Section 140 BNS 2023: Kidnapping or Abducting in Order to Murder or for Ransom

Section 140 of the Bharatiya Nyaya Sanhita, 2023 (BNS) kidnapping और abduction के उन गंभीर forms को punish करता है जिनमें victim को murder, ransom, secret and wrongful confinement, grievous hurt, slavery या unnatural lust जैसे specific purposes के लिए kidnap या abduct किया जाता है। Section 140 में अलग-अलग circumstances के लिए अलग punishment prescribed है, जिसमें कुछ परिस्थितियों में death penalty या life imprisonment तक का प्रावधान है।

Statutory Scheme

Section 140 को चार मुख्य aggravated situations में समझा जा सकता है:

Section 140(1) — kidnapping/abduction in order to murder.

Section 140(2) — kidnapping/abduction for ransom or to compel Government, foreign State, international inter-governmental organisation or any other person to do or abstain from doing an act.

Section 140(3) — kidnapping/abduction with intent to cause secret and wrongful confinement.

Section 140(4) — kidnapping/abduction with the object or knowledge relating to grievous hurt, slavery or unnatural lust.

Section 140(1): Kidnapping or Abduction in Order to Murder

Section 140(1) तब लागू होता है जब कोई व्यक्ति किसी person को kidnap या abduct करता है:

  • ताकि उस person को murder किया जाए; या

  • उसे इस प्रकार dispose किया जाए कि उसे murder किए जाने का danger हो।

इस offence के दो core components हैं:

Kidnapping/abduction, और

specific murderous purpose or knowledge.

केवल kidnapping prove हो जाना Section 140(1) के लिए पर्याप्त नहीं है। Prosecution को kidnapping/abduction के साथ requisite intention/knowledge भी establish करना होगा।

Punishment under Section 140(1)

Section 140(1) के तहत punishment है:

  • Imprisonment for life, या

  • rigorous imprisonment up to 10 years, और

  • fine.

यह offence BNSS First Schedule के अनुसार cognizable और non-bailable है तथा इसका trial Court of Session द्वारा किया जाता है।

Illustration under Section 140(1)

BNS स्वयं दो illustrations देता है।

यदि A, Z को India से kidnap करता है और उसका intention या knowledge है कि Z को किसी idol के लिए sacrifice किया जा सकता है, तो Section 140(1) लागू हो सकता है।

दूसरे illustration में A, B को उसके home से forcibly carry या entice करता है ताकि B को murder किया जा सके। यह भी Section 140(1) का offence है।

इन illustrations से स्पष्ट होता है कि actual murder का होना आवश्यक नहीं है; kidnapping/abduction के समय requisite murderous purpose या knowledge statutory requirement है।

Leading Supreme Court Judgment: Badshah v. State of Uttar Pradesh

Badshah & Others v. State of Uttar Pradesh, (2008) 3 SCC 681, Supreme Court of India corresponding IPC Section 364 के interpretation के लिए महत्वपूर्ण authority है।

Supreme Court ने कहा कि Section 364 के ingredients में kidnapping prove करना और यह establish करना शामिल है कि kidnapping इस purpose से हुई थी कि victim को murder किया जाए या उसे ऐसी स्थिति में dispose किया जाए जिससे murder का danger हो। Court ने यह भी स्पष्ट किया कि kidnapping अपने-आप यह inference नहीं देती कि उसका purpose क्या था; intention को prior, contemporaneous और subsequent circumstances से determine किया जा सकता है। (CaseMine)

यह principle BNS Section 140(1) के लिए highly relevant है क्योंकि इसकी statutory language corresponding IPC Section 364 के समान है।

Section 140(2): Kidnapping for Ransom

Section 140(2) सबसे गंभीर provisions में से एक है।

यह तब लागू होता है जब accused:

  • किसी person को kidnap या abduct करता है; या

  • kidnapping/abduction के बाद उस person को detention में रखता है;

और:

  • death या hurt की threat देता है; या

  • अपने conduct से reasonable apprehension पैदा करता है कि victim को death या hurt हो सकता है; या

  • victim को hurt या death cause करता है,

in order to compel Government, foreign State, international inter-governmental organisation या any other person:

Three Alternative Components under Section 140(2)

Section 140(2) की language में statutory structure carefully देखना आवश्यक है।

पहले kidnapping/abduction या उसके बाद detention होना चाहिए।

इसके बाद “and” के साथ death/hurt threat या reasonable apprehension वाला component आता है।

इसके बाद “or” के माध्यम से hurt/death cause करके Government या किसी other person को compel करने वाला alternative आता है।

इस statutory structure को Supreme Court ने corresponding IPC Section 364-A के context में specifically examine किया है। Mohan Lal Sharma v. State of Uttar Pradesh, 2023 में Supreme Court ने Section 364-A के conditions को अलग-अलग identify करते हुए बताया कि kidnapping/detention, threat/reasonable apprehension और ransom/compulsion elements को statutory language के अनुसार पढ़ना आवश्यक है। (Science Government Portal)

Ransom Is Not the Only Purpose

Section 140(2) को केवल “kidnapping for ransom” तक सीमित करना technically सही नहीं है।

Statutory wording Government, foreign State, international inter-governmental organisation or any other person को compel करने के उद्देश्य को भी cover करती है।

इसलिए ransom demand न होने पर भी, यदि statutory threat/hurt/death और compulsion elements किसी act को करने या न करने के लिए establish होते हैं, तो Section 140(2) की applicability examine की जा सकती है।

Leading Supreme Court Judgment on Ransom

Mohan Lal Sharma v. State of Uttar Pradesh, 2023, Supreme Court of India corresponding IPC Section 364-A की interpretation के लिए महत्वपूर्ण authority है। Supreme Court ने इस provision के ingredients को conjunctive और alternative components में analyse किया और स्पष्ट किया कि prosecution को statutory requirements के अनुसार kidnapping/detention तथा threat/reasonable apprehension और ransom/compulsion components establish करने होते हैं। (Science Government Portal)

इसी principle को BNS Section 140(2) के substantially similar language के context में relevant माना जा सकता है, हालांकि यह IPC-era judgment है, BNS Section 140 पर direct judgment नहीं।

Section 140(2) Punishment

Section 140(2) के तहत:

  • Death, या

  • Imprisonment for life, और

  • fine

का provision है।

BNSS First Schedule के अनुसार यह cognizable, non-bailable और Court of Session triable offence है।

Section 140(3): Secret and Wrongful Confinement

Section 140(3) तब लागू होता है जब कोई व्यक्ति किसी person को kidnap या abduct करता है और उसका intention उस person को:

“secretly and wrongfully confined”

करने का होता है।

यहाँ दो essential elements हैं:

Kidnapping or abduction, और

intention to secretly and wrongfully confine the victim.

इसलिए mere wrongful confinement और Section 140(3) identical offences नहीं हैं। Section 140(3) में kidnapping/abduction और specific intention अतिरिक्त ingredients हैं।

Meaning of Secret and Wrongful Confinement

BNS Section 127 wrongful confinement को define करता है। जब कोई व्यक्ति दूसरे व्यक्ति को इस प्रकार wrongfully restrain करता है कि उसे certain circumscribing limits से बाहर जाने से रोका जाता है, तो वह wrongful confinement है।

Section 140(3) में इसके साथ secretly confined करने का specific intention होना चाहिए।

Supreme Court ने corresponding IPC Section 365 के context में ऐसे cases को examine किया है। State of Assam v. R. K. Punishment under Section 140(3)

Section 140(3) के तहत:

  • Imprisonment of either description up to 7 years, और

  • fine

prescribed है।

BNSS First Schedule के अनुसार यह offence:

  • Cognizable

  • Non-bailable

  • Triable by Magistrate of the First Class

है।

Section 140(4): Grievous Hurt, Slavery or Unnatural Lust

Section 140(4) kidnapping/abduction के एक अलग aggravated purpose को cover करता है।

यह provision तब लागू होता है जब व्यक्ति को kidnap या abduct किया जाता है:

  • grievous hurt के लिए;

  • slavery के लिए;

  • किसी person की unnatural lust के लिए;

या accused को यह knowledge हो कि victim को इस प्रकार subject या dispose किया जाना likely है।

इसलिए Section 140(4) में intention के साथ-साथ statutory wording के अनुसार knowledge of likelihood भी relevant हो सकती है।

Essential Ingredients of Section 140(4)

Section 140(4) के मुख्य ingredients हैं:

Kidnapping or abduction

और

specific purpose/knowledge कि victim को grievous hurt, slavery या unnatural lust के लिए subject किया जाएगा या ऐसी danger में dispose किया जाएगा।

Actual grievous hurt, slavery या sexual exploitation का completion हर case में आवश्यक नहीं है यदि statutory purpose/knowledge itself proved है।

Vinod Chaturvedi v. State of Madhya Pradesh, (1984) 2 SCC 350, Supreme Court of India corresponding IPC provisions concerning abduction की interpretation में relevant authority है। Supreme Court ने abduction के लिए force या deceitful means से inducement की statutory requirement पर विचार किया।

इस judgment से Section 138 BNS की abduction definition के साथ-साथ Section 140 जैसे aggravated abduction offences के लिए foundational principle मिलता है: पहले यह establish करना आवश्यक है कि statutory sense में abduction वास्तव में हुई। (Sci API)

Section 140(4) and Section 141

Section 140(4) में kidnapping/abduction का purpose grievous hurt, slavery या unnatural lust है।

इसके विपरीत Section 141 BNS India के बाहर से किसी girl under 21 years या boy under 18 years को import करने से संबंधित है, जब purpose forced or seduced illicit intercourse हो।

इसलिए दोनों provisions में sexual exploitation-related factual overlap संभव हो सकता है, लेकिन statutory ingredients अलग हैं।

Section 140(4) के तहत:

  • Imprisonment up to 10 years, और

  • fine

prescribed है।

BNSS First Schedule इसे cognizable, non-bailable और Court of Session triable offence classify करता है।

Section 140 and Section 137

Section 137 kidnapping को define और punish करता है। सामान्य kidnapping के लिए maximum punishment 7 years and fine है।

Section 140 aggravated kidnapping/abduction को punish करता है जहाँ kidnapping/abduction के पीछे specific serious purpose मौजूद हो।

इसलिए Section 140 को Section 137 का simple repetition नहीं माना जा सकता। Section 140 में additional purpose or knowledge statutory offence को aggravated बनाता है।

Section 138 केवल abduction की definition देता है—force से compel करना या deceitful means से induce करना।

Section 140 उस defined kidnapping/abduction को तब punish करता है जब उसके साथ specific aggravated purpose मौजूद हो।

Section 138: “क्या victim को force/deceitful means से किसी place से जाने के लिए induce किया गया?”

Section 140: “यदि abduct किया गया, तो किस specific purpose से?”

Section 140 and Section 142

Section 142 knowingly kidnapped या abducted person को wrongfully conceal या confine करने वाले person को punish करता है।

Section 140 में accused स्वयं kidnapping/abduction करता है और specific purpose/knowledge statutory ingredient है।

Section 142 में accused को यह knowledge होना चाहिए कि person kidnapped या abducted है और वह thereafter उसे wrongfully conceal/confine करता है।

Procedural Classification

Section 140 के सभी four sub-sections में offence cognizable और non-bailable है, लेकिन trial court अलग हो सकता है।

Sections 140(1), 140(2) और 140(4) का trial Court of Session करता है, जबकि Section 140(3) का trial Magistrate of the First Class करता है।

इस classification का practical महत्व bail, investigation और trial jurisdiction के context में है।

Evidence and Proof

Section 140 के prosecution में केवल victim को kidnap या abduct किए जाने का evidence पर्याप्त नहीं हो सकता। प्रत्येक sub-section का specific mens rea/purpose independently relevant है।

Is Section 140 Compoundable?

BNSS Section 359 की compounding table में Section 140 BNS listed नहीं है। इसलिए Section 140 के offences को BNSS Section 359 के तहत compoundable offence नहीं माना जाता

Conclusion

Section 140 BNS, 2023 kidnapping और abduction के aggravated forms को punish करने वाला महत्वपूर्ण provision है। इसमें murder, ransom, secret wrongful confinement, grievous hurt, slavery और unnatural lust जैसे serious purposes को अलग-अलग statutory clauses में address किया गया है।
