Section 148 BNS 2023: Conspiracy to Commit Offences Punishable by Section 147

Section 148 of the Bharatiya Nyaya Sanhita, 2023 (BNS) Chapter VII “Of Offences Against the State” का महत्वपूर्ण provision है। यह Government of India के विरुद्ध war wage करने से संबंधित Section 147 के offences की conspiracy तथा criminal force या show of criminal force के माध्यम से Central Government या State Government को overawe करने की conspiracy को punish करता है।

Statutory Provision

Section 148 BNS के अनुसार, जो व्यक्ति within or without and beyond India

  • Section 147 के तहत punishable किसी offence को commit करने की conspiracy करता है; या

  • criminal force अथवा criminal force के show के माध्यम से Central Government या किसी State Government को overawe करने की conspiracy करता है,

उसे imprisonment for life, या imprisonment of either description up to 10 years, और fine से punish किया जाएगा।

Section 148 की Explanation विशेष रूप से कहती है कि इस Section के तहत conspiracy constitute करने के लिए conspiracy के pursuance में कोई act या illegal omission होना आवश्यक नहीं है।

Essential Ingredients

Agreement or Conspiracy

Criminal conspiracy का core element agreement between two or more persons है। Supreme Court ने criminal conspiracy की settled jurisprudence में कहा है कि conspiracy का foundation unlawful object को accomplish करने के लिए agreement है। [Noor Mohammad Mohd. इसलिए केवल किसी व्यक्ति का मन में कोई unlawful intention रखना और दूसरे व्यक्ति के साथ उस उद्देश्य के लिए agreement न होना सामान्यतः conspiracy के essential concept को satisfy नहीं करता।

First Form: Conspiracy to Commit Section 147 Offence

Section 148 का पहला limb उस conspiracy को punish करता है जिसका object Section 147 में punishable offence commit करना है।

Section 147 में Government of India के विरुद्ध:

  • waging war,

  • attempting to wage war, या

  • abetting the waging of war

को punish किया गया है।

इसलिए:

महत्वपूर्ण बात यह है कि Section 147 का actual offence ultimately complete होना Section 148 conspiracy के लिए आवश्यक नहीं है, क्योंकि Section 148 स्वयं conspiracy को independent offence के रूप में punish करता है और Explanation overt act की आवश्यकता को expressly remove करती है।

Second Form: Conspiracy to Overawe Government

Section 148 का दूसरा limb अलग प्रकार की conspiracy को cover करता है।

इसमें conspiracy का उद्देश्य होना चाहिए कि:

Central Government या any State Government को criminal force या criminal force के show के माध्यम से overawe किया जाए।

यहाँ “overawe” का concept महत्वपूर्ण है। इसका सामान्य अर्थ Government को criminal force या उसके प्रदर्शन के माध्यम से भयभीत/दबाव में लाकर उसके lawful governmental authority के exercise को प्रभावित करने का प्रयास है।

इस limb में conspiracy का object Government को criminal force या उसके show के माध्यम से overawe करना होना चाहिए।

No Overt Act Required

Section 148 की Explanation इस provision की सबसे महत्वपूर्ण विशेषताओं में से एक है।

यह स्पष्ट करती है:

“To constitute a conspiracy under this section, it is not necessary that any act or illegal omission shall take place in pursuance thereof.”

अर्थात conspiracy के लिए यह जरूरी नहीं कि conspirators ने अपने agreement को execute करने की दिशा में कोई overt act या illegal omission कर भी दिया हो।

इसे इस प्रकार समझें:

यह statutory rule Section 148 को सामान्य attempt या completed offence से अलग करता है।

Supreme Court on Criminal Conspiracy

Section 148 BNS नया provision है, लेकिन इसका conspiracy concept पुराने criminal conspiracy jurisprudence से जुड़ा है।

Supreme Court ने Noor Mohammad Mohd. Yusuf Momin v. State of Maharashtra, (1970) 1 SCC 696 में criminal conspiracy को substantive offence के रूप में explain किया और agreement को इसका foundation माना। (Sci API)

इसी principle को बाद के decisions में भी reaffirm किया गया है। Supreme Court ने कहा है कि conspiracy ordinarily secrecy में hatch होती है और direct evidence उपलब्ध होना आवश्यक नहीं; agreement को surrounding circumstances और conduct से infer किया जा सकता है, लेकिन inference legally established circumstances पर आधारित होना चाहिए। [State (NCT of Delhi) v. Nazir Khan and Waging War Jurisprudence

Section 148 के पहले limb को समझने के लिए Section 147 के “waging war” concept की Supreme Court jurisprudence भी relevant है।

Nazir Khan v. State of Delhi, (2003) 8 SCC 461 और State (NCT of Delhi) v. Navjot Sandhu, (2005) 11 SCC 600 में Supreme Court ने पुराने IPC Section 121 के संदर्भ में “waging war” की nature पर चर्चा की। Court ने इस expression को हर प्रकार की violent activity या ordinary public disorder के समान नहीं माना। (Sci API)

Section 148 में Section 147 offence की conspiracy होने के कारण, conspiracy के alleged object को identify करना और यह देखना आवश्यक होगा कि वह वास्तव में Section 147 के statutory offence से संबंधित है या नहीं।

Section 148 and Section 149: Difference

Section 149 एक अलग stage को cover करता है। इसमें कोई व्यक्ति men, arms or ammunition collect करता है या otherwise prepares to wage war, और उसका intention Government of India के विरुद्ध war wage करने या war के लिए prepared रहने का हो।

Territorial Reach

Section 148 expressly कहता है “within or without and beyond India”

इसका मतलब statutory provision भारत के बाहर से की गई ऐसी conspiracy को भी अपने textual scope में रखता है, यदि conspiracy Section 148 में specified object से संबंधित हो।

यह Section 148 की territorial reach को ordinary domestic conspiracy provisions की तुलना में विशेष रूप से महत्वपूर्ण बनाता है।

मान लीजिए A और B आपस में agreement करते हैं कि वे Government of India के विरुद्ध ऐसा war initiate करेंगे जो Section 147 के ambit में आता है।

यदि prosecution agreement/conspiracy establish कर देता है, तो:

केवल यह कहना कि दो या अधिक व्यक्तियों ने Government की किसी policy का विरोध किया, Government की आलोचना की या किसी political objective पर चर्चा की, अपने-आप Section 148 establish नहीं करता।

Section 148 के लिए prosecution को specified conspiracy establish करनी होगी—या तो Section 147 में punishable offence commit करने की conspiracy, या criminal force/show of criminal force के माध्यम से Central या State Government को overawe करने की conspiracy।
