Section 147 BNS 2023: Waging or Attempting to Wage War Against the Government of India

Section 147 of the Bharatiya Nyaya Sanhita, 2023 (BNS) Chapter VII “Of Offences Against the State” में स्थित एक अत्यंत गंभीर offence है। यह उस व्यक्ति को punish करता है जो भारत सरकार के विरुद्ध war wages, ऐसा war attempts करता है, अथवा ऐसे war को abets करता है।

Statutory Provision

Section 147 BNS provides:

“Whoever wages war against the Government of India, or attempts to wage such war, or abets the waging of such war, shall be punished with death, or imprisonment for life and shall also be liable to fine.”

इस Section की Illustration में कहा गया है कि यदि A joins an insurrection against the Government of India, तो A ने Section 147 में defined offence commit किया है।

Simple Meaning

Section 147 को केवल “सरकार के खिलाफ हिंसा” के रूप में समझना पर्याप्त नहीं है। इसका statutory concept “waging war against the Government of India” है।

Essential Ingredients

Section 147 के तहत prosecution के लिए conduct को statutory alternatives में से किसी एक में establish करना होगा:

Waging War

Accused ने Government of India के विरुद्ध war wage किया हो।

Attempting to Wage War

Accused ने war wage करने का attempt किया हो, भले ही war ultimately पूरा न हुआ हो।

Abetting Waging of War

Accused ने Government of India के विरुद्ध war wage करने के act को abet किया हो।

ये तीनों अलग statutory forms हैं और prosecution को जिस form में charge लगाया गया है, उसके आवश्यक ingredients establish करने होंगे।

Meaning of “Waging War”

“Waging war” Section 147 का सबसे महत्वपूर्ण concept है। BNS Section 147 की language पुराने IPC Section 121 से substantially identical है। Supreme Court ने IPC Section 121 की interpretation करते हुए कहा है कि “waging war” को ordinary violent disturbance या हर प्रकार के lawless violence के बराबर नहीं माना जा सकता। [Nazir Khan v. Supreme Court के अनुसार “waging war” का assessment करते समय nature and scale of the operation, arms/firepower, target, design and intention जैसे factors relevant हो सकते हैं। हर violent act, public-order disturbance या political objective से जुड़ी हिंसा स्वतः “waging war” नहीं बन जाती। [State (NCT of Delhi) v. Nazir Khan v. State of Delhi

Supreme Court ने Nazir Khan v. State of Delhi, (2003) 8 SCC 461 में “waging war” के concept को explain किया। Court ने यह emphasise किया कि केवल हथियार प्राप्त कर लेना और Government troops के विरुद्ध उनका उपयोग कर देना पर्याप्त नहीं है; conduct को एक planned operation के context में देखा जाना चाहिए और यह establish होना चाहिए कि objective Government forces को defeat/overwhelm करने तथा आगे resistance को crush करने की nature का था। (Sci API)

यह principle BNS Section 147 के interpretation में अत्यंत relevant है क्योंकि Section 147 ने IPC Section 121 की core language को retain किया है।

Navjot Sandhu @ Afsan Guru, (2005) 11 SCC 600 में Supreme Court ने Parliament attack के context में Section 121 IPC की applicability पर विस्तृत discussion किया। Court ने कहा कि “waging war” को इतना broad नहीं किया जाना चाहिए कि प्रत्येक violent act या public-order disturbance उसके भीतर आ जाए। साथ ही, war के assessment में target, objective, modus operandi और operation की nature महत्वपूर्ण factors हो सकते हैं। (CaseMine)

Mohammad Irfan v. State of Karnataka

Supreme Court ने Mohammad Irfan v. State of Karnataka, 11 July 2022 में Section 121 IPC के context में फिर से Nazir Khan और Navjot Sandhu के principles को consider किया। Court ने यह भी observe किया कि “waging war” को केवल इस आधार पर restrict नहीं किया जा सकता कि accused का उद्देश्य existing Government के स्थान पर कोई दूसरा Government स्थापित करना था या नहीं। (Sci API)

Political Objective Alone is Not Enough

Supreme Court की jurisprudence का महत्वपूर्ण point यह है कि केवल political objective या Government policy के विरोध में हिंसक activity को automatically “waging war” नहीं माना जा सकता।

इस distinction का practical importance बहुत अधिक है क्योंकि Section 147 में punishment अत्यंत गंभीर है।

Section 147 में punishment के दो प्रमुख alternatives हैं:

Section 148 में conspiracy के लिए यह आवश्यक नहीं है कि conspiracy के pursuance में कोई act या illegal omission वास्तव में हुआ हो।

Section 147 and Section 149: Difference

Section 149 उस stage को specifically address करता है जहाँ कोई व्यक्ति men, arms or ammunition collect करता है या otherwise prepares to wage war, और उसका intention Government of India के विरुद्ध war wage करने या war के लिए prepared रहने का हो।

इसलिए broad distinction:

Section 147 and Section 152: Important Distinction

Section 147 और Section 152 दोनों Chapter VII में हैं, लेकिन इनके ingredients अलग हैं।

Section 147 specifically war, attempt to wage war या abetment of waging war को address करता है।

Section 152 purposely or knowingly words, signs, visible representation, electronic communication, financial means या अन्य means से secession, armed rebellion, subversive activities, separatist activities को encourage करना अथवा India's sovereignty, unity and integrity को endanger करने वाले acts को punish करता है। Section 152 में lawful means से Government measures में alteration के लिए disapprobation को Explanation के अनुसार offence नहीं माना गया है, जब तक statutory prohibited activities excite/attempt न की जाएँ।

Section 147 and Constitutional Context

Section 147 का subject matter offences against the State से संबंधित है। इसके application में Court को statutory offence के ingredients को strictly examine करना होगा।

विशेष रूप से “waging war” को इतना व्यापक नहीं बनाया जा सकता कि हर प्रकार का violent protest, public disorder या Government criticism Section 147 बन जाए। Supreme Court ने पुराने Section 121 IPC के interpretation में इसी caution को emphasise किया है। [State (NCT of Delhi) v. BNS Section 147, पुराने IPC Section 121 के corresponding provision के रूप में आया है। दोनों provisions की substantive language लगभग समान है।
