Section 135 BNS 2023: Assault or Criminal Force in Attempt to Wrongfully Confine a Person
Section 135 of the Bharatiya Nyaya Sanhita, 2023 (BNS) उस स्थिति को अपराध बनाता है जब कोई व्यक्ति किसी अन्य व्यक्ति को wrongfully confine करने के attempt में उस व्यक्ति पर assault या criminal force का प्रयोग करता है। इस offence के लिए अधिकतम एक वर्ष का imprisonment, या ₹5,000 तक fine, या दोनों का प्रावधान है।

Statutory Provision
Section 135 BNS का मूल प्रावधान है:
“Whoever assaults or uses criminal force to any person, in attempting wrongfully to confine that person…”
ऐसे व्यक्ति को imprisonment of either description up to one year, or fine up to ₹5,000, or both से punish किया जा सकता है।
यह provision IPC Section 357 का corresponding provision है। IPC Section 357 और BNS Section 135 की statutory language लगभग समान है। (IndiaCode by eCourtsIndia)

Object and Scope
Section 135 का application तब होता है जब wrongful confinement अभी पूर्ण रूप से establish न हुआ हो, लेकिन किसी व्यक्ति को wrongfully confine करने के attempt के दौरान assault या criminal force किया गया हो।
इसलिए Section 135 को समझने के लिए तीन concepts को अलग-अलग समझना आवश्यक है:
Assault → Criminal Force → Wrongful Confinement
BNS में wrongful restraint और wrongful confinement को Sections 126 और 127 में separately define किया गया है।

Essential Ingredients
Assault or Criminal Force
Section 135 का पहला essential ingredient है कि accused ने किसी person पर assault या criminal force किया हो।
BNS Section 130 assault को define करता है। Assault के लिए actual physical contact आवश्यक नहीं है। ऐसा gesture या preparation भी assault हो सकता है जिससे व्यक्ति को reasonable apprehension हो कि उसके विरुद्ध criminal force का प्रयोग किया जाने वाला है।
इसलिए केवल मारना, पकड़ना या धक्का देना ही relevant conduct नहीं है; facts के अनुसार threat या gesture भी Section 130 के assault की definition को satisfy कर सकता है।

Attempt to Wrongfully Confine
दूसरा और सबसे महत्वपूर्ण ingredient है कि assault/criminal force “in attempting wrongfully to confine that person” किया गया हो।
अर्थात assault और proposed wrongful confinement के बीच causal connection होना चाहिए।
यदि A ने B को किसी अन्य उद्देश्य से मारा और उसका उद्देश्य B को confine करना नहीं था, तो केवल assault के आधार पर Section 135 automatically लागू नहीं होगा।

Same Person Must Be the Target
Section 135 की language में है:
“to any person, in attempting wrongfully to confine that person”
इसलिए जिस person के विरुद्ध assault/criminal force किया गया है, उसी person को wrongfully confine करने का attempt होना statutory language का महत्वपूर्ण हिस्सा है।

Meaning of Wrongful Confinement
BNS Section 127(1) के अनुसार जब कोई व्यक्ति किसी अन्य व्यक्ति को इस प्रकार wrongfully restrain करता है कि उसे certain circumscribing limits से बाहर जाने से रोक दिया जाए, तो वह wrongful confinement है।
उदाहरण के लिए, यदि A किसी कमरे के दरवाजे पर B को रोकने के लिए force का प्रयोग करता है ताकि B उस कमरे से बाहर न जा सके, तो facts के अनुसार यह wrongful confinement की दिशा में conduct हो सकता है।

Wrongful Restraint and Wrongful Confinement — Difference
यह distinction Section 135 के लिए अत्यंत महत्वपूर्ण है।
Wrongful restraint में व्यक्ति को उस direction में जाने से रोका जाता है जिसमें उसे जाने का अधिकार है।
Wrongful confinement wrongful restraint का अधिक specific form है, जिसमें व्यक्ति को certain circumscribing limits के भीतर रोक दिया जाता है।
उदाहरण के लिए:
A सड़क पर B का रास्ता रोकता है → facts के अनुसार wrongful restraint.
A B को कमरे के अंदर रोक देता है और B कमरे की सीमा से बाहर नहीं जा सकता → wrongful confinement.
BNS Section 126 wrongful restraint और Section 127 wrongful confinement को अलग-अलग deal करते हैं।

Attempt and Completed Offence
Section 135 विशेष रूप से “attempting wrongfully to confine” की स्थिति को address करता है।
यदि wrongful confinement वास्तव में complete हो जाता है, तो facts के अनुसार Section 127 भी attract हो सकता है। दूसरी ओर, यदि confinement complete नहीं हुआ लेकिन उसे wrongfully confine करने के attempt में assault/criminal force किया गया, तो Section 135 relevant हो सकता है।
इसलिए prosecution को alleged conduct की stage और nature दोनों establish करनी होंगी।

Punishment under Section 135
Section 135 के तहत:

BNSS First Schedule के अनुसार Section 135 BNS का offence:
Cognizable है;
Bailable है; और
Any Magistrate द्वारा triable है।

इसका practical significance यह है कि यह offence cognizable होने के कारण police investigation के लिए statutory powers का उपयोग कर सकती है, जबकि bailable होने के कारण accused को bail का statutory right उपलब्ध होता है, subject to applicable procedural requirements.

Is Section 135 Compoundable?
यहाँ एक महत्वपूर्ण procedural point है।
BNSS Section 359 की compounding table में Sections 131, 133 और 136 BNS के offences specifically listed हैं, लेकिन Section 135 BNS listed नहीं है। इसलिए Section 135 को Section 359 के तहत ordinarily compoundable offence नहीं माना जा सकता।
यह Section 135 को Section 133 से अलग करता है।

Section 135 and Section 127 — Difference
इन दोनों provisions को अलग रखना आवश्यक है।
Section 127 BNS स्वयं wrongful confinement को punish करता है।
Section 135 BNS उस conduct को punish करता है जिसमें wrongful confinement करने के attempt में assault या criminal force किया जाता है।
इसलिए Section 135 में assault/criminal force एक अतिरिक्त statutory ingredient है।

Section 135 and Section 134 — Difference
Section 134 और Section 135 दोनों Chapter VI में assault/criminal force से संबंधित specific offences हैं, लेकिन उनका object अलग है।
Section 134: assault/criminal force + theft attempt involving property worn or carried by the person.
Section 135: assault/criminal force + attempt to wrongfully confine that person.
Section 134 में property-related purpose आवश्यक है, जबकि Section 135 में wrongful confinement का attempt आवश्यक है।

Section 135 and Section 131 — Difference
Section 131 सामान्य assault/criminal force को cover करता है, जब वह grave and sudden provocation के अलावा किया गया हो।
Section 135 में assault/criminal force का specific purpose or connection wrongful confinement के attempt से होना आवश्यक है।
इसलिए प्रत्येक assault का मामला Section 135 नहीं बनेगा; wrongful confinement attempt से संबंधित additional ingredient establish करना आवश्यक है।

Corresponding IPC Provision
BNS Section 135 का corresponding provision IPC Section 357 था, जिसका title भी “Assault or criminal force in attempt wrongfully to confine a person” था। BNS में इसे substantially carry forward किया गया है, जबकि fine को ₹1,000 से बढ़ाकर ₹5,000 किया गया है। (IndiaCode by eCourtsIndia)

Leading Supreme Court Judgments

State of M.P. v. Mehtaab, 2015, Supreme Court of India का उल्लेख IPC Section 357 के context में मिलता है, लेकिन उपलब्ध material से यह स्पष्ट है कि Supreme Court का principal issue Section 357 BNS/IPC के ingredients की interpretation नहीं था। इसलिए इसे Section 135 के ingredients पर leading authority के रूप में cite करना उचित नहीं होगा। (IndiaCode by eCourtsIndia)
यह distinction महत्वपूर्ण है क्योंकि केवल किसी judgment में IPC Section 357 का उल्लेख होना और उस Section के ingredients पर binding ratio निर्धारित करना अलग बातें हैं।

Jay Engineering Works Ltd. & Ors. v. State of West Bengal & Ors., Supreme Court, 1967 में Supreme Court ने “gherao” की factual/legal nature पर विचार करते हुए wrongful restraint, wrongful confinement, assault और IPC Section 357 का संदर्भ लिया। Judgment में Court ने wrongful confinement को ऐसी restraint के रूप में explain किया जिसमें व्यक्ति को निश्चित सीमाओं के बाहर जाने से रोका जाता है। (Indian Kanoon)
यह decision Section 135 के लिए विशेष रूप से useful है क्योंकि यह wrongful confinement और assault/criminal force के relationship को समझने में सहायता करता है। हालांकि यह भी IPC-era judgment है और directly BNS Section 135 पर decided case नहीं है।

Legal Test for Section 135
Section 135 के किसी prosecution में Court को broadly यह examine करना होगा:
क्या assault या criminal force हुआ?
↓
क्या वह act victim को wrongfully confine करने के attempt के दौरान/उद्देश्य से किया गया था?
↓
क्या proposed conduct wrongful confinement की statutory concept तक पहुँचता है?
↓
क्या prosecution ने इन ingredients को admissible evidence से establish किया है?
यदि केवल assault establish हो और wrongful confinement का attempt establish न हो, तो Section 135 की applicability अलग प्रश्न बन जाती है।

Important Evidence Considerations
Section 135 के prosecution में facts के अनुसार निम्न evidence relevant हो सकते हैं:
eyewitness testimony;
CCTV/video footage;
location और surrounding circumstances;
injury या medical evidence, जहाँ assault/criminal force alleged हो;
accused और victim के conduct;
alleged confinement की जगह और physical boundaries;
electronic communications, यदि वे intention या circumstances establish करने के लिए legally admissible हों।
Evidence की admissibility और proof Bharatiya Sakshya Adhiniyam, 2023 के applicable provisions के अनुसार निर्धारित होगी।

Conclusion
Section 135 BNS, 2023 का उद्देश्य उस specific conduct को punish करना है जिसमें किसी व्यक्ति को wrongfully confine करने के attempt में assault या criminal force का प्रयोग किया जाता है। इसकी maximum punishment one year imprisonment, ₹5,000 fine, or both है। यह cognizable, bailable और Any Magistrate द्वारा triable offence है।
Section 135 को समझने में BNS Sections 126 और 127 के wrongful restraint/wrongful confinement definitions तथा Section 130 की assault definition सबसे महत्वपूर्ण statutory provisions हैं। इसके predecessor IPC Section 357 के judgments केवल उसी सीमा तक उपयोगी हैं जहाँ वे relevant legal principles explain करते हैं; उन्हें BNS-specific Supreme Court rulings के रूप में प्रस्तुत नहीं किया जाना चाहिए।
