 149 के direct judgments नहीं हैं; ये पुराने IPC Section 121 के interpretation से संबंधित हैं। क्योंकि Section 149 का statutory wording preparation to wage war पर focused है, पुराने Section 121 precedents को केवल appropriate interpretative context में apply करना चाहिए।

Supreme Court Judgments
Section 149 BNS पर अभी ऐसा direct Supreme Court judgment identified नहीं है जो इस नए provision के सभी ingredients की authoritative interpretation करता हो।
फिर भी Section 147 से जुड़े “waging war” concept को समझने के लिए ये leading Supreme Court authorities relevant हैं:
Nazir Khan v. State of Delhi
Nazir Khan v. State of Delhi, (2003) 8 SCC 461 में Supreme Court ने IPC Section 121 के context में “waging war” की प्रकृति पर विचार किया। Court ने war के concept को ordinary unlawful violence से अलग context में examine किया।

State (NCT of Delhi) v. Navjot Sandhu @ Afsan Guru, (2005) 11 SCC 600 में Supreme Court ने Section 121 IPC के संदर्भ में “waging war” की scope पर विस्तृत चर्चा की। यह authority Section 149 में प्रयुक्त war-related expression को broader statutory context में समझने में relevant है।
लेकिन इसे Section 149 BNS का direct precedent नहीं माना जाना चाहिए।

Section 149 BNSलेकिन केवल persons का gathering या arms possession establish होने से Section 149 स्वतः साबित नहीं होता। Specified intention और war-related preparation का connection evidence से establish होना आवश्यक है।

Section 149 में preparation punish की गई है।
Section 150 में कोई व्यक्ति Government of India के विरुद्ध war के design के existence को conceal करता है, और उसका intention यह होता है कि concealment war को facilitate करेगा या उसे ऐसा likely होने का knowledge होता है।
