Section 146 BNS 2023: Unlawful Compulsory Labour
Section 146 of the Bharatiya Nyaya Sanhita, 2023 (BNS) ऐसे व्यक्ति को punish करता है जो किसी person को उसकी इच्छा के विरुद्ध unlawfully labour करने के लिए compel करता है। यह provision व्यक्ति की freedom of choice और freedom from forced labour की criminal-law protection से संबंधित है।

Statutory Provision
Section 146 BNS का exact statutory rule है:
“Whoever unlawfully compels any person to labour against the will of that person…”
ऐसे व्यक्ति को imprisonment of either description up to one year, or fine, or both से punish किया जा सकता है।

Essential Ingredients
Section 146 के statutory language से offence के मुख्य ingredients निकलते हैं:

इन ingredients में “unlawfully” और “against the will” विशेष रूप से महत्वपूर्ण हैं। केवल employment dispute या किसी contractual disagreement से स्वतः Section 146 का offence establish नहीं होता; prosecution को statutory ingredients establish करने होंगे।

Meaning of “Compels”
“Compels” का statutory context यह बताता है कि accused का conduct ऐसा होना चाहिए जिससे व्यक्ति को उसकी इच्छा के विरुद्ध labour करने के लिए बाध्य किया जाए।
इसमें factual circumstances महत्वपूर्ण होंगे—जैसे coercion, threat या अन्य unlawful pressure के माध्यम से व्यक्ति से काम कराया गया हो। लेकिन Section 146 के लिए प्रत्येक कठोर या अनुचित employment condition को स्वतः “compulsion” मानना उचित नहीं होगा; criminal liability statutory ingredients और evidence पर depend करेगी।

Meaning of “Against the Will”
Section 146 में legislature ने expressly “against the will of that person” शब्दों का इस्तेमाल किया है।
इसका अर्थ है कि prosecution को यह establish करना होगा कि labour कराया जाना संबंधित व्यक्ति की इच्छा के विपरीत था।

Punishment
Section 146 में Court के पास तीन statutory alternatives हैं:
Imprisonment:
Either description की imprisonment, जो one year तक हो सकती है।
Fine:
केवल fine भी लगाया जा सकता है।
Both:
Imprisonment और fine दोनों लगाए जा सकते हैं।
इसलिए Section 146 में mandatory imprisonment नहीं है; statute imprisonment, fine अथवा दोनों में से punishment prescribe करता है।

इसलिए Section 146 को Section 145 जैसे slavery-related serious offence से procedural classification में अलग समझना चाहिए। Section 145 cognizable, non-bailable और Court of Session triable है, जबकि Section 146 cognizable, bailable और any Magistrate triable है।

Section 145 and Section 146: Difference
दोनों provisions slavery और labour exploitation से जुड़े हैं, लेकिन उनका statutory focus अलग है।

Relationship with Constitutional Protection
Section 146 को constitutional prohibition against forced labour के broader context में भी देखा जा सकता है। Article 23(1) of the Constitution of India traffic in human beings और begar तथा other similar forms of forced labour को prohibit करता है।
इसलिए Section 146 का subject matter constitutional protection against forced labour से closely connected है। लेकिन constitutional violation और Section 146 की criminal liability को identical मानना उचित नहीं है—criminal prosecution में BNS Section 146 के statutory ingredients को establish करना आवश्यक होगा।

People's Union for Democratic Rights v. Union of India
Supreme Court ने Article 23 की interpretation करते हुए forced labour को केवल physical force तक सीमित नहीं माना और यह स्पष्ट किया कि आर्थिक परिस्थितियों से उत्पन्न ऐसी स्थिति जिसमें व्यक्ति अपनी इच्छा के विरुद्ध labour करने के लिए बाध्य हो, constitutional prohibition के scope में आ सकती है। [People's Union for Democratic Rights v. यह judgment Section 146 BNS की direct interpretation नहीं है; इसका relevance Article 23 के forced-labour principle के संदर्भ में है।

Practical Example
मान लीजिए A, B को unlawful threat या अन्य unlawful compulsion के माध्यम से उसकी इच्छा के विरुद्ध काम करने के लिए बाध्य करता है।
