Section 144 BNS 2023: Exploitation of a Trafficked Person
Section 144 of the Bharatiya Nyaya Sanhita, 2023 (BNS) trafficking के बाद उस व्यक्ति के exploitation को अलग अपराध के रूप में punish करता है। इसमें trafficked child और trafficked person के लिए अलग-अलग punishment निर्धारित की गई है।

Statutory Scheme
Section 144 को दो parts में समझा जाता है:

Object of Section 144
Section 143 BNS trafficking के act को punish करता है, जबकि Section 144 trafficking के परिणामस्वरूप trafficked person के exploitation को separately criminalise करता है।
इसे इस प्रकार समझा जा सकता है:

Separate criminal liabilityइसलिए Section 143 और Section 144 का subject matter closely connected है, लेकिन दोनों provisions का statutory focus अलग है।

Section 144(1): Exploitation of a Trafficked Child
Section 144(1) specifically trafficked child के exploitation को address करता है।
इस offence के लिए punishment है:
minimum 5 years rigorous imprisonment
जो 10 years तक extend हो सकती है
और fine भी लगाया जाएगा।
BNSS First Schedule इसे cognizable, non-bailable offence classify करती है और इसका trial Court of Session में होगा।
BNS में “child” का अर्थ 18 वर्ष से कम आयु का व्यक्ति है। इसलिए Section 144(1) में child की age determination महत्वपूर्ण factual issue हो सकती है।

Section 144(2): Exploitation of a Trafficked Person
Section 144(2) trafficked person के exploitation को punish करता है।
इसमें punishment है:
Rigorous imprisonment for not less than 3 years but which may extend to 7 years, and fine.
इस offence को भी BNSS First Schedule के अनुसार cognizable और non-bailable रखा गया है तथा trial Court of Session में होगा।

Meaning of Exploitation
Section 144 को Section 143 के साथ पढ़ना आवश्यक है। Section 143 trafficking को exploitation के purpose से किए गए specified acts के रूप में address करता है। Section 144 उस trafficked person के exploitation को separately punish करता है।
इसलिए किसी particular prosecution में Court को statutory ingredients और prosecution evidence के आधार पर यह determine करना होगा कि:

Section 144 and Child Trafficking
Child trafficking के context में Sections 143 और 144 को अलग-अलग समझना जरूरी है।
Section 143(4) trafficking of a child को punish करता है, जिसके लिए minimum 10 years rigorous imprisonment और life imprisonment तक का provision है।
इसके बाद यदि trafficked child का exploitation होता है, तो Section 144(1) का independent offence भी relevant हो सकता है, जिसके लिए 5–10 years rigorous imprisonment और fine prescribed है।
इस प्रकार statutory scheme trafficking और subsequent exploitation दोनों को अलग-अलग criminal conduct के रूप में address करती है।

Cognizable and Non-Bailable Offence
Section 144 के दोनों sub-sections को BNSS First Schedule में:
Cognizable + Non-bailable + Court of Session triable
classify किया गया है।
BNSS के अनुसार cognizable offence वह है जिसमें police officer warrant के बिना arrest कर सकता है; और non-bailable offence का अर्थ यह नहीं है कि bail कभी नहीं दी जा सकती, बल्कि bail का determination applicable statutory provisions और judicial discretion के अनुसार होता है।

Duty to Give Information
BNSS Section 33 में Sections 140 to 144 BNS के offences को उन offences की सूची में expressly शामिल किया गया है जिनके commission या intention की जानकारी रखने वाले व्यक्ति को nearest Magistrate या police officer को forthwith information देना है।
यह Section 144 के मामलों में reporting obligation के procedural framework को समझने के लिए महत्वपूर्ण है।

Supreme Court Judgments
Section 144 BNS एक नया BNS provision है और उपलब्ध material के आधार पर Section 144 BNS की exact statutory language पर Supreme Court का कोई leading judgment identified नहीं है। इसलिए किसी पुराने IPC case को Section 144 BNS की direct authoritative interpretation के रूप में प्रस्तुत करना उचित नहीं होगा।
हालाँकि, trafficking और exploitation से जुड़े मामलों में Supreme Court के पुराने decisions facts और applicable predecessor/special laws के संदर्भ में relevant हो सकते हैं। किसी specific case में उन authorities को BNS Section 144 के statutory text के साथ carefully distinguish करना आवश्यक होगा।

Practical Example
मान लीजिए किसी व्यक्ति को Section 143 के ingredients के अनुसार trafficking के माध्यम से एक जगह लाया गया और बाद में उसका exploitation किया गया।
ऐसी स्थिति में analysis दो स्तर पर किया जाएगा:
