Section 145 BNS 2023: Habitual Dealing in Slaves
Section 145 of the Bharatiya Nyaya Sanhita, 2023 (BNS) मानव दासता से संबंधित ऐसे conduct को अपराध बनाता है जिसमें कोई व्यक्ति habitually slaves को import, export, remove, buy, sell, traffic या deal करता है। यह provision पुराने IPC Section 371 के corresponding provision के रूप में BNS में मौजूद है। (IndiaCode by eCourtsIndia)

Statutory Provision
Section 145 BNS के अनुसार, जो व्यक्ति habitually imports, exports, removes, buys, sells, traffics or deals in slaves, उसे imprisonment for life, अथवा imprisonment of either description up to 10 years, और fine से punish किया जा सकता है।

Meaning of Section 145
Section 145 का मुख्य उद्देश्य ऐसे व्यक्ति को punish करना है जो slavery-related activities में habitually involved है।
इस Section में केवल एक isolated transaction को statutory language सीधे पर्याप्त नहीं बताती; provision में “habitually” शब्द का प्रयोग किया गया है। इसलिए prosecution को habitual conduct establish करना महत्वपूर्ण होगा।
इस Section के अंतर्गत निम्न activities expressly covered हैं:

Section 145 के statutory wording को देखते हुए prosecution के लिए मुख्यतः निम्न aspects महत्वपूर्ण हैं:
There Must Be Dealing in Slaves
Accused का conduct slaves से संबंधित होना चाहिए। Provision ने “import”, “export”, “remove”, “buy”, “sell”, “traffic” और “deal” जैसे अलग-अलग acts expressly enumerate किए हैं।

Habitual Conduct
Section 145 का सबसे महत्वपूर्ण शब्द “habitually” है।
इसका अर्थ यह है कि prosecution को केवल किसी एक घटना पर निर्भर रहने के बजाय ऐसे facts/evidence establish करने होंगे जिनसे accused की repeated या habitual involvement दिखाई दे।
हालाँकि, BNS Section 145 स्वयं “habitually” की कोई separate statutory definition नहीं देता। इसलिए किसी particular case में habitual conduct का determination evidence और circumstances के आधार पर होगा।

Punishment
Section 145 में दो alternative imprisonment options दिए गए हैं:
Life imprisonment, अथवा
Imprisonment of either description up to 10 years + fine.
“Imprisonment of either description” का अर्थ statutory framework में rigorous imprisonment या simple imprisonment में से applicable imprisonment है।
इसलिए Section 145 एक गंभीर offence है और इसमें Court के पास statutory maximum के भीतर punishment determine करने की discretion रहती है।

BNSS First Schedule के अनुसार Section 145 का classification है:

इसका practical consequence यह है कि Section 145 के मामले में police investigation और arrest से संबंधित BNSS के cognizable-offence framework लागू होंगे, जबकि bail का प्रश्न non-bailable offence के applicable provisions के अनुसार निर्धारित होगा।

Section 145 and Section 143: Important Distinction
Trafficking और habitual dealing in slaves को एक ही offence नहीं माना जाना चाहिए।
Section 143 में trafficking की statutory definition दी गई है और exploitation का purpose expressly incorporated है। दूसरी ओर Section 145 में legislature ने विशेष रूप से habitual import, export, removal, buying, selling, trafficking or dealing in slaves को punish किया है।

Relationship with IPC Section 371
BNS Section 145 का predecessor IPC Section 371 था, जिसका title भी “Habitual dealing in slaves” था।
दोनों provisions की operative language substantially identical है। BNS Section 358 ने IPC को repeal किया और BNS 1 July 2024 से लागू हुआ; इसलिए 1 July 2024 के बाद के conduct के लिए corresponding provision Section 145 BNS है। (IndiaCode by eCourtsIndia)

Importance of the Word “Habitually”
Section 145 की prosecution में “habitually” एक central issue है।

Section 145 automatically established नहींलेकिन यदि evidence से repeated conduct, continuing dealings या slavery-related transactions का pattern establish होता है, तो habitual element का प्रश्न materially मजबूत हो सकता है।
इसलिए investigation में previous transactions, communications, financial dealings, transportation records, witnesses और अन्य relevant evidence का महत्व हो सकता है। वास्तविक case में admissibility और evidentiary value Bharatiya Sakshya Adhiniyam, 2023 तथा facts पर depend करेगी।

Supreme Court Judgments
Section 145 BNS पर अभी ऐसा direct Supreme Court judgment identified नहीं है जो BNS Section 145 के “habitually” या इसके सभी ingredients की authoritative interpretation करता हो। इसलिए किसी IPC Section 371 case को बिना qualification के BNS Section 145 का direct precedent कहना उचित नहीं होगा।
IPC Section 371 का statutory text BNS Section 145 में substantially carried forward हुआ है। इसलिए पुराने Section 371 के judicial decisions interpretative assistance दे सकते हैं, लेकिन BNS के तहत उनका application facts और statutory continuity के आधार पर करना होगा। (IndiaCode by eCourtsIndia)

Practical Example
मान लीजिए A लगातार कई व्यक्तियों को slavery के लिए खरीदता, बेचता और दूसरे स्थानों पर भेजता है तथा उसके विरुद्ध repeated transactions का evidence उपलब्ध है।
ऐसे facts में analysis इस प्रकार होगा:
