Section 132 BNS 2023: Assault or Criminal Force to Deter Public Servant from Discharge of Duty

Section 132 of the Bharatiya Nyaya Sanhita, 2023 (BNS) public servants को उनके lawful official duties के discharge में assault या criminal force से protection देता है। यदि कोई व्यक्ति किसी public servant पर assault या criminal force करता है, या उसे उसके duty से रोकने/डराने के उद्देश्य से ऐसा करता है, अथवा public servant द्वारा lawful discharge of duty में किए गए act के consequence में ऐसा करता है, तो Section 132 लागू हो सकता है।

Statutory Provision

Section 132 BNS के अनुसार, यदि कोई व्यक्ति—

  • किसी public servant पर उसके duty के execution में assault करता है या criminal force use करता है; या

  • उस public servant को उसके duty को discharge करने से prevent या deter करने के intention से assault/criminal force करता है; या

  • public servant द्वारा उसके duty के lawful discharge में किए गए किसी act के consequence में assault/criminal force करता है,

तो उसे imprisonment of either description up to 2 years, or fine, or both से punish किया जा सकता है।

यह provision पुराने Section 353 IPC के corresponding provision के रूप में लागू हुआ है। BNS 1 July 2024 से प्रभावी है। (India Code)

Section 132 BNS

Object of Section 132

Section 132 का उद्देश्य public servant को उसके lawful official functions के दौरान या उन functions के कारण होने वाले assault/criminal force से protect करना है।

लेकिन Section 132 हर disagreement, protest, verbal argument या obstruction को अपराध नहीं बनाता। Provision में specifically assault या criminal force की requirement है। Supreme Court ने पुराने IPC Section 353 के समान provision की interpretation में इसी distinction पर जोर दिया है। Manik Taneja v. State of Karnataka, (2015) 7 SCC 423 में Court ने कहा कि mere allegations या criticism पर्याप्त नहीं हैं; prosecution को assault/criminal force और public duty को prevent/deter करने के आवश्यक ingredients दिखाने होंगे। (Indian Kanoon)

Essential Ingredients

Public Servant

पहली requirement यह है कि जिस व्यक्ति के विरुद्ध assault या criminal force किया गया है, वह public servant हो।

BNS में “public servant” की विस्तृत definition Section 2(28) में दी गई है। इसमें विभिन्न categories के government/public functionaries शामिल हैं।

इसलिए प्रत्येक सरकारी कर्मचारी के मामले में केवल उसका government employment देखना पर्याप्त नहीं; यह भी examine किया जाना चाहिए कि वह BNS की statutory definition में public servant की category में आता है या नहीं।

Assault or Criminal Force

दूसरा आवश्यक element है कि accused ने assault या criminal force किया हो।

Section 129 BNS में criminal force और Section 130 BNS में assault की definitions दी गई हैं।

इसलिए केवल verbal disagreement, abuse, criticism या ordinary obstruction अपने-आप Section 132 establish नहीं करते। Relevant conduct को Sections 129 और 130 की statutory requirements satisfy करनी होंगी।

Connection with Official Duty

Section 132 में public servant और उसके official duty के बीच connection आवश्यक है।

यह connection तीन alternative forms में statute ने दिया है:

Execution of duty — public servant अपने duty के execution में था।

Intent to prevent or deter — accused का intention public servant को duty discharge करने से prevent या deter करना था।

Consequence of lawful act — assault/criminal force public servant द्वारा उसके lawful duty के discharge में किए गए किसी act के consequence में किया गया।

Three Situations Covered by Section 132

Assault During Execution of Duty

यदि public servant अपने official duty को perform कर रहा है और उसी दौरान उस पर assault या criminal force किया जाता है, तो Section 132 लागू हो सकता है।

उदाहरण के लिए, कोई public servant अपनी statutory duty perform कर रहा है और accused उसे physically attack करता है ताकि वह duty continue न कर सके।

Assault to Prevent or Deter Duty

इस situation में public servant उस समय duty perform कर रहा हो, यह हमेशा आवश्यक नहीं है। यदि accused का intent ही public servant को उसके duty को discharge करने से prevent या deter करना है, तो provision लागू हो सकता है।

उदाहरण के लिए, किसी अधिकारी को उसकी lawful inspection करने से रोकने के उद्देश्य से उस पर criminal force का प्रयोग किया जाए।

Consequence of Lawful Discharge of Duty

तीसरी स्थिति तब है जब public servant ने अपने duty के lawful discharge में कोई act किया या करने का प्रयास किया और उसी के consequence में उस पर assault/criminal force किया गया।

इसमें statute specifically lawful discharge of duty की requirement रखता है।

Meaning of Assault and Criminal Force

Section 132 को समझने के लिए Sections 129 और 130 अत्यंत महत्वपूर्ण हैं।

Criminal Force

Section 129 के अनुसार criminal force में Section 128 के अर्थ में force का intentional use, बिना consent के, और prescribed criminal intention/knowledge के साथ होना आवश्यक है।

इसलिए केवल public servant को verbally threaten करना Section 132 का criminal force नहीं बनता, जब तक applicable facts में assault/criminal force के statutory ingredients satisfy न हों।

Assault

Section 130 में assault के लिए gesture या preparation ऐसा होना चाहिए जिससे present person को apprehension हो कि criminal force use होने वाला है।

इसलिए actual physical contact हर assault case में आवश्यक नहीं है।

Section 130 BNS

Punishment Under Section 132

Section 132 के तहत:

Imprisonment: imprisonment of either description, maximum 2 years

Fine: कोई fixed maximum amount prescribed नहीं है

Or: imprisonment और fine दोनों

इस प्रकार Section 132 में कोई mandatory minimum imprisonment prescribed नहीं है।

इस classification का practical महत्व है। Cognizable होने के कारण police First Schedule के अनुसार warrant के बिना arrest कर सकती है; non-bailable होने का अर्थ यह है कि bail as of right उपलब्ध नहीं होती, बल्कि Court के discretion के अनुसार bail consider की जाती है।

दोनों provisions में assault/criminal force common है, लेकिन circumstances अलग हैं।

Section 131 ordinary assault/criminal force के लिए general provision है, जबकि Section 132 public servant की official duty से connected aggravated situation को specifically punish करता है। (India Code)

Section 132 and Section 121: Important Distinction

Section 121 BNS voluntarily causing hurt or grievous hurt to deter public servant from his duty से संबंधित है। Section 132 दूसरी ओर assault या criminal force से संबंधित है।

इसलिए यदि public servant को actual hurt caused हुआ है, तो facts के अनुसार Section 121 की applicability भी examine करनी होगी। यदि conduct assault/criminal force की statutory definition satisfy करता है और Section 132 के official-duty requirements भी मौजूद हैं, तो appropriate provisions facts के आधार पर determine किए जाएंगे।

Leading Supreme Court Judgment

Manik Taneja & Anr. v. State of Karnataka & Anr.

(2015) 7 SCC 423; Supreme Court of India

यह Section 132 BNS के लिए सबसे महत्वपूर्ण Supreme Court authorities में से एक है, क्योंकि Section 132 का statutory language पुराने Section 353 IPC से substantially carried forward है।

इस case में appellants ने Bengaluru Traffic Police के Facebook page पर comments/post किए थे। उनके विरुद्ध IPC Sections 353 और 506 के तहत proceedings initiated हुईं।

Supreme Court ने Section 353 IPC के essential ingredients को identify करते हुए कहा कि accused ने public servant पर assault या criminal force किया होना चाहिए और उसका requisite connection public servant के duty discharge को prevent/deter करने से होना चाहिए। Court ने पाया कि available allegations में ऐसा force या assault नहीं था और इसलिए Section 353 के ingredients establish नहीं हुए। (Indian Kanoon)

यह principle BNS Section 132 के लिए सीधे relevant है क्योंकि BNS provision वही core statutory requirements रखता है।

Supreme Court ने Section 353 IPC के ingredients के संदर्भ में यह distinction examine किया कि public servant के विरुद्ध assault/criminal force और उसका duty से connection prosecution को establish करना होता है।

यह authority विशेष रूप से इस proposition के लिए useful है कि केवल public servant के official function से जुड़ा विवाद अपने-आप Section 353/132 का offence नहीं बनाता; statutory ingredients का proof आवश्यक है। (indiankanoon.org)

यह public servant के official duty को obstruct करने और IPC Sections 186 तथा 353 के distinction के संदर्भ में महत्वपूर्ण Supreme Court authority है।

इस jurisprudence से यह principle सामने आता है कि mere obstruction/resistance और assault/criminal force अलग legal concepts हैं। Section 132 BNS के लिए केवल resistance या obstruction पर्याप्त नहीं; Section 129/130 के अनुसार assault या criminal force establish करना आवश्यक है।

Section 132 and Mere Obstruction

यह practical litigation point अत्यंत महत्वपूर्ण है।

यदि कोई व्यक्ति public servant को केवल verbally object करता है या उसके काम में कोई obstruction करता है, तो Section 132 automatically लागू नहीं होगा।

BNS में public servant को उसके public functions में obstruct करने के लिए Section 221 अलग offence है। Section 221 में punishment up to 3 months imprisonment, ₹2,500 fine, or both है और यह non-cognizable तथा bailable offence है।

इसलिए:

Mere obstruction → Section 221 may be relevant.

Assault/criminal force + required official-duty connection → Section 132 may be relevant.

Sections 132 and 221 BNS

Section 132 and Lawful Duty

Section 132 में “lawful discharge of his duty” शब्द विशेष महत्व रखते हैं।

यदि public servant का act itself unlawful था, तो Section 132 की third limb—जिसमें assault/criminal force किसी lawful discharge of duty के consequence में होता है—के application का प्रश्न अलग तरीके से examine होगा।

इसका अर्थ यह नहीं कि public servant के unlawful conduct के विरुद्ध कोई physical force automatically lawful हो जाता है। Private defence और अन्य applicable provisions के statutory requirements अलग से examine किए जाएंगे।

Section 132 BNS

Is Actual Injury Necessary?

नहीं।

Section 132 का offence assault या criminal force पर आधारित है। Actual bodily injury होना आवश्यक ingredient नहीं है।

यदि accused ने Section 129 के अर्थ में criminal force या Section 130 के अर्थ में assault किया और बाकी Section 132 requirements satisfy होती हैं, तो injury के बिना भी Section 132 लागू हो सकता है।

यदि actual hurt भी caused हुआ है, तो facts के अनुसार Section 121 BNS या अन्य applicable hurt provisions भी relevant हो सकते हैं।

Mens Rea Under Section 132

Section 132 में तीन alternative statutory situations हैं, इसलिए mens rea का analysis facts के अनुसार अलग हो सकता है।

यदि public servant duty execute कर रहा है, तो accused द्वारा उसके विरुद्ध assault/criminal force का connection official duty से establish होना चाहिए।

यदि purpose public servant को duty से prevent/deter करना है, तो intention to prevent or deter express statutory requirement है।

यदि act public servant के lawful official act के consequence में किया गया है, तो उस lawful act और subsequent assault/criminal force के बीच connection establish करना होगा।

Section 132 BNS

Compounding of Section 132

BNSS Section 359 की compounding table में Sections 131, 133 और 136 के assault/criminal force offences expressly listed हैं, लेकिन Section 132 listed compoundable offences में नहीं है।

इसलिए Section 132 को ordinary Section 131 की तरह statutory compounding provision के अंतर्गत compoundable नहीं माना जा सकता।

Actual bodily injury आवश्यक नहीं है।
